Venting Systems for Heat-Producing Appliances Supplemental Letter Ballot on NFPA 211 First Revision No. 11

(F2015 Cycle)

As a result of the Second Revision No. 7 failing ballot, the committee is being balloted on

the related First Revision No.11 to determine if support remains for the text of this First

Revision.

I am in support of the First Revision No. 11

11.1 Factory-Built Fireplaces. 11.1.1

Factory-built fireplaces shall be listed and installed in accordance with the terms of the listing and the manufacturer’s instructions . 11.1.2

Hearth extensions shall be provided in accordance with the manufacturers' manufacturer’s instructions or be of masonry on noncombustible construction in accordance with Section 11.3 . 11.1.3

Factory-built fireplaces shall be secured to the floor or structural framing of the building in order to prevent shifting. 11.1.4

Only listed decorative shrouds at the termination of a factory-built fireplace chimney shall be permitted. 11.1.5

Factory-built fireplace system accessories shall be one of the following: (1) Listed for use with the specific factory-built fireplace and installed in accordance with the terms of their listing (2) Acceptable to the AHJ and installed as approved and in accordance with the manufacturer’s installation instructions

EXPLANATION OF VOTE - An explanation must accompany a negative or abstaining vote. The proposed revision would restrict installation of accessories in a manner inconsistent with certification requirements for products such as gas logs and fireplace inserts. UL 127 provides specific provisions that allow for installation of decorative gas appliances and unvented fireplace inserts on a generic or “blanket” basis. NFPA 54 allows installation of decorative gas appliances (listed to ANSI Z21.60) as well as unlisted decorative gas appliances. These standards do not require evaluation of these “accessories” on a fireplace model specific basis. The proposed change would, therefore, result in conflicting requirements. It would also seem to require an AHJ's involvement in the use of simple accessories such as grates, andirons and decorative surrounds/mantels with no justification. While I understand the intent, the definition of “accessories” is, in my opinion, too broad and does not adequately distinguish between what I would consider to be “optional components” of the fireplace system and other accessories which have no effect on the fireplace safety certification. For example, a factory built fireplace tested and listed per UL 127 without an integral grate is tested with andirons (if higher temperatures result) and it is assumed that the user may use a grate or andirons in the field. Factory-Built Fireplaces that are certified with an integral grate are required to include a warning in instructions and on a label stating that the grate must only be replaced by the grate model specified by the manufacturer.

Committee Members on Chimneys, Fireplaces, and Venting Systems for Heat‐Producing Systems,  According to the attached results, the supplemental ballot on NFPA 211 Second Revision 7 has failed ballot. According to Section 4.4.10.2.1(a) of the Regulations Governing the Development of NFPA Standards, where a Second Revision that revised text that was proposed in a First Revision fails Ballot, a Supplementary Ballot shall be conducted to determine whether the Committee is in support of the related First Revision.  If the committee still supports the First Revision, it will be included into the Second Draft as a Second Revision. However, if the results of the Supplementary Ballot do not support the text from the First Revision, no text changes will be included in the Second Draft, and text will revert back to previous edition text if any. If there was no previous edition text, the new material will be deleted.
