Capitol Report…

This session was one for the history books. Not only did we experience a 14 month leg-islative session, a two week

teacher walkout, and the fi rst decent budget in years… but we also reached our ROADS fund cap ($575 Million)! This year we should see $104 million additional dollars sent to ODOT to be put into the 8-Year Construction Work Plan. Going into session we were nervous that we would have to take a loss due to the pressure to give teachers a pay raise. Our friends in the Okla-homa House of Representatives (Kevin Wallace) helped us to avoid having to use road dollars to fund other necessary things.

By the time you read this, I fully expect the governor to have signed a bill into law (Thank you, Representative Avery Frix!) that will allow ODOT to immediately publish bid results on letting day. We hope this will be a welcome change- a big diff erence from waiting to have us populate fi elds on the web site, details to follow on this one.

As we watched the session come to an end, we immediately begin to refocus on the elections around the corner. We con-tinue to raise money for our PAC. We are doing so in order to help those legislators who helped us secure funding this year. We have serious issues in the senate, and we have had to have members who are strong enough to help make sure road funds continue to go towards our roads and bridges. We are review-ing all incumbent supporters and will also roll the dice on possi-ble incoming new freshmen members as well. If you have not given to the PAC, we hope that you will consider it.

Thanks to all of you who came out to be a part of the Governor’s Candidate Forum. I have been to 6 of them and I can honestly say, we had the best attended forum in the entire state. Your participation was a loud message that we are engaged, we do care, and that we want to hold our state leaders accountable. The evening was a great success because of the many of you who attended!

Thank you all for your help during this session. We did well. Let’s take a day to celebrate, then begin planning for next year.

The AOGC Scholarship Committee is pleased to announce our 2018-2019 Scholarship recipients. The committee narrowed the 31 applicants down to 10 wonderful candidates for interviews. After a two-day interview process, the committee made the tough decision to narrow to the following three recipients. We feel these candidates will make fantastic members of the road and bridge building community in Oklahoma. Please take a minute to say hello as you see them at AOGC events this year.

Tanner Fialkowski is a Construction Management Technology major at OSU with a Dual Option of Heavy Highway/Commercial. Tanner interned with Manhattan Road & Bridge last summer and will begin an internship with Allen Contracting this summer. Tanner plans to graduate in May 2020, and then work in heavy highway industry in Oklahoma.

Iaan Obed Hernandez Moreno plans graduate from OSU in May 2019 with a degree in Construction Management – Heavy Civil. As a native of Mexico, Iaan is bilingual, and hopes to work in Oklahoma upon graduation to stay close to his family who settled in the Yukon area. Iaan interned with Crossland Heavy Contractors and will be interning with AOGC member Sherwood Construction this summer.

As a 2017 AOGC Scholarship recipient, Morgan Miller is familiar with our association. Morgan is a Civil Engineering major at OSU and hopes to graduate in December 2020. Currently, Morgan works full time as an inspector at ODOT, and attends school full time. She hopes to continue working at ODOT or the private sector in road and bridge construction in Oklahoma when she graduates.

A special thank you to the scholarship committee for all their hard work this yearoverhauling the scholarship program: Alma Pickle (Advanced Workzone Services),

Frequently Asked Questions (FAQs)

Q: Does Bidexpress reject my bid if there is a 5 percent DBE goal and I could only enter 3 percent?A: No, Bidexpress will still accept your bid. The next step would be for you to submit your “Good Faith Eff orts” (DBE Form 5) along with justifi cation to the Civil Rights Division for review. This form should be submitted with the “Confi rmation of Intent to Subcontract Federal-Aid Project” (DBE Form 6) by the Wednesday (close of business) following bid opening. The DBE Form 5 is available under “ODOT Forms” on ODOT’s website and information about the Good Faith Eff ort process is located on the Civil Rights Division’s webpage.

Q: Do I need to enter all DBE subcontractors into Bidexpress, regardless if I use them toward the DBE commitment?A: The fi elds, “Will Use Quote” and “Response” on Bidexpress have been modifi ed and are no longer available. Primes should only list the DBE subcontractors they will use if awarded the contract.

A: The Federal Regulations requires that federal projects are reviewed on a case-by-case basis to determine if DBE opportunities are available. Goals are established independently of the contractor’s past performance. Furthermore, since the DBE goals are determined prior to knowing who the prime contractor is on each project, it would be impossible to take a contractor’s past performance into account when determining the goal for the project prior to bidding.

Q: I am a prime contractor and have a DBE subcontractor that has been nonresponsive on coming out to the project to fulfi ll their subcontract agreement. Can I terminate the DBE?A: It depends. As per the federal regulations, the prime contractor must notify the DBE in writing, with a copy of their intent to request to terminate and/or substitute, and the reason for the request. The prime contractor must give the DBE fi ve days to respond to the prime contractor’s notice prior to submitting the DBE form 4 request.

Q: Does the 15 day prompt payment apply only to DBE subcontractors?A: No. The 15 day prompt payment applies to all subcontractors. Primes are required to pay all their subcontrac-tors within 15 days after receiving payment from ODOT.

Q: If a DBE Prime is awarded a federal contract with a DBE goal, will the agency be able to capture 100 percent as credit?A: No, not necessarily. The agency can initially assume that we can credit 30 percent of the total cost of the con-tract if it’s awarded to a DBE Prime, as per federal regulations. The DBE Prime is still required to list all subcontractors (DBE and non DBE fi rms) onto the required DBE Form 2’s and DBE Form 3’s in order to calculate the actual percentage of DBE credit.
