Proposed Project / Development (Appendix A): Stage 1 (Costean Lode) is to re-open an existing open cut costean trench to excavate ore resources left on the floor of the trench, the ground disturbing works are to extend the existing pit out 35 metres by 8 metres wide, down to a depth of 17 metres. Also checked were areas North to Thomas’s Tunnel, area around the Southern Trenches open cut, and the proposed portal location for the underground development and the areas for the waste stockpile, a map showing areas walked is attached.
Purpose of Survey (Appendix B): To ensure no Aboriginal Heritage sites are impacted by the proposed development

The area has been disturbed by various mining activities since 1896; there are numerous signs of these activities in and around the lease area.

Assessment Methods
Field Survey Methods: Walked the area on foot paying attention to any erosion and soil profiles in the existing trenches
Justification: Best ways to conduct surveys
Issues: None
Ground Surface Visibility: In the new proposed area for trenching surfaces visibility was 0%. Profiles of existing open cut trenches were checked to see whether any Aboriginal Heritage Sites are present. Also checked were areas North to Thomas’s Tunnel, area around the Southern Trenches open cut, and the proposed portal location for the underground development and the areas for the waste stockpile, a map showing areas walked is attached the surface visibility in these areas was less that 10%
Discussion: As the area is surrounded by Burns Peak and other hills, water from these drains down into the swampy Heath area making it an area not suitable for Aboriginal sites to be present, The wet sclerophyll forest was covered in leaf litter making it impossible to see any Aboriginal stone tools that may or may not have been present.

Why?
The wet sclerophyll forest may have been walked through in drier times or when the area was burnt by Aboriginal people, but due to the terrain and boggy nature of button grass, camps, would have been established on the higher drier peaks surrounding the lease area.

Legislative Framework As contained under Section 10 (3) of the Aboriginal Relics Act 1975; Any person finding a relic must inform the Director or an authorised officer, as soon as practicable. This is done by registering sites through Aboriginal Heritage Tasmania, Department of Environment, Parks, Heritage and the Arts. As contained under Section 14 (1) of the Aboriginal Relics Act 1975; “Except as otherwise provided in this Act, no person shall, otherwise than in accordance with the terms of a permit granted by the Minister on the recommendation of the Director – (a) destroy, damage, deface, conceal, or otherwise interfere with a relic; (b) make a copy or replica of a carving or engraving that is a relic by rubbing, tracing, casting, or other means that involve direct contact with the carving or engraving; (c) remove a relic from the place where it is found or abandoned; (d) sell or offer or expose for sale, exchange, or otherwise dispose of a relic or any other object that so nearly resembles a relic as to be likely to deceive or be capable of being mistaken for a relic; (e) take a relic, or cause or permit a relic to be taken, out of this State; or (f) cause an excavation to be made or any other work to be carried out on Crown Land for the purpose of searching for a relic.” Only the Minister can, on the recommendation of the Director, grant a Permit under the Aboriginal Relics Act 1975. Recommendations The below recommendations represent the opinion of the writer only. The Costean Lode the area North to Thomas’s Tunnel, the area around the Southern Trenches open cut, and the proposed portal location for the underground development and the areas for the waste stockpile, are all free of Aboriginal Cultural material and it is highly unlikely Aboriginal sites are present in the lease area. The findings of the survey conclude that no Aboriginal heritage sites will be impacted by the proposed project/development. Therefore there are no immediate Aboriginal heritage issues and there is no requirement for a Permit under the Aboriginal Relics Act 1975. If at any time during ground disturbing activities you suspect Aboriginal heritage you must cease works immediately and inform the Tasmanian Aboriginal Land and Sea Council 62 310288 and Aboriginal Heritage Tasmania (ph. 62 33 6613) of the discovery. Aboriginal Heritage Tasmania will advise of the necessary arrangements for the further assessment of the discovery. Based on the findings of the assessment, appropriate management recommendations will be developed for the cultural heritage find.
