Republic of the Philippines LUNGSOD NG PASAY, KALAKHANG MAYNILA Tanggapan ng Sangguniang Panlungsod Resolution No. 4935, Series of 2019 A RESOLUTION ADOPTING THE COASTAL AND SEA USE PLAN ("CSUP") OF THE CITY OF PASAY SUBJECT TO ALL APPLICABLE LAWS, RULES AND REGULATIONS ON THE MATTER Sponsored by: ALL MEMBERS OF TH SANGGUNIANG PANLUNGSOD WHEREAS, the Cityof Pasay ("City") is one of the smallest and most densely populated cities in the country, comprising only of nineteen (19) square kilometers, half of which territory i occupied by the Ninoy Aquino International Airport ("NAIA") from which it derives no revenue; WHEREAS,the City is besieged by acute land scarcity and congestion, as its population continues to grow, and business establishments expand; WHEREAS, to address the problem of urban congestion and land scarcity, the City has opted to utilize its municipal waters for reclamationin accordance with its social and economic priorities; WHEREAS, the City has embarked on a 360-ha and a 265-ha reclamation projects under joint venture agreements ("JVAs") with the private sector, to create new environment-friendly areas for mixed-use development, at no financial cost to the government. WHEREAS,based on the City's Environmental Impact Statement ("EIS") Report, as reviewed by DENR accredited technical expes, the project sites are outside any declared watershed, sanctuaries, protected areas and national historical landmarks and will not cause any displacement of fisherfolks, there being no corals, mangrove and significant marine life in the project site, making productive fishing completely non-existent. WHEREAS, based on the City's EIS Reports, as reviewed and approved by DENR technical experts, there are no informal settlers who will also be displaced as the existing coastal area of Pasay City (comprising of the CCP- MOA Complex) are completely free from any informal settlers. WHEREAS, the City fully suppos the Manila Bay Rehabilitation which the President launched with the creationin January 2019 of the Presidential Task Force to through Administrative Order No. 16 (S-2019), to finally execute the Supreme Court Writ of Continuing Mandamus to clean up, rehabilitate and preserve Manila Bay issued in MMDA v. Conceed Residents of Manila Bay, (G.R. Nos. 171947-48, December 18, 2008) ("Mandamus Case") and accordingly, implement the Operational Plan for the Manila Bay Coastal Strategy --the cleanup of Manila Bay being indispensable to the success of the City's reclamation projects. WHEREAS,in its letter to DENR Secretary Roy Cimatu and the House Committee on Metro Manila Development, the City emphasized that the City's reclamation projects will in fact hasten the rehabilitation of Manila Bay as the initial phase of the projects involves dredging thousands of metric tons of wastes from Manila Bay's seabed, and improve its overall water quality and marine life, at zero financial cost to the government. 1
