    WASHINGTON THIS WEEK The FCC's 3 -2 Republican -Democratic split shows up immediately on ownership issues. 3 -2 was the vote when the FCC approved Rupert Murdoch's $5.358 purchase of the Chris Craft TV group. Chairman Powell says in multiple -station, multiple- market transactions. it is common for the combined entity to create temporary violations of our ownership rules." The New York -market "temporary violation" is the one that really stands out: For the next 2years, News Corp. will be allowed to own two VHF TV stations plus the New York Post daily newspaper. News Corp. already owns the Post and Fox affiliate WNYW /Channel 5. The Chris Craft deal adds UPN affiliate WWOR/Channel 9. Both Democrats on the FCC strongly dissented. Gloria Tristani says the decision "shows the lengths the Commission will go to avoid standing in the way of media mergers." Newly- seated Democrat Michael Copps says it "stretches the statutes, denies operative Commission rules. and omits critically important consideration of public interest." The FCC also voted to allow News Corp. to exceed the 35% national TV cap while the courts review that issue. The D.C. Circuit Court of Appeals will hear arguments on that in September.

    Several applicants appy to be the interim operator of Mike Rice's revoked licenses - including Rice himself. The FCC stripped Rice of licenses in Indiana and Missouri after holding hearings on his prison sentence for having sex with minors and on his alleged misrepresentation to the Commission. Those stations are in a Twilight Zone situation as the FCC takes applications for interim operators, headed toward an auction of the licenses and CPs that could takeyears to resolve (given the FCC's problems with FM auctions). Rice has lost literally millions of dollars in assets, and is now filing to become interim operator, under the former name of "Contemporary Media." His rationale? He tells M Street that under the FCC's own character standards. he's now fully entitled to be a licensee, since his offense occurred over lOyears ago. As it stands, those stations, including WBOW, Terre Haute (640) remain on the air under Rice's temporary management

    but not the "interim operator" status he seeks. The FCC continues the "Twilight Zone" situation by treating Rice's stations as new CPs and (apparently) deleting their current calls.

    The FCC revokes the licenses of two stations in the Virgin Islands. Administrative Law fudge Richard Sippel denies Family Broadcasting's Motion for Summary Decision and takes the final step of officially revoking the licenses for WSTX- AM/FM, Christiansted. The Commission found that Family Broadcasting principal Gerard Luz A. fames was operating from an

    unauthorized location, and then misrepresented the situation. James may choose to appeal outside the FCC, but these stations may be up for auction/ reassignment: WSTX (970) and WSTX -FM (100.3). They're currently simulcasting calypso music.

    A $300,000 "voluntary contribution" by American Tower Systems will clean the record on a list of tower complaints at the Commission, thanks to a newly -published Consent Decree. The FCC originally slammed ATS -a spinoff of the onetime American Radio Systems - with $212,000 in fines, citing problems with tower registration for new and existing towers, lighting, painting, and ownership changes. But ATC sat down with the Commission and detailed its proposed "compliance plan ". and now the

    FCC is basically accepting that through a consent

    decree. That ends the investigation and obliges the FCC to treat the original notices of violation and liability as "null, void and expunged." The consent decree lasts for 36 months.

    The FCC's "red flag" is no longer killing deals. We've analyzed the outcome of several recent transfer app filings and concluded that the Mass Media Bureau's "red flag" designation under the so- called "processing guidelines" doesn't mean much, these days. The red flag is nearly 3years old, and Chairman Kennard never

    presented an underlying policy for it: It simply appeared

    one day on the listing of some transfer apps. In practical terms, the Mass Media Bureau staff pulls the BIA revenues on the relevant radio market, and stamps a "red flag" if the transfer involves 50% or more revenue in the hands of one owner, or 70% or more in the hands of two. That's even if the transfer involves an existing cluster. That "red flag" was enough to stall or even kill deals under Kennard (ask Journal about the delay in getting approval for its Great Empire deal). Today, under Powell - one observer says "It might slow the deal down 30 days, maybe a little longer." But that's it. The one exception: If the proposed acquisition draws a petition.

    Broadcasters are filing lots of objections against would -be Low Power FMs. We even spotted one "Petition for Immediate Dismissal with Prejudice ", filed against Edgardo Colon's request for a new 88.5 in Philadelphia. PA. lust guessing, but that's got to be the University of Pennsylvania's WXPN, also at 88.5 and also licensed to Philadelphia. We don't understand how the FCC gave that app a second look, much less

    published it. M Street is also seeing plenty of informal objections and formal motions to dismiss.

    aggregation" or "national database." It will allow subscribers to play Scrabble with geography and create custom geographies,

    across more than one market, or even across one market and an un -rated area. It's a new

    selling tool that Clear Channel's Randy Michaels thinks will revolutionize the way radio is sold. Arbitron says it's always been open to the idea. Of course, this new "game" won't be easy to open up: M Street notes

    that the new regional aggregation approach

    will need approval from bodies like the Arbitron Advisory Council and possibly outside groups. too. There are a million methodological details to work out and then

    the media buyers will see how they like it. One thing's for sure: Arbitron will never be the same.

    Citadel - Arbitron's other hold -out group - signs up. Citadel didn't even know that Arbitron and Clear Channel were at loggerheads, when it began its own tough

    negotiations. COO Bob Proffitt tells M Street "we had some frustrating moments, but we did come to a fair deal" with Arbitron. Citadel had a different negotiating situation from Clear Channel: With Citadel, it WAS all about the money. Though Citadel, like other Arbitron subscribers, should enjoy the benefits of the "national database"!' regional aggregation" tool that Clear Channel was able to extract from Arbitron.

    Infinity's Opie & Anthony crusade continues. The hot afternoon duo finally cracks Boston doing afternoons, live, on modern rock and Stern affiliate WBCN (104.1). We believe there was heavy local

    resistance at WBCN, but Opie & Anthony debuted August 7. Meanwhile, the O&A team is hitting Seattle and Portland on the AM dial. In Seattle, talk returns to 1090, as KYCW

    shelves classic country to pick up Premiere's

    Jim Rome (9am- noon), Westwood's Ron & Fez

    (noon -3), Opie & Anthony (3 -7pm) and Phil Hendrie (7- 10pm). It will use the Sporting News Radio Network late nights. For now,

    Opie & Anthony will also be heard in mornings - but we expect that's temporary, until Twisted Radio host Bob Rivers' non - compete ends in Seattle. Down in Portland,

    Infinity ditches classic country on 970 to do "Extreme Talk ", also aimed atyounger males.

    KUPL will pick up calls of KUFO, parallel to rocker KUFO -FM. The lineup at 970 includes

    Don & Mike (9am -Ipm), Opie & Anthony (I- 5). Sports Junkies (5 -8pm) and Ron & Fez (8-

    midnight). Meanwhile Bob Rivers (5 -9am) hits

    the air immediately in Portland.

    Viacom's Bill Figenshu offers advertisers a $100.000 guarantee that KIKK -FM, Houston will stay country. His "Dear Advertiser" letter comes as the station deals with a nasty Spring Arbitron (3.0 to 1.6) and makes significant changes to both airstaff and playlist. But it's staying country: Figenshu's personal guarantee

    is good to any active advertiser "throughout my tenure as Senior Vice President at Infinity."

    On the air, KIKK -FM (95.7) pulls back from its

    flirtation with Americana and re- focuses on mainstream country - particularly country music that "sounds like Texas."

    It's a home -run baseball book so far. The Spring Arbitrons seem to be showing surprisingly strong listening for play -by -play on the radio - Just ask KIRO, home of Ichiro and the Seattle Mariners. Entercom's KIRO

    blasted an amazing 5.0 to 9.7 between Winter and Spring - nearly a 100% jump because of the Mariners. In the tough New York market,

    the Yanks helped WABC pick up a full share. One researcher notes that Arbitron's People Meter may be very, very good to baseball - diarykeepers don't always associate the station with the game when they fill out their radio listening. That could partially explain why nighttime and weekend listening was up in the

    Spring People Meter test in Wilmington. DE - Panel members were listening to the Phillies play -by -play.

    John Hogan becomes President/COO of Clear Channel Radio. Chief Operating Officer, working with CEO Randy Michaels, is

    the job vacated by Kenny O'Keefe at the end of the second quarter. John Hogan is currently a

    Senior VP based in Atlanta. He and Clear Channel Radio CEO Randy Michaels have worked together since the Jacor days - for more than IS years. Also at Clear Channel Radio, Jerry Kersting is CC's new Chief Financial Officer. Kersting's the "dealmaker"

    who handled the nuts and bolts of last year's divestitures from the AMFM Inc. merger.

    Infinity's backing a collective contest for non -Infinity stations in non -Infinity markets. Yes, it's an unusual- sounding deal for Infinity, coming out of Columbus. OH. That's where Infinity's GM Dave Robbins is

    working with Columbus -based The Positioning Works and Don Hallett. Collective contesting generates larger prizes because it ties together multiple stations (which must make the required on -air legal

    disclosures). Hallett's been involved in strategizing previous collective contest promos. Reach Hallett at (866) Radio -25. Participation is on a first -come basis for what may be the first independent collective contesting initiative.

    Music Buddha's "Song Sonar" joins the online music -testing fray. Current vendors like RateTheMusic promise to capture the rapidly- changing tastes of PI listeners, and are typically offered as a link off of the station's website. Music Buddha's Song Sonar has

    three "modules ": Sonic Response. Add - Worthy, and Imager (which shows songs that are the station's current "image" songs by daypart). The service offers live, real -time data, to monitor how listener response changes whileyou're making adjustments to the playlist. More at "www.MusicBuddha.com."

    Jones adds two country shows and subtracts one. Iones debuts a new 7- night- a -week overnight country show. starring lohn Hendricks, which nicely dovetails with (though doesn't require) the "Lia" show that

    clears 7- midnight. Meanwhile. Jones is dropping the weekly syndicated Crook & Chase country countdown, and introducing (on Labor Day Weekend), a new Great American Country countdown, hosted by GAC cable -TV personality Dallas Turner.

    From Chicago, the Radio Hall of Fame's Class of 2001 - Four of them: Eddie "Roch- ester" Anderson, Jack Benny's longtime comic sidekick. Paul HarveyAurandt. Bob Uecker, play -by -play voice of the Milwaukee Brew- ers. And KMOX, St. Louis legend Jack Carney. Those four men will be inducted into the Chicago -based Radio Hall of Fame in a black -tie ceremony on Sunday, November 3.

    The Hall's Bruce DuMont plans a "Tribute to Bob Hope" for this year's awards, the 10th

    anniversary of the Radio Hall of Fame.

    New York, NY

    ABC finally scores a New York City affiliate for ESPN Radio with an LMA

    and $78M purchase option for WEVD (1050). The LMA that puts ESPN on WEVD full -time begins September I. and it will expand a beachhead that began when ABC finagled the clearance of Dan Patrick on WEVD from I -4pm. Terms of the deal: ABC will LMA WEVD for up to two years. Then it has the option of buying it for $78M. For the seller, the important thing is that the proceeds go into the Forward newspaper op- erations. The Forward publishes Jewish papers in English, Yiddish and

    (since 1995) Russian. We expect Forward to ask the IRS for permission to return to its former not -for -profit status. WEVD at 1050 has a 50,000 - watt signal, but it's highly directionalized. WEVD does a fine job cover-

    ing the five boroughs, plus territory to the north and east. But it's severely limited to the south, in New Jersey. ESPN Radio 1050 will become the market's third all- sports signal, after WFAN and Sporting News Radio's WSNR (620). 1050 was the original home of Jeff Smulyan's pioneering all- sports "Fan ", before Smulyan acquired then -WNBC and moved WFAN

    down to 660.

    Portland, OR

    Salem buys itself a new contemporary Christian "Fish" for $35.8M. This ranks as one of theyear's big move -in stories. KJUN went on the air in 1999 licensed to Tillamook, OR, and then Thunderegg partners George Kriste, Lance Anderson, Ernie Hopseker and Bob Case came into the

    picture. They moved KJUN into Portland by re- licensing it to Scappoose, and now sell it for nearly $36 million. Salem will take over the station via an LMA in the fourth quarter. As for the latest "Fish" outlet, Salem's Ed Atsinger says "Portland is a very strong market for Christian music." One other person should be smiling at the early -2002 closing: original KJUN principal Brian Lord, who remained a principal in this deal. Broker for

    Atlanta, GA

    Radio One begins a $30,000 -a -month agreement to LMA the future Class A at 102.5 licensed to Mableton, GA. The permittee of 102.5 is Mableton Investment Group, and Radio One says it will change the calls from WAWE to WAMJ, giving it the calls currently attached to its own 107.5. Radio One's using this opportunity gaining a fourth FM in Atlanta

    to realign its cluster there. Here's the drill: #I, WHTA at 97.5 remains urban as "Hot 97.5." #2, 107.5, which just abandoned urban AC for

    smooth jazz, takes new calls of WJZZ. #3, The WAMJ calls move from 107.5 to the new 102.5 - format TBA. #4, WPEZ, the move -in at 107.9 that Radio One is buying. It's now country - but that will change. Stuart, FL

    WSTU (1450) is being acquired by former WNSW GM George Kalman. Kalman tells M Street he's planning to use WNSW as the new

    base for his syndicated adult standards shows. Those are the 12-year-old

    "Weekend with Perry ". focusing on Perry Como; and the soon -to- launch "Make Believe Ballroom ", hosted by Lee Arnold. WSTU is currently doing

    oldies. Seller is Resort Radio Systems. WSTU's facility is a I -kw non -

    directional fulltimer at 1450 KHz.

    Lancaster, SC

    Spanish -language operator Estuardo Rodriguez buys WAGL, Lancaster (1560) for $700,000. Rodriguez already operates Spanish -

    language WLLN, Lillington, NC, so this purchase makes him a group. by

    M Street's definition. We'd expect a format change at WAGL, near Rock

    Hill, SC. WAGLs currently doing a mix of country. talk and southern gospel. Seller is Len Phillips' Palmetto Broadcasting System. WAGL is a

    50 -kw directional daytimer, and the brokers are Bruce Houston and David

    Houston of Blackburn.

    Albany, NY

    Jim Morrell's Pamal Broadcasting does something unusual - it sells a station (WIZR. Johnstown, NY at 930). The former Albany

    Broadcasting is selling off an AM that's essentially a daytimer to Joseph Isabel, who's already holding adult standards WCSS, Amsterdam, NY at

    1490. This deal has Isabel's "IZ Communications" acquiring WIZR, which is basically doing soft AC, using ABC's 45+ soft AC format. It's got I -kw

    day, 28 -w night, ND. In Pamal's Capital District home market, it retains properties such as CHR "Fly 92" WFLY and soft AC WYJB. Broker on the

    $550,000 sale of WIZR from Pamal to Joseph Isabel: Dick Kozacko.

    Outside Grand Rapids, MI

    Duke Wright's Midwest group is paying $1,450,000 for classic rock

    WYVN, Saugatuck (92.7). Midwest is also compensating seller Chris Conrad $50,000 for a three-year non -compete within 50 miles of the Saugatuck signal contour. Wright has properties in nearby Grand Rapids (AC WHTC), Battle Creek (including country WNWN -FM) and Kalamazoo (hot AC WFAT), and now acquires class A WYVN in Saugatuck, MI from Chris Conrad, who's based in Holland, MI.

    Outside of Idaho Falls, ID

    Ryan Frandsen's Sand Hill Media lays out $I.2M for the on -air soft AC "QFM" KADQ-FM, and a future FM (the CP for KOSZ, a new class CI at 107.I). Seller is Ted Austin, Jr., who has owned KADQ Rexburg. ID at 94.3 for quite a fewyears. It's a C2. Broker: Greg Merrill of Media Services Group.

    Could Be Anywhere, USA:

    Dealmaking has been markedly quiet so far in 2001. though Clear Channel's

    been pulling off more "tuck -in" and new- market deals than you might think. But look for lots of quiet deal -talk at the NAB Radio Show in New Orleans. Brokers and group heads are seldom seen palavering on the

    exhibit floor but they often get together for discreet chats in nearby hotels. We expect some action out of the NAB Radio Show, as always sooner or later.

    "After looking at several options, we decided on the VADIS platform and DC consoles from KLOTZ,' says John Decker, Chief Engineer, Capstar Communications, Tucson. 'Why? First, our install would be much faster since most of the plant wiring could be reduced to a simple Ethernet line and a fiber optic cable connecting each room with our rack room.

    "Secondly, all four stations were to be housed in the same facility, and we had to share audio sources all around the plant. This is a function that is part of the KLOTZ system. Our entire plant is now based on a digital audio 'bcck- bone' that provides an improved audio signal.

    Passions are running high over the Amber Plan

    And guess what? We hear key Congressional reps are already keenly aware

    of the abducted -child -alert plan and are tracking it. For broadcasters, the fast - spreading "Amber Alert plan" is producing a real fault line: Proponents of the abducted - child -alert plan in markets like Dallas rave about it. ABC's Tyler Cox tells M Street "To me, this is an opportunity for stations to do what they're licensed to do - it's not a burden." But some broadcasters are privately concerned

    that it will be just that. We believe every U.S. broadcaster may soon be dealing with the Amber Plan, if the FCC includes some level of abducted -child alert in the next set of EAS revisions.     New FCC Chairman Michael Powell is earning respect from radio

    Yes, so far,

    radio likes the new Michael Powell Commission, because execs tell us

    they know what to expect. The level of unpredictability under previous Chairman Bill Kennard perplexed many buyers, sellers, attorneys and brokers. Execs keep talking about "the process", and they're

    pleased with the way it's now functioning under former military officer Powell. M Street expects the new Powell FCC to reveal more of its face at the NAB Radio Show, just after Labor Day. All three new Commissioners (Abernathy. Copps and Martin) will be on hand for the Friday morning "Policymaker's Breakfast ", and we expect many FCC staffers to be in the Big Easy, too. If you can't be there (and lots of companies aren't sending their GMs, GSMs or PDs) -M Street will be at the NAB to cover it foryou.

    Signs of life in the station -trading market

    There's a pulse beating, even if the deals are "only" $1 million to $3 million, and even if the advertising slowdown persists like a bad cold. And it's not just Clear Channel

    that buying, though CC is the most commonly -

    seen name in this week's "Transaction Digest."

    CC picks up four stations in the Hudson Val- ley (ones it couldn't take lastyear), and adds stations in Beaumont, Parkersburg and Shamokin (PA). And Tele -Media begins what may be the process of unraveling the entire group by selling its four Albany, NY stations to Jim Morrell's Pamal Broadcasting and Ed Levine's Galaxy group. Overall, broker Larry Patrick says "the logjam may be breaking ", and

    that could be because potential sellers are getting more realistic about station -trading multiples. Brokers tell us one thing, here in late summer 2001: They're busy.

    WASHINGTON THIS WEEK Sayonara, Mass Media Bureau? There's serious talk that the FCC's Mass Media Bureau may vanish as part of a rumored scheme to consolidate the Bureau into the cable bureau, to form a new super - bureau. The FCC is already committed to streamlining its processes. and over the last decade. it has actually handled more business with fewer staffers. And based on a recent analysis M Street conducted of the time - lapse between filings and approval. the Mass Media Bureau and other offices seem to be cranking stuff out quite expeditiously. We expect to hear much more about the Mass Media Bureau at the NAB Radio Show - but some of it may be off the record. Grizzled MMB Chief Roy Stewart was fielding questions about the "merger" story at this month's Texas Association of Broadcasters convention in San Antonio.

    The FCC inspector started writing up violations at Radio One's Boston -market WBOT, Brockton (97.7)

    and didn't quit until the grand total was $21,500. The single biggest piece of that ticket was a $10.000 fine for failing to have a public inspection file at the main studio (a charge Radio One disputes). The rest of the fines include $8,000 for EAS equipment not installed (the FCC didn't like Radio One's excuses about shipping delays). $500 for not having a local toll -free phone number, after Radio One took over WBOT and moved the main studio from Brockton to Boston (Radio One didn't know it was a toll call). $2,000 for failing to have operating power logs. And $1.000 for failing to have station logs. Radio One didn't help itself by asking for leniency based on its clean record. The FCC's Boston office had earlier Found violations right there at WBOT.

    Better check the FCC's recent list of Low Power FM filings. The Commission just "accepted for filing" 232 new apps which is a long way from "granted ", of course. These LPFM apps are all from the January filing window, and are now subject to objections and petitions to deny. They're all viewable online. by city of license and frequency, at "FCC.gov."

    Following a lengthy FCC revocation process, the Mike Rice stations are in legal limbo. In fact they' re practically invisible to the Commission. Look up "WBOW" at "FCC.gov ", and it doesn't exist. The call letters aren't there and the technical facility has been deleted from the database, though the Terre Haute AM at 640 KHz is certainly on the air, and be- ing operated by Rice under (apparently) Public No- tice. Same for modern AC WZZQ Terre Haute (107.5), and for the Rice stations in Missouri licensed to Lake Broadcasting, such as KBMX, Eldon. Mean- while, Mike Rice tells M Street he's done his time and is fully qualified to get his eight revoked li- censes and permits back - under the FCC's own character policy. He's waging his fight on several lev- els: Rice's Contemporary Media is among the parties filing to be "interim operators" of the 8 stations and

    CPs in Indiana and Missouri that the FCC is threaten- ing to rip out of his control. He's also ready to file to be their permanent licensee. And Rice tells M Street he's just filed an Application for Review to stop the revocations themselves, though the process is very far along. Other applicants to be interim operators of the Rice stations: Missouri Indiana Broadcasting, LLC, and Indacom, Inc.

    There's still a battle -royal over streaming royalties - and the next legal move on streaming royalties is up to the six radio groups and the NAB. Bonneville, Cox. Emmis, Entercom. Infinity and Susquehanna lost a big round in Philadelphia, where U.S. District Court Judge Berle Schiller ruled against them in a suit which had been moved from New York City. What's next? The six groups, plaintiffs in the Philadelphia action, decide where to go from here, then consult with NAB executives in Washington. There's no timetable - except the ticking clock that could be piling up more back -royalties to be paid to labels once the streaming royalty rate is finally determined by a three -member panel. We'd be very surprised if this doesn't land back in the lap of Congress, where the NAB has friends.

    Time's running out to prepare the initial filing for the 350 -station FM Auction #37. The filing window for required Form 175 opens September 24 and closes October 5. This is the controversial auction that was abruptly bumped from May 9 back to December 5. About 350 CPs will be up for potential auction. depending on how the FCC juggles the appellate court decision about the bidding status of non -profits. Here are the rest of the key dates currently on the schedule: Up -front payments are due November 5 (one month before the auction). The mock auction is December 3 and - if all goes well - the auction itself commences on Wednesday, December 5.

    Pay up early, as a convenience but ifyou pay the FCC late, you fork over a 25% late fee. The FCC is allowing regulatory fees to be paid earlier than the normal "filing window', which is a nice surprise. The announced filing window for Fiscal Year 2001 is September 10- September 21, but thisyear the FCC's going to accept fee payments "at any time prior to this window." It's mailing public notices to licensees and permitees about the FY 2001 payments. Fees range from $250 for a class C AM facility serving under 20,000 population, up to $4.550 to a Class B, C, CI or C2 FM with more than 1,000,000 population served. A CP for a new FM station will setyou back $925. The FCC is also rolling out its new "FeeFiler" software, available online and a darn handy time -saver for licensees and permittees who are paying for multiple facilities.

    Trouble at Big City Radio: It may have to raise additional equity or re- structure its debt. Phrases like "These matters raise substantial doubt about the company's ability to continue as a going concern" will earn careful scrutiny at the SEC. Its actually a stock phrase, and Big City management says its working on solutions to the cash crisis. The problem: "Cash on hand is not sufficient to support the company's operations through December 31

    and its growth strategy. Nor is it sufficient to fund the $9.8M interest payment due on the notes [debt] on September 15." That's the big date that's looming on the calendar: the semi- annual interest payment on some pricy 11 -1/4% notes. It's due September 15 and must be paid

    in cash.

    Look for consolidation or operating agreements among independent syndicators. NBG's acquisition of Glenn Fisher's operation

    for $5.3M in July and the apparent sale of Las Vegas -based Talk America to somebody (identity still undisclosed) are just the beginning of this new phase in the business. One syndicator paints the picture in

    stark terms: "Premiere, Westwood

    and ABC are the big guys. The independents are now thinking about how to cooperate to compete with them." One name

    you can expect to hear in the Rumor Mill: New York -based United Stations Radio Network. It's got stability and also name recognition with veterans Nick Verbitsky and Dick Clark.

    Spring Arbitrons in eight markets are still on ice. Arbitron continues to embargo markets such as Cleveland, and it refuses to say why

    which baffles subscribers we've heard from.

    Arbitron says the reasons are not related to the recent contract imbroglios with Clear Channel and Citadel.

    Take your ears to New Orleans. and help out DAB developer iBiquity. In New Orleans. the DAB testers are looking for experienced professionals "who know what

    radio should sound like." A sidebar of the NAB will be the National Radio System Committee's

    scientifically- conducted "DAB Listening Test ",

    and they're looking for participants who are PDs, GMs, and engineers. The tests will last two hours. Check "NAB.org" for info and the sign -up sheet. The NRSC will forward all test results to the FCC, which will be considering an in -band standard for FM '. Digital Audio i I g U I T Y Broadcasting this °t s' Fall. Meanwhile, in

    a new filing with the NRSC, iBiquity says its new DAB system for FM beats analog and won't interfere with current FM signals. Bob Struble's team delivered results of 95,000 hours of field tests on 11 radio stations to the National Radio Systems Committee. Struble

    sounds confident the NRSC will recommend iBiquity's in -band Digital Audio Broadcasting solution to the FCC. He expects FCC authorization for digital FM (not AM) in early 2002, with a big launch of commercial DAB equipment at the Spring NAB in Las Vegas.

    That was no baby crying that was a PSA. There was a lot of wailing in Milwaukee at 7:20am on August 14: 50 straight seconds of a baby crying. followed by a PSA voiceover that said "No matter how much she cries, no matter how tired you are, no matter how frustratedyou get - never, ever shake a baby." Emergency room docs and nurses know that

    "shaken baby syndrome" affects thousands of children ayear. We salute the 18 stations in Milwaukee who agreed to air the "shaken baby"

    PSA at the same time. And kudos to the BVK ad agency for producing the spot and spreading

    the idea of a "roadblock" making sure that if you tuned away from this powerful message on one station,you ran into it somewhere else.

    It's a shoot -out between dueling country countdown shows. As veteran stars Lorianne

    Crook and Charlie Chase debut a new countdown show for

    United Stations on October 6, after leaving the fold at Jones. Over at Jones,

    its new Dallas Turner

    weekend GAC countdown show debuts over Labor Day Weekend. And contractually. Crook & Chase can't appear on United Stations until October 6 -7. They're offering stations a five-

    week gap -filling series of commercial -free shows hosted by country artists, but conspicuously devoid of Crook & Chase themselves.

    Prediction: Arbitron's new "National Database" product could trigger a new wave

    of ownership consolidation. In a nutshell: A group like Infinity or Entercom may need to acquire a group like Citadel or Cumulus. just to keep up with Clear Channel. Here's the

    thinking: Arbitron's national database (or "regional aggregation ") produces significant

    selling advantages for players with big regional

    footprints. They can go to a McDonald's franchise group and show ratings for an entire

    region or state. That's probably good for radio revenue, in the long run. But the company that

    reaps the most advantage from that approach

    will likely be Clear Channel. because it's got by far the most extensive national reach. (And we're not even talking about CC's radio -plus- outdoor reach.) Smaller companies could find themselves disadvantaged - not even aware there's a buy going down at the regional level.

    There's a new nighttime sex and relationship

    talkshow in syndication, as Fisher Entertainment picks up San Diego's "Love Soup." Glenn Fisher, now working for Portland, OR -based NBG Radio Network, says he's already lined up 11 charter affiliates. Those

    include Bob Kieve's KARA, San Jose. Emmis'

    KKLT, Phoenix, Emmis -owned WENS, Indianapolis, and Simmons -owned KQMB, Salt

    Lake City. Licensed clinical psychologist Dr.

    Lori Pollick hosts the show on KFMB -FM, San Diego. which debuted only last December.

    "Love Soup with Dr. Lori" airs on "Star 100.7" from 8 -IOpm Pacific, Monday -Thursday. Check

    out excerpts of the show at "HiStar.com."

    A Denver concert promoter says its David vs. Goliath. and he's suing Clear Channel for antitrust. Denver's "Nobody In Particular"

    filed suit in U.S. District Court, alleging that CC uses the vertical integration of its concert promotion business (the former SFX, now Clear Channel Entertainment) and its radio

    station alliance to keep artists from doing business with its local rival. The Denver Post

    says the promoter wants damages and a jury

    trial. CC Radio's Pam Taylor tells the L.A. Times "We play by the rules and we will vigorously defend ourselves against this."
