A MESSAGE FROM NPCC’S BOARD CHAIRMAN, IAN BENJAMIN

The leading voice and information source for New York City area nonprofits, the Nonprofit Coordinating Committee of New York (NPCC) is the largest membership group for nonprofits in the region. In Fiscal Year 2015 (October 1, 2014 to September 30, 2015), we continued to strengthen the nonprofit sector. This is clear from the impact of our Nonprofit Excellence Awards, where we acknowledge the excellent work that our sector does, and the day-to-day support of our members through workshops, information and cost-savings programs. This report tells the story of that impact.

As we do every year, we served as a “one stop shop” for nonprofit organizations, offering information, guidance, hands-on help, management and governance support and discounts on business services. The following pages reveal how NPCC strengthened nonprofits in so many ways, particularly serving our more than 1,400 members through scores of free workshops as well as capacity-building programs that deliver practical management training and coaching. We worked with City, State and federal government agencies to promote clear, fair and least burdensome regulations so that nonprofits could comply without curtailing their work to achieve their missions, and we informed and helped nonprofits themselves to be accountable and effective.

While continuing NPCC’s powerful work, we also underwent a significant change in 2015. Michael Clark stepped down as President of NPCC after a decade-long tenure during which he contributed greatly to NPCC’s success and to the sector as a whole. We also announced Michael’s successor: Sharon Stapel, who comes to NPCC from the New York City Gay and Lesbian Anti-Violence Project.

As you review these pages, and the work that NPCC has done in 2015, know that we at NPCC are as excited about the work we will accomplish in 2016. We will be making some changes - to our website, to our newsletter and to the ways we communicate with our stakeholders - while continuing the effective existing programming that NPCC offers.

As always, our deep and undying gratitude to our members, supporters, partners, board members and amazing staff for contributing to NPCC’s success. You remind us every day why we do this work and how important our nonprofit sector is to the New York City area.

STRENGTHENING NONPROFITS

One of the most important roles that the Nonprofit Coordinating Committee plays is as a high-value conduit of knowledge and expertise. Whether by promoting best practices through our annual Nonprofit Excellence Awards,

publishing a widely read monthly newsletter, hosting more than 50 “sold out” workshops or offering 200+ resource materials, NPCC is a major portal of information for the New York City area’s nonprofit sector. Our programs include:

2015 New York Community Trust Nonprofit Excellence Awards Program

The 2015 Nonprofit Excellence Awards were produced by NPCC in partnership with The New York Community Trust and Philanthropy New York. The program was sponsored by WNYC, and also supported by the Clark Foundation, Ford Foundation, RSM US LLP, and Columbia Business School Executive Education Programs in Social Enterprise. In its ninth year, the Awards program raised awareness about excellent management in the large and diverse nonprofit community in the

New York City area, identified best management practices, and helped educate all nonprofits on what it takes to measurably improve their performance in Eight Key Areas of Nonprofit Excellence. To date, a

total of 2,343 unique nonprofit organizations, representing a broad cross-section of the nonprofit community in New York City, Long Island and Westchester, have participated in the Awards program,

which has been the source of at least 3,825 reported organizational improvements among these groups.

The 2015 Awards drew a total of 56 applications, which were reviewed by an expert Selection Committee. After an eight month, three-stage selection process, the 33-member Selection Committee identified three winning organizations. The 2015 winners were announced and interviewed at a Best Practices Workshop and Awards Presentation in November, 2015.

New York Common Pantry, the Gold Prize Winner for Overall Management Excellence, received a $30,000 prize; America Needs You received the Silver Prize and $20,000; and, BRC, the Bronze Prize winner, received $10,000. The winners also received scholarships for the Columbia Business School Executive Education Programs in Social Enterprise.

The Nonprofit Excellence Awards encourage all applicants to improve their management practices, enabling them to become more

excellence in the nonprofit sector. To date, the 2015 Awards program has served 291 unique nonprofits, and those organizations have reported making 305

organizational improvements as a result of participating in the program. To encourage and support participating nonprofit

effective in achieving their organizational mission. Testimonials like that of Muzzy Rosenblatt, Executive Director of BRC (below), are evidence of how this program raises the bar for management

managers in implementing management best practices, NPCC staff provided tailored feedback to applicants based on the Selection Committee’s notes and scoring of their applications: in 2015, 61% requested and received this feedback. Participants already have reported using this detailed feedback to inform new strategic plans, improve program performance, and revamp communication strategies. To further promote awareness and use of excellent management strategies spotlighted by the Awards program, NPCC conducts the annual series of Pathways to Excellence workshops to disseminate best practices and management lessons from the program’s first nine years.

Information, Guidance, and Referrals to Nonprofits

NPCC provides a large volume of reliable and personalized assistance for nonprofit managers through responses to requests for information, referrals and guidance. This is rated by members as our most valuable service and clearly is the key to our high membership retention. Results from our Fall 2015 member survey reveal that 94% of organizations using our information and referral services rated them “excellent,” “very good,” or “good.”

they would use what they learned to improve their organizations. Some 62% of respondents to our three-month follow-up surveys reported making organizational improvements based on workshop information.

NPCC’s website provides access to our newsletter, Member Directory, Information Databank--a library of helpful tools, sample policies, and other templates--and also to a wide range of publications, including the Salary Survey, Employee Benefits Survey, How to Read the New IRS Form 990, Emergency Preparedness Guide, our first-ever Audit Survey and much more. of information to our readers, including government affairs and issue alerts, management and governance issues, and nonprofit sector “thought pieces.” In Fiscal Year 2015, newsletter circulation included 3,200 mailed print copies per month and e-blasts to an average of 5,500 individuals at our member organizations each month. The e-blasts generated an average of 1,350 monthly page views.

Government Grants Information Service (GGIS)

GGIS helps members secure government grants through customized funding alerts. In Fiscal Year 2015, 925 grant announcements were sent to over 800 subscribers with federal, State and City government grant opportunities. Some 78% of organizations using GGIS rated it “very good” or “excellent.” Members reported securing more than $10 million in government grants last year using GGIS.

Workshops and Roundtables

NPCC’s workshops provide technical and managerial expertise and information to area nonprofits. We regularly update and add topics, evaluate member interest in future topics, and track workshop results. In Fiscal Year 2015, NPCC offered 55 workshops covering a wide range of management issues. Attendance remained high, with most workshops “sold out” in advance. Total attendance for all 55 workshops was 2,610. Some 89% of attendees completing workshop evaluations reported that the workshops were helpful; 86% reported learning something new or useful; and 95% reported that

visitors viewing an average of 21,235 pages per month.

Nonprofit Outsourcing Clearinghouse (NOC)

NOC helps nonprofits reduce administrative costs, increase productivity, and improve operational quality through outsourcing key back-office services. Our online NOC database includes some 95 vetted outsourcing vendors from eight areas: bookkeeping and financial management, fundraising, human resources, IT services, legal services, marketing and communications, purchasing, and risk management. NPCC also offers a “A Nonprofit Guide to Outsourcing” to help nonprofits make sound decisions about outsourcing services.

SERVING OUR MEMBERS

The Nonprofit Coordinating Committee is the largest membership and service organization for all types of 501(c)(3) nonprofits in the New York City area. Through NPCC, members have access to 15 cost-saving vendor programs.

These partnerships help member organizations to operate more effectively and accountably. As a result, these organizations better serve their communities, clients and causes.

At the end of Fiscal Year 2015, NPCC’s total membership, which includes individuals and corporate members, was 1,421 and nonprofit membership was 1,385. As we learned in 2014, a number of our members are struggling with cashflow problems this year, making it difficult to renew their membership in NPCC as quickly as they have in past years. Even in the face of challenges like these, NPCC maintained an impressive membership renewal rate of 88%.

In an effort to increase NPCC’s brand awareness and to build our membership, we maintained

strong partnerships with several key networking and umbrella organizations over the past year. We look forward to strengthening partnerships like these in and around the New York City area nonprofit sector and anticipate that they will help us to expand NPCC’s reach in 2016 and well beyond.

Member Cost-Savings Programs

NPCC offers a robust portfolio of cost-saving vendor services that help our members focus their money and resources on program work, rather than back-office expenses. In Fiscal Year 2015,

our members saved more than $3.3 million by participating in these programs. We offered the following cost-saving services for our members:

Retirement Benefits Program

For over 20 years, NPCC has partnered with MetLife to offer members two comprehensive retirement benefit plans: a 403(b) Tax Deferred Annuity (TDA) plan and a Simplified Employer Pension Plan (SEPP). At the end of Fiscal Year 2015, 290 organizations were enrolled, with total assets exceeding $155 million.

In 2015, NPCC rolled out a new retirement program exclusively for our 501(c)(3) members. The new program with Nationwide offers discounted pricing on ERISA 403(b) and/or 401(k) retirement plans. Nationwide also provides access to IRON Financial to provide associated 3(38) fiduciary investment services. NPCC is also offering our members two separate ERISA 3(16) fiduciary services, one through Pentegra and another through 401K SAFE, to off-load the often time-intensive administration of their retirement plans.

Insurance Programs

For many years, NPCC has partnered with Crystal & Company

to offer our members a cost-effective and comprehensive Directors and Officers (D&O) Liability Insurance program. The policy covers nonprofits and their directors, officers, employees, trustees, committee members and volunteers. Over 600 member organizations had coverage through this program in Fiscal Year 2015, saving a total of $1.1 million.

In addition to our D&O insurance program, NPCC offered members a Property and Casualty Insurance program, administered through Crystal & Company and Northeast Agencies, Inc. The policy covered property loss, business interruption and crime; general liability; automobile liability; physical damage; workers’ compensation

and employers’ liability; special events; and, excess liability.

Managing Unemployment Costs

NPCC partners with Unemployment Services Trust (UST) to help members safely opt out of the state unemployment tax system. UST helps eligible nonprofits save up to 60% on their state unemployment tax rate through ongoing education, expert claims management, and reserve building. In Fiscal Year 2015, members saved $120,374 in unemployment costs by participating in the UST program.

for complete payroll processing services at a significant discount off their regular rates. Last year, more than 700 NPCC members saved $560,000 on payroll services through the Paychex program.

TransitChek

Through NPCC’s partnership with TransitChek, NPCC members can enroll in the Commuter Benefit Program and set aside a portion of their pre-tax salary for commuting costs. In Fiscal Year 2015, the program saved NPCC members $24,034 by reducing overall payroll taxes.

Discounted Office Supplies

NPCC members have access to

thousands of office supplies, printing and copy services, furniture and design solutions, janitorial and green cleaning supplies through the Staples Advantage program. More than 754 NPCC members participated in the program in Fiscal Year 2015. The program saved members almost $1.2 million.

Background Check Services

Through NPCC’s membership in the National Council of Nonprofits, we also partner with Coeus Global, a company that provides screening and background check services in full compliance with state and federal regulations. In Fiscal Year 2015, NPCC members saved more than $48,000 through this program.

Conference Calls and Web Conferencing

NPCC members have access to discounts on telephone and web conferencing through ReadyTalk. This vendor partnership is made possible through NPCC’s membership in the National Council of Nonprofits. Last year, more than 128 members saved $246,410 through the program.

Financial Management

Jitasa offers finance, accounting and bookkeeping services tailored to meet the needs of nonprofits. In Fiscal Year 2015, more than 38 NPCC member organizations participated in the program, saving an estimated total of $24,652.

Discounted Financial Management Courses

FMA Institute offers NPCC members discounts on the institute’s Certified Nonprofit Accounting Professional (CNAP) courses as well as trainings on Excel and QuickBooks.

Legal Assistance: Employment and Labor Relations

Attorney Allen Breslow, a regular NPCC workshop presenter, offers guidance on questions about labor and employment law, and employee benefits to several NPCC members. In 2015, 95 member organizations sought advice or utilized these services, with total savings exceeding $300,000.

Discounted Publications and Memberships

Through NPCC membership, nonprofits have access to significant savings on BoardSource and Theatre Development Fund memberships, plus discounted subscriptions to The Chronicle of Philanthropy, Crain’s New York Business and Stanford Social Innovation Review.

WORKING WITH GOVERNMENT

The Nonprofit Coordinating Committee’s unique mission, among more than 80 varied nonprofit umbrella groups in our area, is to represent the full breadth of the 501(c)(3) nonprofit community on sector-wide issues, particularly

governance and regulatory matters that affect all New York nonprofit corporations. NPCC’s Government Relations Committee is the only New York City area umbrella of this kind, advocating for and protecting the broad legal and regulatory environment that governs all sizes and types of charitable nonprofits.

The Government Relations (GR) Committee is composed of the area’s top nonprofit legal and accounting professionals, including five former heads of the NYS Attorney General’s Charities Bureau. Its views on nonprofit regulatory and legal matters are sought routinely by key officials at all levels of government.

The Committee meets 10 months a year and consults regularly with the Governor’s office, State agencies and legislators, the Attorney General’s office, local officials

and federal bodies that regulate nonprofits. This enables NPCC to continuously inform New York City area nonprofits on key regulatory and legal developments affecting the entire sector.

In Fiscal Year 2015, the Committee continued to be chaired by Barbara Schatz, NPCC Board Member and Clinical Professor of Law at Columbia Law School, and staffed by Robert J. Vanni, NPCC’s Senior Consultant for Government Relations. Some highlights of the Committee’s work include:

Nonprofit Revitalization Act (NPRA) and NYS Nonprofit Law Reform

The NPRA was signed into law by the Governor in December, 2013, following significant input and support by NPCC and the GR Committee. Following enactment of a short technical corrections bill in 2014, the Committee has closely followed how practitioners and scholars are interpreting and implementing the Act’s broad changes. The NPRA represents the most significant change to the NYS

Not-for-Profit Corporation Law in almost 40 years.

During the reporting period, representatives of the Committee met with the leadership of the Charities Bureau concerning NPRA and urged them to clarify and offer guidance on many of the questions facing nonprofits and their legal advisors in their efforts to comply with and interpret the new NPRA provisions. The Committee’s objective has been to learn from its members the problems they perceive with NPRA and to take steps to make it more internally consistent, clearer, and easier to implement. NPCC and others met with members of the staffs of Senator Ranzenhofer and Assemblyman Brennan, NPRA cosponsors, to urge additional amendments. As a result, a working group was formed, composed of NPCC, Lawyers Alliance, the State Bar Association, the City Bar Association, and the Law Revision Commission. This working group prepared a white paper with a unified set of recommended amendments and the reasons therefore for legislators, the Attorney General, and others.

In an effort to help NPCC members to comply with the requirements of the NPRA, members of the Committee led two workshops to explain elements of NPRA and to respond to questions about implementation of its provisions. As a resource for our members, NPCC and the GR Committee drafted and posted on the NPCC website a by-laws review checklist and sample whistleblower and conflict of interest policies that comply with the terms of the NPRA.

Governor’s Executive Order #38 (EO 38) and Regulations

Final regulations to implement EO 38, aimed at reducing excessive compensation at State-funded entities, have been posted on the websites of State agencies. In June, 2013, the Executive Office issued a substantial document, “Preliminary Guidance - Executive Order #38 and Related Regulations,” to assist nonprofits considered to be “Covered Providers” to better understand how to comply with the Executive Order’s terms. Organizations are beginning to implement these terms; however, the GR Committee is monitoring two lawsuits that deal with the constitutionality of the Order. Both lawsuits are on appeal, awaiting hearings.

New York State Contract Reform and Related Federal Contract Reforms

Fran Barrett, the Governor’s Interagency Coordinator for Not-for-Profit Services, is leading an effort along with the State Division of the Budget to streamline the State’s process of contracting with nonprofits. NPCC and the GR Committee have actively

participated in discussions about this effort. With a final Master Contract released in March, 2013, the new contracting process and use of the new Master Contract are being rolled out by various State agencies. We remain in regular contact with Ms. Barrett to discuss developments in the Grants Gateway program.

Related to this effort, the federal Office of Management and Budget (OMB) issued the “OMB Uniform Guidance” that significantly impacts the process whereby the federal government contracts with nonprofits. The Guidance became effective on December 26, 2014. Among the more significant changes is the requirement that, if federal funds are used to pay for services from nonprofits, then the contract must reimburse nonprofits for related indirect costs at a negotiated rate but not less than 10%. This applies when nonprofits use federal funds coming directly through federal contracts and also indirectly, through state and municipal contracts. Representatives from the National Council of Nonprofits, the organization largely responsible for securing these nonprofit-friendly reforms in the new OMB Uniform Guidance, advised the GR Committee on the provisions of the Guidance, their impact on nonprofits, and next steps. They also conducted a workshop for NPCC members on using the OMB Uniform Guidance to cover indirect costs. Last May, NPCC and the GR Committee led a seminar on the Uniform Guidance at the United Way of Westchester’s Nonprofit Summit.

developments in order to best advise and educate NPCC members of their rights, opportunities and responsibilities under the federal OMB Uniform Guidance.

NYC Efforts to Limit Nonprofit Real Estate Tax Exemptions

The City Department of Finance and City Tax Commission have taken certain unilateral actions to limit, deny or withdraw nonprofit real estate tax exemptions. NPCC and the GR Committee have been very concerned and active on these matters.

In the matter of the Drug Policy Alliance (DPA), a request for an exemption was summarily denied by the Department of Finance. In 2015, the City appealed a 2013 decision by the NYS Supreme Court finding that DPA was entitled to a real estate tax exemption to the Appellate Division of the Supreme Court. NPCC submitted another amicus curiae brief. In September, 2015, the Appellate Division remanded the case to the Supreme Court on technical grounds. NPCC continues to follow this case.

In a second real estate tax exemption matter, Greater Jamaica Development Corporation (GJDC) sued the Department of Finance

for its decision to revoke some of GJDC’s real estate tax exemptions. The City appealed a 2013 decision by the Appellate Division, finding the City’s revocation arbitrary and capricious, to the Court of Appeals and NPCC filed an amicus curiae brief in support of GJDC. In July, 2015, the Court of Appeals issued a decision reversing the lower court’s decision and finding on behalf of the City, stating that the ownership and operation of certain public garages by GJDC were not charitable functions and thus not due a nonprofit real estate tax exemption. Though this decision is somewhat of a setback, it is our hope that it will be viewed as a tax on “commercial” activities and not as a general incursion on nonprofit real estate tax exemptions. NPCC has met with other interested parties to discuss the possible implications of the decision and to consider next steps.

Other Matters

NPCC and the GR Committee closely followed other matters in Washington for their potential negative impact on nonprofits. This included negotiations concerning threats to limit charitable deductions, the impact of sequestration, Presidential Congressional budget proposals

and negotiations, postal reform as it relates to nonprofit postal rate discounts, continuing IRS oversight and investigations efforts, and proposed IRS regulations changes concerning 501(c)(4) corporations.

Due to the continuing economic problems faced by New York State municipalities, the GR Committee is watching proposals around the State to increase fees on nonprofits, such as water and sewer fees, as well as discussions concerning the imposition of PILOTs (Payments in Lieu of Taxes).

The GR Committee continued to monitor, comment, and report on many State and City matters, including changes in minimum wage laws, City Human Rights Law, the launch of the City’s HHS Accelerator program, NYC Earned Sick Time Act, and State and City lobby law changes, regulations by the Joint Committee on Public Ethics (JCOPE), and City laws banning discrimination based on an applicant’s criminal history record or credit history.

The GR Committee will take action as appropriate and will keep NPCC members advised of these and other issues that might affect them.
