INTRODUCTION

The Annual Report of the Louisiana State Board of Nursing, for the year beginning January 1, 2007 and ending December 31, 2007, was prepared in accordance with LA R.S. 37:911 et seq., particularly LA R.S. 37:918.10, which provides that the Board shall “publish an annual report for distribution to the Governor and Legislature.” The purpose of this report is to present data on the activities of the Board and to provide data relative to the registered nurse population in Louisiana. In 2007, the Board of Nursing met a total of eight (8) days in Board meetings, including four (4) days of open business sessions and four (4) days of closed disciplinary sessions. Further, the Board met a total of four (4) days in committee meetings, that included four (4) days Administrative Committee meetings, four (4) days Credentialing Committee meetings, four (4) days Education Committee meetings, three (3) days Compliance Committee meetings, and four (4) days Practice Committee meetings. In addition, the Board met a total of two (2) days in Advisory Council meetings and one (1) day in a subcommittee meeting. The actions taken at these meetings are reported among the activities of the Board. This report also presents the current organization of the Board of Nursing as well as the goals and objectives of the Board and the significant activities of the professional staff. Statistical data regarding the admission, enrollment and graduation data from the Board-approved nursing education programs is presented in tabulated form for each reference. Statistical data depicting the characteristics of the licensee population is included. The 2007 Annual Report contains objective data that can be used in planning and decision-making relative to professional nursing in Louisiana.

STRATEGIC PLAN FOR 2007 TO 2010

MISSION STATEMENT

To safeguard the life and health of the citizens of Louisiana by assuring persons practicing as registered nurses and advanced practice registered nurses are competent and safe.

GOALS AND OBJECTIVES Goal I: Promote regulatory effectiveness. Objectives: 1. Identify performance indicators for each major function, incorporating national

benchmarking: licensing (RN & APRN); approval of educational programs; practice standards; compliance processes; and Recovery Nurse Program.

2. Develop and implement tools for measuring performance and continuous quality

improvement. 3. Develop business continuation/disaster plan. 3. Collect and analyze the criminal background data on student nurses to evaluate the

regulatory effectiveness of jurisdiction over student nurses. 4. Provide guidance and consistency to nursing schools regarding the denial of students

entering clinicals. 5. Establish permanent headquarters in Baton Rouge metropolitan area to promote

regulatory effectiveness that meets staff and board needs. 6. Recruit qualified staff to fill vacancy. Goal II: Assure efficient and timely responses to nursing issues affecting patient safety. 1. Develop and implement tools to facilitate investigative process and establish better staff

workloads.

2. Revise policy regarding delay/denial of licensure enhancing the disciplinary process and student nurses. 3. Evaluate the remote placement of Regional Managers.

4. Provide presentations to undergraduate and graduate students in nursing programs and licensees.

3. Collaborate with the Board of Regents and LPN board to expand the nursing programs in

order to alleviate the nursing shortage crisis that exists in Louisiana as mandated by SCR 134.

Goal IV: Identify and regulate evolving role of the registered nurse and advanced practice registered nurse as a professional while protecting the public.

1. Monitor the emerging roles of APRNs.

2. Identify critical data related to the accessibility of properly prepared registered nurses and advanced practice registered nurses and work collectively with nursing organizations, healthcare providers, and other regulatory agencies to resolve needs.

3. Continue to develop consumer information section on website, and more timely updates

to the website.

Goal V: Facilitate board and staff development.

1. Support the continuous development of board and staff. 2. Support and embrace the strategic plan.

3. Establish mechanisms for improving internal communications.

MAJOR MOTIONS AND OTHER ACTIONS OF THE BOARD IN 2007

ADMINISTRATIVE ISSUES: Adopted a resolution that the Executive Director can sign checks or in her absence, any two of the following directors: Thania Elliott, Elaine Vallette or Peggy Griener. Approved charging the verification fee of $25.00 for public document requests for non-governmental entities. Approved Imagenow proposal and recommended further negotiations for the implementation of document management, imaging, and work flow technology for LSBN. Approved to direct board staff to implement the distribution of “The Examiner” via electronic format to all licensees for whom the board has email addresses. Approved budget adjustments for Fiscal Year July 1, 2006- June 30, 2007. Adopted and signed the Louisiana Compliance Questionnaire for audit engagements of government entities. Accepted the Vice-President’s Report and First Quarter Financial Statement Report for (July 1, 2007 – September 30, 2007). Accepted the Executive Director’s Report and First Quarter (July 1, 2007 – September 30, 2007). Granted proposed Amendments to 2007 – 2008 budget. Approved proposed 2008 – 2009 Fiscal Budget. Accepted the 2008 Louisiana State Board of Nursing Meeting Dates. Approved proposed revisions to Rule LAC 46:XLVII.3335 Continuing Education.

CREDENTIALING ISSUES: Approved Board staff to initiate the rulemaking process for the change of rules in Chapter 45 (Advanced Practice), specifically the rule requirement for 500 clinical hours for initial prescriptive authority as written in the presented draft for rule change.

Approved the Hospice and Palliative Nurse certification from the National Board for Certification of Hospice and Palliative Nurses (NBCHPN) as a Louisiana State Board of Nursing (LSBN) approved Continuing Education requirement. Approved Credentialing Committee’s recommendation to the Board to direct staff to initiate rule-making and change for the 1st offense for continuing education non-compliance of annual license renewal to be an informal reprimand. Approved to direct Board staff to gather the following information about reinstatement statistics to present at the October 2007 Credentialing Committee:

• Total number of reinstatement nursing licenses issued in 2006 for applicants who had not worked in nursing for 5 years or more.

• Of that total number, how many completed only the 60 contact hour, and how many completed an RN Refresher Course.

• Provide a count of the number of inquiries received from nurses asking about reinstatement of their Louisianan license who have been inactive or delinquent for 5- years or more that have not been practicing/working in nursing elsewhere.

• Furthermore, the committee directs Ms. Morvant, Ms Griener and Dr. Vallette to meet and review the current rules regarding continuing education requirements for reinstatement and make recommendations at the next Credentialing Committee meeting.

Accepted the Credentialing Committee’s recommendations to the Board approval of the certification by the Pediatric Nursing Certification Board (PNCB) for the APRN role of Certified Pediatric Nurse Practitioner – Acute Care (CPNP-AC) and for the Louisiana State Board of Nursing to recognize and license nurse applicants applying for the specialty.

EDUCATION ISSUES: Accepted the site visit report and full approval of the baccalaureate program at the University of Louisiana at Lafayette with the following commendations:

1. Commend the ULL Department of Nursing for achievement of the NLN Center of Excellence in Nursing Education designation.

2. Commend the faculty for strong community relationships 3. Commend the faculty and program for successful implementation of major

curriculum revisions and institution of creative curriculum options to meet community needs.

Approved that LSU Health Sciences Center’s RN to MSN program be recognized as equivalent to a BSN and a MSN and the BSN equivalency is reflected on the transcript.

Accepted the ANNUAL REPORT and continue full approval of the diploma program in nursing at Baton Rouge General Medical Center. Accepted the ANNUAL REPORT and continue full approval of the associate degree in nursing program at Delgado Community College/Charity School of Nursing. Accepted the ANNUAL REPORT and continue full approval of the associate degree in nursing program at Louisiana State University at Alexandria. Accepted the ANNUAL REPORT and continue full approval of the associate degree in nursing program at Louisiana State University at Eunice. Accepted the ANNUAL REPORT and continue full approval of the associate degree in nursing program at Louisiana Tech University and recommend they seek to add a masters in psych/mental health nursing prepared faculty. Accepted the ANNUAL REPORT from the associate degree in nursing program at Nicholls State University, continue full approval, and commend them for 100% NCLEX-RN pass rate. Accepted the ANNUAL REPORT and continue full approval of the associate degree in nursing program at McNeese State University and notify LSBN when NLNAC acts on accreditation.

SUMMARY REPORT OF NURSING COMPLIANCE ACTIVITIES - 2007

In 2007, during four (4) scheduled formal disciplinary hearings, the Board heard 383 disciplinary cases during closed Board Hearings. These cases involved: formal complaints against licensees, applicants or students; reinstatement requests from licensees with suspended licenses; consent agreements; ratification of staff actions for automatic/summary suspensions, denial/delay of licensure or students for clinical nursing courses, and review of Settlement Orders. During 2007, the disciplinary section received 1212 complaints against registered nurses, registered nurse applicants, or students requiring preliminary investigation. Not counted as complaints are anonymous letters and telephone calls received each month which involve disciplinary matters, but which fail to produce sufficient evidence to begin an investigation. The types of complaints received during 2007 against nurses or applicants were: PERCENTAGE TYPES OF COMPLAINTS

After investigating the various complaints and based on the information received, a total of three hundred ninety-eight (364) disciplinary actions were taken. Of this number, a total of one hundred sixteen (116) students or applicants for NCLEX-RN came before the Board, primarily to respond to prior criminal convictions. During this year, a total of thirty-four (34) individuals requested reinstatement of suspended licenses. Of these, twenty-six (26) licenses were reinstated, four (4) delay/denied and four (4) granted “inactive”. Also during the year, 1103 investigations were closed without formal disciplinary action.

SUMMARY REPORT ON RENEWAL OF LICENSEES WITH DEFAULTED STUDENT LOANS

In accordance with Louisiana Revised Statute 38:2951, the Louisiana State Board of Nursing withheld the 2008 licensure renewals on thirty-seven (37) registered nurses who were deemed by the Louisiana Office of Student Financial Assistance (LOSFA) to be in default of a student loan. Certified letters were mailed notifying these registered nurses that their 2008 renewal could not be processed until the Board received notification from LOSFA that payment arrangements had been made. As of February 6, 2008, twenty-eight (28) of the thirty-seven (37) individuals had complied with LOSFA and were permitted to seek licensure renewal. One (1) nurse of the remaining nine (9) had her license suspended for non-compliance, and the remaining eight (8) were placed on a delinquent licensure status and were not able to practice as a registered nurse in Louisiana.

SUMMARY REPORT ON RELICENSURE AUDIT

In accordance with LAC 46:XLVII.3335.I.2, the Louisiana State Board of Nursing performed an audit on the continuing educational requirements for 2007 license renewal on one-thousand-two-hundred-twenty-six (1226) registered nurses. Letters were mailed to these nurses advising that they had been selected for the random audit. Of the one-thousand-two-hundred-twenty-six (1226) registered nurses selected, one-thousand-one-hundred-thirty-five (1135) were compliant. Ninety-one (91) nurses were non-compliant with the following breakdown:

- Sixteen (16) signed Consent Orders for audit non-compliance - Ten (10) nurses went Inactive - Twelve (12) submitted explanation and given 30 days to complete CEs and met

that deadline - Forty-eight (48) provided written explanation for cause in not meeting audit and

waived - Two (2) had already been disciplined for other cause - Two (2) were deceased - One (1) retired

In accordance with LAC 46:XLVII.4513.D.5, the Louisiana State Board of Nursing performed an audit on the continuing competency for prescriptive authority for 2007 license renewal on thirty (30) advanced practice nurses. Letters were mailed to these nurses advising they had been selected to audit the additional hours of pharmacology needed for their prescriptive authority privileges. All thirty (30) APRNs were compliant.

NURSING EDUCATION ARTICULATION IN LOUISIANA

The Louisiana Nursing Articulation Model was developed in 2005 to assure that Louisiana programs in nursing were providing opportunities for articulation for the Louisiana nurse population. The model has been adopted by both regulatory boards of nursing and is in place in all programs preparing for RN licensure. In 2006, there were five hundred eighty-four (584) licensed practical nurses enrolled in programs preparing for RN licensure and there were two hundred forty (240) RNs enrolled who were seeking baccalaureate degrees. The model is comprehensive and is consistent with trends throughout the United States. The model is as follows:

Louisiana Nursing Education Articulation Model Overview: Through Act 818 of the 1991 Louisiana Legislature, the Nursing Supply and Demand Commission (NSDC) was established and charged, in part, with the responsibility of developing an articulation model that was organized and integrated in such a fashion to permit the maximum amount of prior training to be credited against the requirements of any subsequent nursing education program(s). This plan was to include nursing assistant through the baccalaureate degree in nursing. To this end, the NSDC adopted an articulation model in 1993 entitled Articulation Plan for Nursing in Louisiana and presented the report to the Joint Legislative Committee on Health and Welfare on April 6, 1993. Through this legislation, the nursing boards were charged with review of standards and action necessary to implement the articulated curricula required. In addition, there was a charge to the Board of Regents and other education management boards relative to implementation of the plan. That model did and continues to enhance upward mobility in nursing education within Louisiana. The enclosed document reflects a refinement and update of that model. Revisions are proposed to augment the progression of individuals through all levels of nursing education from nursing assistant to registered nurse. The revisions allow for:

• Streamlining of the current process of awarding transfer and advanced placement credit at all levels

• Continuity across programs in the process of awarding transfer and advanced placement nursing credit

• Greater ease in the transfer process for students • Ease in awarding transfer and advanced placement credit for the educational

institution • A decrease in the time it takes a student to graduate, which addresses also, the

current health care personnel shortages

The revisions bring the model in line with national trends and also make it consistent with national articulation models.

Definition:

• Articulation is defined as a process through which academic programs facilitate the educational progress with minimal loss of credit and duplication of knowledge and skills.

Goals:

• To facilitate the educational mobility of nursing personnel across the state • To increase the nursing health care workforce • To provide seamless progression in nursing education • To meet the educational needs of the citizens of Louisiana • To assure a qualified healthcare workforce that meets the health care needs of the

state Assumptions:

• There is a common core of knowledge, attitudes, cognitive and psychomotor skills that graduates of all three types of nursing programs should acquire; however, there are distinct differences in the breadth, depth, scope of preparation and knowledge of each type of graduate1

• Not every individual wishes to seek credentials at the next practice level, however, the opportunity for academic progression should be available for those that wish to do so

• Clinical experiences at each level contribute to the overall knowledge base • Public awareness of articulation initiatives is critical to their success • Adherence to Board of Regents transfer matrix for general education courses is

occurring at all public post-secondary educational institutions in the state

Implementation Standards: • Each school must have autonomy to set admission/progression/graduation

requirements • Nursing programs in practical, associate and baccalaureate degree programs must

meet standards determined by the Louisiana State Board of Practical Nurse Examiners or Louisiana State Board of Nursing

• All graduates must meet minimum program and curriculum standards • Any articulation plan must maintain professional standards and promote quality

instruction • Articulation plans must adhere to the standards of higher education regulatory

boards • Articulation is a mandatory process for all nursing education programs in

Louisiana • Adequate faculty and clinical practice facilities are available to support the

program

General Expectations Of All Students: • Student must meet admission requirements of the

University/College/School/Technical Program • Student must meet all prerequisite and/or general education core requirements • Student must be a graduate of a Certified Nursing Assistant Program, approved

Practical Nurse program or an accredited Diploma or Associate degree program in nursing

• Student must be certified as a nursing assistant or licensed as a practical nurse or a registered nurse in Louisiana

Articulation Plan Nursing Assistants to LPN

Practical Nursing programs will award a minimum of 3 semester credit hours or the equivalent to a certified nursing assistant upon validation of clinical competencies.

• Must meet admission requirements for the program • Must be certified as a nursing assistant in Louisiana • Competency testing may be required • Work experience may be required

LPN to RN (Associate Degree in Nursing)

A minimum of 12 semester credit hours of nursing credit will be awarded to Licensed Practical Nurses entering an Associate Degree Nursing Program in Louisiana after completion of any general education, prerequisite, and transitional course requirements.

• Must meet admission requirements of the University/College/School

• Must have completed general education/prerequisite coursework

• Must be a graduate of an approved LPN Program • Must hold an unencumbered license as a practical nurse in

the State of Louisiana • Competency testing/credit examinations may be required. • Work experience may be required

Once admitted to the professional component of the program, this program can typically be completed in one year of full time continuous study. LPN to RN (Baccalaureate Degree in Nursing)

diploma-nursing program • Must hold an unencumbered license as a registered nurse in

Louisiana • Work experience may be required • Competency testing may be required

Once admitted to the professional component of the program, this program can typically be completed in one year of full time continuous study. Additional Notes: Institutions will follow Institutional policy relative to the age of coursework being transferred. All public institutions must follow the Board of Regents Transfer Matrix for transfer of General Education Courses. The Louisiana State Board of Nursing and the Louisiana State Board of Practical Nurse Examiners will take action to allow for full implementation of the Louisiana Nursing Education Articulation Model by Fall 2005. The Louisiana Nursing Education Articulation Model will be implemented fully for all new students entering in Fall 2005. The Louisiana State Board of Nursing and the Louisiana State Board of Practical Nurse Examiners are charged with assuring compliance in implementation of and ongoing utilization of the Louisiana Nursing Education Articulation Model and will report annually to appropriate official public agencies through the annual reports of the respective Boards.

Of this number 2,140 individuals were licensed. There were 2,007 graduates from 23 nursing programs in Louisiana who tested for the first time during 2007. Of this number, 1,753 were licensed; thereby, achieving an 87.34 percent pass rate for first time candidates from nursing programs in Louisiana. This is above the national average of 85.47 percent. INDIVIDUALS REVIEWED BY THE BOARD DUE TO CRIMINAL ARREST/CHARGES, ADDICTION, IMPAIRMENT OR PRIOR DISCIPINARY ACTION GRADUATES: There were 284 candidates testing who answered yes to prior criminal arrest/charges, drug or alcohol addiction, physical or mental impairment, and/or disciplinary action by another Board. STUDENTS: There were 3,090 students requesting approval from the Board to enter or continue in clinical nursing courses and 567 were placed under investigation in 2007. Investigations were closed on 651 students. There were 4,284 students approved, 27 delayed, and 29 denied.
