The effect of this is that applications coming in now will be processed before the applications of families who have already been waiting for five and six months. Deputy Ó Snodaigh said every effort must be made to ensure all applicants are processed and paid before Christmas. He said that “Due to the failure of the government to properly resource the Department of Social Protection, application processing times have become inexcusably long across a range of social welfare schemes. This leaves families in desperate situations. It forces them to go into arrears on their household bills and leaves them at risk of energy disconnections, eviction and at the mercy of money-lenders. It is leaving families hungry as evidenced by the rise in food poverty. Family Income Support is one such scheme in which a growing back-log of applications has been building up over the last six months in particular. “These processing times are also a source of embarrassment for the government. And I suspect it is this embarrassment coupled with a desire to defer as many back-payments as possible until the next budgetary cycle that has prompted the minister to make a grossly unfair and fiS MUST be Paid bY ChRiSTMaS cynical decision. “I understand that the minister, along with senior officials, has taken a decision to instruct the Family Income Support section of the department to only process applications received on or after November 5th. The effect of this is that applications coming in now will be processed before the applications of families who have already been waiting for five and six months. Dublin Sinn Féin Cllr. Mícheál Mac Donncha,commenting on the news that greyhoud Waste hasbeen found, for the third time this year, to haveillegally stored waste on a farm, stated that“greyhound Waste has been found illegally storingwaste on two farms in County Kildare during thesummer and now again on another farm in CountyDublin. This is the company to which Dublin CityCouncil management sold the waste collectionservice for Dublin City last January, despite severalvotes by the elected councillors against such a

move.“Now 7,000 tonnes of waste collected bygreyhound has been found illegally stored on threefarms during the course of 2012. once again thishighlights the disaster of waste privatisation, withwaste collection and disposal in the City of Dublinnow in the hands of a company with a badenvironmental record.“Citizens are paying more not only for a poorerservice but also for one which cannot be trustedto dispose of waste safely and legally.”

Walsh said that ‘Duringthe course of theChildren’s referendumcampaign I noticedoutside one of thechurches in the DublinSouth West areasomeone collecting fora charity based inlimerick. He had withhim what seemed alegitimate laminatedpermit with thecharity’s name on it

however when I madefurther enquiries to thegardaí later on theyconfirmed that thoughthe charity organisationwas genuine they hadappointed no collectorsin Dublin thatweekend.’ Walsh says‘It would appear thatthe permit wasphotocopied and usedfraudulently’.Walsh continued ‘this isa good time for charitycollections and it is tobe hoped that peoplewill respond as well asthey can to Christmasappeals, however Doorto Door collectionsshould be viewed withsuspicion; charities youhave never heard of

Cllr. William lavelle, local councillor for lucan hasreiterated his call for installation of a children’splay area at Hermitage Park, at a safe locationsuitable to local residents.

At the June 2012 County Council meetingcouncillors approved a proposed new Play Policy.In response to this lavelle called for installation ofa children’s play area at Hermitage Park. lavellehas now tabled a motion for the next lucan AreaCommittee meeting “requesting the Manager toprepare plans for installation of a new children’splay area at Hermitage Park; and to seek fundingfor installation in 2013."

“We all know that play is vitally important forchildren’s development, health and wellbeing.lucan’s existing playgrounds at griffeen valleyPark and Adamstown are incredibly popular. Butgiven that lucan now has a population similar toWaterford City, I believe we deserve additionalplayground provision. To ensure a goodgeographical dispersal of playgrounds I believe thatHermitage Park, in particular the newer part of thepark between Ballyowen lane & Mount Andrewestate would make an appropriate location for anew playground to service the large population inthe east lucan and Ballyowen area.” lavelleconcluded

Dublin South West TD,Seán Crowe, has calledon the government toprotect familiesreceiving a rentsupplement, or it willdirectly lead to morepeople losing a roofover their heads.Crowe’s commentsfollow the release of areport from Focus

Ireland on the rentsupplement scheme.Deputy Crowe said:“People areincreasingly strugglingunder thegovernment’s austeritypolicies and many arealready at risk of losingtheir home. In the pastthree years rentsupplements have been

cut by an average of28%. Any further cuts inthe rent supplementscheme will literallyforce people out oftheir accommodation.

“The currentgovernment’s policiesof cut-throat austerityhave already pushedmany families and

households to the brinkof homelessness. If theupcoming Budget failsto protect peoplestruggling on lowincomes or dependenton welfare, there willbe a massive increase inthe number ofhouseholds that are atrisk of losing theiraccommodation. This

personal insolvency arrangements

A Personal Insolvency Arrangement (PIA)applies to secured and unsecured debt andincludes loans secured on properties bymortgage. This is the innovative aspect ofthe legislation and is principally designedto create an environment whereby dealsare done which do not involve vacating theFamily Home. Again, the idea behind thePIA is that a Debtor will approachCreditors, both secured and non-secured,with a proposal. That proposal can be inany format and can involve elementssimilar to the DSA. It will be done througha PIP who will have conducted a fullfinancial analysis on the Debtor. Theultimate aim of the PIA is that within 6years, the Debtor would have returned tosolvency and the key to the PIA is that theDebtor would retain ownership of theFamily Home. A Personal InsolvencyArrangement cannot inVolVe theDiSpoSal or Sale of a family home,

except in certain DefineDcircUmStanceS. The Act is clear. everyeffort must be made to secure the FamilyHome. Inevitably, that will involve thewriting down of the debt to affordablelevels. The restructure can includechanges in the amount, split mortgages,term extensions and changes in theinterest rates. In short, the Act mandatesthe parties to be inventive in coming to along term financial restructuring, allowingthe Borrower to remain in their home andmeet those debts they can reasonablyafford.

The PIA should last for no longer than 6years and should result in the ultimatesolvency of the Debtor. The Act providesa non-exhaustive list of the types ofarrangements considered and includes: -

a) That the Debtor pay interest fora period not exceeding the time of thearrangement;

b) That the term of the loan beextended;

c) That payments be deferred for aperiod not exceeding the time of thearrangement;

d) Interest rate alteration;

e) Debt for equity swap;

f) Debt write-off subject torecovery in the event of future sale ofassets;

g) Capitalisation of arrears;

h) Debt reduction;

In many case, a PIA will involve acombination of secured and unsecureddebt and will therefore have elements ofa DSA.

what happens if creditors refuse tocooperate?

Anybody is entitled to propose a DSA orPIA once they meet the criteria ofinsolvency. However, Creditors can rejectthe proposal. In most cases, there will beone or maybe two major Creditors who,because of the size of the debts, will havean effective veto power. If the Creditorsreject the proposal, the InsolvencyProcess is at an end. The Debtor can then

In thisedition, we will deal with PersonalInsolvency Arrangements (PIA) and howit might help people trying to cope withhigh levels of debt.

Readers are reminded to read the articlein the last edition to fully understandthis proposed new legislation and how itmight help them.

if we assume the Debtor does notapply for bankruptcy then whathappens?

Creditors are then entitled to pursueJudgment and or gain possession of thesecured assets and/or apply tobankrupt the Debtor but in each case,it will require application to the Court.To begin with where a Creditorunreasonably refuses a proposal for aPIA or DSA, the Court can arguablyfrustrate an application by theCreditor to bankrupt the Debtor. Thenew laws provide that beforeadjudicating a Debtor bankrupt on footof a petition presented by a Creditor,a Court is required to consider theassets and liabilities of the Debtor andassess whether it may be appropriateto adjourn proceedings to allow theDebtor to enter into sucharrangements as is specified by theCourt in adjourning the hearing. Thispower given the Court might well beunderstood to mean that the Courtwill, in effect, be able to indirectlyforce a settlement arrangementand/or Personal Insolvencyarrangement and to refuse bankruptcyif the Creditors unreasonably refuse toaccept proposals. Furthermore, therewill be legal costs implications forCreditors who have unreasonablyrefused to accept proposals made inconnection with a proposal for a DSAor PIA. In other words, they may haveto pay their own costs, in which casethe process of bankruptcy becomes anexpensive one for the Creditor andpotentially hugely expensive if theproceedings are to be adjourned againand again, with banks having little ornothing to show for it in the end. But,most importantly, the Debtor is nowentitled, once the Creditors veto theproposals, to apply to bankrupthimself. once bankrupt, the Debtorwill emerge from the process Debtfree after three yearS andCreditors who veto proposals facegetting far less than under a DSA or PIAand, in many cases, they will getnothing at all. During the period ofBankruptcy, the Debtor will, in manycases, be able to retain their FamilyHome. As a matter of law, a FamilyHome cannot be disposed of under

Bankruptcy unless a Court agrees.

is a court going to agree to the sale offamily home where the creditor hadunreasonably refused a pia?

Furthermore, the Debtor is entitled toretain what are described as “reasonableliving expenses”. These will, in manycases, mean that there is nothing left forthe Creditor. So, on a day-to-day basis,life goes on normally for the Debtor. Thedifference of course is that there is a lightat the end of the tunnel. This is the keyto the legislation. Currently, as it nowstands, Debtors have no cards to play.They can go into Bankruptcy but they maynever emerge. under the new legislation,they will emerge debt free in a maximumof three years. In the meantime, most cansimply get on with their lives. Any stigmaassociated with Bankruptcy has long sincegone.

you might ask, what happens if thecreditor vetoes the bankruptcy proposaland then seeks possession of the familyhome?

If a Creditor seeks to repossess a FamilyHome, having refused a fair andreasonable offer of a PIA, there should beconsequences. It must be ordered that theCourt should adjourn to allow furtherproposals or adaptations of proposals. Allthis will come at a big cost to the Bankswhich may impose some level of commonsense.

In short, the new legislation provides greathope for Borrowers. It provides for abenign Bankruptcy regime and includes theCourt in the mix so that the Banks will nolonger be free to dictate the terms of theBankruptcy. once the message goes out tothe Banks that the objectives of the Actwill be meet, they will begin to accept andimplement the arrangements that arenecessary and the process of personalrecovery for many borrowers can begin.

The Irish DentalAssociation has calledon the government toensure that apercentage of anyrevenue raised througha proposed 'sugar tax'on soft drinks should gotowards an oralhealthcare programme.The IDA said that due tothe negative effectwhich the consumptionof soft drinks have ondental health and thecutbacks which thecountry's two maindental schemes havesuffered, it was logicalthat a proportion of anymonies raised should beallocated to dentalhealth.The IDA said the

From a dentalperspective it is clearthat a reduction in thefrequency and volumeof intake of any sugarydrink or food may helpin reducing the risk ofdental caries. As sugarsweetened beveragesare poor in nutrients,recommendations tolimit their intake wouldgenerally appear to beimportant for thepromotion of goodnutrition. What is clearis that we need toreduce our consumptionof all sugary drinks.. Soreducing consumption isnot the issue, findingthe best way to achieve

“1 in 14 Irish homeshave high radon levels.In the vast majority ofthese homes theoccupants are unawarethat they are living withsuch a serious health

risk and because theyare unaware of theproblem, they can’tprotect themselves,”according to Dr AnnMcgarry, Chiefexecutive of the RPII.“one person every twodays dies from a radoninduced lung cancer.over the past decadeup to 2000 people inthis country have diedfrom this preventablehealth problem. Thestarting point is forpeople to test theirhome for radon andwhere high levels are

found, to reduce thoselevels. Radon is only aproblem if it isignored,” Dr Mcgarrysaid.The RPII ran acomprehensiveinformation campaignin Wexford to raiseawareness of the gasand to encouragepeople to test theirhomes. In the past twoyears the RPII hasundertaken six of thesecampaigns in Sligo,Carlow, Waterford,galway, SouthTipperary and Kerry –

all high radon counties. Radon has beenclassified by theInternational Agency forResearch on Cancer, apart of the WorldHealth organisation, asa group 1 carcinogen.This places radon in thesame group ofcarcinogens as asbestosand tobacco smoke as acause of lung cancer.Ireland has some of thehighest radon levels inhomes found in europe.Based on currentknowledge, it isestimated that inIreland, for thepopulation as a whole,a lifetime exposure(i.e. 70 years) to radonin the home at the

national Referencelevel carries a risk ofabout 1 in 50 ofcontracting fatal lungcancer. This isapproximately twicethe risk of death in aroad accident.Testing your home forradon gas is easy. Thetest involves two radondetectors being placedin your home, one in abedroom and a secondin a living room for athree-month period.The detectors are sentand returned by postfor analysis. A numberof service providersprovide a radonmeasurement service.The cost of ameasurement is around

€50 depending on whichservice provider ischosen and includespostage.If radon reduction isrequired there are twostraightforwardmethods commonlyused. If a moderateradon level is found,improving indoorventilation may besufficient and the costof this is relatively low.If higher levels arefound, a fan assistedsump can be installedwhich can reduce radonlevels by over 90%. Burglary statistics compiled over the pastfew years enable us to forecast that duringthe next four weeks more that one thousandtwo hundred (1200) burglaries are likely tooccur in the greater Dublin area. It is alsopossible to forecast that in more than sixhundred of these incidents, the burglar willlikely gain entry through a front or backentrance door.

The entrance door was originally createdmany centuries ago to provide security andto keep the weather at bay. With increasingfuel costs the onus in recent decades hasbeen on rendering these doors thermallyefficient. While this has been an excellentdevelopment and helped us save on fuelbills, unfortunately during the same periodmost door manufacturers have lost sight ofthe need to ensure that the door is strongenough to keep intruders out. Therefore,while we have gained much in terms ofthermal efficiency the reality is that duringthe past twenty years most front and backentrance doors (particularly upvc doors)installed in Ireland, are not strong enough

to stop an aggressive burglar.

The good news is that we are now beginningto see some door manufacturers actingresponsibly and starting to produce doorswhere security is given the consideration itdeserves. Dublin South West TD, Seán Crowe, haswelcomed the launch of the Tallaght basedChildhood Development Initiative (CDI)report and believes that the positive workand additional supports CDI offer need to bereplicated in communities that are beingheld back by disadvantage, right across theState.Deputy Sean Crowe said:"I want to welcome and support the callfrom the Tallaght-based ChildhoodDevelopment Initiative (CDI) for theestablishment of an early interventionspeech and language therapy service indisadvantaged areas."The evidence based CDI report shows thatearly intervention services helps reducedisadvantage in pre-school children beforethey begin their formal education."The report bases its findings on a pilotearly intervention scheme that has vastlyimproved educational outcomes forchildren in Tallaght West since 2007 and wasindependently evaluated by the Centre forSocial and educational Research at DublinInstitute of Technology."This ground-breaking service has providedtherapeutic support to 157 children. Thechildren were identified as struggling tocope with educational matters and fallingbehind their classmates in terms ofeducational development."of the 157 children involved in the study,18 per cent were discharged as their skillshad improved to a normal standard after aperiod of support. If it wasn’t for thetherapeutic support of CDI these childrenwould probably still be struggling to copeand remain behind their peers.

"The government needs to take notice ofthese impressive outcomes, and use theglaringly obvious evidence contained in thisreport, when planning for the future.“It is a well-established fact that speechand language development can be of hugeconcern in disadvantaged areas, and if thisis not addressed by the time these childrenstart primary school, it will cause lifelongdifficulties in their literacy and learningabilities.“As well as the development of dedicatedservices for disadvantaged communities,the report also recommends that all earlyyears practitioners, teachers, and relatedprofessionals, receive appropriate trainingin speech and language development."The report also highlights the vitallyimportant roles parents can and do play.educating parents on the need for and valueof speech and language therapy is vital topromoting attendance at speech andlanguage services. Services should also beresponsible for ensuring that parents areappropriately informed and involved intheir child’s therapy process."one parent at the launch said that her 2year old son only had a range of about 20words before he started speech andlanguage therapy, but the slow painstakingwork had now transformed him and made amuch happier and confident child."This is a good news story and shows theneed for CDI projects to be replicated androlled out right across the country. Thesystems identified in this report work andshould be used to transform and ignite thehuge potential that these young childrenclearly have."

MePs have voted in favour ofsupervisory rules governingshale oil and gas extractionin the eu.Two reports passed at theplenary session of theeuropean Parliament thisweek called for fracking tobe supervised, and for eugovernments to exercisecaution about allowing theexploitation ofunconventional fossil fuels,pending further analysis ofwhether full-scale regulationis appropriate.MePs said a “robustregulatory regime” wasneeded for all shale gasactivities, includinghydraulic fracturing, andthat environmentallyfriendly processes and bestavailable techniques shouldbe used to achieve thehighest safety standards.However the Parliamentdecided to vote down anamendment urging memberstates not to authorise anynew fracking operations inthe eu.Indepdent MeP Marian

Socialist MeP Paul Murphyhas hit back at criticism overa letter sent to Taoiseachenda Kenny this week callingon the government to allowabortion in Ireland.Mr Murphy and 52 otherMePs signed the letterdescribing the recent deathof Savita Halappanavar as a“tragedy which highlightsthe need for immediateaction to introducelegislation for abortion inIreland”.

He was the only Irish MeP toput his name to the letter, orto take part in a protest atthe european Parliament inStrasbourg, one of hundredsacross the world whichbrought Ireland's lack ofabortion legislation underthe international spotlight.Irish labour MeP PhilPrendergast criticised theletter, although supportingthe labour Pary position infavour of legislating forabortion in line with theSupreme Court ruling on the'x' case.The MeP, who worked as amidwife for many years,accused Mr Murphy of usingthe “awful tragedy” ofSavita's death to pursue anagenda, which she claimsought to be a separate issue.Ms Prendergast alsorubbished the claim made byMr Murphy and others thatSavita died because doctorsrefused to terminate herpregnancy for religous orlegal reasons.“I've worked in front lineservices for years. Ifsomeone comes in with aninevitable abortion, thematter is dealt with, usually

by immediate evacuation ofthe product of conception.The woman's life issacrosanct.
