Middletown and Durham will enter into a definitive and binding long term agreement (the "Agreement") in which Middletown would agree to allow for the construction of piping and other improvements required to supply adequate amounts of potable water to the properties in the area known as the Superfund Site Area A and Durham would agree to purchase such water from Middletown at established prices and perform administrative functions and responsibilities with respect to monitoring, billing and collecting for water usage by the properties within said Superfund Site Area A. 2. The Agreement would be contingent on any approvals required to be obtained by the Parti es under applicable laws, ordinances, codes, rulings, regulations and orders from federal, state and local officials, department heads, boards, commissions, legislative bodies or other agencies having subject matter jurisdiction. 3. Construction of the piping and other improvements and connecting the affected properties to the piping would be financed by entities other than the Town of Durham and the City of Middletown. 4. Areas identified as "Areas B, C, D and E" in said report would be connected to t he piping based on available funding to Durham. Mayor Drew calls the meeting to order at 71 O pm and asks Nicholas Brenchak to lead the public in the Pledge of Allegiance

The Call of Meeting was read and accepted Mayor Drew declares the Call a Legal Call and the Meeting a Legal Meeting

Councilman Serra moves to amend the agenda to move First Selectwoman Laura Francis and Director Guy Russo to the top of the agenda to discuss item 15-20 the MOU to purchase water and substitute agenda item 11-1 and to add one Contingency Fund Transfer Councilman Berch seconds the motion The Chair asks if Councilman Santangelo wishes to address the motion He does not The Chair calls for the vote and it is unanimous to approve with eleven aye votes by the members present

Chair asks First Selectman Francis to come forward and welcomes her He recognizes Councilman Santangelo who asks Mr Guy Russo what will happen and what is the financial impact Mr Russo states he would like to address the concept It has not changed and what has changed is the EPA and the Superfund clean-up of the factory site and reallocation of funding from the EPA to solve engineering and water problems Selectwoman Francis will address the specifics The specific infrastructure for Middletown is a water tank built up by Watch Hill It was an acquired site after the bankruptcy of the developer and they have the highest site in that area There will be new pipe to handle the water supply and the last is although they have rehabbed the pump station but to redo the pump to a booster near the Long Hill tank Those financial components will come to Middletown along with the engineering The City will not pay for the engineering and he asked EPA proviso that it pass muster with his Chief Engineer Fazzino and we get good product when he comments

Councilman Serra states we have the capacity for this Mr Russo responds that is a great question and the final negotiations hinged on our last water supply plan and part is adequacy of water supply and the Department of Health had to look at past and future use and there is ample water to do this Between the finances of EPA and DEEP funding and the Department of Health approval and Selectwoman Francis and I were on a conference call and it is getting the pieces together There is ample water Councilman Serra asks if it is the Kleen Energy one Mr Russo replies it is a future source and does not meet the State regulations but Laurie Matthew has agreed and asked her staff to hold off and will give us time to look at the well to see if it is potable water Councilman Serra states the agreement will be a fair fee Mr Russo responds yes that would be the idea It would be capitalized and Durham would have a master meter at the border and pay for all the use Councilman Serra states it is a revenue Mr Russo responds yes and the additional is chemicals and electricity

Councilwoman Kasper asks if Laurel Brook Reservoir would be in the future Mr Russo responds that is an emergency source of water for us The newer virgin technologies will make it more useful Cost wise the technologies need to come down and we will not abandon it

Councilman Berch asks what the projected cost of the project is itself Mr Russo responds that is good question and there have been estimates and that is why EPA wants a final design that is biddable The project is parsed in different pieces EPA will pay for the superfund site and beyond that Durham

Councilman Klattenberg states the amount of water provided is it residential and commercial use Selectman Francis states most is residential and there are some businesses of retail except for Durham manufacturing However the manufacturing is not part of this it is to bring the water just to the superfund site Councilman Klattenberg states no commercial use of the water Selectwoman Francis responds not manufacturing but restaurants Councilman Klattenberg asks if the line location has been proposed Mr Russo responds on the west side of Rte 17

The Mayor reads a proclamation into the record in memoriam honoring Ray Jacobs City Employee who passed away suddenly They are proclaiming June 5 2012 Ray Jacobs day and honoring his memory by naming a field at the Thomas Smith Park after him Councilman Serra states he had worked with him and remembers how he would come to Vinal ensuring that the facilities fields gym and cafeteria would be available for the programs they were offering He states he is glad to see the field named for him Mrs Jacobs comes forward to receive the plaque from the Mayor she receives the applause of the public

Councilman Faulkner asks that Rosa Browne come forward He reads the resolution and moves it for approval Councilman Serra seconds that motion He discusses that we should do a lot more to recognize the accomplishments of the Citys residents and specifically all that Ms Browne has done for her community both locally and at the State level She thanks the Council Councilman Pessina states he cant let Rosa leave without saying something special She is one of the most compassionate and humbler persons active in the community She opened doors for us in the community policing program When he was at commencement at Southern he saw her get her Masters Degree You are a true ambassador of the City and he thanks her for what she has done for the City She receives the applause from the public and Council The Chair states without objection the resolution can be approved by acclamation It is approved without objection

the intent of this Agreement that each participating municipality shall be liable only for its proportionate share of responsibility All disputes concerning apportionment of liability hereunder shall be resolved by a single arbitrator chosen by the parties II the parties are unable to agree upon a single arbitrator then the court shall appoint the arbitrator

7 For grant and funding initiative purposes the Chief of Police for the lead agency within the participating group orhis designee shall act as the representative and fiduciary for the group Lead agency responsibility may be transferred to another participating agency upon the unanimous written consent of all the Chiefs of Police for the departments participating in this compact

8 Not later than five (5) years from the effective date of this agreement the effectiveness of this agreement shall be reviewed by the body that approved the agreement for each participating municipality

Councilman Santangelo states first Selectman Kalinowski approached us when he first sat on the WPCA this is a major step for Middletown We can provide services to other communities We are also taking care of Durhams problems by being good neighbors As you heard earlier this evening it is being paid for by State and Federal dollars and it will help lower our rates in Middletown A comment made earlier by a citizen who was worried about our water supply Middletown is in a unique situation Our river is a tidal river we run out of water when the ocean runs out of water We will have plenty of water

Re Durham Meadows Super Fund Site Durham CT

Dear Ms Loughlin

I am providing you with these written comments regarding the City of Middletown Water Department Service Extension as recommended in the EPA Proposed Plan for the Durham Meadows Superfund Site Let me first thank you and your staff at the EPA for their close liaison with the City of Middletown in the development ofEPAs alternatives and options with regards to remedying the current problems in the Town of Durham Connecticut As I have stated to you and publicly on behalf of the City of Middletown Water Department and our Water Pollution Control Authority the City of Middletown remains prepared to assist the Town of Durham with the extension of the City of Middletown water service into Durham

While the City of Middletown remains committed to ass1stmg our sister community to the south the single caveat in doing so has always been the requirement that the current rate payers and the citizens of the City of Middletown be held harmless (cost neutral) for any extension of service to the Town of Durham I along with staff have reviewed the Metcalf amp Eddy EPA Proposed Plan for the extension of water to the Town of Durham and would like to offer several comments not only on the proposed EPA Plan but some alternatives that we would strongly suggest that the EPA endorse

Metcalf amp Eddy Plan - EPA Option

In reviewing the work of Metcalf amp Eddy the City has identified some additional costs that have not been included within the initial capitalization of the plan which Metcalf amp Eddy has detailed to the EPA The first item which needs to be drawn to the surface is the need for additional water quantity in order to service the Town of Durham In preparation of this report I understand that Metcalf amp Eddy did contact our staff regarding the hydraulic grade line (HGL) of the City of Middletowns system in close proximity to the Durham border The correct answer to this question was 500 feet NGVD 29 While the City maintains sufficient head for the purposes of supplying the Town of Durham there is insufficient flow available to supply the additional customers that would be added This small section of Middletown in the Talcott Ridge area is serviced by two hydro-pneumatic pumps that pump on demand much like a residential well system Because of the size of these pumps and the availability of district piping in Middletown it would not be possible to supply Durham with the additional water required unless there was an upgrading to the hydro-pneumatic pump station and an improvement to district piping to the Durham town line

Our preferred option in this matter has always been the establishment of the Cherry Hill Water Tower The Cherry Hill Water Tower along with district piping and improvements to the hydro-pneumatic pump station to a full booster pump station would allow for ample water quantity to service the expansion of the Middletown system in a southerly direction through the downtown area of the Town of Durham

In our initial review following the public hearing we understood that the $70 million dollar number that was discussed at the initiation meeting on July 12 2005 was a capitalization number Further investigation into the Metcalf amp Eddy report has indicated that this was a compilation of both capital and on-going O amp M And while at the initiation meeting I did not raise the $7 0 million dollar number as a problem It was only because I had anticipated that the $70 million dollars was a capital number which in fact included refurbishment of the pump station district piping and funding for the Cherry Hill Water Tower I will state again clearly these three items would be essential for the City of Middletown to supply the Town of Durham in the quantity that is needed without imposing an economic hardship to the citizens of the City of Middletown

Fuss amp ONeill Plan - City of Middletown Option

Previous to the EPAs establishment of the proposed plan the City of Middletown Water Department cooperatively with the DEP and the Town of Durham had worked extensively on developing preferred options for the expansion of water service to the

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

amp ONeill report the rehabilitation of the hydro-pneumatic pump station to a full booster pump station and improvements to district piping I would note that the Fuss amp ONeill report did include contribution for the Cherry Hill Water Tower and also large diameter

piping improvements from the proposed Cherry Hill Water Tank to the town line The total cost estimate based on our review to complete the Fuss amp ONeill full redundant service area with ample fire protection for the Town of Durham and also providing elements to the City of Middletown to keep this extension cost neutral to the residents of the City of Middletown is $1315141600

Action Plan

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas

Mayor Drew calls the meeting to order at 71 O pm and asks Nicholas Brenchak to lead the public in the Pledge of Allegiance

The Call of Meeting was read and accepted Mayor Drew declares the Call a Legal Call and the Meeting a Legal Meeting

Councilman Serra moves to amend the agenda to move First Selectwoman Laura Francis and Director Guy Russo to the top of the agenda to discuss item 15-20 the MOU to purchase water and substitute agenda item 11-1 and to add one Contingency Fund Transfer Councilman Berch seconds the motion The Chair asks if Councilman Santangelo wishes to address the motion He does not The Chair calls for the vote and it is unanimous to approve with eleven aye votes by the members present

Chair asks First Selectman Francis to come forward and welcomes her He recognizes Councilman Santangelo who asks Mr Guy Russo what will happen and what is the financial impact Mr Russo states he would like to address the concept It has not changed and what has changed is the EPA and the Superfund clean-up of the factory site and reallocation of funding from the EPA to solve engineering and water problems Selectwoman Francis will address the specifics The specific infrastructure for Middletown is a water tank built up by Watch Hill It was an acquired site after the bankruptcy of the developer and they have the highest site in that area There will be new pipe to handle the water supply and the last is although they have rehabbed the pump station but to redo the pump to a booster near the Long Hill tank Those financial components will come to Middletown along with the engineering The City will not pay for the engineering and he asked EPA proviso that it pass muster with his Chief Engineer Fazzino and we get good product when he comments

Councilman Serra states we have the capacity for this Mr Russo responds that is a great question and the final negotiations hinged on our last water supply plan and part is adequacy of water supply and the Department of Health had to look at past and future use and there is ample water to do this Between the finances of EPA and DEEP funding and the Department of Health approval and Selectwoman Francis and I were on a conference call and it is getting the pieces together There is ample water Councilman Serra asks if it is the Kleen Energy one Mr Russo replies it is a future source and does not meet the State regulations but Laurie Matthew has agreed and asked her staff to hold off and will give us time to look at the well to see if it is potable water Councilman Serra states the agreement will be a fair fee Mr Russo responds yes that would be the idea It would be capitalized and Durham would have a master meter at the border and pay for all the use Councilman Serra states it is a revenue Mr Russo responds yes and the additional is chemicals and electricity

Councilwoman Kasper asks if Laurel Brook Reservoir would be in the future Mr Russo responds that is an emergency source of water for us The newer virgin technologies will make it more useful Cost wise the technologies need to come down and we will not abandon it

Councilman Berch asks what the projected cost of the project is itself Mr Russo responds that is good question and there have been estimates and that is why EPA wants a final design that is biddable The project is parsed in different pieces EPA will pay for the superfund site and beyond that Durham

Councilman Klattenberg states the amount of water provided is it residential and commercial use Selectman Francis states most is residential and there are some businesses of retail except for Durham manufacturing However the manufacturing is not part of this it is to bring the water just to the superfund site Councilman Klattenberg states no commercial use of the water Selectwoman Francis responds not manufacturing but restaurants Councilman Klattenberg asks if the line location has been proposed Mr Russo responds on the west side of Rte 17

The Mayor reads a proclamation into the record in memoriam honoring Ray Jacobs City Employee who passed away suddenly They are proclaiming June 5 2012 Ray Jacobs day and honoring his memory by naming a field at the Thomas Smith Park after him Councilman Serra states he had worked with him and remembers how he would come to Vinal ensuring that the facilities fields gym and cafeteria would be available for the programs they were offering He states he is glad to see the field named for him Mrs Jacobs comes forward to receive the plaque from the Mayor she receives the applause of the public

Councilman Faulkner asks that Rosa Browne come forward He reads the resolution and moves it for approval Councilman Serra seconds that motion He discusses that we should do a lot more to recognize the accomplishments of the Citys residents and specifically all that Ms Browne has done for her community both locally and at the State level She thanks the Council Councilman Pessina states he cant let Rosa leave without saying something special She is one of the most compassionate and humbler persons active in the community She opened doors for us in the community policing program When he was at commencement at Southern he saw her get her Masters Degree You are a true ambassador of the City and he thanks her for what she has done for the City She receives the applause from the public and Council The Chair states without objection the resolution can be approved by acclamation It is approved without objection

WHEREAS the Connecticut Immigrant and Refugee Coalition which includes many not for profit member organizations to protect the rights and welfare of immigrants and refugees as well as foster their civic participation and

WHEREAS according to the US Census Bureau in statistics released in 2010 African Americans and Hispanics represent 20 of Middletowns residents the American Community Survey estimates that 10 of Middletowns residents is comprised of Naturalized and non US citizens and

WHEREAS Cl RC holds an Annual Immigrant Day Ceremony where individuals born outside of the United States who become naturalized citizens and reside in Connecticut and who contribute to their profession andor community are honored and

WHEREAS on April 23i 2012 Rosa Browne was honored by the Connecticut Immigrant and Refugee Coalition at its Annual Immigrant Day Ceremony and

WHEREAS Ms Rosa Browne was born in Panama and became a United States citizen who resides in the City of Middletown Connecticut and

WHEREAS Rosa continued her academic education earning Masters Degrees in both Public Health and Management and

WHEREAS she currently practices her profession as an employee of Yale-New Haven Hospital and

the intent of this Agreement that each participating municipality shall be liable only for its proportionate share of responsibility All disputes concerning apportionment of liability hereunder shall be resolved by a single arbitrator chosen by the parties II the parties are unable to agree upon a single arbitrator then the court shall appoint the arbitrator

7 For grant and funding initiative purposes the Chief of Police for the lead agency within the participating group orhis designee shall act as the representative and fiduciary for the group Lead agency responsibility may be transferred to another participating agency upon the unanimous written consent of all the Chiefs of Police for the departments participating in this compact

UNDERSTANDING As a result of groundwater contamination problems in Durham centered in an area shown on a series of detailed maps in a study entitled Environmental Impact Evaluation Durham Water System Extension prepared by Fuss amp ONeill Inc September 2009 Revised September 201 O Middletown would agree to an extension Qf its existing water system south on Rte 17 from Talcott Ridge Drive and the site of the new Cherry Hill Storage Tank to Durham Center as shown on Figure 2-1 and FIGES-2 and FIGES-3 in said Evaluation and supply water to the properties located in the affected area shown as Superfund Site Area A on said maps

1 Middletown and Durham will enter into a definitive and binding long term agreement (the Agreement) in which Middletown would agree to allow for the construction of piping and other improvements required to supply adequate amounts of potable water to the properties in the area known as the Superfund Site Area A and Durham would agree to purchase such water from Middletown at established prices and perform administrative functions and responsibilities with respect to monitoring billing and collecting for water usage by the properties within said Superfund Site Area A

2 The Agreement would be contingent on any approvals required to be obtained by the Parties under applicable laws ordinances codes rulings regulations and orders from federal state and local officials department heads boards commissions legislative bodies or other agencies having subject matter jurisdiction

3 Construction of the piping and other improvements and connecting the affected properties to the piping would be financed by entities other than the Town of Durham and the City of Middletown

Dear Ms Loughlin

I am providing you with these written comments regarding the City of Middletown Water Department Service Extension as recommended in the EPA Proposed Plan for the Durham Meadows Superfund Site Let me first thank you and your staff at the EPA for their close liaison with the City of Middletown in the development ofEPAs alternatives and options with regards to remedying the current problems in the Town of Durham Connecticut As I have stated to you and publicly on behalf of the City of Middletown Water Department and our Water Pollution Control Authority the City of Middletown remains prepared to assist the Town of Durham with the extension of the City of Middletown water service into Durham

While the City of Middletown remains committed to ass1stmg our sister community to the south the single caveat in doing so has always been the requirement that the current rate payers and the citizens of the City of Middletown be held harmless (cost neutral) for any extension of service to the Town of Durham I along with staff have reviewed the Metcalf amp Eddy EPA Proposed Plan for the extension of water to the Town of Durham and would like to offer several comments not only on the proposed EPA Plan but some alternatives that we would strongly suggest that the EPA endorse

Metcalf amp Eddy Plan - EPA Option

In reviewing the work of Metcalf amp Eddy the City has identified some additional costs that have not been included within the initial capitalization of the plan which Metcalf amp Eddy has detailed to the EPA The first item which needs to be drawn to the surface is the need for additional water quantity in order to service the Town of Durham In preparation of this report I understand that Metcalf amp Eddy did contact our staff regarding the hydraulic grade line (HGL) of the City of Middletowns system in close proximity to the Durham border The correct answer to this question was 500 feet NGVD 29 While the City maintains sufficient head for the purposes of supplying the Town of Durham there is insufficient flow available to supply the additional customers that would be added This small section of Middletown in the Talcott Ridge area is serviced by two hydro-pneumatic pumps that pump on demand much like a residential well system Because of the size of these pumps and the availability of district piping in Middletown it would not be possible to supply Durham with the additional water required unless there was an upgrading to the hydro-pneumatic pump station and an improvement to district piping to the Durham town line

Our preferred option in this matter has always been the establishment of the Cherry Hill Water Tower The Cherry Hill Water Tower along with district piping and improvements to the hydro-pneumatic pump station to a full booster pump station would allow for ample water quantity to service the expansion of the Middletown system in a southerly direction through the downtown area of the Town of Durham

In our initial review following the public hearing we understood that the $70 million dollar number that was discussed at the initiation meeting on July 12 2005 was a capitalization number Further investigation into the Metcalf amp Eddy report has indicated that this was a compilation of both capital and on-going O amp M And while at the initiation meeting I did not raise the $7 0 million dollar number as a problem It was only because I had anticipated that the $70 million dollars was a capital number which in fact included refurbishment of the pump station district piping and funding for the Cherry Hill Water Tower I will state again clearly these three items would be essential for the City of Middletown to supply the Town of Durham in the quantity that is needed without imposing an economic hardship to the citizens of the City of Middletown

Fuss amp ONeill Plan - City of Middletown Option

Previous to the EPAs establishment of the proposed plan the City of Middletown Water Department cooperatively with the DEP and the Town of Durham had worked extensively on developing preferred options for the expansion of water service to the

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

amp ONeill report the rehabilitation of the hydro-pneumatic pump station to a full booster pump station and improvements to district piping I would note that the Fuss amp ONeill report did include contribution for the Cherry Hill Water Tower and also large diameter

piping improvements from the proposed Cherry Hill Water Tank to the town line The total cost estimate based on our review to complete the Fuss amp ONeill full redundant service area with ample fire protection for the Town of Durham and also providing elements to the City of Middletown to keep this extension cost neutral to the residents of the City of Middletown is $1315141600

Action Plan

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas

Councilman Klattenberg states the amount of water provided is it residential and commercial use Selectman Francis states most is residential and there are some businesses of retail except for Durham manufacturing However the manufacturing is not part of this it is to bring the water just to the superfund site Councilman Klattenberg states no commercial use of the water Selectwoman Francis responds not manufacturing but restaurants Councilman Klattenberg asks if the line location has been proposed Mr Russo responds on the west side of Rte 17

The Mayor reads a proclamation into the record in memoriam honoring Ray Jacobs City Employee who passed away suddenly They are proclaiming June 5 2012 Ray Jacobs day and honoring his memory by naming a field at the Thomas Smith Park after him Councilman Serra states he had worked with him and remembers how he would come to Vinal ensuring that the facilities fields gym and cafeteria would be available for the programs they were offering He states he is glad to see the field named for him Mrs Jacobs comes forward to receive the plaque from the Mayor she receives the applause of the public

Councilman Faulkner asks that Rosa Browne come forward He reads the resolution and moves it for approval Councilman Serra seconds that motion He discusses that we should do a lot more to recognize the accomplishments of the Citys residents and specifically all that Ms Browne has done for her community both locally and at the State level She thanks the Council Councilman Pessina states he cant let Rosa leave without saying something special She is one of the most compassionate and humbler persons active in the community She opened doors for us in the community policing program When he was at commencement at Southern he saw her get her Masters Degree You are a true ambassador of the City and he thanks her for what she has done for the City She receives the applause from the public and Council The Chair states without objection the resolution can be approved by acclamation It is approved without objection

WHEREAS on April 23i 2012 Rosa Browne was honored by the Connecticut Immigrant and Refugee Coalition at its Annual Immigrant Day Ceremony and

WHEREAS Ms Rosa Browne was born in Panama and became a United States citizen who resides in the City of Middletown Connecticut and

the intent of this Agreement that each participating municipality shall be liable only for its proportionate share of responsibility All disputes concerning apportionment of liability hereunder shall be resolved by a single arbitrator chosen by the parties II the parties are unable to agree upon a single arbitrator then the court shall appoint the arbitrator

7 For grant and funding initiative purposes the Chief of Police for the lead agency within the participating group orhis designee shall act as the representative and fiduciary for the group Lead agency responsibility may be transferred to another participating agency upon the unanimous written consent of all the Chiefs of Police for the departments participating in this compact

8 Not later than five (5) years from the effective date of this agreement the effectiveness of this agreement shall be reviewed by the body that approved the agreement for each participating municipality

UNDERSTANDING As a result of groundwater contamination problems in Durham centered in an area shown on a series of detailed maps in a study entitled Environmental Impact Evaluation Durham Water System Extension prepared by Fuss amp ONeill Inc September 2009 Revised September 201 O Middletown would agree to an extension Qf its existing water system south on Rte 17 from Talcott Ridge Drive and the site of the new Cherry Hill Storage Tank to Durham Center as shown on Figure 2-1 and FIGES-2 and FIGES-3 in said Evaluation and supply water to the properties located in the affected area shown as Superfund Site Area A on said maps

1 Middletown and Durham will enter into a definitive and binding long term agreement (the Agreement) in which Middletown would agree to allow for the construction of piping and other improvements required to supply adequate amounts of potable water to the properties in the area known as the Superfund Site Area A and Durham would agree to purchase such water from Middletown at established prices and perform administrative functions and responsibilities with respect to monitoring billing and collecting for water usage by the properties within said Superfund Site Area A

2 The Agreement would be contingent on any approvals required to be obtained by the Parties under applicable laws ordinances codes rulings regulations and orders from federal state and local officials department heads boards commissions legislative bodies or other agencies having subject matter jurisdiction

I am providing you with these written comments regarding the City of Middletown Water Department Service Extension as recommended in the EPA Proposed Plan for the Durham Meadows Superfund Site Let me first thank you and your staff at the EPA for their close liaison with the City of Middletown in the development ofEPAs alternatives and options with regards to remedying the current problems in the Town of Durham Connecticut As I have stated to you and publicly on behalf of the City of Middletown Water Department and our Water Pollution Control Authority the City of Middletown remains prepared to assist the Town of Durham with the extension of the City of Middletown water service into Durham

While the City of Middletown remains committed to ass1stmg our sister community to the south the single caveat in doing so has always been the requirement that the current rate payers and the citizens of the City of Middletown be held harmless (cost neutral) for any extension of service to the Town of Durham I along with staff have reviewed the Metcalf amp Eddy EPA Proposed Plan for the extension of water to the Town of Durham and would like to offer several comments not only on the proposed EPA Plan but some alternatives that we would strongly suggest that the EPA endorse

Metcalf amp Eddy Plan - EPA Option

In reviewing the work of Metcalf amp Eddy the City has identified some additional costs that have not been included within the initial capitalization of the plan which Metcalf amp Eddy has detailed to the EPA The first item which needs to be drawn to the surface is the need for additional water quantity in order to service the Town of Durham In preparation of this report I understand that Metcalf amp Eddy did contact our staff regarding the hydraulic grade line (HGL) of the City of Middletowns system in close proximity to the Durham border The correct answer to this question was 500 feet NGVD 29 While the City maintains sufficient head for the purposes of supplying the Town of Durham there is insufficient flow available to supply the additional customers that would be added This small section of Middletown in the Talcott Ridge area is serviced by two hydro-pneumatic pumps that pump on demand much like a residential well system Because of the size of these pumps and the availability of district piping in Middletown it would not be possible to supply Durham with the additional water required unless there was an upgrading to the hydro-pneumatic pump station and an improvement to district piping to the Durham town line

Our preferred option in this matter has always been the establishment of the Cherry Hill Water Tower The Cherry Hill Water Tower along with district piping and improvements to the hydro-pneumatic pump station to a full booster pump station would allow for ample water quantity to service the expansion of the Middletown system in a southerly direction through the downtown area of the Town of Durham

In our initial review following the public hearing we understood that the $70 million dollar number that was discussed at the initiation meeting on July 12 2005 was a capitalization number Further investigation into the Metcalf amp Eddy report has indicated that this was a compilation of both capital and on-going O amp M And while at the initiation meeting I did not raise the $7 0 million dollar number as a problem It was only because I had anticipated that the $70 million dollars was a capital number which in fact included refurbishment of the pump station district piping and funding for the Cherry Hill Water Tower I will state again clearly these three items would be essential for the City of Middletown to supply the Town of Durham in the quantity that is needed without imposing an economic hardship to the citizens of the City of Middletown

Fuss amp ONeill Plan - City of Middletown Option

Previous to the EPAs establishment of the proposed plan the City of Middletown Water Department cooperatively with the DEP and the Town of Durham had worked extensively on developing preferred options for the expansion of water service to the

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

amp ONeill report the rehabilitation of the hydro-pneumatic pump station to a full booster pump station and improvements to district piping I would note that the Fuss amp ONeill report did include contribution for the Cherry Hill Water Tower and also large diameter

piping improvements from the proposed Cherry Hill Water Tank to the town line The total cost estimate based on our review to complete the Fuss amp ONeill full redundant service area with ample fire protection for the Town of Durham and also providing elements to the City of Middletown to keep this extension cost neutral to the residents of the City of Middletown is $1315141600

Action Plan

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas

the intent of this Agreement that each participating municipality shall be liable only for its proportionate share of responsibility All disputes concerning apportionment of liability hereunder shall be resolved by a single arbitrator chosen by the parties II the parties are unable to agree upon a single arbitrator then the court shall appoint the arbitrator

7 For grant and funding initiative purposes the Chief of Police for the lead agency within the participating group orhis designee shall act as the representative and fiduciary for the group Lead agency responsibility may be transferred to another participating agency upon the unanimous written consent of all the Chiefs of Police for the departments participating in this compact

8 Not later than five (5) years from the effective date of this agreement the effectiveness of this agreement shall be reviewed by the body that approved the agreement for each participating municipality

UNDERSTANDING As a result of groundwater contamination problems in Durham centered in an area shown on a series of detailed maps in a study entitled Environmental Impact Evaluation Durham Water System Extension prepared by Fuss amp ONeill Inc September 2009 Revised September 201 O Middletown would agree to an extension Qf its existing water system south on Rte 17 from Talcott Ridge Drive and the site of the new Cherry Hill Storage Tank to Durham Center as shown on Figure 2-1 and FIGES-2 and FIGES-3 in said Evaluation and supply water to the properties located in the affected area shown as Superfund Site Area A on said maps

1 Middletown and Durham will enter into a definitive and binding long term agreement (the Agreement) in which Middletown would agree to allow for the construction of piping and other improvements required to supply adequate amounts of potable water to the properties in the area known as the Superfund Site Area A and Durham would agree to purchase such water from Middletown at established prices and perform administrative functions and responsibilities with respect to monitoring billing and collecting for water usage by the properties within said Superfund Site Area A

2 The Agreement would be contingent on any approvals required to be obtained by the Parties under applicable laws ordinances codes rulings regulations and orders from federal state and local officials department heads boards commissions legislative bodies or other agencies having subject matter jurisdiction

I am providing you with these written comments regarding the City of Middletown Water Department Service Extension as recommended in the EPA Proposed Plan for the Durham Meadows Superfund Site Let me first thank you and your staff at the EPA for their close liaison with the City of Middletown in the development ofEPAs alternatives and options with regards to remedying the current problems in the Town of Durham Connecticut As I have stated to you and publicly on behalf of the City of Middletown Water Department and our Water Pollution Control Authority the City of Middletown remains prepared to assist the Town of Durham with the extension of the City of Middletown water service into Durham

While the City of Middletown remains committed to ass1stmg our sister community to the south the single caveat in doing so has always been the requirement that the current rate payers and the citizens of the City of Middletown be held harmless (cost neutral) for any extension of service to the Town of Durham I along with staff have reviewed the Metcalf amp Eddy EPA Proposed Plan for the extension of water to the Town of Durham and would like to offer several comments not only on the proposed EPA Plan but some alternatives that we would strongly suggest that the EPA endorse

Metcalf amp Eddy Plan - EPA Option

In reviewing the work of Metcalf amp Eddy the City has identified some additional costs that have not been included within the initial capitalization of the plan which Metcalf amp Eddy has detailed to the EPA The first item which needs to be drawn to the surface is the need for additional water quantity in order to service the Town of Durham In preparation of this report I understand that Metcalf amp Eddy did contact our staff regarding the hydraulic grade line (HGL) of the City of Middletowns system in close proximity to the Durham border The correct answer to this question was 500 feet NGVD 29 While the City maintains sufficient head for the purposes of supplying the Town of Durham there is insufficient flow available to supply the additional customers that would be added This small section of Middletown in the Talcott Ridge area is serviced by two hydro-pneumatic pumps that pump on demand much like a residential well system Because of the size of these pumps and the availability of district piping in Middletown it would not be possible to supply Durham with the additional water required unless there was an upgrading to the hydro-pneumatic pump station and an improvement to district piping to the Durham town line

Our preferred option in this matter has always been the establishment of the Cherry Hill Water Tower The Cherry Hill Water Tower along with district piping and improvements to the hydro-pneumatic pump station to a full booster pump station would allow for ample water quantity to service the expansion of the Middletown system in a southerly direction through the downtown area of the Town of Durham

In our initial review following the public hearing we understood that the $70 million dollar number that was discussed at the initiation meeting on July 12 2005 was a capitalization number Further investigation into the Metcalf amp Eddy report has indicated that this was a compilation of both capital and on-going O amp M And while at the initiation meeting I did not raise the $7 0 million dollar number as a problem It was only because I had anticipated that the $70 million dollars was a capital number which in fact included refurbishment of the pump station district piping and funding for the Cherry Hill Water Tower I will state again clearly these three items would be essential for the City of Middletown to supply the Town of Durham in the quantity that is needed without imposing an economic hardship to the citizens of the City of Middletown

Fuss amp ONeill Plan - City of Middletown Option

Previous to the EPAs establishment of the proposed plan the City of Middletown Water Department cooperatively with the DEP and the Town of Durham had worked extensively on developing preferred options for the expansion of water service to the

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

amp ONeill report the rehabilitation of the hydro-pneumatic pump station to a full booster pump station and improvements to district piping I would note that the Fuss amp ONeill report did include contribution for the Cherry Hill Water Tower and also large diameter

piping improvements from the proposed Cherry Hill Water Tank to the town line The total cost estimate based on our review to complete the Fuss amp ONeill full redundant service area with ample fire protection for the Town of Durham and also providing elements to the City of Middletown to keep this extension cost neutral to the residents of the City of Middletown is $1315141600

Action Plan

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas

Action Plan

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

Metcalf amp Eddy Plan - EPA Option

In reviewing the work of Metcalf amp Eddy the City has identified some additional costs that have not been included within the initial capitalization of the plan which Metcalf amp Eddy has detailed to the EPA The first item which needs to be drawn to the surface is the need for additional water quantity in order to service the Town of Durham In preparation of this report I understand that Metcalf amp Eddy did contact our staff regarding the hydraulic grade line (HGL) of the City of Middletowns system in close proximity to the Durham border The correct answer to this question was 500 feet NGVD 29 While the City maintains sufficient head for the purposes of supplying the Town of Durham there is insufficient flow available to supply the additional customers that would be added This small section of Middletown in the Talcott Ridge area is serviced by two hydro-pneumatic pumps that pump on demand much like a residential well system Because of the size of these pumps and the availability of district piping in Middletown it would not be possible to supply Durham with the additional water required unless there was an upgrading to the hydro-pneumatic pump station and an improvement to district piping to the Durham town line

Our preferred option in this matter has always been the establishment of the Cherry Hill Water Tower The Cherry Hill Water Tower along with district piping and improvements to the hydro-pneumatic pump station to a full booster pump station would allow for ample water quantity to service the expansion of the Middletown system in a southerly direction through the downtown area of the Town of Durham

In our initial review following the public hearing we understood that the $70 million dollar number that was discussed at the initiation meeting on July 12 2005 was a capitalization number Further investigation into the Metcalf amp Eddy report has indicated that this was a compilation of both capital and on-going O amp M And while at the initiation meeting I did not raise the $7 0 million dollar number as a problem It was only because I had anticipated that the $70 million dollars was a capital number which in fact included refurbishment of the pump station district piping and funding for the Cherry Hill Water Tower I will state again clearly these three items would be essential for the City of Middletown to supply the Town of Durham in the quantity that is needed without imposing an economic hardship to the citizens of the City of Middletown

Fuss amp ONeill Plan - City of Middletown Option

Previous to the EPAs establishment of the proposed plan the City of Middletown Water Department cooperatively with the DEP and the Town of Durham had worked extensively on developing preferred options for the expansion of water service to the

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

Town of Durham The preferred option is captured in the codified documents which support the EPA Proposed Plan and we believe it addresses all of Durhams current and long-term needs The Fuss amp ONeill report recommended a rehabilitation of the current pump station district piping and the establishment of a Cherry Hill Water Tower on land currently owned by the City of Middletown Water Department Additionally the Fuss amp ONeill report detailed the extension of large diameter water mains to the Middletown Town Line and onward through the Main Street area of Durham terminating at the intersection of Routes 17 and 79 The large diameter water mains would allow for transmission of water through the downtown area and would allow for fire protection to most all public buildings important to the residents of the Town of Durham

The City of Middletown Water Department understands that the charge of EPA is not to solve economic development andor fire prevention issues in this central business area of the Town of Durham However it is essential that the EPA solution does not proceed in a vacuum of these other requirements Therefore the City of Middletown is encouraging the EPA along with area legislators both Federal and State to consider the establishment of a Water Development Fund to which the EPA portion from the Potentially Responsibility Parties (PRPs) will be contributed in a full capitalization of the actual costs to achieve the EPA recommended solution

Analysis

For the purposes of detailing the relative costs of each of these proposals I have asked my staff to take the Metcalf amp Eddy Proposal on behalf of the EPA and add to it a set aside based on our best engineering estimate for rehabilitation of the hydro-pneumatic pump middot station to a booster pump station Also the improvements to district piping towards the Durham Town Line and the establishment of a set aside for the Cherry Hill Water Tower The attached worksheet (Table I) captures these costs in tabular form and is the true cost of capitalization of this project so as not to financially impact the residents of the City of Middletown The cost of this construction is estimated at $708429400 It is this cost that EPA should seek to provide water as it is recommending

On the Table 2 which is attached I directed my staff to take the original Fuss amp ONeill estimate from the year 2000 and update the unit pricing based on the Metcalf amp Eddy pricing where available and then for other units which were not available give a best estimate of construction for those items which are not detailed within the Metcalf amp Eddy report Additionally and utilizing the same estimates they have added to the Fuss

The City of Middletown Water Department is suggesting a cooperative action plan between EPA Federal and State Legislators the Town of Durham and the City of Middletown Water Department Noting that the difference between the true cost neutral impact to the City of Middletown of imposing the EPA Plan is $708429400 verses the Fuss amp ONeill-City of Middletown preferred plan for full fire protectionredundant water service for the Town of Durham is $1315141600 There is a funding gap which exists of $606712200

The City of Middletown is encouraging the Town of Durham and the EPA to establish a Town of Durham Water Development Fund in which funds will be contributed from the EPA and the Potentially Responsible Parties (PRPs) for the Durham Meadows Superfund Site It would be our strong recommendation that added to these funds would be supplemental funds which should be made available from the State of Connecticut for Petroleum Tank Fund Sites of which two exist in close proximity to the service area and along the route of the proposed water main extension and that the Town of Durham look towards Federal legislators for assistance in providing additional funds to provide for the large diameter water main improvements and fire hydrants and pressure reducing stations that would be necessary to provide long-term fire protection to the Durham downtown area

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas

Within my ten-years as Director of the Water and Sewer Department I have looked on while the Merriam Manufacturing Plant has burned in the Durham downtown area as well as the Time Out Tavern just this previous spring As an outsider but someone with life-long and intimate knowledge of the Town of Durham it appears to make sense that the center core be offered fire protection for the long-term health and viability of the Town of Durham The Main Street corridor houses almost all of the important public buildings of the town including schools the public library town hall fire department post office and churches as well as the numerous businesses which have

given and maintain the bucolic character of Durham I would note that the extension of water unlike sanitary sewer will not impact development density in Durham Therefore the extension of water even in more ample quantities to address fire protection will not increase the density of development in the Town of Durham and therefore will not affect the rural flavor and nature of this town

I would like this response to serve as a call for action in the aggregation of funding for the Town of Durham such that a long-term and vital solution can be sought for the downtown area of Durham for both potable water for its residents impacted by the Superfund Site and also for the Town of Durham to maintain their long-term viability by way of fire protection and enhanced business development

I would like again to thank the EPA for allowing this opportunity for public comment and should the EPA have further inquiry of me or my staff regarding the development of our costs or the proposals and recommendations that have been made within this formal submittal we remain ready to answer questions and expand on these ideas
