brought to recover damages for a breach of promise of marriage. The nature of the complaint was sufficient to excite the curiosity and attention of the Jury; and if, on the investigation of the case, the action should appear to be well founded, the honest minds of those he was addressing would soon arrive at a just decision with regard to the extent of the injury this plaintiff had received and would award her an adequate condensation for her wrongs.

To-day they had to consider the case of a female, the best part of whose life had been consumed by the defendant in a long courtship; and who ultimately deserted her to marry another, without alleging the slightest fault to that lady, or assigning any reasonable cause for his capricious behaviour. Miss Chard, the plaintiff in this suit, was the daughter of a respectable farmer, living at Chardstock, in this county, and one of a family of eight children; she was now in her 27th year. Mr Bently, the defendant, was the son of an opulent farmer, residing a short distance from the plaintiff's father and at the time this courtship commenced, superintended his father’s business, but more recently had established himself in a farm of considerable magnitude, that was believed to be his own property. He was some years older than the plaintiff, being in his 35th year. From the contiguity of the two farms, an intimacy arose between the families so many as 13 or 14 years since; and as the attentions of the defendant were then particularly addressed to the plaintiff, her parents thought it prudent to inquire if his intentions were honourable towards Miss Mary Ann [Chard] and whether his visits to her were sanctioned with the approbation of his father and friends. Mr Bently assured the mother of the plaintiff that he came to her house as the suitor of her daughter and that his father had no objection whatever to their marriage; and for many years afterwards he was in the constant habit of seeing Miss Chard twice or thrice a week; and the only reason he gave for delaying the marriage so long was that his property was not sufficient to support an establishment equal to the respectability of their families, but which, he said, he should be able to do on coming into the possession of property which he expected from his friends; and he more than once observed, that he neither expected nor required any fortune with Miss Chard on their marriage.

The defendant left his father’s house about two or three years since, to take possession of the Haulditch farm and estate, still in the neighbourhood of Mr Chard’s, on his own account, and continued the same attentions to Miss Chard for some tome afterwards, as he had done before, but deferring the marriage on account of the delapidated state of the farm house, which he was anxious to repair before taking home a wife. At length the 1st of April was appointed for the wedding day and every preparation was made by Mrs Chard, the mother, to celebrate an event which was considered alike advantageous and joyful to both families; the happiness of this day, however, the defendant never permitted Miss Chard to enjoy, for, on the Thursday before the day on which the marriage was to be solemnized, Mr Bently sent for this young lady’s brother and informed him that he could not make Miss Chard his wife, for that his father and he had had some angry words about it and that he (the father) would not suffer the marriage to take place. On the day after the disappointment, Mr Bently came crying to the house and declared the fault was not his; “It had always been his determination to marry Mary Ann and if ever he married a woman, she should still be his wife”. From this time he ceased to visit the plaintiff. To another friend, who had also interested himself on this young lady’s behalf, the defendant had likewise said that “if he ever

married any other woman but Mary Ann, he would consent to have his head taken off”. [This expression was accompanied with a [illegible] and deliberate [illegible] of the hand round the throat, by the witness when related the conversation, which raised a laugh in the Court that for several minutes interrupted the detail he was giving].

Many months had not elapsed from the period of this cruel disappointment before the defendant married a widow lady, named Jeffries, who lived at Thorncomb, close by his father’s house, and it was suspected that, for some time previous to the marriage day being appointed with Miss Chard, the defendant had been paying his address to Mrs Jeffries, possibly with the view to augmenting his fortune, even at the expense of the happiness of that lady, who, in every honourable thought that could associate itself with the female mind, had looked upon the defendant as her husband for many years past. These were the circumstances of the case and the Jury, in estimating the injury Miss Chard had sustained, would take into their consideration the irreparable loss which twelve or fourteen years were to a young lady, with all its possible consequences, and return a verdict accordingly.

The plaintiff’s mother and brother, with two other friends, were examined and fully supported the statement made by the Learned Serjeant.

Mr Erskine, in addressing the Jury, on the defendant’s behalf, admitted that the plaintiff was entitled to a verdict, but he apprehended this would not be considered a case where heavy damages ought to be given; for, in truth, with the exception of not having married the lady, there was not the slightest imputation against the defendant that he had done any act that was at all calculated to wound the feelings of Miss Chard, or affected future interests. It had been charged to the defendant that at the time he had appointed to marry the plaintiff, he was then courting another lady, whom he afterwards made his wife; but the evidence was directly against this allegation, as it had been distinctly stated that Mr Bently had not been observed paying attention to Mrs Jeffries more than seven or eight months prior to his marriage with her, which took place in October, 1825, considerably more than twelve months after he had ceased to be intimate with the plaintiff. The fair presumption therefore was that the defendant, as he has stated had declined fulfilling his engagements with Miss Chard, knowing the disinclination his father had to the match and being conscious that by marrying against his consent, he would be entailing ruin on himself and unhappiness on the lady who should become his wife.

Mr Justice Burrough said a verdict must be given for the plaintiff as it was admitted a promise had been made and broken. His Lordship scarcely knew of any greater injury that could be done to a young lady than to desert her after a long courtship and the Jury, by their verdict, should protect them from having their feelings and interests thus trifled with. The only apology the defendant had offered for his conduct was that his father was averse to the marriage; but that was not to be assumed as a fact, which was not supported by evidence and here the Jury had heard nothing to the contrary but that the match was equally agreeable to the parents of both parties.

His bride, Paula HEWITT, is the daughter of Mr and Mrs Alan Hewitt of Shelves Farm, Luppit, Honiton. Paula is known for her adaptability and this was reflected in the fact that although she was running a garage in Surrey, she turned her hand to needlework and made her attracted wedding dress and those of her four attendants..........
