Section 1: Introduction and Classes of Membership

11..11 IInnttrroodduuccttiioonn

The Hong Kong Institute of Construction Managers, Limited (HKICM), formerly known as Hong Kong Institute of Builders, Limited, was established in 1997 to promote professional excellence in the management of both building and civil works. The pre-requisites for attainment of HKICM membership include academic eligibility and appropriate professional experience. This booklet is published with guidelines to assist candidates in preparing for application for the different classes of HKICM membership. The criteria for election and application procedures for different classes of membership are described in Section 2 of this Handbook. The information on application to the class of Construction Supervisor membership is also introduced, in sub-section 2.4. It is anticipated that the professional development and recognition of the frontline site supervisors will soon earn its significance. Section 3 outlines the procedures of Professional Assessment, including the Professional Interview, Presentation and Test Paper, for the reference of applicants for Fellow and Member Classes. Section 4 states the Institute's guidelines for Continuing Professional Development. In Section 5 the expectations of HKICM on the professional conduct of its members are therein stipulated. Sections 6 and 7 recorded the accredited educational programmes and the fees and subscriptions schedules respectively. Last but not least, the Quality Charter printed in Section 8 of this Handbook denotes the commitment of the Institute in Quality and Professionalism.

11..22 PPrraaccttiiccaall EExxppeerriieennccee

The acquisition of appropriate training and experience is an essential element in the development of a building professional. It is a period during which skills, knowledge and attitudes of a practical nature are acquired in an industrial environment. Training and experience aims to develop judgement and critical abilities so that projects can be undertaken with due regard to technical, economic, financial, environmental, legal, ethical and social factors. It is important for Candidates to acquire a comprehensive understanding of the construction process from inception to completion.

The unique characteristics of the local construction environment dictate that normally at least four years of the post-qualification experience of the Candidate seeking admission as a Member should have been gained in the HKSAR, however, equivalent experience gained elsewhere which satisfies the Institute may also be acceptable. A record giving full details of employment and the nature of training received and experience gained should be kept by the Candidate to assist in documenting the formal application for membership. It is expected that Candidates will have gained experience in a number of construction disciplines, such as:

Project Management Quantity Surveying

Site management Building Surveying

Construction Planning Facilities Management

Construction Estimating Construction Safety

Construction Procurement Construction Research

Note: This list is not intended to be exhaustive, Candidates working in other

construction related disciplines will also be considered for membership.

11..33 CCllaasssseess ooff MMeemmbbeerrsshhiipp aanndd DDeessiiggnnaattiioonnss

There are 6 different Classes of Membership:

(I) Honorary Fellow / Fellow (II) Member (III) Associate (IV) Construction Supervisor (V) Graduate (VI) Student Candidates who are admitted to the Institute in the capacity of either Honorary Fellow, Fellow, Member or Associate will be allowed to use one of the following designations. However, only Fellows and Members collectively referred to as Corporate Members have full voting rights: Honorary Fellow : FHKICM(HON) 榮譽資深會員

Fellow : FHKICM 資深會員

Member : MHKICM 會員

Associate : AHKICM 仲會員

All Corporate Members are entitled to use the title "Cr" (which is an abbreviation for

"Construction Manager") before their English names and the title "營造師" after their Chinese names.

All Corporate Members registered as a Registered Construction Manager in the Register of Construction Managers established under the Construction Managers Registration Regulations are entitled to use the title “R.C.M.” (which is an abbreviation for

“Registered Construction Manager”) after their English names and the title "註冊營造師

" after their Chinese names.

All Construction Supervisors as defined under the Constitution and Bye-Laws of the Institute and registered as a Registered Construction Supervisor in the Register of Construction Supervisors established under the Construction Supervisors Registration Regulations are entitled to use the title “R.C.S.” (which is an abbreviation for “Registered Construction Supervisor”) after their English names and the title "註冊營造監工" after

their Chinese names.

11..44 EEnnttrryy RReeqquuiirreemmeennttss

Candidates applying for a particular Class of Membership will normally be required to fully satisfy the entry requirements for the Class of Membership to which the Candidate seeks admission to the Institute. In exceptional circumstances, the Board of Membership may recommend to the General Council that a Candidate who does not fully satisfy the entry requirements be admitted.

11..55 HHooww ttoo AAppppllyy ffoorr MMeemmbbeerrsshhiipp

Each Candidate must complete a Membership Application Form, duly signed by the requisite number of nominations. The completed application form should be submitted to the Secretariat marked for the attention of the Honorary Secretary together with separate cheques, one for the application fee, one for the entrance fee (for Member Class of Membership application only) and the other for the amount of membership subscription appropriate to the Class of Membership for which the Candidate seeks admission. Certified true copies of academic and/or professional qualifications, duly certified true and correct by the Candidate and a recognized professional, must be submitted to the Institute together with the completed application form. HKICM would normally inform the new applicants of their application feedback within six months from the date of receipt of the full set of required documents (duly signed and endorsed) and payments for application.

Section 2: Routes to Different Classes of Membership

22..11 HHoonnoorraarryy FFeellllooww [[FFHHKKIICCMM((HHOONN))]] // FFeellllooww CCllaassss [[FFHHKKIICCMM]] 2.1.1 Introduction

Fellow is the highest grade of membership of the Institute. As senior members of the profession, Fellows are in a position to make a major contribution to the affairs of the Institute on issues in the public interest, of a learned society nature, and in the setting of standards for qualification.

2.1.2 Routes to Fellow Class of Membership

There are three routes to the Fellow Class of membership:

I. Honorary Fellow

II. Transfer from the Member Class

III. By Direct Entry 2.1.3 Eligibility for Admission or Transfer

2.1.3.1 Honorary Fellow

The Institute may, under very exceptional conditions, admit a distinguished construction professional to be an Honorary Fellow. Such a person will be of particular eminence, will have obtained an international reputation in their field, and possess some tangible recognition of eminence, such as a national honour or award, and in the opinion of the General Council have rendered outstanding service to the Institute or the profession and who by means of either their position or experience or eminence may be able to render assistance in promoting the objects of the Institute. Such Honorary Memberships are not entitled voting rights in the business of the Institute.

The General Council may recommend any person as an Honorary Fellow at a General Meeting of the Institute. A person so recommended may be elected by a single majority of the Corporate Members present who are entitled to vote or exercise such right at the General Meeting.

2.1.3.2 Fellow Class (with Voting Rights)

2.1.3.2.1 Transfer from the Member Class

To transfer to the Fellow Class of the Institute, the Candidate will normally:

i. be at least 35 years old; and

ii. be a Member of the Institute or Corporate Members of other professional bodies of equal status; and

iii have been engaged in the profession having a minimum of 10

years recognized working experience, of which a minimum of 3 years in the HKSAR, since attaining Member grade of the Institute or Corporate membership of other designated pro-fessional bodies.

In addition to the position held by the Candidate at the time of application, the following factors will be taken into account: a. Employment Experience

The proof of holding a position of considerable technical and/or managerial responsibility in the construction field and having a minimum of 10 years of recognized working experience.

b. Membership of Professional Bodies

Membership of other professional bodies recognized by the Institute, the grade and the length of such membership.

c. Continuing Professional Development

The extent of effort made towards continuing professional development.

d. Contribution to the Institute or Construction Field

The extent of contribution made to the Institute's activities and development, or noteworthy contribution to the construction field.

2.1.3.2.2 Direct Entry

Candidates who would normally meet the requirements for Corporate Membership of the Institute and who hold a prominent position in the construction field may apply for direct admission to the grade of Fellow. Such Candidates for direct entry to the grade of Fellow, in addition to meeting the criteria for transfer from the Member Class (other than being a Member of the Institute), are required to have: i. high education qualifications or fellowship of an approved

professional institute; or ii. made some noteworthy contribution to the construction field;

or iii. materially advanced the practice of construction from technical

and/or managerial points of view.

The General Council may, at its discretion, require any Candidate seeking admission to be a Fellow to submit to a Professional Assessment to be conducted by a Panel of Professional Assessors duly authorized by the General Council for that purpose.

2.1.4 Professional Assessment

A Candidate seeking admission to the class of Fellow shall be required to attend a Professional Assessment, at the discretion of the General Council. The Professional Assessment, if so required, shall be conducted by a Panel of Professional Assessors delegated by the General Council for the purpose of assessing the extent to which a Candidate for the class of Fellow meets the admission requirements and to ascertain the quality of the Candidate's technical and responsible experience within a recognized discipline in the construction field.

Details of the Professional Assessment are given in Section 3 of this Handbook.

2.1.5 Application Procedure

Any Candidate desirous of being admitted as a Fellow shall sign and deliver to the Honorary Secretary a nomination in the form prescribed by the General Council signed by five Corporate Members, at least three of whom shall be Fellows.

2.1.6 Fees and Subscriptions

The current application, transfer, re-instatement and annual subscription fees are detailed in Section 7 of this Handbook.

An applicant for election to the class of Fellow must submit, together with the application, the election application fee and the subscription fee. The subscription fee will only be charged by the Institute upon successful election of the applicant. The election application fee, however, is non-refundable. An applicant for transfer from the Member Class to the Fellow Class must submit, together with the application, the transfer application fee and, the difference between the Fellow subscription fee and the Member subscription fee. This difference will only be charged by the Institute upon the successful transfer of membership. The transfer application fee, however, is non-refundable.

22..22 MMeemmbbeerr CCllaassss [[MMHHKKIICCMM]] ((wwiitthh VVoottiinngg RRiigghhttss)) 2.2.1 Routes to Member Class of Membership

There are 2 routes to the Member Class of membership:

I. The Formal Academic Qualification and Professional Training Route (The Normal Route)

II. The Mature Route

2.2.2 Eligibility for Admission or Transfer 2.2.2.1 The Formal Academic Qualification and Professional Training Route (The

Normal Route)

For admission or transfer to the Member Class via the academic qualification and professional training route, a Candidate must:

i. be at least of 25 years of age;

ii. fulfil the academic requirements* of the Institute;

iii. have had post qualification professional experience of a minimum of four years of an approved nature in the HKSAR or mainly in the HKSAR;

iii. pass the Professional Assessment, if so requested at the discretion of the General Council;

v. pass the Professional Interview, if the Candidate is exempted from the whole or part of the Professional Assessment due to the exemption allowed under the recognized qualification of Corporate Membership of other recognized professional bodies.

* Academic qualifications that meet the requirements of the Institute for the Member Class are:

a. A degree or equivalent qualification in Construction or related disciplines as assessed by the Hong Kong Council for Accreditation of Academic and Vocational Qualifications as being of equal status; or the recognized programmes in Section 6 of this Handbook, or

b. Other acceptable qualifications, such as full membership of an approved professional body, as the General Council may designate as being of equal status. For Discipline admission/classification, criteria stated in Section 6 of this Handbook shall apply.

2.2.2.2 The Mature Route

For admission to Member Class via the Mature Route, a Candidate must:

i. be at least of 35 years of age at the date of application;

ii. have had a minimum of ten years of experience (of which at least three years have been in the HKSAR or mainly in the HKSAR) in posts of generally increasing responsibility within a recognized discipline in the construction field;

iii. have attained a position demonstrating a level of competence that would have admitted the Candidate to the class of Member had the Candidate satisfied the normal academic requirements;

iv. submit a paper and pass the Professional Assessment.

2.2.2.2.1 The Paper

Candidates of at least 35 years of age who seek entry via the Mature Route must have had at least ten years of professional level experience. Candidates in this category are persons with considerable responsible experience within a recognized discipline in the construction field, but lacking the normal academic qualifications prescribed for Corporate Membership. Such a person may, if his candidature is approved, seek admission to the class of Member by submitting a Paper under the supervision of an appropriate Supervisor on the subject of an approved construction or building related topic and passing the Professional Assessment.

The Paper shall be in English, normally around 10,000 words in length, on a subject approved by the Institute. Original papers must be typewritten or printed, preferably in double spacing, on single sides of A4 paper. Two copies shall be provided and, signed by an appropriate Supervisor to certify it is the Candidate's own work. In the Paper, the Candidate shall be expected to offer an ordered and critical exposition of the subject, defining the problems, detailing managerial solutions and the application of managerial and technological principles to practical construction problems.

2.2.3 Professional Assessment

A Candidate seeking admission to the class of Member shall be required to attend a Professional Assessment. The Professional Assessment shall be conducted by a Panel of Professional Assessors delegated by the General Council for the purpose of assessing the extent to which a Candidate for the class of Member meets the admission requirements and to ascertain the quality of the Candidate's technical and responsible experience within a recognized discipline in the construction field.

Details of the Professional Assessment are given in Section 3 of this Handbook.

2.2.4 Application Procedure

Any Candidate desirous of being admitted as a Member shall sign and deliver to the Honorary Secretary a nomination in the form prescribed by the General Council signed by four Corporate Members of the Institute, at least one of whom shall be a Fellow.

2.2.5 Fees and Subscriptions

The current application, transfer, re-instatement and annual subscription fees are detailed in Section 7 of this Handbook.

An applicant for election to the class of Member must submit, together with the application, the election application fee, the entrance fee and the subscription fee. 22..33 AAssssoocciiaattee CCllaassss [[AAHHKKIICCMM]] 2.3.1 Routes to Associate Class of Membership

There are two routes to the Associate Class of membership:

I. Transfer from the classes of Graduate, Student or Construction Supervisor

II. By Direct Entry

2.3.2 Eligibility for Admission or Transfer

To become an Associate Member of the Institute, whether by way of Transfer or Direct Entry, a Candidate must:

i. be at least of 23 years of age;

ii. have obtained an accredited Higher Diploma or Higher Certificate or an acceptable equivalent as assessed by the Hong Kong Council for Accreditation of Academic and Vocational Qualifications, or other qualifications as detailed in Section 6 of this Handbook, in a construction related discipline; and

iii. have received a minimum of five years of training and/or working experience in the construction field in the HKSAR, or mainly in the HKSAR. Pre-qualification experience is acceptable but such acceptable experience is calculated as half of the number of the actual years of pre-qualification experience. The total number of years of acceptable pre-qualification experience should not be more than two and a half years counted towards the five years of minimum required working experience.

2.3.3 Application Procedure

Any Candidate desirous of being admitted as an Associate shall sign and deliver to the Honorary Secretary a nomination in the form prescribed by the General Council signed by four Corporate Members of the Institute, at least one of whom shall be a Fellow.

22..44 CCoonnssttrruuccttiioonn SSuuppeerrvviissoorr CCllaassss 2.4.1 Introduction

In order to widen the scope for the professional development needs of front-line building professionals, the Institute admits Construction Supervisor Members so as to motivate construction site staff through systematic site management training and Continuing Professional Development activities provided by the Institute.

2.4.2 Eligibility for Admission or Transfer

To become a Construction Supervisor Member of the Institute, whether by way of Direct Entry or Transfer, a Candidate must:

i. be at least of 18 years of age; and

ii. be a Certificate or Diploma holder of a recognized examining body (e.g. CIC, IVE or equivalent) in a recognized subject; and

iii. a) have at least one year of recognized working experience in the HKSAR; or

b) 1. be a Student Member of the Institute for at least one year; and

2. has completed CPD training for not less than 10 CPD hours (either organized or accredited by the Institute) during the year; and

3. engaged with a construction company on confirmed status; and

iv. has adequate knowledge in safety supervision, workmanship and quality control in the relevant subject areas as recognized by the Institute.

2.4.3 The Technical Competence Interview

Candidates seeking admission to the class of Construction Supervisor membership are required to attend an Interview to ascertain his/her relevant working experience, awareness of duties and responsibilities as a construction supervisor.

The Interview will be conducted by a Panel of Professional Interviewers delegated by the General Council for the purpose, an admitted Construction Supervisor Member can serve as one of the Panel Members for the Interview.

Candidates should satisfy the Panel of Interviewers with his/her competence and practical working experience in construction; as well as personal responsibilities to the society, employer, colleagues and collaborating partners.

The Interview may be conducted in English, Putonghua or Cantonese. However, due to the international nature of the construction profession in Hong Kong, Candidates are required to demonstrate their English proficiency and therefore part of the Interview will be conducted in English. The Interview will be of about 20 minutes’ duration. Exemption from the Professional Interview may be granted at the discretion of the Board of Membership to Candidates who are registered "Technically Competent Person" with the Buildings Department of the HKSAR, or those who possess recognized equivalent qualifications for the purpose.

2.4.4 Application Procedure

Any Candidate desirous of being admitted as a Construction Supervisor Member shall sign and deliver to the Honorary Secretary a nomination in the form prescribed by the General Council signed by two members of the Institute. At least one of the nominators shall be a Corporate Member and the other can be a Construction Supervisor Member or above.

2.4.5 Fees and Subscriptions

The current application, re-instatement and annual subscription fees are detailed in Section 7 of this Handbook. An applicant for election to the Construction Supervisor Member class must submit, together with the application, the election application fee and the subscription fee. The subscription fee will only be charged by the Institute upon the successful election of the applicant. The election application fee, however, is non-refundable.

22..55 GGrraadduuaattee CCllaassss 2.5.1 Eligibility for Admission

Candidates seeking admission to the Graduate Class of membership shall:

i. be at least of 18 years of age;

ii. have obtained an accredited honours degree or an acceptable equivalent qualification in a recognized construction discipline; and

iii. have been graduated within the last ten years. 2.5.2 Application Procedure

Any Candidate desirous of being admitted as a Graduate Member shall sign and deliver to the Honorary Secretary an application in the form prescribed by the General Council signed by their Employer.

Any Candidate, who shall be a student, desirous of being admitted as a Student Member shall sign and deliver to the Honorary Secretary an application in the form prescribed by the General Council.

33..22 IInnttrroodduuccttiioonn

A Candidate seeking admission to the Class of Fellow or Member shall be required to attend a Professional Assessment, at the discretion of the General Council. The Professional Assessment shall be conducted by a Panel of Professional Assessors delegated by the General Council for the purpose of assessing the extent to which a Candidate for the class of membership meets the admission requirements and to ascertain the quality of the Candidate's technical and responsible experience within a recognized discipline in the construction field. Candidates shall be expected to demonstrate that they have worked independently, assumed appropriate levels of responsibility, acquired practical knowledge and been aware of their responsibilities to their employers, colleagues, members of the construction team and the community at large. Candidates must be able to demonstrate the presentation and communication skills that are required to operate at a professional level within the industry.

33..33 CCoonntteenntt ooff tthhee PPrrooffeessssiioonnaall AAsssseessssmmeenntt

Candidates shall be aware that because of the international nature of the construction industry, they will be required to demonstrate a reasonable level of competence in both spoken and written English. To this effect, the Professional Assessment will primarily be conducted in English. In addition, a Candidate will be required to write a Test Paper (2 hours) in English on a subject specified by the Panel as part of the Professional Assessment. The Professional Assessment consists of 3 parts: the Professional Interview, the Presentation, and the Test Paper.

3.3.1 Professional Interview

i. The Professional Interview shall be based on the written report on the Candidate's training and experience submitted as part of the Presentation described in 3.3.2.1 below. The purpose of the Professional Interview is to enable the interviewing panel to satisfy itself that the Candidate fulfils the requirements for admission to Corporate Membership of the Institute.

ii. It is anticipated that the Professional Interview will be of 40 minutes duration (and might be followed by a further two hours to allow the Candidate to complete the Test Paper).

3.3.2 Presentation by the Candidate

The following submissions are required from Candidates for the Professional Assessment.

a. The Report shall be a written document setting out the Candidate's experience and shall be used as the basis of the Interview. Candidates should therefore give careful thought to its structure and content before commencing its preparation.

b. The Report should be concise, between 1,600 and 2,000 words, in English, typewritten on single sides of A4 paper and submitted in two copies.

c. At the head of the Report, the Candidate must set out in chronological order, giving the months and years in each case, the inclusive dates of the particular periods of training and experience that the Candidate has had.

d. The Report should be an objective overview of the Candidate's experience and qualifications that provides clear evidence of the nature of the Candidate's experience, the level of personal duties and responsibilities, and personal development and career progression.

3.3.2.2 Drawings and Documents (to be presented at the Professional Interview)

During the presentation, the Candidate is required to provide evidence or examples of recent work in support of the Candidate's claim to professional status, such as drawings, reports, plans, photographs, or such similar documents as appropriate.

3.3.2.3 Continuing Professional Development (CPD) Record (to be submitted together

with the application form) A record of Continuing Professional Development should be provided, in two copies. CPD may include technical conferences, seminars, symposia, courses, organized site visits and meetings of professional bodies. It is desirable to have as much CPD events as possible, within which a balance between technical, managerial, contractual and other subjects at professional level should be sought.

3.3.3 Test Paper

i. Candidates shall be required to demonstrate their ability to write a reasoned and logical commentary in English.

ii. There will normally be two questions available from the Panel. The Candidate is expected to answer either one of them in not less than 1,500 words.

iii. The questions shall be quite general such that there is no 'right answer' to which the Candidate is expected to produce. It is rather a test on the presentation and analytical competence of the Candidate.

iv. The Candidate shall be allowed two hours to complete the Test Paper, conducted either before or after the Professional Interview.

i. Candidates shall be notified in writing within three months from the date of the Professional Assessment whether they have passed, or, are deferred. In cases of deferment, it may be recommended for a period of six months, or for a period up to two years.

ii. In the event the Candidate is deferred, a written explanation will accompany the notification.

iii. Candidates shall be allowed to re-apply for the Professional Assessment after the recommended period of deferment.

iv. Should any Candidate wish to appeal against the result of the Professional Assessment, the Candidate shall give written notice to the Board of Membership within 14 days from the date of the notification of deferment. An appeal fee of HK$600.00 must accompany the written notice of appeal, payable to the “Hong Kong Institute of Construction Managers, Limited”.

v. Such appeal shall be reviewed by the Board of Membership for the purpose. The decision of the Board shall be conclusive and final.

Section 4: Continuing Professional Development (CPD)

44..11 OOvveerrvviieeww

Advanced developments in technologies bring higher expectations from the public and fast changing social conditions bring challenges. Expectations of the society and the government towards the construction profession for enhanced standards therefore keep rising. It spells the necessity and the growing importance of continuing professional development to keep construction practitioners abreast of methodologies and the latest technological developments in construction, for higher standards and better quality.

CPD, under the demanding high expectations of the public hence carries, in addition to personal professional developments, a commitment to social responsibilities. The Institute, in such direction, organizes series of CPD events for its members aiming to enhance professional competency.

Members are strongly urged to participate in full CPD activities as this will substantially contribute to the enhancement of their professional competency. In addition, members are required to maintain their own proper records as evidence of compliance with CPD requirements must be produced upon application for admission, upgrade, transfer and reinstatement of membership.

44..22 CCPPDD RReeqquuiirreemmeennttss

It is important that CPD should be concerned with matters that are related to the advancement or consolidation of knowledge specifically oriented towards, or directly relevant to the Construction Profession. It should have sufficient academic content and not be merely an acquisition of peripheral skills.

It was resolved by the General Council during the meeting held on 3 August 2016 that ALL members (except the classes of Construction Supervisor, Graduate and Student where such requirements are optional) should complete a minimum of 30 hours per year on a mandatory basis starting 1 April 2017.

iv. All members, except the classes of Construction Supervisor, Graduate and Student

where CPD requirements are optional, should complete a minimum of 30 hours per year on a mandatory basis starting from 1 April 2017. A minimum of 10 hours should fall within the type of ‘Seminar and Training’; a maximum of 14 hours for ‘Structured Learning and Programmes’, a maximum of 10 hours for ‘Community, Institutional and Social Services’ and a maximum of 8 hours per year for ‘Private Study/Self Learning’.

v. The format of CPD activities can include but not limited to participating and organizing of courses, lectures, seminars, symposia, conferences, presentations, workshops, industrial attachment and visits, e-learning and professional activities which are carried out by the Institute or other peer organizations.

vi. All members (including fellows and associates) would be required to declare

whether they have met the CPD requirements at the annual membership renewal with effect from 1 April 2017.

vii. The Institute may carry out CPD spot‐checks on a percentage of the membership

throughout the year. When asked to submit CPD details, members (including fellows and associates) should keep the original and submit a copy of the CPD Log Sheet (sample attached) for the period specified, normally one or more of the previous two years. Supporting documents such as receipts, tickets, and certificates are normally not required to be submitted, but should be retained in case more information on a particular item is requested.

viii. Members who are not able to provide adequate evidence to support the

fulfillment of the required CPD hours shall be required to be reviewed in one year time. It is expected that the member will complete a minimum of 30 hours of CPD during that year, and continue to accumulate more CPD hours as other members do. Cases of continuing non‐compliance of this requirement shall be dealt with individually by the Board of Membership and the Council as appropriate.

Section 5: Professional Conduct and Rules of Conduct

55..11 PPrrooffeessssiioonnaall CCoonndduucctt 5.1.1 Standard of Conduct

All members of the Institute shall observe high and honourable standards of professional conduct. Guidance notes on such standards shall be issued by the General Council from time to time which shall be subject to ratification by resolution at a General Meeting. Such guidance may include recommended Scales of Charges for professional work undertaken by members.

5.1.2 Suspension/Expulsion

The General Council shall have power to take such action against any member as it deems fit, including suspension of membership (for such period as it thinks fit) or expulsion of any member who in its opinion has failed to observe a high and honourable standard of professional conduct or is believed to be, or is believed to have been guilty of any act or conduct detrimental to the best interests of the Institute or its members.

5.1.3 Investigation of Complaints

If the General Council is called upon to investigate any complaint against a member, the General Council or any Committee appointed by it for this purpose shall: 5.1.3.1 notify the member of the complaint; 5.1.3.2 request the member to make an explanation in person and, if he so wishes, in

the company of his lawyer, at a time and place to be specified; 5.1.3.3 request the member or any other person to provide such documentary or

other evidence of the matter as may be thought fit; 5.1.3.4 consider all aspects of the complaint; 5.1.3.5 in the case of a Committee, make recommendations to the General Council on

its findings.

5.1.4 Action following Investigation of Complaints

5.1.4.1 If the General Council determines the complaint is proven justified, it shall

determine what action should be taken against the member including whether to expel or suspend the member for such period as it thinks fit.

5.1.4.2 If the General Council determines the complaint is not justified, it shall inform

the member of the decision or take such action as it thinks fit.

5.1.4.3 Any member suspended under this Part shall has no right to vote at any meeting or to hold any office in the Institute, or to have or exercise any of the other rights or privileges of membership during the period of his suspension. Nevertheless, his obligations under Fees and Subscriptions (Section 7 of this Handbook) shall stand, and he shall be entitled to receive the publications of the Institute and use the appropriate abbreviated designation after his name.

5.1.4.4 Any member expelled from the Institute under this Part shall cease to be a member of the Institute and shall have thenceforth no rights whatsoever in the Institute.

5.1.4.5 The Honorary Secretary shall forthwith give to any member suspended or expelled under this Part notice in writing of such suspension or expulsion, and every member shall be notified in writing of the General Council's decision.

5.1.5 Appeal

5.1.5.1 Save as described in 5.1.5.2 below, the decision of the General Council with respect to the suspension or expulsion of a member shall be final and no appeal may be entered into.

5.1.5.2 A member aggrieved by the decision of the General Council with respect to a question of laws has the right to give notice within 30 days of such suspension or expulsion of his intention to contest the decision of the General Council in a Court of Laws.

5.1.5.3 Should the Court of Laws uphold the appeal, the General Council or its appointed Committee shall re-investigate the complaint having regard to its determination on the question of laws concerned.

5.1.6 Associates

The conduct of Associates shall be judged similarly to that of Members and in the case of misconduct action shall proceed as under Sections 5.1.1 to 5.1.5.

5.1.7 Construction Supervisors

The conduct of Construction Supervisors shall be judged similarly to that of Members and in the case of misconduct, actions shall proceed as under Sections 5.1.1 to 5.1.5.

5.1.8 Graduates and/or Students

The conduct of Graduates and/or Students shall be judged similarly to that of Members and in the case of misconduct, actions shall proceed as under Sections 5.1.1 to 5.1.5.

55..22 RRuulleess ooff CCoonndduucctt These Guidance Notes and Rules apply to all members. The General Council may change or add any rules from time to time provided that such changes or additions are not contrary to the Bye-Laws. Notices of changes or additions to the Rules will be published in the website or newsletter.

In these Rules of Conduct:

I. “Members” shall mean all Corporate and Non-Corporate Members of the Institute.

II. “Logo” refers to the logo approved by the Institute for use by Corporate Members only.

III. “advisory service” includes project management, contract management, design and the giving of advice upon the construction, alteration, maintenance or repair of a building or other structure, including method, feasibility or cost in the form of written or verbal reports or drawings.

5.2.1 Standard of Conduct

5.2.1.1 Members shall, in fulfilling their professional responsibilities and the duties

which they undertake, have full regard to the public interest. 5.2.1.2 Members shall demonstrate a level of competence consistent with their class

of membership. 5.2.1.3 Members shall at all times act with integrity so as to uphold and enhance the

dignity, standing and regulations of the Institute. 5.2.1.4 No Member shall be connected with any occupation or business in any way

which would, in the opinion of the General Council, prejudice his professional status or the reputation of the Institute.

5.2.1.5 Members undertaking work in a country other than their own shall observe

these Rules so far as they are applicable. 5.2.1.6 Members shall discharge their duties with complete fidelity and probity, in

particular they shall: 5.2.1.6.1 not divulge to any person, firm or company any information of a

confidential nature relating to the business activities or processes of their Employer or Client acquired during the course of their work;

5.2.1.6.2 not, without the permission of their Employer or Client, render

any services, with or without remuneration, which conflicts with the interests of their Employer or Client;

5.2.1.6.3 ensure, when providing an advisory service, that the advice given

is fair and unbiased;

5.2.1.6.4 ensure, when undertaking any other construction related activity, that all such work is in accordance with good practice and current standards and complies with all statutory and contractual requirements;

5.2.1.6.5 at no time improperly offer or accept gifts or favours which would be interpreted by the Institute as exerting an influence to obtain preferential treatment;

5.2.1.6.6 not undertake work for which they knowingly lack sufficient professional or technical competence, or the adequate resources to meet their obligation;

5.2.1.6.7 if not competent to undertake part or all of a particular advisory service shall either decline to give advice or secure appropriate competent assistance;

5.2.1.6.8 only use the distinguishing letters of membership and appropriate description prescribed in the Bye-Laws and in accordance with the principles of these Rules of Conduct;

5.2.1.6.9 not, unless Corporate Members be permitted, use the logo approved by the Institute for use by members in connection with their advisory service in accordance with the principles of these Rules of Conduct and the guidelines published by the Institute from time to time;

5.2.1.6.10 if providing an advisory service be required to obtain professional indemnity insurance to cover the full liability of any advisory service offered;

5.2.1.6.11 if undertaking any other construction related activity be required to maintain insurances and indemnify their Client against the risks for which insurance is commonly effected arising out of the works in respect of workmen, third parties and adjoining properties;

5.2.1.6.12 not maliciously or recklessly injure or attempt to injure, whether directly or indirectly, the professional reputation, prospects or business of others;

5.2.1.6.13 keep themselves informed of current thinking and developments appropriate to the type and level of their responsibility. They should be able to provide evidence that they have undertaken sufficient study and personal development to fulfil their professional obligations in accordance with the current guidelines for Continuing Professional Development (CPD);

5.2.1.6.14 only advertise their services in accordance with the conditions set out in these Rules of Conduct. Within this framework, they are permitted to make their experience and availability known to individuals and organisations where it is believed that an opportunity may exist for their services;

5.2.1.6.15 at all times have due regard for the safety, health and welfare of

themselves, colleagues and any others likely to be affected, and in particular be expected to have:

i. knowledge of the health and safety risks in the industry and the main principles and strategies for control;

ii. an understanding of the responsibilities for safety, health and welfare placed on all parties involved in the building process;

iii. a working knowledge of current legislation and advisory information;

iv. a recognition of the importance of keeping themselves up-to-date.

5.2.1.7 Further, it shall be the duty of every Member:

5.2.1.7.1 when acting for a Client or when in contemplation of acting for a prospective Client whose interests conflict or may conflict with his own, or those of any of his associates to disclose the relevant facts forthwith to the Client or prospective Client and to the associate and where such disclosure is oral to confirm the same in writing at the earliest opportunity and inform the Client that he shall be unable to act or continue to act unless the Client requested him to do so;

5.2.1.7.2 to ensure that neither he personally nor any firm or company carrying on practice of which he is a partner or director acts for two or more parties with conflicting interests without disclosing the relevant facts to each of those parties forthwith and confirming such disclosure in writing at the earliest opportunity.

5.2.1.8 For the purposes of this paragraph of these Guidance Notes:

5.2.1.8.1 "Partner" shall include a sole principal of a practice or a partner in a firm or a Director of a company;

5.2.1.8.2 "firm" shall mean a practice firm or company carrying on practice in construction;

5.2.1.8.3 "contravention" shall include any act or omission which would if committed by a Member constitute a contravention.

5.2.1.9 Every Member who:

5.2.1.9.1 is or holds himself out or allows himself to be held out to be a Partner in a firm; or

5.2.1.9.2 allows his name and/or designatory letters or designation to appear on the note paper or in the advertisements of any firm in which no other Partner is a Member; or

5.2.1.9.3 is a Partner in a firm which is so connected with another firm in which no Partner is a Member that in the opinion of the General Council persons dealing with that other firm believe or may be induced to believe that the two firms are connected, shall be held responsible for any contravention of the Bye-Laws committed by any Partner or by any member of the staff of such firm or other firms, provided that if such Member shall show that without any default on his part he had no reason to be aware and was not aware of any such contravention and that he had prior to such contravention taken all such steps as may be reasonable to ensure that such contravention was not committed he may be relieved of responsibility for such contravention.

5.2.1.10 No Member shall:

5.2.1.10.1 offer or provide whether to a prospective Client or a third party any gift or favour whether in money or otherwise designed to secure instructions for work;

5.2.1.10.2 having once quoted a fee for professional services revise that quotation to take account of the fee quoted by another Member for the same services;

5.2.1.10.3 quote a fee for professional services which is to be calculated by reference to the fee quoted or charged by another Member reduced by some proportion or amount;

5.2.1.10.4 directly or indirectly exert undue pressure or influence on any person, whether by the offer or provision of any payment, gift or favour or otherwise, for the purpose of securing instructions for work, or accept instructions from any person on whom he has reason to believe that undue pressure or influence may have been exerted by a third party in expectation of receiving a reward for the introduction;

5.2.1.10.5 act or offer to act in any capacity in relation to any matter which is the subject of judicial or quasi-judicial proceedings either on the footing that no charge will be made unless the proceedings are successful or on the footing that the amount of the charge will be related to the degree of success attained.

5.2.1.11 No Member shall solicit instructions for work in a manner that may bring the

Institute into disrepute.

5.2.1.12 Every Member shall:

5.2.1.12.1 keep in one or more bank accounts separate from his own, his firm's or his company's bank account (as the case may be) any Clients' money held by or entrusted to him, his firm or his company in any capacity other than that of beneficial owner;

5.2.1.12.2 account at the due time for all moneys held, paid or received on behalf of or from any person (whether a Client or not) entitled to such account and whether or not after the taking of such account any payment is due to such person.

5.2.1.13 No Member shall carry on practice under any such name, style or title as to prejudice his professional status or the reputation of the Institute.

5.2.2 Distinguishing Letters and Use of Descriptions

5.2.2.1 Members who are entitled to use their distinguishing letters of membership and/or descriptions may only do so in conjunction with their personal name. Distinguishing letters and/or descriptions may not be used in conjunction with the name of a business or other organisations.

5.2.2.2 Members who are proprietors, partners or directors of a business may display their names, any appropriate distinguishing letters of membership, and supporting descriptions on the premises and name boards of the business.

5.2.2.3 Members may display their names, any appropriate distinguishing letters of membership, and/or descriptions, on personal stationery, site notice boards and publications, and on those of businesses and/or other organisations with which they are connected.

5.2.2.4 The Institute will from time to time publish guidance setting out the exact style and manner in which members' distinguishing letters and descriptions may be used.

5.2.2.5 Logo Corporate members offering advisory services may use the logo approved by the General Council on: - Stationery - brochures and report covers - advertisements - drawings - site signboards

in accordance with guidelines as published by the Institute from time to time.

5.2.2.6 Advisory Service The Institute does not prescribe a scale of fees. Any charges made by a member shall be fair and reasonable.

Before undertaking a remunerated advisory service members must agree in writing with their Clients:

5.2.2.6.1 the nature, scope and limitation of the proposed advisory service and where appropriate the manner in which it is to be provided and documented;

5.2.2.6.2 the basis and timing of any charge to be made including that for abandoned work;

5.2.2.6.3 any provision to be made for reimbursement of printing costs, travelling and other related expenses;

5.2.2.6.4 procedures for settlement in the event of a dispute;

5.2.2.6.5 the nature and scope (including any restriction or limitation) of the insurance offered in relation to any advisory service including but not limited to professional indemnity, Third Party Liability and Employer's Liability insurance.

Note: The Institute can, on request provide details of insurers prepared to

consider the forms of risk mentioned in Section 5.2.2.6.5 above. The arrangement and operation of such insurances is entirely a matter between the member and the insurer.

5.2.2.7 Advertising

5.2.2.7.1 Advertisements shall be factual and relevant in substance and presentation. They must not contain information which is untrue, misleading, unfair, flippant or otherwise discreditable to the profession.

5.2.2.7.2 If any advertising agency is used by a member, the member remains responsible for ensuring that advertisements conform to the provisions of these Rules of Conduct.

5.2.3 Disciplinary Powers

5.2.3.1 In accordance with the provisions of Professional Conduct under Section 5.1

of this Handbook if a Member is found to have contravened the Standard of Conduct as laid down in Section 5.2.1 of this Handbook or any provision of the Bye-Laws the General Council shall have power to take any one or more of the following courses of action, that is to say:

5.2.3.1.1 to reprimand or severely reprimand the Member;

5.2.3.1.2 to require the Member to give an undertaking to refrain from continuing or repeating the conduct which is found to have constituted the contravention;

5.2.3.1.3 to suspend the Member from Membership of the Institute for such periods as the General Council may determine;

5.2.3.1.4 to expel the Member from the Institute;

5.2.3.1.5 to order the Member to pay the expenses incurred by the Institute in the investigation of the complaint and the disciplinary proceedings against the Member including but not limited to legal costs incurred therefor.

5.2.3.2 If in respect of a Member there is produced to the General Council

5.2.3.2.1 evidence of conviction by a Court of competent jurisdiction for any criminal offence involving embezzlement, theft, corruption, fraud or dishonesty of any kind or any other criminal offence carrying on first conviction a maximum sentence of not less than twelve months imprisonment; or

5.2.3.2.2 a legal notice that he has been adjudicated bankrupt or a certified copy of a deed of arrangement he has entered into with or for the benefit of his creditors; and

5.2.3.2.3 a copy of a letter sent by the Institute to the Member i. informing him of the powers of the General Council under

the Bye-Laws; ii. giving him not less than 21 days’ notice of the date of the

meeting of the General Council at which the matter is to be considered; and

iii. inviting him to make such submissions in writing as he may think fit;

the General Council after considering any submission as aforesaid may either: i. refer the matter to the Committee of Investigation

hereinafter mentioned for enquiry and action; or ii. without further enquiry forthwith expel the Member from

the Institute. 5.2.3.3 The General Council may if they think fit temporarily suspend the Member

from membership of the Institute pending such enquiry as last aforesaid.

5.2.3.4 All decisions of the General Council shall take immediate effect and shall be duly recorded; and the General Council may cause to be published in the Journal and in such newspapers or other publications as the General Council may think fit notice of reprimand or severe reprimand; suspension or expulsion of a Member together with such particulars as the General Council shall think desirable of the misconduct, breach of Bye-Laws, conviction or other matter for which the penalty in question was imposed.

5.2.3.5 If a Member is expelled his name shall be removed from the Register and he shall thereupon cease for all purposes to be a Member of the Institute. His diplomas of Membership shall be immediately returnable to the Institute and he shall not be entitled to use any designation or description which implies membership or former membership of the Institute.

5.2.3.6 If a Member is suspended he shall not be entitled during the period of his

suspension to exercise any of the rights or privileges of membership of the Institute. He shall however remain in all other respects subject to the provisions of the Bye-Laws and to the exercise of the Institute's disciplinary powers in respect of any contravention of those provisions committed by him during the period of his suspension.

5.2.3.7 Once a Member has been notified that a complaint or allegation has been

made against him or that a conviction, bankruptcy or other matter mentioned in these guidance notes has been notified to the Institute he shall not be entitled to resign from membership of the Institute and any such proceedings may be continued notwithstanding his attempted resignation.

5.2.4 Disciplinary Bodies

The disciplinary bodies of the Institute shall consist of a Committee of Investigation and a Disciplinary Board sitting in private. 5.2.4.1 The Committee of Investigation

5.2.4.1.1 The Committee of Investigation shall be selected by the President and shall consist of three members who shall be Fellows. The President shall appoint one of the members to be its chairman. The chairman shall appoint a Member of the Institute to be its secretary.

5.2.4.1.2 If in the opinion of the Committee of Investigation the investigation of a particular complaint or allegation may require specialist knowledge or expertise not available to the Committee, it may appoint a Member who in its opinion has such knowledge or expertise to serve ad hoc as a full additional member of the Committee for the purpose of considering the particular complaint or allegation.

5.2.4.2 The Disciplinary Board 5.2.4.2.1 The Disciplinary Board shall be drawn from a Disciplinary Panel. 5.2.4.2.2 The Disciplinary Panel shall be appointed by the General Council.

Members shall be appointed for a period of two years. The Disciplinary Panel shall consist of a maximum of twenty Members.

5.2.4.2.3 The Disciplinary Board shall be selected by the President and shall consist of not less than three nor more than five members of the Disciplinary Panel, as the President may decide. A Member appointed on to the Committee of Investigation shall not be appointed on to the Disciplinary Board. The President shall appoint one of the members of the Board to be its chairman. The chairman of the Board shall appoint a Member of the Institute to be the secretary. The President shall also advise two other members of the Disciplinary Panel to hold themselves in readiness to replace any of those selected who may in the event be unable to attend the hearing. The Board shall sit with an assessor being a solicitor or barrister of not less than ten years standing and who shall be appointed by the President.

5.2.5 Disciplinary Procedure

5.2.5.1 The Committee of Investigation

5.2.5.1.1 When a complaint or allegation is made against a Member of a breach of the Bye-Laws the President shall appoint a Committee of Investigation and the Honorary Secretary shall transmit to the Committee details of the complaint or allegation, together with any documentary evidence in support thereof.

5.2.5.1.2 The Honorary Secretary shall inform the Member of the complaint or allegation made against him and shall also inform him that a Committee of Investigation has been appointed.

5.2.5.1.3 The Committee shall consider the documents and may either reach a conclusion thereon or call for further information or evidence from the complainant or from any other person.

5.2.5.1.4 The Committee shall keep minutes of its investigations and decisions but the circulation of those minutes shall be confined to members of the Committee during the period of investigation after which they shall be made available to the Office Bearers of the General Council.

5.2.5.1.5 If the Committee recommends that the subject matter of the complaint or allegation should not become a formal charge it shall so inform the Office Bearers of the General Council. The Office Bearers after due consideration of the Committee's recommendation shall inform the Member of their decision by letter to the Member.

5.2.5.1.6 If the Committee recommends that the subject matter of the complaint or allegation should become a formal charge it shall so inform the Office Bearers of the General Council. The Office Bearers after due consideration of the Committee's

recommendation shall inform the Member of their decision by letter to the Member. In the event of the Office Bearers accepting the Committee's recommendation the President shall appoint a Disciplinary Board and the Honorary Secretary shall be given such assistance as he may need for the purpose of instructing the Institute's solicitors and (if they so advise) counsel to draw up the charge and generally prepare the case for presentation to the Disciplinary Board.

5.2.5.2 The Disciplinary Board

When the charge has been drawn up the Honorary Secretary shall after consultation with the Chairman of the Board fix a date, time and place for the hearing (sufficiently far ahead for the Member to be given not less than 28 days’ notice thereof) and shall: 5.2.5.2.1 by recorded delivery post addressed to the Member's last known

address:

i. send him a copy of the charge;

ii. invite him (if he so wishes) to submit a written answer by way of defence to the charge;

iii. inform him of the date, time and place of the hearing and of his rights under the provisions of Professional Conduct as laid down in Section 5.1 of this Handbook (i.e. Part V of the Bye-Laws);

iv. call upon him to state within the next 14 days whether he intends to appear at the hearing and if so whether only in person or by solicitor and/ or counsel;

v. warn him that if he does not elect to appear at the hearing the Board may proceed in his absence;

vi. require him to serve on the Honorary Secretary not less than 14 days before the date of the hearing a list of such documents if any upon which he intends to rely at the hearing;

vii. inform him that the Institute is also required to serve upon the Member not less than 14 days before the hearing a list of the documents to which the Institute intends to refer;

viii. inform him that either he or the Institute (as the case may be) may require copies of any documents included in a list served by either of them upon payment of any proper charge therefor; and

ix. send him a copy of the procedure note for the conduct of the hearing approved by the General Council;

5.2.5.2.2 send to the Institute's solicitor a copy of the letter and accompanying documentation sent in pursuance of the foregoing requirements; and

5.2.5.2.3 make arrangements for the hearing by the Board.

5.2.5.3 If the Member charged fails to attend either in person or by solicitor or

counsel before a Board either at an original hearing or at any adjourned hearing or otherwise avail himself of his rights the Board shall satisfy itself that he was duly given notice thereof and has not shown good cause for his failure to attend and if so satisfied may proceed in his absence and without further reference to him.

5.2.5.4 A Board may at its discretion adjourn a hearing from time to time. 5.2.5.5 The Board shall:

5.2.5.5.1 conduct the hearing in a judicial manner in accordance with the

procedure approved by the General Council; and 5.2.5.5.2 if its finding is that the charge is proved, receive evidence of the

Member's record and hear any statement or speech in mitigation by the Member or on his behalf.

Section 7: Fees and Subscriptions

77..11 AApppplliiccaattiioonn aanndd SSuubbssccrriippttiioonn FFeeeess

An Applicant is required to pay an application fee, an entrance fee (for Member Class of Membership application only) and a subscription fee at the time of making an application, whether for the election to new membership or for the transfer (upgrade) of the membership class. The entrance fee and subscription fee will ONLY be charged upon successful election or application for transfer (upgrade) of membership. The application fee, however, is non-refundable. Applicants should submit separate cheques, one for the application fee, one for the entrance fee (if any) and one for the appropriate amount of subscription fee, together with the completed application form. The fees and subscriptions schedules recorded in this section (with effect from 1 April 2014 and subject to change from time to time as determined by the General Council) illustrate the fees and subscriptions payable under the following circumstances: a. Election of membership (new applications, see Section 7.2) b. Annual membership renewal subscriptions (see Section 7.3) c. Transfer (upgrade) of membership (see Section 7.4) d. Re-instatement of membership (see Section 7.5)

77..22 EElleeccttiioonn ooff MMeemmbbeerrsshhiipp

An Applicant newly applying for election of membership will have to pay for the application fee, entrance fee (for Member Class of Membership application only) and submit the pro-rata amount of membership subscription fee, according to the date of admission and the class of membership applied for (candidates admitted during the first half of the membership year will have to pay for the full 12 months subscription fee and those admitted in the second half of the membership year will have to pay for half of the subscription fee). Notes:

1. Membership year runs annually from 1 April of current year to 31 March of the following year.

2. The process of admission will normally take 3 to 6 months (from the date of receipt

of full application including all necessary documents and payments) to complete depending on the availability of the services of Professional Assessors and the Board of Membership members who are all serving on honorary basis.

77..66 EExxeemmppttiioonnss i. Honorary Fellows shall pay no application fee or annual subscriptions. ii. Any Member having been a Corporate Member of the Institute for at least five

years who has reached the age of 65 years shall be exempted from the payment of further annual subscriptions on application to the General Council.

iii. The General Council may exempt a Member, from year to year, from the payment

of the annual subscription, who from ill health or other sufficient causes is unable to carry on full-time professional practice. This includes also the membership dues in arrears.

iv. The General Council may exempt the estate of any deceased member from the

payment of arrears of membership dues.

77..77 AArrrreeaarrss i. A member, who is in arrears with the membership dues for more than six months

after the due date, shall not be entitled to any of the membership rights, unless exemption from the payment of the dues has been granted by the General Council.

ii. A member, who is in arrears with the membership dues for more than six months

after the due date, shall be notified by the Honorary Secretary in writing. If the member, after three months from the notification, failed neither to settle the membership dues nor to provide satisfactory written explanation, a final 14 days notice for the compliance of payment shall be served. The General Council shall expunge the name of the member from the Register upon further failure of the member to settle the membership dues.

77..88 AAppppeeaall FFeeee

An appeal fee of HK$600.00 must accompany the application or written notice for appeal against the result of the Professional Assessment (see 3.4).
