LEGISLATION IN CAPE TOWNCoCT EVENTS PERMIT OFFICE

RESPONSIBILITY : ORGANISERPut in place such measures as may be prescribed to ensure the physical safety and security of persons and their property at an event.Must cooperate with and assist the event safety and security planning committee and the VOC commander in the performance of their functions. Appoint sufficient persons to be responsible for safety and security at an event, including a safety officer, security officers and such other persons as may be prescribed.

RESPONSIBILITY : ORGANISER

Appoint stewards responsible for:•The marshalling and overseeing of the safe general flow of spectators;

•Provision of event information to spectators;•Provision of ushering services; andProvision of assistance with emergency evacuation procedures to spectators. May appoint volunteers to provide any function or service in support of an event.Stewards and volunteers are not allowed to provide security services, unless they are registered as security officers.

RESPONSIBILITY : ORGANISERIn the case of a medium-risk or high-risk event, the organiser must be at least 21 years old and have the necessary capacity, resources and event-related experience to organise the event. In case of a low-risk event, the organiser must ensure that:

•A safety officer is appointed;•A written safety plan is prepared;•Measures are put in place to give effect to the safety plan; and

•Ensure that the local police station is informed of the event details prior to the event.

RESPONSIBILITY : ORGANISER

The written safety plan must provide the following detail of the event:- Safety measures; Security measures; Crowd management measures;Motor vehicle parking arrangements; and Emergency medical measures.

RESPONSIBILITY : NATIONAL COMMISSIONERThe National Commissioner:May direct an organiser to implement such additional measures as may be necessary;Must establish an event safety and security planning committee for each medium-risk or high-risk event;Must appoint a VOC commander;May prohibit the sale of event tickets at the stadium or venue on the day of the event;

RESPONSIBILITY : NATIONAL COMMISSIONER

May stipulate conditions to be included in a high-risk event safety certificate;May amend or replace a safety certificate;May prohibit or restrict the admission of a person or a group of persons by issuing a prohibition notice; andMay issue a spectator exclusion notice with regard to an undesirable spectator.

DEFINITIONSAccreditation – Vehicles means:

“all vehicles referred to in legislation which are accredited, subject to the meeting of criteria provided for , in order to entitle such vehicles to gain access to certain restricted areas.

Disaster Management means: A continuous and integrated multi-sectoral, multi-disciplinary process of planning & implementation of the measures referred to in section 1 of the Disaster Management Act, 2002 (Act No 57 of 2002).”Disaster Management Plan means:

Will incorporate all safety & security contingency plans andany other applicable plans so as to enable the Disaster Management Centre, in whose jurisdiction the event is being held, to fulfill its responsibilities adequately as contemplated in the Disaster Management Act”

Emergency Services means:“in relation to a sports or recreational event, … all public and private sector medical services, including emergency medical services and health services, the fire department and Metro or local authority traffic and/or by-law enforcement police”


“National Safety Officer” means:

“a person, suitably qualified & experienced in the planning, supervision, & provision of safety & security to an event hosted at a stadium or a venue, appointed in writing by a Controlling Body”. “Safety & Security Committee” means: “a committee, which must be established & maintained by a controlling body, for the purposes of advising the Controlling Body & the National Safety Officer regarding the coordination of, but not limited to, all safety & security matters in connection with the hosting of an event at a stadium or venue”.

DEFINITIONS

Event means, but is not limited to:“ a sporting, entertainment (including live acts), recreational, educational , cultural, religious , political, business (including marketing, public relations & promotional), charitable, exhibitional, conferential, organizational & similar activities hosted at a stadium or a venue

• Event Organizer means:“in relation to a sports or recreational event , any person who plans , is in charge of, manages, supervises, holds an events and /or sponsorship rights to or in any manner controls or has a material interest in the hosting of an event;”

• Fire Service means:“a service provided for in terms of the Fire Brigade Services Act, 1987 (Act No. 99 of 1987)”;

DEFINITIONS

Municipal Disaster Management Centre means“ a centre established in the administration of a

municipality in terms of section 43 of the Disaster Management Act, 2002 and which has the ultimate responsibility to oversee all disaster management aspects as contemplated in terms of section 44 of the said Act where these are applicable to an event”.

Safety & Security Plan means:“a comprehensive document, drafted prior to the Event, in

English, in a legible & electronically transmissible format, which provides for, but is not limited to, the formulation of proper and reasonable safety & security contingency plans, operational procedures, standards, steps and/or any other measures designed to promote AND maintain the physical well-being & protection of property of all persons, inside or in close proximity to a Stadium or a Venue, as referred to in Section 19 of the Act;”

DEFINITIONS

Safety, for the purposes of this Act, means: with reference to a person & amongst others, the state of being safe, free form danger & risks & the prevention of physical harm”

Security, for the purposes of this Act means: “ with reference to any person and amongst others, the taking of steps or measures designed to guard, guarantee or protect such a person against criminal acts or other associated dangers attributable to deviant or anti-social behaviour of another person”

Traffic Free Zone means:“ an area dedicated, in terms of a safety & security plan, asmore fully contemplated by sections 12 and 20, wherein nomotor vehicle may travel or park unless specificallyaccredited to do so”

DEFINITIONS


VOC or Venue Operations Centre means:“ means a temporary or permanent facility, located inside a stadium or venue, which houses an on-site operational control centre from where the entire safety & security operation at a stadium or a venue and it’d precinct, for the purposes of an event, are coordinated from as more fully contemplated in Section 26 of the Act.”

“Controlling Body” means: “ a) the national body controlling a sport or recreational activity in the

Republic; b) the professional organizing arm (inc. any juristic person created in

pursuance of its objectives) of a national controlling body of a sport or recreational activity in the Republic;

c) any person who has a material or substantial interest in the operations of a controlling body;

d) any person who holds themselves out to be and/or conducts themselves in a manner which one would reasonably equate to that of the activities of a controlling body, as contemplated in the Act;
