Full Terms and Conditions

1. PARTICIPATING COUNTRIESThe Big Match 2014 FIFA World Cup™ game promotion (the “Promotion”) will be conducted in McDonald’s GCC COOP (the “Promoter” or “McDonalds”) restaurants in the following participating countries across the Gulf Cooperation Council (“GCC”); the Kingdom of Saudi Arabia, the State of Kuwait, the Kingdom of Bahrain, the United Arab Emirates, the Sultanate of Oman and the State of Qatar. Any reference within these Terms & Conditions to ‘across the GCC’ or ‘participating countries’ refers only to these six (6) countries.

Although the Promotion is conducted in all six (6) GCC countries, these Terms and Condition only relate to the following countries: the Kingdom of Saudi Arabia, the State of Kuwait and the Kingdom of Bahrain, (the “Territory”). A separate set of Terms and Conditions relate to all other GCC countries. Game Cards / Game Pieces within the Territory will be governed only by these particular Terms and Conditions regardless of any other factor, including where the Winner claims his or prize, or the Winner’s country of residence. If you are a resident of another GCC country, please see the applicable Terms and Conditions at www.mcdonaldsarabia.com [the “website”]. McDonald’s is not responsible for any lost opportunity to redeem a prize should a Winner act in accordance with the incorrect version of Terms and Conditions or fail to notice a county-specific distinction below.

2. PARTICIPANTSYou must be a resident of the Kingdom of Saudi Arabia, the State of Kuwait or the Kingdom of Bahrain with a valid government issued identity card / residence visa or a GCC country issued passport to participate in The Big Match 2014 FIFA World Cup™ Game Promotion. Any inability to furnish a copy of the relevant document may disqualify an otherwise valid Winner from redeeming his or her prize.

The following are not eligible to participate: (i) any persons who, on or after 1st January 2014, were or are directors, officers or employees of McDonald’s GCC COOP Partners Inc. or any company supplying prizes (“Prize Partners”) or any company responsible for redemption of prizes for the Promotion and their respective parent companies, franchisees, subsidiaries, affiliated companies or service agencies, and those companies retained in any way by McDonald’s for the administration of the Promotion, (ii) any company that buys and/or delivers McDonald’s products on behalf of McDonald’s customers, (iii) any other persons involved in the development, production, or distribution of materials for this Promotion, (iv) persons who are immediate family members (defined as spouse or biological or adoptive or step – mother, father, sister, brother, daughter, son or dependant) of, or reside in the same household as, any person in any of the preceding categories, or otherwise restricted as required by law, (v) any person acting on behalf of a syndicate or collection of persons acting in concert, and (vi) any person entering via an agent or using the services of an organisation which is an entity carrying on the business of entering (or advising on entering) prize promotions.

Neither the Promoter nor any redeeming outlet of a prize shall be under any obligation to enquire whether the person submitting any game piece is the person entitled to make the claim, irrespective as to whether or not that person first obtained that game piece (but without affecting the Promoter’s rights in relation to anyone in breach of these Terms and Conditions).

2.1 PARTICIPATION LIMITATIONSTo participate in the Promotion, you must be an adult of majority age, and be legally able to

give consent (in each case based on applicable laws of your jurisdiction), on or before the date you attempt to redeem a prize. If you are under the age of majority, or are otherwise required to obtain permission of your legal guardian in your jurisdiction, your parent or legal guardian must give their consent for you to participate. In certain cases, this consent must be obtained in writing before a prize may be claimed.

3. PROMOTIONAL PERIOD Game Cards will be available while stocks last from 00:01 (local time) on Saturday, 11 January through 23:59 (local time) on Friday, 21 February 2014 (“Promotional Period”) at participating McDonalds restaurants in the Territory. These dates are subject to the availability of the promotional game cards while stocks last and may therefore be reduced or extended by the Promoter, at its discretion, in order to facilitate the distribution of all promotional game cards, if required. The deadline for prize claims (as set out within these Terms and Conditions) may consequently be unilaterally amended by the Promoter accordingly. Participating stores which run out of Game Cards before the end of the Promotional Period will take reasonable efforts to communicate this fact to consumers.

4. HOW TO ENTER4.1 How To Obtain The Big Match 2014 FIFA World Cup™ Game Cards (“Game Cards”)

While stocks last at each participating McDonald’s restaurants, you will automatically obtain a promotional Game Card with any Large Extra Value Meal purchased* from the specific products listed below, including in-store, take-out and Drive-Thru service (“Qualifying Purchases”). You will receive one Game Card in return for your corresponding purchase as specified below. Multiple Qualifying Purchases will receive the corresponding number of Game Cards.

Please note the list of Extra Value Meals below may vary from country to country, and some products may be seasonal. Please check local menus or inquire with a McDonald’s team member.

It is the customers’ responsibility to ensure they receive their designated number of Game Card(s) at the time of their original purchase (as printed on the receipt). Game Card(s) cannot be re-issued after the original transaction has been completed.

Refunds of any transactions in which Game Card(s) were issued can only be accepted in the event the customer returns their original till receipt and the exact quantity of original Game Card(s) issued.

The Promoter reserves the right to offer additional Game Card(s) at any time during the Promotion. Check for details of any changes on the Website.

4.2 How to Play and Win:

Upon receipt of your Game Card, simply bend the card to break the centre perforation and open up the Game Card ‘doors’ to reveal;

4.2.1 100% INSTANT WINEvery Game Card is a winner and includes an Instant Win prize, either McDonald’s food or Partner Prizes. Simply open your Game Card to reveal your instant win prize and claim as printed on the game piece and described in section 5 “Prizes To Be Won”. See section 6 “How to Claim” for full details and how to claim prizes.“Everyone is a winner” refers to the fact that every game card contains an instant win game piece for a McDonalds food prize or partner prize.

4.2.2 DAILY PRIZE DRAW You will also have the chance to win Tickets & Travel Package for two (2) people to the 2014 FIFA World Cup™. There will be forty-two (42) Daily Prize Draws across the GCC.


Participants may begin submitting their entry codes on or after 00:01 on 11 January 2014. Daily Prize Draws will take place every working day (i.e., excluding Fridays, Saturdays and Public Holidays) commencing on Sunday, 12 January with the last drawing(s) taking place on Sunday 23 February 2014.

The Promoter may make two or more drawings on randomly selected working days to compensate for weekends, public holidays, and any other event preventing the draw from taking place on a particular day.

specific game pieces) for The Big Match game promotion • Enter your country of residence and personal details as instructed during registration • Complete your registration NO LATER THAN 23:59 (local time) on 21 FEBRUARY

2014, otherwise the Daily Draw Code will expire and the Daily Prize Draws will end the following day.

Each Daily Draw Code can be registered once only and you will receive a confirmation message upon successful registration.

4.3 Distribution of Promotional Game Cards / Game Pieces 4.3.1 Distribution Procedure for Promotional game cards for all prizes:

All Promotional Game Cards feature 2 game pieces and have been distributed by the Promoter on a random basis amongst participating McDonald’s restaurants in the participating GCC countries.

4.3.2 Total Number of Winning Game pieces In respect of the game pieces produced for the Promotion the Promoter verifies: (i) that every Game Card contains at least one winning game piece which entitles Participants to an Instant Win prize and (ii) for each type of Instant Win prize, that the number of game pieces for that Instant Win prize type shall be the same as the total number of Instant Win prizes advertised for that prize type.

4.3.3 Only ORIGINAL and AUTHENTIC McDonald’s The Big Match 2014 FIFA World Cup™ Game Cards / Game Pieces, as determined and confirmed by the Promoter and / or prize partner at its sole discretion will be accepted as valid game pieces that entitle the holder to win the relevant prize. Game Cards / game pieces cannot be resold or transferred and the authenticity of any Game Cards/ game pieces acquired in this manner, or any manner other than directly from a participating McDonald’s restaurant are not guaranteed by the Promoter.

4.3.4 Any Game Cards / game pieces produced for any other McDonald’s promotions in other countries and/or from past years are not valid for the purposes of this McDonald’s The Big Match promotion.

4.3.5 ALL game piece(s) will be retained on redemption (unless redeemed online, when the Prize Partner and/or Promoter reserves the right to req(unless redeemed online, when the Prize Partner and/or Promoter reserves the right to require prior sight of any game piece(s) prior to redemption) and only original and authentic game pieces will be accepted. VOID game pieces will not be accepted (expired, torn, defaced, damaged, counterfeit, photocopy, incomplete or illegible).

4.3.6 Please take care not to damage your game piece(s) - they will become void if you do. A void game piece is any game piece deemed by the Promoter, or by any other prize-supplier involved with prize-redemption, to have expired or to be torn, defaced, damaged, counterfeit, a photocopy, incomplete or illegible or if it has been offered for sale or been transferred or a claim made in respect of it by an ineligible person. Additionally, any Game Card(s) / game piece(s) and/or game leaflet which (in the Promoter’s discretion) is misprinted shall be void.

6. HOW TO CLAIM - PRIZE DETAILS AND CONDITIONS

CONDITIONS APPLICABLE TO ALL PRIZE CLAIMS - Instant Win and Daily Draw

If you are under the age of majority in your jurisdiction your parent or legal guardian must claim any prize on your behalf.

Only ORIGINAL and AUTHENTIC McDonald’s The Big Match 2014 game pieces will be accepted. Prizes can only be claimed in the country in which the Game Card was purchased and/or received. The Promoter reserves the right not to award a prize which is a prize claim originating from any countries outside the country of issue and for which the Game Card was intended for distribution for this Promotion. For example, if you receive a Game Card from a store in the Kingdom of Bahrain, that card must be redeemed in a store in the Kingdom of Bahrain.

Prizes to be claimed in-store will only be awarded following verification of the respective game pieces over the counter by McDonald’s staff.

PlayStation®4 & PlayStation®Vita prizes as well as Tickets & Travel Package for 2 (people) to the 2014 FIFA World Cup™ will only be awarded following verification of the respective game pieces by the McDonald’s security team at Head Office. Although there may be some communication via telephone, email, SMS or MMS, OFFICIAL confirmation of a winning claim will only ever be issued as a written letter to the winner.

It is your responsibility to ensure you have claimed your prize(s) as per the dates stated within these Terms & Conditions and as printed on winning game pieces, after which the related game piece will become void and unconditionally expire. Extension of game piece validity will not be entertained.

The last day to enter the Daily Prize Draw will be 21 February 2014 across all GCC countries.

Prizes are not for use in conjunction with any other promotion or offer (including any price reductions are valid against the purchase requirement at the time of redemption).

Prizes may not be exchanged for cash or any other alternative (unless stated) and game piece(s) and prizes are non-negotiable, non-transferable, non-divisible and are not permitted to be sold or resold or used for advertising, promoting or other commercial purposes (including competitions or trade promotions) or to enhance the demand for other goods and/or services (including loyalty/rewards programmes) without prior written consent from the Promoter and/or Prize Partners.

To the fullest extent permitted by law, all participants, prize winners and travellers, as the case may be, indemnify the Promoter and the Prize Partners, their advertising agencies, partners, advisers, nominated agents, suppliers, affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in the Promotion (including, as a result of any act or omission, whether as a result of negligence, unintentional misconduct or otherwise on the part of the Promoter and/or the Prize Partners and/or use of any or all Prizes).

6.1 PLAYSTATION® 4 AND PLAYSTATION® VITA PRIZES The prize consists of either:• 1 x 160GB PlayStation® 4 System

DO NOT GIVE your winning game piece(s) for a PlayStation®4 or PlayStation® Vita prize to a McDonald’s restaurant member of staff as they have no authority to verify any of these prize claims and these prizes CANNOT be claimed or redeemed at any McDonald’s restaurant.

Simply request to see the Restaurant Manager/Shift Manager who will give you a Prize Claim Declaration Form (Prize Claim Form as stated on game pieces) to complete. Complete the Prize Claim Declaration Form and submit it, with all items listed below to your local McDonald’s Head Office.i) your ORIGINAL game pieces for a PlayStation®4 or PlayStation®Vita prize (see below for

further information); andii) the completed & signed Prize Claim Declaration Form (available in all participating

stores); andiii) a photocopy of your government-issued ID / resident visa or GCC government issued

Passport information page ; and iv) a photocopy of your proof of address (e.g. a telephone bill in your name).

Please note that before the prize can be awarded as detailed in this section, the ORIGINAL Instant Win PlayStation® 4 or PlayStation® Vita game piece(s) must be submitted to the local McDonald’s Head Office for Verification by a security team to confirm the Game Piece is authentic and winning and the prize claim is valid.


Please telephone your local McDonald’s Head Office (as printed on the Prize Claim Declaration Form) to register your claim and agree a convenient time and date to submit your prize claim including all the documents listed above.

The Prize Claim Declaration Form includes provision for you as the winner to release the Promoter and others concerned with this Promotion from responsibility or liability for various claims in respect of the prizes.

It is your responsibility to ensure you have claimed your PlayStation® 4 or PlayStation® Vita prize NO LATER THAN 2 April 2014 after which the prize claim will expire and the related game piece(s) will become void.

Following verification by the McDonald’s security team, a winner’s letter will be issued to the along with the prize, which will be delivered to the winner’s chosen physical address within their country of residence.

The PlayStation®4 or PlayStation®Vita prizes will be supplied with a 1 year warranty valid within their country of residence.

The prizes are non-transferrable and cannot be exchanged for cash. Colour and base model-specifications are pre-determined and will not be changed to suit the winner’s preferences.

6.2 PLAYSTATION® PLUS 30 DAY TRIAL CODE PRIZEThe PlayStation® Plus 30 Day Trial Code Instant Win prize CANNOT BE claimed & redeemed at any McDonald’s Restaurants.

6.4 INSTANT WIN McDONALD’S FOOD PRIZES - Prize Details & Conditions and How to ClaimTake the Instant Win game piece for any McDonald’s food prize to any participating McDonald’s restaurant across the GCC as stated on the winning game piece and NO LATER THAN CLOSING TIME 2 April 2014, after which the prize claim and the related game piece will expire and become void.

You must present the ORIGINAL Instant Win game piece to a McDonald’s crew member to redeem the food prize as printed on the Instant Win game piece. The game piece will be retained by McDonald’s.

Only one a-la-carte food prize can be redeemed per person per visit (where a visit shall mean a consecutive 4 hour period).Instant Win game pieces for McDonald’s a-la-carte food prizes may only be claimed during normal serving hours (as printed on winning game pieces and as stated below or the serving time of the participating countries) of the appropriate food prize.

7. DAILY PRIZE DRAWEntry into the Daily Prize Draws will open from 00:01 (local time) on 11 January 2014 through 23:59 (local time) on 21 February 2014. The actual 42 Prize Draws will take place from 12 January through 23 February 2014 (excluding Fridays, Saturdays & Public Holidays) across the participating GCC countries. Daily Prize Draws which fall on a Friday, Saturday or a Public Holiday will be held the next available working day. Therefore, the Promoter may hold multiple Daily Draws on the same working day throughout the Daily Draw period.

Winning Daily Prize Draw codes will be announced and updated on the Website In the event a registered participant fails to claim the winning code and prize (see below for details), or is disqualified for not complying with any of the Terms & Conditions, the Promoter reserves the right to select an alternative winner (or otherwise dispose of the prize as required by law) in order to ensure all Daily Draw Prizes are won and to update previously announced winning codes on the website.

One Daily Prize Draw code will be drawn each day to win Tickets & Travel package for 2 (people) to the 2014 FIFA World Cup™ and a total of 42 prizes are available to be won across the participating GCC countries. 7.1 HOW TO ENTER THE DAILY PRIZE DRAWTo register for the Daily Prize Draw you must enter your Daily Draw Code (as printed on specific game pieces) and personal details via the website www.mcdonaldsarabia.com starting on or after 00:01 (local time) on 11 January 2014 and NO LATER THAN 23:59 (local time) on 21 FEBRUARY 2014, otherwise the Daily Draw Code will expire and the Daily Prize Draws will cease the following day.

Applicable only for residents of the Kingdom of Saudi Arabia. Before you submit your registration for the Daily Prize Draw, you must correctly answer a multiple-choice trivia question related to the 2014 FIFA World Cup™. A correct response will allow you to enter the Daily Prize Draw.

EACH individual Daily Draw Code entitles you to enter the Daily Prize Draw once. You may enter as many times as they like, so long as each registered entry is based on a single and unique Daily Draw Code, however you are entitled to win only ONE Daily Prize Draw.

7.2 VERIFICATION OF DAILY PRIZE DRAW CLAIMS Before a Daily Draw Prize is awarded, it must be submitted and verified as follows:

7.2.1 If you are under the of age of majority in your respective country and claiming a Daily Draw Prize, your parent or legal guardian must submit the prize claim on your behalf.

7.2.2 If you have entered the Daily Prize Draw and your Daily Draw Code is drawn as a valid and winning code, you will be contacted by your local McDonald’s Head Office in your respective country at the contact number you provided when you registered on the website for the Daily Prize Draw.

7.2.3 DO NOT GIVE your winning game piece(s) for a Daily Draw Prize to a McDonald’s restaurant member of staff as they have no authority to verify any of these prize claims. Simply request to see the Restaurant Manager / Shift Manager who will give you a Prize Claim Declaration Form to complete.

7.2.4 The Prize Claim Declaration Form includes provision for you as the winner (and the companion for the Tickets & Travel Package to the 2014 FIFA World Cup™ prize) to release the Promoter and others concerned with this Promotion from responsibility or liability for various claims in respect of the prizes. Please collect the Prize Claim Declaration Form from a Restaurant Manager / Shift Manager after being notified that your Daily Draw Code has been drawn as you will have seven (7) days to submit your prize claim to your local McDonald’s Head Office.

7.2.5 All Daily Draw Prize claims must be submitted to the local McDonald’s Head Office as per the process outlined below. Upon receipt of the prize claim, a security team, in the presence of an independent auditor and / or local official, will be responsible for verifying the claim to confirm that the submitted game pieces are original, authentic and winning.

Verification by a security team will take place as and when prize claims are received and during standard working hours of 09:00 – 17:30 Sunday to Thursday (but not on Fridays, Saturdays or and Public Holidays).

Within 24 hours of the Daily Prize Draw taking place (excluding Fridays, Saturdays and Public Holidays) and the winning Daily Draw Code being drawn, you will receive a call from your local McDonald’s Head Office, who will ask you to provide information printed on your game pieces which features the winning Daily Prize Draw code as well as some personal details such as your date of birth, full name, address, email and identity card / residence visa / passport number.

When McDonald’s contacts you, they will agree a convenient time and date for you to submit your prize claim to your local McDonald’s Head Office, including all the following documents;

i) your ORIGINAL game piece featuring the winning Daily Draw Code ii) the completed & signed Prize Claim Declaration Form (available in all participating stores)iii) a photocopy of your identity card / residency visa or passport information page, and iv) a photocopy of your proof of address (e.g. a telephone bill in your name).

If you are under the of age of majority in your respective country, you will be asked to have your parent or legal guardian, speak to us so that we can confirm your parent’s/legal guardian’s personal details and address.

It is your responsibility to make yourself available and contactable via the telephone/mobile number and/or email address provided in your registration details. The Promoter will make multiple reasonable efforts to contact you on any and / or all these possible methods. However,intheeventthatthelocalMcDonald’sHeadOfficeisunabletoreachyouand cannot obtain the above mentioned items to process your prize claim within seven (7) days from the date your Daily Draw Code was drawn), your prize claim will become null void and your prize and any right therein will lapse and the Promoter will have the right to select an alternative winner (or otherwise dispose of the prize as required by law).


For your own future reference, we recommend that before you submit your prize claim, you make a photocopy of the game piece featuring the winning Daily Draw Code and the completed & signed Prize Claim Declaration Form you are submitting.

Do not submit any other game pieces other than the specific game piece which features the winning Daily Draw Code and as indicated on the Prize Claim Declaration Form you have signed for submission.

In the event you can no longer keep the agreed date and time to submit your prize claim to your local head office, it is the responsibility of you or your parent/legal guardian (if applicable) to call your local McDonald’s Head Office back if you are unable to keep the scheduled appointment.

The Promoter accepts no liability or responsibility for any game pieces and supporting documents as listed above that become damaged, delayed, mis-delivered or lost, and as a result of which your prize claim can no longer be processed and so your right to claim the prize becomes null and void.

7.2.6 The Promoter will endeavour to contact you via telephone and also in a written letter within 7 days (of RECEIPT of your Daily Prize Draw claim) to confirm if your Daily Draw prize claim is valid and you are a declared winner or, if your Prize Claim Declaration Form details and/or your game pieces and/or your Daily Draw Code is incomplete or invalid, you will also be notified in writing to explain why.

7.2.7 Following verification and confirmation that you are a winner, a winners’ letter will be sent to you explaining all details of your prize and what you must do next to organise the Tickets & Daily Prize Draw Package for two (2) people to the 2014 FIFA World Cup™ and any relevant deadlines.

7.2.8 Winners and their travelling companion are responsible for their own personal safety and protection once they have claimed their prize. 7.3 SPECIFIC CONDITIONS OF THE TICKETS & TRAVEL PACKAGE FOR TWO (2) PEOPLE TO THE 2014 FIFA WORLD CUP™Following the Daily Prize Draw and verification by the McDonald’s security team at local Head office a winner’s letter will be issued confirming who the winner should contact to organise the Tickets & Travel Package prize.

The prize comprises of 4 days and 3 nights package to Rio de Janeiro, Brazil for 2 (two) people. The total value of each Ticket & Travel Package is approximately US$15,000* (fifteen thousand US dollars).*The prize value is as quoted by the Prize Sponsor as of November 2013 and may be subject to price fluctuations at a later date.

Each Ticket & Travel Package comprises of:• Return economy class air tickets from the Daily Prize Draw winners’ country of residence

to Rio de Janeiro, for the winner and 1 (one) individual of the winner’s choice (‘Travellers’) travelling on the same itinerary for 4 days at the end of June 2014 (“Travel Dates”). The choice of airline carrier and Travel dates will be determined by the Promoter; and

• 3 nights’ accommodation at the 4 star Marina Palace Hotel, overlooking Leblon Beach on a bed and breakfast basis, twin-sharing hotel accommodation for 2 (two) people; and

• 2 (two) Category 1 tickets to attend one FIFA World Cup™ match in June 2014 in Rio de Janeiro; and

• Arrival and departure transfers to / from airport and all ground transportation as determined by itinerary in Rio de Janeiro.

Travellers may be both adults (above the age of majority in your country of residence) OR a combination of 1 (one) adult and 1 (one) child, provided that the winner accompanying the child is over the age of majority in their country of residence.

All Travellers must have a valid passport at the time when the Tickets & Travel Package is booked and that remains valid for at least 6 (six) months from the return date and are responsible for organising their own visas and requisite documentation to Brazil and must be able to travel during the Travel Dates in order to qualify to be declared a winner or participate as a Traveller.

All Travellers will be required to submit their valid passports, visa and any requisite documentation to the Promoter NO LATER THAN 1 APRIL 2014 in order for travel arrangements to be made.

The Tickets & Travel Package Prize is exclusive to the winner and is non-negotiable and non-exchangeable.

Should the winner be unable to travel or use the Tickets & Travel Package Prize on the Travel Dates determined by Promoters, the original winner will be able to nominate someone else to receive the prize. Both the original winner and their nominated recipient will be required to sign a form declaring this transfer has been authorised. However once the Tickets & Travel Package Prize has been issued and booked it is no longer transferable and no further changes can be accommodated.

For the avoidance of doubt, should a participant be refused a visa to travel to Brazil, such participant will be deemed not to have qualified for the Tickets & Travel Package Prize.


The final itinerary will be made available to the Daily Prize Draw winner after their Tickets & Travel Package has been booked.

Travel and hotel reservations are subject to availability and any amendments of travel dates will be at the Promoters discretion.

The Promoter shall not be responsible for any changes, substitution, withdrawal, cancellation or postponement of any part of the itinerary beyond its reasonable control. The Promoter is not obliged to award any other prizes in lieu if any such event is cancelled, postponed, substituted, withdrawn, changed or unavailable. The Promoter reserves the right to change the Tickets & Travel Package Prize details without prior notification to the extent permitted by law.

All ancillary costs, including but not limited to passport, visas, additional transport, meals, personal and incidental expenses, insurance (unless stated), government taxes, airport taxes, management fees or other fees applicable are the responsibility of the winner and/or Travellers. Winner and his/her companion agree to bear all travel risks.

If a travel advisory is issued against travel to Brazil, or the Brazilian government issues quarantine restrictions, or in the event of the onset of SARS or any other kind of epidemic or disease in one of the participating GCC markets or Brazil or in the event of outbreak of war, hostilities, insurgencies, terrorism, civil commotions, riots, strikes, lockouts or any other circumstances beyond the reasonable control of the Promoter, the Promoter shall have no liability to provide the Tickets & Travel Package Prize and may substitute with any other prize of comparable commercial value. Awarding of an alternative prize is at the Promoters absolute discretion.

All Travellers will be accompanied by an individual selected by the Promoter for the full duration of the Tickets & Travel Package Prize. All Travellers must undertake to behave in an appropriate and reasonable manner and shall not act in any manner to bring the Promoter, host, their affiliates and/or associated companies’ name into disrepute. Should the Promoter determine that the Traveller’s conduct is unacceptable, the Promoter shall at its sole discretion and without any form of compensation to the winner and / or travellers return the winner and / or travellers to their country of residence on the next available flight without any prejudice to any other rights or remedies that the Promoter may have in law or otherwise.

THE PROMOTER WILL REQUIRE THE WINNERS TO COMPLETE AND SUBMIT AN INFORMATION DISCLOSURE AGREEMENT AND INDEMNIFICATION TO ENABLE THE PROMOTER TO ENSURE COMPLIANCE WITH THESE RULES AND RELEVANT LAWS. SHOULD ANY WINNER REFUSE OR BE UNABLE TO COMPLY WITH THIS RULE FOR ANY REASON, SUCH WINNER WILL BE DEEMED TO HAVE REJECTED THE TICKETS & TRAVEL PACKAGE PRIZE AND IT SHALL REVERT BACK TO THE PROMOTER.

To the extent permitted by law and if agreed to by each winner, the Promoter may require the winners be identified, photographed and published in printed media, or to appear on radio and television, when accepting their Ticket & Travel Package Prize and/or after having received their Ticket & Travel Package Prize. The winners will be given the opportunity to decline the publication of their images or participating marketing the Promoters and / or material of the Prize Partners in so far as it relates to this game promotion.

Winners may contact the Promoters as indicated in their winners’ letter for any queries regarding their Tickets & Travel Package Prize.

8. ADDITIONAL CONDITIONS APPLICABLE TO ALL PRIZESAny advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the normal retail-price for all prizes which are available to be won; it does not thereby imply that any prize will be awarded in the absence of a corresponding valid claim.

Reproduction of any prize imagery does not thereby imply any endorsement or association by the producer of that prize-type nor by the owner of any brand associated with that prize-type.

Ownership of prizes (other than food prizes) pass from the relevant Prize Partner direct to winners and not via the Promoter.

9. RESPONSIBILITYTo the fullest extent permitted by applicable law (but not otherwise) the Promoter, its agents for administering the game and the Prize Partners assume no responsibility and are not liable for:- (i) the accuracy or otherwise of the prize description or illustration, (ii) the non-availability, loss, interception or interference with, late receipt or damage of or to any prize claim, Promotional game card, game pieces, voucher(s), prize or notification or other communication, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a prize, or (iv) any taxes, fees, charges or other costs which winners may be required to pay at any time in connection with a prize, (save to the extent that the Promoter has expressly and specifically accepted responsibility in these Terms and Conditions for the same), (v) all costs, injuries, losses or damages of any kind, due in whole or in part, directly or indirectly, to a person’s participation in the Promotion, or arising out of a person’s participation in any Promotion related activity, or their receipt, use or misuse of any prize that may be awarded to them, or (vi) any missing, damaged, lost or delayed receipt of game cards or game pieces through the purchase of any Qualifying Purchase from any company that provides purchase and/or delivery service on behalf of customers.All Prizes remain the property of the Promoter or the Prize Partner, pending redemption by winners and or delivery of the prize to the winners and the Promoter reserves the right to dispose of any unclaimed prizes as they deem appropriate or as required by law.

The Promoter is not responsible for the quality and warranty of any prizes provided by the Prize Partners or other suppliers nor acts as their agent in relation to the delivery to winners of prizes other than those supplied directly by the Promoter.

For any prize which must be claimed by the winner’s parent / legal guardian, the Promoter will not be obliged to award it to anyone other than that parent/legal guardian, if the winner is less than the age of majority in their respective country. The Promoter may also withhold that award should the Promoter determine in its sole discretion that a dispute may have arisen as between the winner and the parent / legal guardian in relation to the prize. The Promoter is not liable or responsible to verify the identity of the parent or legal guardian.

The submission of prize claims is the sole responsibility of the prize claimant. Any tax liability or life, health, travel, accident or other insurance (unless stated) associated with any prize is payable by the prize winner and is their sole responsibility.

10. THE PROMOTER’S RIGHTSTo the extent permitted by law, the Promoter reserves the right and at any time at its absolute discretion and without giving any reason or notice, to vary, modify, or amend the terms of these Terms and Conditions in such manner as the Promoter thinks fit. Any changes will be communicated on the Website www.mcdonaldsarabia.com and all participants in the Promotion shall be deemed to have accepted such amended or modified terms by their ongoing participation in the Promotion.

In the event of any discrepancy between any printed Terms and Conditions, rules, short guides, declarations, or between the English and Arabic versions, the English Terms and Conditions as communicated on the Website will prevail.

The Promoter may (i) extend any time limit or waive any of the Terms and Conditions where a person might otherwise have been disqualified (without obliging the Promoter to relax the Terms


and Conditions on any further occasion for that entrant or at all for any other person), (ii) terminate or suspend the Promotion at any time due to supervening circumstances beyond the Promoter’s control, or (ii) substitute a product deemed to be an appropriate replacement and of equal or greater value in the place of any of the prizes (or any part of a prize). The Promoter’s decision in the exercise or interpretation of any of its rights or discretions in connection with these Terms and Conditions shall be final and binding.

11. FORCE MAJEURE/PRINTING AND PRODUCTION ERRORSIn the event the Promoter is prevented from continuing with the Promotion as contemplated herein by any event beyond its control, including but not limited to accidental damage, fire, flood, natural or manmade or public health epidemic, earthquake, explosion, labour dispute or strike, act of public enemy, or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any provincial or local government law, or regulation, order of any court or jurisdiction, or other cause not reasonably within Promoter’s control (each a “Force Majeure” event or occurrence), then subject to any government approval which may be required, the Promoter shall have the right to modify, suspend, extend or terminate the Promotion.

The Promoter also reserves the right, to the extent permitted by law, without prior notice and at any time, to terminate the Promotion, in whole or in part, or modify, suspend, or extend the Promotion in any way, or deem the game cards / game pieces void and invalid if it determines, in its sole discretion, that the game cards / game pieces in question reflect printing or other errors which have destroyed or severely undermined the proper play, integrity and / or feasibility of the Promotion.

If, due to printing or production errors for any reason, more potential winners come forward seeking to claim prizes in excess of the number of each type of prize set forth in these Terms and Conditions, the winners, or remaining winners, as the case may be, of the advertised number of prizes available in the Promotion may be selected in a random draw from among all persons making purportedly valid claims for such prizes in the sole discretion of the Promoter. Inclusion in such a random draw (to the extent permissible under local law) shall be each prize claimant’s sole and exclusive remedy in such circumstances.

12. PRIVACY POLICYIn administering this Promotion, the Promoter may collect personal information from you and, unless it has first obtained your consent, the Promoter (i) will not collect more of your personal information than it needs for the purpose of administering and analysing this Promotion and carrying out publicity as stated in these Terms and Conditions, (ii) will only use your personal information for that purpose which may include transferring your personal information to its associates, and (iii) will only transfer your personal information outside the participating GCC countries for the purpose of verifying your prize claim, all in accordance with applicable local laws. Selected partners of the Promoter (depending upon the nature of the prize and whether in addition to or in place of your providing personal data to the Promoter) may require you to provide to those partners personal data in connection with claiming/redeeming prizes and you should satisfy yourself with the privacy policies of such partners, as the Promoter does not accept any responsibility for them.

13. PUBLICITY RELEASESubject to obtaining your prior approval and subject to compliance with all relevant laws in relation to the protection of personal information, you agree that McDonald’s, its parent company, subsidiaries, affiliates, franchisees and agencies, and any of their successors, assigns, promotional partner licensees and the Prize Partners may use your name, voice, and likeness and any statements made by or attributed to you relating to McDonald’s or the Promotion in any and all media, and you release McDonald’s and the Prize Partners from any liability arising from such use, including, without limitation, claims for invasion of privacy, infringement of your right of publicity, and defamation. The Promoter reserves the rights to publish winner’s names and town of residential.

GENERALAll instructions, rules and conditions on any advertising or promotional materials (including notifications, Game Cards and pieces, acceptance forms, redemption forms, declaration forms, prize claim forms and prize acknowledgement forms) relating to this Promotion form part of the Terms & Conditions although, in the event of conflict, these provisions shall prevail over all such other instructions, rules and conditions. Expressions which have been defined above shall have the same meanings when used in such other instructions, rules and conditions wherever the context admits.No claim under or participation in this Promotion or any game piece(s) is valid in combination with any other offer or promotion, save to the extent expressly stated herein.In administering this Promotion, the Promoter and/or the Prize Partners may carry out an employment background check (in addition to the information given by winners on their Prize Claim Declaration Forms) as they consider necessary or desirable for the purposes of verifying any claim and a claimant’s compliance with the Terms and Conditions and any prize may be withheld unless and until the Promoter and the Prize Partner is satisfied with the verification. Should the Promoter determine based on the evidence in its possession at any given time that an entrant is in breach of the Terms and Conditions, then the Promoter may adjudge (in its sole discretion) that such entrant is ineligible to take part in this Promotion and every other promotion or offer of the Promoter and every entry, claim and request by that entrant then in process shall be disregarded and have no force or effect.

By participating in the Promotion, including (without limitation) the opening and peeling of any game card(s) / piece(s), participants and / or their parents/legal guardians agree to abide by and be bound by these Terms and Conditions and the decisions made by McDonald’s and its Prize Partners for the Promotion, namely adidas Emerging Markets FZE (“adidas”), Sony Middle East and Africa FZE (“Sony”) and The Coca-Cola Company (collectively, the “Prize Partners”) and of the terms of the following licence:

You understand and accept that (i) the Promoter retains ownership of all Game Card(s)/piece(s) and ownership or control of the trade marks and other intellectual property in and over the Game card(s)/piece(s) and all Promotion-advertising at all times (“the Property”), (ii) the Promoter grants you a licence to use the Property solely for the purposes of the proper participation in the Promotion in accordance with the Terms and Conditions, (iii) none of the following shall be considered proper participation in the Promotion, namely; any sale, offer to sell, giving away or other dealing with any Game card(s)/piece(s), any use for any purpose whatsoever of any Promotion advertising or any feature taken from it or anything which is a breach by you of the Terms and Conditions, (iv) you may not assign this licence or any benefit under it, (v) any use of the Property for a purpose not stated to be permitted or any failure otherwise to observe any provision of this licence shall result in automatic termination of the licence without requirement as to notice and amount to an irremediable infringement of the Promoter’s intellectual property entitling the Promoter to all rights and remedies available by law, and (vi) following termination or expiry of this licence you will return all Game Card(s)/piece(s) to the Promoter without attempting to redeem the same and shall cease to use the Property for any purpose whatsoever.

By participating in the Promotion and/or redeeming any prizes, participants and/or their parents/legal guardians release and agree to hold, subject to the maximum extent permitted under law, McDonald’s, McDonald’s agents for administering the Promotion and the Prize Partners harmless from and against any and all costs, injuries, losses or damages of any kind, due in whole or in part, directly or indirectly, to their participation in the Promotion, or arising out of their participation in any Promotion-related activity, or their receipt, use or misuse of any prize that may be awarded to them.

You acknowledge that these Terms & Conditions form a contract between you and McDonald’s in relation to participation in the Promotion. Any dispute arising out of or in connection with the Terms & Conditions, including any question regarding its existence, validity or termination, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre and you hereby consent to the jurisdiction of that Court. This contract shall be governed by and construed


in accordance with the laws of Dubai and the United Arab Emirates. The contract between you and the Promoter shall be deemed to have been formed and performed in the United Arab Emirates.

The rights conferred by these Terms and Conditions (insofar as they are relevant) are for the benefit of the Prize Partners and McDonald’s agents for administering the Promotion. Each of the aforesaid entities shall have the right to assert and enforce those provisions relevant to itself directly against the participants of the Promotion and/or their parents/legal guardians on its own behalf.

All age limits shall be deemed to be actual age as at the time when a claim is made for the relevant prize offered in the Promotion, unless expressly stated otherwise in these Terms and Conditions.

Any game card(s) / piece(s) or prize claim(s) will be void if it is deemed by the Promoter, Prize Partner or agents for administering the game involved with prize-redemption, to have been offered for sale or a claim made in respect of it by an ineligible person. Any game card(s) / piece(s) and/or game leaflet which (in the Promoter’s discretion) is misprinted shall be void and an entrant’s sole remedy will be (subject to availability) a replacement game card / piece or game leaflet (as appropriate).

Nothing in these Terms and Conditions shall affect your statutory rights. The Promoter may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in these Terms and Conditions.

The obligations of the organisers of this Promotional competition and the Prize Partners are deemed fulfilled in full at the time that the game piece is redeemed for a prize or at such point as the Promoter terminates the Promotion in accordance with these rules.
