Wage Negotiations

We exchanged proposals on April 22. Historically you don’t get real concerned initially at the proposals. You come to expect attacks on certain Articles within our contract. Although they may be proposals by the City, many never make it to the Fact Finder. This year’s proposals by the City have infuriated the Wage Team. The City is attempting to attack a vast majority of Articles in our contract that has been in place for many years. Apparently they have interpreted the language in these articles differently than what they have, in some cases, for the past 40 years. Their proposals are transparent in that you see the hatred and vindictiveness of those who have drafted these proposals. I will not discuss in specifics these proposals. However, I can say they are a direct attack on the FOP and will give you just an example of such. One proposal involves totally abolishing the office “broom closet” the FOP has in the Safety Bldg. As you know they have disabled my access to the city system, not just the e-mail, but also MIS. In addition, they have disabled my ability to use the printers. They have stooped to a new low.

Apathy

In the past we have went through tough times during negotiations, votes of no confidence etc. What these tough times have done is united us and has given us that much more resolve. I don’t see that happening this time. Of all the times we should all be up in arms and come together, it is now. At our last Lodge meeting we had almost more retired members there than active. I sent out a survey to the active members concerning a vote of no confidence and have received back only a fourth. I know that is a high percentage for a return rate on mail surveys but I believe we should have a much higher number. There may be some of you who did not receive the survey due to us not having your new address. If you did not receive one, give me a call at 608-6999.

We have worked hard on creating a new website that has many forums where members can discuss matters of importance. This is where I can openly post information for you and you can send me private e-mails to discuss matters. Again, only about a fourth has registered for this website. You can register by going to www.fopdayton44.org.

Apathy is just not occurring in the FOP, but virtually every other organization such as ours. Yes we are all busy with our lives, kids games, recreational activities, careers etc but we need to take time to be at least somewhat involved in the FOP. If members do not start attending meetings or supporting the FOP in some other manner, the FOP will fade into oblivion. Unless things change, in the next 5 or 10 years, no longer will the Dayton FOP be a strong voice for its members but just an emblem you put on your license plate. The City could not be happier that our members have fallen into this state of apathy. I urge you to get involved. I realize a lot of you work on meeting nights, but occasionally take some comp time and attend a meeting. This is not the time for apathy, but the time to rally. I represent you and am proud to be leading the charge as we go up the hill. However, I want to make sure as we charge up the hill, the troops are behind me!

Awards Banquet 2010

Brothers and Sisters:

“Unless the Lord builds the house, its builders labor in vain.

Unless the Lord watches over the city, the watchman stands guard in vain.”

-Psalm 127:1

This Psalm was written by King David as the Holy Spirit spoke through him. I mentioned this scripture in the opening prayer at the Awards Banquet on April 17, 2010. Why do you think I talked about this Psalm while standing in front of the award recipients? What does this have to do with police work? Everything. Now let me clarify by relating this scripture to law enforcement:

If police officers stay stationary in their cruisers and don’t patrol their beats and serve the citizens they are sworn to protect, then our streets will never be safe enough for us to work, rest, or play.

If detectives remain in the office morning through evening, instead of interrogating suspects or developing confidential informants; subsequently, criminals will feel free to do whatever they want in our neighborhoods.

If sergeants have the mindset that their officers can’t think on their own and micro-manage all their efforts in accomplishing tasks, then no real work will ever be effectively accomplished.

If commanders never get in the mood to develop new strategies to combat crime or allocate resources to difficult sectors in the inner city, then we will watch businesses, churches, and schools close their doors for good.

Now let me revert back to Psalm 127:1. Notice David uses words such as “builders labor…” and “watchman stands guard…” If God planned for us just to be people who pray and not do, then David should have changed his words into: “Unless the Lord builds the house while the builders rest…” or “Unless the Lord watches over the city while the guard sleeps…”

The Lord spoke through David stating we have the responsibility to do the work, not God Himself. We (men and women of blue) are to use our own mind, strengths, and will power to solve crimes. Our strength comes by asking the Holy Spirit to empower us to do the work of the Lord. In other words, the Lord wants us on our knees to pray, but He also wants us to getter done. Make sense?

Brothers and Sisters should adversity from the pencil-pushers from the top stop us from doing our sworn duties? Remember this: “For all of us must appear before Christ, to be judged by Him. We will each receive what we deserve, according to everything we have done, good or bad, in our bodily life.” -2 Corinthians 5:10 God bless,

The Police Memorial Service on May 7, 2010 @ 12:00 Noon at Fifth Third Field in Downtown Dayton. Volunteer Retirees are needed to escort surviving family mem-bers to the Memorial Wreath for placement of flowers. Volunteer Retirees are asked to wear Gray pants, Blue or White shirt, and a blue sport jacket.

Procession starts from the Career Academy at 11:30 am. If you do not wish to walk, seating at the field will be available at 11:00am.

Retiree Leo Budenz is organizing a firearms qualifications for CCW permit holders this summer. Contact Leo for information.

The new FOP Website is up and running and so far the Retirees are outnumbering the Active members using the site. Remember that the E-mail system that we depended on for many years is being shut down.

The website is in a NEW format-----one of FORUMS, information can be posted by members and accessed by all other users of the site. These postings can be in the form of questions or requests for activity details, or just communication (s) between members.

The May Retiree’s meeting (May 18, 2010) is featuring a Cook-out, so the meeting time is changed to 7:00 pm. So mark the calendar for the May Eat & Meet.

Derrick McDonald is running for Re-Election to State FOP Office of Sgt. At Arms. Der-rick is raffling a Shotgun to raise funds and is also Hosting a Great American Cook-out at the Lodge Hall. Food and Corn Hole Tournament and other activities will be available. The Retiree’s supported Derrick in his effort by donating $200.

The FOP 44 Retirees held their monthly meeting on April 20, 2010 at the FOP Lodge Hall in Huber Heights, Ohio.

At the Tuesday May 18th retirees meeting we are having a cook-out starting at 6:00 PM with food and drinks provided. The regular meeting will start at 7:00 PM instead of the regular starting time of 7:30 PM and an awards ceremony will be conducted honoring those retired members eligible to receive FOP service pins for their years of membership in the FOP. For those who are unable to attend the ceremony and live out of state, arrangements will be made to mail the pins to you. The following is a list of those retired members being recognized this year.

What energy crisis? Don't you just hate boring meetings? Stand up, sit down, blah, blah, blah. Even the ultra-talented and relentlessly good-looking FOPA #1 has hosted more than its share of gatherings where people fidg-eted to stay awake – and those were the polite ones. Not in April. Either the stars were aligned, every-one ate their Wheaties or the meeting on the other side of the room – which forced us literally to move left of center – was just the ticket we needed. People were jazzed, ideas were flying, votes were deci-sive, bing, bam, boom – shoulda been there, it was great.

Here, in completely subjective order, are the items we tackled.

Committees

Seized by a real sense of urgency, a number of people people signed up to push membership in the A-Lodge. If you'd like to be part of this, let us know what special skills you bring to the table. If you have a marketing background, say so; ditto business connections, advanced computer skills or oodles of free time. A bit of financial wizardry (preferably legal) would be particularly welcome. We don't always know what our members' specialties are. If you don't have time, that's okay. You can join us at meetings and share ideas and expertise in that fashion.

We see this as a very intentional time in our history. If we are passive, our numbers could dwindle and we could simply dissolve, as other A-Lodges have; how sad given that we were the first FOPA in the United States. Even more important: we don't want to sit in meetings and accomplish nothing. We'd like to invite some of the region's business VIPs to join us so they have a cohesive way of com-municating their safety needs to our city leaders. The FOPA is a perfect forum for that. It's a message we haven't advertised very well lately, and we need to do better.

Email List

On a similar note, we continue to update our email list of A-lodge members, and in that process will ask you to indicate something about yourself. It's not a matter of nosiness – well, we never like to call it that – we are just trying to ensure our organization's survival by being as dynamic as possible. Since just a handful of people attend meetings, a lot of members don't even know each other.

Join the Web Site

Make sure you sign up at the new FOP Web site (www.fopdayton44.org). This is a private site, so once you apply, wait for approval. It takes more than five seconds. For some people, it takes more than an hour, though we're sure it's nothing personal. When you have your own log-in and password, you can get the Aegis online, exchange messages with other members, and keep up to date on lodge news.

New Members

Dennis Hughes, who is retired from DP&L, will be sworn in at May's meeting. There will be a second reading on another member and – if we are all doing our jobs – some first readings as well.

Help Wanted

A callout (not that kind of a callout) was made for helpers at Derric McDonald's fundraiser May 22. If you can set up tables or games, or assist in any way, please let John Grove or David Brewster know.

A sad and beautiful farewell

A huge gathering of friends, including large numbers of the safety community – both police and fire – turned out to be with our FOPA Conductor Chuck Upthegrove and his wife Barbara when their son Christopher died last month. April 8 was a stunningly gorgeous day and the parking lot of the Baker-Hazel & Snider Funeral Home overflowed with people for hours. It was a moving testament to Chris-topher and the family that launched him. We wish Chuck and Barbara and their other children strong hearts in the months ahead.

Memorial Day Coloring Contest

We are conducting a coloring contest among the 2nd grade students in Montgomery County elementary schools with the assistance of Dayton Public School program. Students will be asked to color a police picture and then will be judged and prizes will be awarded at the Montgomery County Law Enforcement Memorial Service on May 7th.

Before taken over by the State of Ohio in 1885, legal hangings were conducted by Montgomery County law enforcement per-sonnel. Several county police officials involved in the execution of James Murphy were later appointed to lead the Dayton police force. Chief William Patton’s Dayton police career was at its mid-point in 1885 but he was the Sheriff in 1876 who oversaw Murphy’s hanging.

In Honor of our Fallen Heroes

Montgomery County Law Enforcement Memorial Service

On May 7, 2010 the 37 law enforcement officers who have lost their lives in the line of duty in Montgomery County will be honored at the Fifth Third Field Pavilion at noon. Family members in attendance will be receiving an engraved metal for their fallen officer. Ohio Attorney General Richard Cordray will be the speaker at the Memorial Service.

National Peace Officers' Memorial Service

On May 15, 2010 the names of 123 law enforcement officers who lost their lives in the line of duty in 2009 nationwide will be read in a beautiful ceremony on the lawn of the United States Capitol. Their surviving family members, friends and co-workers will gather to witness the placing of a flower in the memorial wreath honoring the death of these fallen heroes.

While line of duty deaths for 2009 were low, the deaths in 2010 are al-ready 27% higher than last year, Unfortunately, 2009 was faced with several multiple deaths in a single confrontation with the shooting of four officers from Oakland California Police Department on March 21; the deaths of three officers from Pittsburg Pennsylvania Police Department on April 4; two offi-cers killed by gunfire from the Okaloosa County Florida Sheriff's Department on April 25 and four officers killed in the line of duty in Lakewood Washing-ton on November 29.

Our hope and prayer at this time is that these multiple death incidents do not continue to escalate and that the line of duty deaths for this year and coming years continue to decline. We look forward to a day when we honor those who have gone before us without adding to our Roll Call of Heroes. Mark your calendar now

Charles Freeman was the Montgomery County Sheriff in 1881 but he was the deputy who carried out the James Murphy execu-tion in 1876… the most slipshod hanging in Dayton history. It was also Freeman who claimed in 1884 to have seen the ghost of the first man executed, John McAfee, in the old county jail. Freeman would become the Dayton police chief in 1890.

A Montgomery County Sheriff becoming a Dayton Police Chief was not unusual in the late 1800s. Politics played a significant role in appointments although efforts had been made to eliminate it from the control of the police force. Never-theless, politics existed and had undeniable influence on the opera-tion of the force and, of course, on police lead-ership.

In 1885, another mat-ter beyond politics worsened the reputa-tion of the Dayton po-lice force. The Board of Police Commissioners’ secretary, J.H. Ensign, embezzled over $2,500 from police funds and “absconded”. The scan-dal brought fresh at-tention to control of the force. In 1887, a legislative act by the Ohio General Assembly reorganized the Day-ton Police Force yet again.

There are a number of items to report regarding the activities of DPH Foundation, Inc.

1) DPH Foundation has researched the history of the ‘Bank Flyer’, the 1930 Cadillac in the Dayton police fleet that was custom designed for response to bank robberies. The background can be read at: http://www.daytonhistorybooks.com/bankflyer.html. Anecdotal evidence suggests that the ‘Bank Flyer’ may still have been in the police fleet at the time the Safety Building was built in the mid-1950s. The search led to an appeal to the local community in an article appearing in the Dayton Daily News ’Wheels’ section in January 2010 for information as to what happened to this police car.

At the request of DPH, Inc., and in an effort to expand the search to a national audi-ence, Daniel Strohl, the Associate Editor of Hemmings Motor News wrote a feature under the Hemmings Auto Blog on the Hemmings.com website. Hemmings is a monthly magazine catering to traders and collectors of antique, classic, and exotic cars, the largest and oldest publication of its kind. The hope is that with some na-tional exposure, a car shows enthusiast may surface that knows something regarding the whereabouts of the Cadillac. Strohl’s article contains links to the DDN ‘Wheels’ feature on the ‘Bank Flyer’ as well as to the DHBO story. Here is the Hemmings fea-ture:

2) Donations of items and photographs continue to come in. Thanks go to a number of our retired members and friends including: Mark Proffitt, son of Ptl. Ralph Proffitt, for a motorcycle helmet that his father wore when nearly killed in an acci-dent in 1970; Gary Melson for 1970-80s uniforms; Bill Hatfield for FOP memora-bilia and 1960s traffic citations and issued rain coat; Ralph Nickoson for his 1959 police academy book; Mike Sammons for a 1982 “Sting Operation” sweatshirt; John Heck for a generous financial contribution and a police journal; and to the fol-lowing for a variety of photographs: Paul Stewart and Sue Patrick, granddaughter of Sgt. Hazel Clark (1926-1953).

3) DPH, Inc. has been engaged in a cooperative effort with Judy Monseur, PhD. on a documentary production. Judy travels from Columbus to Dayton on weekends to con-duct videotaped interviews of past and present Dayton officers as well as individuals with connections to significant historical events or members of the Dayton police force from years past. Thus far, 12 interviews have been conducted and six more are being scheduled.

DPH Foundation would like to hear from any member willing to be interviewed on camera who participated in, or is in a position to speak about, significant historical event(s) in Dayton police history. In addition to major local happenings, events or accomplishments of national standing are sought (for example, crimes of national no-toriety; Univis labor strike in 1948; the Dayton riots in 1966; the national leader in police communications technology in 1986, etc.). The Ohio General As-sembly created a gov-ernor-appointed, “non-partisan” (actually bi-partisan) Board of Po-lice Directors, purport-edly removing the in-fluence of the Dayton City Council. The act called for two directors appointed from each political party with the mayor serving as an ex-officio member. Chief Patton’s four-year command would end in early 1887. Dayton History Foundation Report cont.

Aside from this particular production, the compilation of all interviews will be con-verted to digital format and then provided to the Dayton History-NCR Archive Center and the Wright State University PL Dunbar Library to be placed in the “Dayton Police Department Collection”. These interviews will remain in the public domain for future use.

4) DPH Foundation, Inc. nominated Chief Rudolph Wurstner for 2010 induction into the Dayton Walk of Fame. Presently, there are no police officers from any local law enforcement agency honored on the Walk of Fame despite the many historic con-tributions and sacrifices to the Dayton area community.

Chief Wurstner, who served from 1902 to 1949 and led the Dayton Division of Police from 1925 to 1949, was determined to be the best first choice for this honor. More will be reported in a later edition of this newsletter.

FOP Lodge No 44 Member of the Year At the Dayton FOP Lodge No. 44 Awards Banquet held in April, Liza Marti-

nez was named our Lodge's Member of the Year. Liza has been active in many Lodge activities over the years, including work as a member of the an-nual Policeman's Ball committee. Liza's most notable contributions are during the Christmas holidays when she organizes the Lodge's Children's Christmas Party with the help of others and, more particularly, her efforts to make Christmas come to the homes of many disadvantage children and families. Every year, she sets up the Angel

Tree at the Lodge. The ornaments are cards with the names of local children in need of certain articles of clothing. Members adopt children by purchas-ing the clothing items listed on the card. Liza ensures that the items end up with the families of those youngsters. Liza is certainly deserving of the honor. Please offer Liza your congratula-tions when you see next see her.
