Sand Beach Township Mobile Home Ordinance Ordinance No. 062718, rev. 1 (Revised September 1, 2019) Ordinance adopted to secure the public health, safety and welfare of the residents and property owners within Sand Beach Township, Huron County, Michigan, by establishing requirements for acceptance of used Mobile Homes. Section 1 Definition: Mobile Home Any and all Mobile Homes, both single and double wide, shall be used for residential purpose only, meeting all applicable zoning restrictions. Section 2 Regulations: (A). Mobile Home must meet or exceed the HUD, June 15, 1976 standard, published under 24 CFR Part 3280. The data plate should state: This manufactured home is designed to comply with the Federal Manufactured Home Construction and Safety Standards in force at time of manufacture. (B). Current, Inspection Report stating manufactured home is designed to comply with the Federal Manufactured Home Construction and Safety Standards in force at time of manufacture or copy of Data Plate must be submitted to the Zoning Administrator for review, prior to permit issue. (C). Ordinance not applicable to Mobile Homes located in Sand Beach Township prior to the Effective date of this Ordinance. (Existing Mobile Homes within Sand Beach Township built prior to HUD, June 15, 1976 standard may not be relocated within Sand Beach Township). Section 3 Violation and Penalties: (A). Any person or entity that violates, disobeys, or refuses to comply with the provisions of this Ordinance, or who causes, allows, or consents to any of the same, shall be deemed to be responsible for a violation of the Ordinance. Any person responsible for a violation of this Ordinance whether as an owner (by deed or land contract), lessee, licensee, agent, contractor, servant, employee, or otherwise, shall be liable as a principal. Any violation of this Ordinance shall result in the following. Mobile Home owners not meeting the requirements of this ordinance shall be given 30 days to remove Mobile Home. After 30 days if mobile home is not removed, Mobile Home owner shall be fined $2000.00 per year until Mobile Home is removed from property. Fine not paid within 6 months will be added to the tax roll as a special property tax assessment. The above fine, when collected shall be paid to Sand Beach Township and shall become part of the General Fund of Sand Beach Township. Section 4 Severability: Should any section, clause or provision of this Ordinance be declared by the courts to be invalid, the same shall not affect the validity of the Ordinance as a whole or any part thereof, other than the part so determined to be invalid. Section 5 Effective Date: Once adopted by the Sand Beach Township Board, said Ordinance will be published in a newspaper of general circulation within the Township. This Ordinance shall become effective thirty (30) days after date of publication.
