MANDATORY CIVIL E-FILING IN TARRANT COUNTY In December 2012, the Texas Supreme Court mandated e-filing in civil matters. The first group of counties (Harris, Dallas, Tarrant, Bexar, Travis, Collin, Denton, El Paso, Hidalgo and Fort Bend), the Supreme Court, the Court of Criminal Appeals and the 14 Courts of Appeal become mandatory January 1, 2014. MANDATORY CIVIL E-FILING IN TARRANT COUNTY

In December 2012, the Texas Supreme Court mandated e-filing in civil matters. The first group

of counties (Harris, Dallas, Tarrant, Bexar, Travis, Collin, Denton, El Paso, Hidalgo and Fort

Bend), the Supreme Court, the Court of Criminal Appeals and the 14 Courts of Appeal become

mandatory January 1, 2014. E-filing in all other counties will become mandatory on a

graduated schedule through July 1, 2016.

This means that attorneys will no longer be able to file paper documents at the

clerk's counter.

Filers will use the EFILETEXAS.GOV web portal to enter their cases, and the Clerk’s

Office will receive them electronically. The portal is available 24 hours a day to

filers. If a filer does not have access to a computer with internet access, kiosks will

be available in the Clerk’s Office to upload from. The filer will need to have their

documents on a flash drive to create a case or append an existing case.

The County Clerk’s Office will no longer have the ability to correct

submitted documents as they did in the paper-based world.

To get started, filers will need to do two things:

Register on the EFILETEXAS.GOV portal (https://efiletexas.gov/)

Engage a service provider- An electronic filing service provider (EFSP)

provides an online service to help you file your documents, and acts as the

intermediary between you and the eFileTexas.gov system. The service

providers listed have all met the requirements for certification outlined by

the Office of Court Administration. Additional providers will be added as

they meet the certification requirements outlined by the Office of Court

Administration. Each EFSP offers a variety of additional services and you

should evaluate which provider meets your filing needs.

Registering as an IndependentUserYou can register as an “independent user” if you are a single user of the system, meaning a user notassociated with any firm or being represented by any firm.Note: Refer to your local court’s website before registering as an independent user, as registrationoptionsmay vary.Perform the following steps to register as an independent user:

1. Click the link.

Note: There is no fee to sign up for e-filing.

2. Select the option.

3. Click the button to continue; click the button to go back; or click the button tocancel the registration process.

4. Read the Usage Agreement before proceeding.

5. Select the check box to accept and agree to the terms listed on your screen.

6. Click the button to continue; click the button to go back; or click the button tocancel the registration process.

7. Complete the Contact Information form.

8. Click the button to continue; click the button to go back; or click the button tocancel the registration process.

9. Complete the User Information form.10.Enter a question in the Security Question field.

Note: Your security question is required to restore your password in case you forget yourpassword.

11. Enter a response in the Security Answer field.

12.Click the button.

The message Your Registration is Complete displays on the screen.

13.Click the button.

Note: You must verify your e-mail address to complete the registration process. A verification e-mail from [email protected] will be sent to you; open the e-mail and click the link to confirmyour e-mail address. If you don't see the e-mail in your inbox, check your junk mail folder for thee-mail.

Your registration is complete, go to your home page to log in.

1 Registeringas a User with anExisting FirmYou can register as a user if your FirmAdministrator has already registeredwith eFileTexas.gov and approvedusers to self-register.

Note: You must know your firm’sname to set up your account. TheFirm Administrator may not allowusers to self register. If this is thecase, the firm’s name is notavailable when searching, and youmust contact the FirmAdministrator to be registered.

Perform the following steps to registeras a user in the firm:

1. Click the link on thelogin screen.

The Registration Wizard opens.Note: There is no fee to sign upfor eFileTexas.gov.

Note: Registration options varyby site.

2. Select the

option.

3. Click the button to selectyour firm, or click thebutton to cancel the registrationprocess.

4. Type your Firm Name, or click the

button to view a list ofall available firms.

5. Select your firm’s name from thelist.

6. Click the button to enteryour account information; click the

button to return to theprevious screen; or click the

button to cancel theregistration process.

Note: An asterisk (*) indicatesrequired information.

7. Complete the User Informationform.

8. Enter a simple Security Questionin the field provided. (Example:What was your high schoolmascot?)

Note: Selectif you are

an attorney, and then enter yourattorney number in the field.Attorney number formats varyby site; refer to your court’swebsite for information on howto enter your attorney number.

Note: Click the buttonif prompted. This verifies your

attorney number is in thesystem.

10.Click the button.eFileTexas.gov displays the

message on the screen.

11. Record the login details displayedfor your records.

12.Click the button.

13.Go to your e-mail inbox to accessyour registration confirmation e-mail.

Note: You must verify your e-mail address to complete theregistration process. Averification e-mail (from [email protected]) will be sentto you. Open the e-mail and clickthe link to confirm your e-mailaddress. If you don't see the e-mail in your inbox, check yourjunk mail folder for the e-mail.

Your registration is now complete.Once you have received your e-mail confirmation, return to thelogin screen to log in to eFileTexas.gov.

2 Logginginto eFileTexas.govYou can log in by using your e-mailaddress and password providedduring the registration process. Youmust log in to be able to useeFileTexas.gov.

Note: Click toregister if you have not registeredto use eFileTexas.gov.

eFileTexas.gov – Quick Reference Guide

1. Go to your eFileTexas.gov homepage.

2. Enter your e-mail address andpassword (case-sensitive) in thefields provided.

3. Select thecheck box to stay logged in toeFileTexas.gov. This keeps youlogged in to eFileTexas.gov untilyou click the logout link to logout.

4. Click the button.

Note: After several failedattempts to log in to the system,your account is locked. You canunlock your account by usingthe Forgot Password? optionand reset your passwordwithout having to contact theFirm Administrator if a securityquestion is associated with theaccount.

Once you have successfullylogged in, you can begin to useeFileTexas.gov.

3 CaseSearch

Search for a case by selecting alocation using the drop-down list, andentering the case number assigned bythe courts or by entering the partyname in the search field.

Advanced SearchThe Advanced Search featureprovides the ability to search by partyname using a person or a businessname. The Advanced Search featureincludes the ability to filter a search byparty name based on the location orthe case type.

Performing an AdvancedSearch by PersonAn asterisk (*) indicates a requiredfield. Note: Color themesmay varyby site.

Complete the following steps toperform an Advanced Search usingthe Person option:

1. Click the Advanced Search link inthe New Case section at the top ofthe screen to open the AdvancedSearch dialog box.

2. Select the Person check box.

Note: Check boxes areconfigurable. This optionmayvary by site. For example, someclients may only havebusinesses in CMS, so a checkbox is not required.

3. Complete the fields in theAdvanced Search dialog box.

4. Click the Search button tocontinue or the Cancel button tocancel. Click the Reset button toreset the form.

The search results are displayed.

4 Filing intoan Existing CaseYou can file into an existing case onceyou have initiated a case.

The procedures that follow describethe three different ways to access acase to file into the case.

Perform the following steps to accessyour case to begin a subsequent filing.

1. Click the link at thetop of the page.

Note: This will take you to theFilings screen.

a. Locate your case on theFilings screen.

b. Click the icon to file intothe case.

c. Complete the 7 filing details,page 4.

5 Filing a NewCaseFile a new case using the CaseInformation screen.

A payment account and a filingattorney must be set up prior to filing anew case. Contact your FirmAdministrator to set up the accountsprior to starting the filing process.

Perform the following steps to file anew case:

1. Click the link.

2. Complete the details for the newcase form using the drop-down list.

Note: An asterisk indicatesrequired fields.

3. Click the button tosave the case information andcontinue.

Note: Once you click the

button, a draft of thepages where all of the requiredfields have been completed isautomatically saved. This featureallows you to stop work on a filingand resume the filing at a later time.To resume filing a saved draft, clickthe link at the top of thepage, find your case on the Filingsscreen, and click the icon.

6 EnteringParty DetailsEach case requires a party type.

Note: An asterisk (*) indicates arequired field. You are required tocomplete all required information forthe party types in the fields provided.

Perform the following steps to enterthe details for the parties involved inthe case:

1. Click the button fromthe Case Information screen toenter the party details for the case.

2. Choose the party type by selectingeither Plaintiff or Defendant underthe Party Type column. You canalso select the party type using thedrop-down menu in the Party Typefield.

3. Enter the party information in thefields provided.

If you want to add another party to

the filing, click thebutton, and enter the partyinformation in the required fields.

4. Click the button to savethe party details, or click the

button toreturn to the previous screen.

7 EnteringFiling DetailsThe Filing Details screen allows youto enter the filing details and calculatethe fees associated with the filing.

Perform the following steps to enterthe filing details for the case:

1. Click the button fromthe Parties screen to enter thefiling details.

2. Select the filing code using theSelect Filing Code drop-downmenu.

3. Select the EFfile check box toselect the e-file option.

4. Enter a brief description of thefiling associated with the filingcode previously selected in theFiling Description field.

5. Type a reference number of yourchoice that you can refer back tofor this filing in the ReferenceNumber field.

6. Select the Lead Document for thisfiling.

a. Clickto

select a Lead Document.

This opens Windows Exploreron your computer.

b. Select a document to uploadfrom the files on your computer.

Note: Only one documentcan be uploaded as a leaddocument.

c. Click to attach the file.

d. Wait as the attachmentuploads.

e. Type a description of theuploaded attachment.

f. Select a security option for theattachment.

g. To delete the uploaded

attachment, click the icon.

7. Select the Attachments to uploadfor this filing.

a. Clickto

select an attachment.

This opens Windows Exploreron your computer.

b. Select the attachments toupload from the files on yourcomputer.

Note: Multiple documentscan be uploaded asattachments simultaneously.

c. Click to attach the file.

d. Wait as the attachmentuploads.

e. Type a description of theuploaded attachment.

f. Select a security option for theattachment.

g. To delete the uploaded

attachment, click locatedunder Confidential.

8. Enter the Filing Comments for thecourt reviewer to read.

9. Click the button toadd more documents to thisenvelope.

10.Review the filing Fees located onthe right side of the screen.

Note: Your credit card isauthorized when submitted;however, the transaction feeswill not post to the credit cardaccount until the court acceptsthe filing. Once the filing isaccepted, the total filing fee tobe submitted for the filing isdisplayed.

11. Select a payment account to useto pay the filing fees.

12.Select the party responsible for thefiling fees.

13.Select a filing attorney.

14.Click the button tosave the filing details when you are

done, or click thebutton to return to the previousscreen.
