London Dumping Convention
Introduction
• Marpol does not apply to the disposal of Land generated wastes into the sea by dumping from ships. This is covered by London Dumping Convention (LDC).
• IMO adopted this convention or prevention of marine pollution by dumping of wastes and other matters.
• It deals with the dumping of wastes by ships, aircrafts, platform and man made structures.
Salient features of this Convention are:
1. Dumping of certain most dangerous wastes is totally prohibited (certain nuclear wastes).
2. Dumping of certain less toxic wastes is allowed provided the states concerned issued prior permit for such dumping.
3. States may permit dumping of other wastes not covered by the points above, by issuing prior general permits.
4. Before dumping wastes at sea the possibility of destroying or incineration of the waste on land should be explored.
5. Dumping of wastes by ensuring safety of Life or Ship is an exception.
Salient features Contd:
6. Incineration of prohibited wastes is permissible at sea provided the incineration sites are at a place that would not cause harm to maritime life and resources.
7. Incineration sites are to be regularly and periodically inspected by states and records kept for the IMO.
8. Disputes between two or more contracting parties shall be settled by the International court of justice or by arbitration. INDIA IS NOT A PARTY TO THIS CONVENTION.
