: These. afe complaints filed against the decision of the

respondents declining permission to the aggrieved students to participate

as contestants in the respective items of art in the District Level and/or

, the State Level Kalolsavam - 2010. Competitions in the performing arts-/'

and cultural events are held in the State School Kalolsavam every year for

pupils studyfng in, , Standards 1 to L2 under the auspices of the Education

Primary School,Level consisting of Standards t to 4, at the Upper Primary

Level consisting of,standards 5 to 7 (category 2), at the High School Level

consisting,of Standards 8 to l-0 {category 3) and at the Higher Secondary

School Level consisting of Standards L1 and 1,2 (category 4). Competitions

for category 1 are to come to an end by the declaration of the results of

the Sub District Level coml.retitions, those for category 2 at the Revenue

competitions, are permitted to compete at the District Level and,

thereafter, at the State Level competitions. Only ttre student or the team

of students, as the case m,^ay be, who in the respective item gets the top

most rank among A grade winners would be eligible to perform as

contestant in the next higher level competitfbn. Students who secure A or

B or C grades are eligible for grace marks at the rate of 30, 24 and LB

respectively. Expenditure for the conduct,'of the State Level School

Kalolsavarn'shall have to be met byrtheGenera{ Educatlon::Depar'tment,,the

,Higher Secondary ' School Department and' the Vocational Higher

hnnl f)pnartm€ o of 3:2:1. The amount thusSecondary School Department in the rati-

received shall be deposited in a Nationalised Bank in the account of the

Director of public Instructions. Fund thus available shall be utilised for

meeting various expenses in consultation with the Directors of the other

two Departments.

Kalolsavam competitions held at the Sub District Level and at the Revenue

District Level for students belonging to Standards B to 10 (High School

level) and standards LL and 12 (Higher Secondary School Level).

3. Government in the General Education Department has

issued guidelines for the conduct of the School Kalolsavam in general and

those pertaining to the conduct'of the competitions for categories 1 to 4, in

particular. These guidelines are called the Manual for School Kalolsavam.

Items meant for category 3 are grouped into 13 divisions and those for

category 4 are grouped into l. L divisions. As far as the competitions for

certain items are concerned, boys and girls are grouped together whereas

for cer[ain other items competitions for boys and girls are held separately. .

4. For the proper conduct of the District level competitions an

Organising Committee shali be constituted in each District. It shall be ttre

Revenue District will be giyen a sum not exceeding rupees one and a half

lakhs for the conduct of the District Level Kalolsavam so that each Sub

District will be eligible to appropriate Rs.20,000/- towards expenses for the

festival. Contributions from the members of the public can be received, if :

need be, for the Revenue District level festival, by selling coupons. Income

and expenditure accounts shall be subjected to auditing by a Chartered

Accountant appointed by the Deputy Director of Education and approved

by the Organising Committee. Performance of the competitors in each t

item shall be observed scrupulously and the'merit of the performance as

also the eligibility of the participants evaluated and assessed for grading

and ranking. -.The Deputy Director of Education shall find out competent

persons for inclusion in the JudEes' panel from the list of persons approved '

by the:Director of Public Instructions. Performance of the contesting*'*

students,in-thgsa.rne r.tefii of competition shall necessarily'be'judged by the :

confidential. Their names and qualifications shall, however, be announced

at the venue of the competition just before the commencement of the

. competition. Well before the commencement of the competition, the

Judges shall be provided with necessary facilities including equipments for

the proper discharge of their duties. Supply of score sheet to the Judges

Judges shall take into account all relevant aspects including the nuances of

the each concerned item of art. They shall assess the merit of the

performance of the parricrpanrs givtrg clue consideratron for the ciiff'erent

-components, split up the marks for the respective components and record

the same in the score sheet. As far as possible corrections and over

writings in the score sheet/mark list shall be avoided. If corrections or

overwritings become unavoidable, the Judge concerned shall attest the

same by subscribing his signature in the respective place. As soon as the

competition in a particular item is over, tabulation of the marks shall be

done in the presence of the Judges and the result of the competition shall

be announced by one of them. For the benefit of the students and all

others concerned this shall be done in the very stage/venue of competltion.

While announcing the result of the competition, care shall be taken to

mention the code and the grade of the top scorer. Similarly, the marks

scored and the grades awarded to other parbicipants also shall be

announced. The original mark list as also the tabulation list shall be kept

in tact in a sealed cover for a minimum period of three months in the offrce

. of the Deputy Director of Education. Director of Public Instructions will

have the power to call for the mark list and the tabulation list and pemse

the same, if necessary. Complaints against the grading or ranking given to

be considered by the Appeal Committee constituted for that purpose. It is

the duty of the Appeal Committee to consider the technical as also the

legal aspects per[aining to. the competition in the respective item. Re-

appraisal of the merit of the performance or replay of the item which is the

subject matter of appeai is not contemplated or permitted while

considering the appeals. ' Decision of the Appeal Committee shall be

recorded by the Chairman. It shall be in the proforrna provided for that

purpose. Rs.500/'will be charged as fees for fi.ling the appeal. The fees

will be refunded if the appeal is allowed. The decision of the Appeal

Committee will be final. Participants or the team consisting of participants

in a compgtition which fail to'secure the first place in the Revenue District

Level competition, will not be allowed to participate in the higher level

competition, except according to the decision of the Appeal Committee.

Persons including students who indulge in discourteous, indisciplined or

provocative behaviour with the intention of disturbing the orderly conduct

of the competition will be subjected to penal action by the Disciplinary

Committee constituted for that purpose. It is the duty of the General

Conveners to constitute the Disciplinary Committee comprising of the

concerned Educational Officers. It shall be ensured that female officers

also are included in the Disciplinary Committee. The total number of

Certificates will be issued to all participants who get A grade. As soon as

the Revenue District Level competitions are over, relevant details about

selected for the State Level competition along with the C.D. shall be made

been made clear by the State Government that only the top scorer with A

grade in each item will have the right to participate in the respective item

at the State Level Competitions.

5. State Level competitions, in the normal course, shall be held

before the end of the third week of December in each year. There shall be

an Organising Committee. and a Working Committee for the proper

conduct of ,the :State ,level competition. Hon'ble Chief ,Minister, Hon'ble

Accounts showing the income and expenditure connected with the conduct

of the State Level Festival shall be subjected to auditing by a Charbered

Accountant and after due discussion and approval, it shall be placed before

the Director of Public Instructions within the stipulated time limit. It shali

be the duty of the Organising Committee to co-ordinate the proper

functioning of the various Committees. In addition to the above

Committees, Sub Committees also will be formed as follows: (a) Reception

Committee (b) Food Committee ( c) Publicity Committee (d) Programme

: 6. Provisions have been made in the Manual for the constitution

of Appeal Committees to consider and dispose of appeals filed at the

District Level Competitions and State Level Competitions. School Level

Appeal Committee shall be presided over by the Educational Offrcer of the

Sub District and four members. Two of the members shall be experts in

the Art subjects and the other two members shall be the Assistant Director

of V.H.S.C. or his representative and the Regional Deputy Director of

H.S.E. or his representatrye. Aggrieved persons shall file appeal rn the

prescribed form accompanied by the fee receipt within one hour from the

time of announcemcnt of the results of the competition. If the appeal is

allowed, the fee shall be refunded to the appellant and in other cases, the

amount received as fee shall be handed over to the Organising.Committee.

All appeals received as above, shall immediately be placed before the

Educational offrcer of the sub District who shall be the chairman of the

Appeal committee. Appeal'committee shalliconsider the appeals in detail'

dispose of the same *i11,i,, five days, and in any event, before the

commencement of the District Level Festival and communicate the

decision in writing to the concerned persons'

7 . Appeal committee in relation to the sub District level

competitions has also to be similarly constituted with the difference ttrat

ascerlaining their willingness. Items for which subject experts are to be

forms of art (3) instrumental music (4) paintings (5) percussion

instruments (6) literature and (7) acting. Officiai notification constituting

lhe Appeal Committee shall be published by the Director of Public

Instructions. AddiHonal members can be iircorporated in the Appeal

Committee if the Director of Public Instructions fi.nds that there is need to

do so. Appeal Committee is empowered to take appropriate decision after

considering the grievances and contentions stated in the appeal.

Regarding the refund of 'fees, getting bio-data of the members, f,ling

declaration as in Annexure 5, etc. similar provisions as in the case of other

Appeal Committees have been incorporated. But the fees.prescribed for

filing the appeal is Rs.1-,000/-. Decision-sf the Appeal Committee shall be

communicated to the persons concerned. Minutes of the Appeal

- .Committee shall berecorded in a register to be maintained for perusal and -

scrutiny. Those who get permission to participate in the State Level

competition based on the decision taken by the Appeal Committee at the

'District Level shall deposit earnest moley of Rs.5,000^. If they fail to

score better marks than persons who had already been allowed to

participate in the State Level competition from the District concetned,

grace marks witl not be awarded nor the certificates issued to them.

Moreover, the earnest money deposit will be forfeited.

Manual that members of

the Judges' panel shall be competent and qualified in the art concerned to

evaluate the perfonnance of each and every contestant in the competition

at the appropriate levels. In order to ensure that the selection and

appointment of experts as members of the Judges Committee is in

accordance with the above stipulation, their bio-data and declaration shall

Complainants in almost all these cases have suffered injustice and

hardship on account of th'e faulff and poor arrangements made by the

organisers of the festival, especially the stage, the light system and the

sound system. Supply of electricity was disrupted or cut off while the

performance was going cn. Poor light arrangemenbs and faulty sound ,

tysterrnaffected the perfonnance of a section of the complainants. Low r

quality amplifier and mike, frequent variations in the electric supply, short ,ri,,s

' circuits, sub standard quality of the tape recorder, non-availability of ,, *generator and similar defects also have given rise to grievances and

- complaints. C. Nos.44, 46, 66, 78, 88, 90, 118, LSZ, 1G0, 166, 169 , !64,

174, 17.8, 1Bg, Ig2, 200, 204, 2!7, 220, 229, 238, 244, 248, 250, 256, 262,

276, 278, 292, 294, 300, 302, 308, 346, etc. of the year 2011. are some of

. them.

14. Complaints have been flled alleging bias, partiality and lack

of integrity on the part of the Jud$es included in the panel, both original

some of the experts on account of their over enthusiasm to nurture certain

participants and schools at the expense of the meritorious have been

Educational Officers have yrelded to the influence of some of the school

authorities for extraneous considerations. It is alleged that affluent

persons have got a say in the.matter of choosing the expert members in

the judges panel. 1-hey asserl that this pattern of functioning has been

accepted by all as if it is the unwritten law. According to them, there is no

machinery to oversee or supervise such maftractices committed by the

Educational Officers and organisers. Things are taken for granted in spite

of the fact that talented students coming from the government schools

and the rural areas in particular are neglected and unfairly treated. C.

Nos. 2116,2!18,2!22, 2L30, 2t4}of the year 2010 and 6, 8, 27., 1g4, 2L8,

222, 232, 234,238,246, 254, 264,266,270,280, 308, 3L4, 326, etc. of the

year 20LL are some of the cases where allegations are directed against the

panel of Judges and the poor quality of judging.

15. In C. No.3L APAL1, the complainants have brought to the

notice of this Forum the foliowing grounds to inipugn the decision of the

respondents. When reproduced, they read like this: (i) The stage was not

for the olatform withoul

proper support, it has affected the smoothness of the stage thereby

adversely affecting the performance of the team. Part of the stage

collapsed during the perforrnance because of the callous negligence of the

organisers. (ii) Electncl[y failed during the perfonnances which too have

affected the perforrnance. (lii) The curtain was pulled down while the

perforrnance was at its climax which caused commotion among the

participants and the audience, and they sought for fresh opportunity to

perform. But it was denied. The photographs produced herewith would i

show the negligence of the organisers in conducting the items in a proper

manner-. (iv) The morale of the participants and the parents has gone

down and no oppor[unity was given for a repeat of the programme. The

entire performance of the [eam of the complainants from the beginning to :

the end is recorded in the CD and if reguired it will be produced at the t

time of hearing. The said CD would,reveal that the complainants' fg36': :*:

could not get a fair opportunity to perform the item though all other teams

$ot a fair opportunity. (v) A request for a repeat performance was denied,

thereby denying a legitimate chance to get L't place in the programme.

(vi) The news regarding the maladministration of the organisers were

widely repor[ed in almost ati the dai]ies which would reveal that the

complainants' team could not get a fair opportunity to perform their event.

the complainants. (vii) As if adding fuel to fire there was callous

negligence on the part of the organisers who pulled down the curtain in

the midst of the performance and lifted again causing intermption to the

programme which adverseiy affected the performance result with

improper assessmcnt of the' result. (viii) Though an appeal was f,led

immediately highliqhting all the grounds mentioned in the complaint, it

was not fairly considered but rejected without assigning any convincing

reason. (ix) With all the adverse conditions, the complainants' team was

given 'A',grade and placed in 3'd rank with a negligible difference in mark.

--j Had there been no interruption and technical snag the complainants' team

would have been adjudged as the best team and given first place with 'A'

grade.

16. In C. No.2212011, the allegation is that two teachers of the

Programme Committee forcibly pushed out the complainants from the

. stage and openly abused the parents of the complainants causing much

mental agony and humiliation to the contestants and their mothers who

. accompanied them.

L7. In C.No.ZOA],/20L1-, the complainant has produced a series of

documents through his Advocate. While producing those documents

over the undermentioned documents is L. Pradeep Kumar,

Right to Information Act, the credentials of the Judges for the items of

'Veena' and 'Tabala' along with the score sheets of the two. item. in the

Kerala State School Kalolsavom held at Kottayam on 18.1 .201 1 and.:

L9.1,20LL respectively, were issued to Mr. Pradeep Kumarvide forwarding

letter No.Y121720911,1 DPI dated 11.2.20LL. No doubt that the Judges for

the two items were eminent Artists, but in the score sheets where those

Judges had put:their marks with their signature, gross irregularities and

manipulations'are ,visible. For example item 613 - Veena for H.S.

General, 5l value points were noted vtz., A - fflloo 20 marks, B-otr{Blruo 2O

marks; C =-,(o3ptp 2O,marks, Dolglgmoi2Q marks and E . dS 20 marks- In ";

: score sheetwhichis numbered as page Nos. 7 & 8 the participant hearing

Similarly 25, out of 20 marks were given to Code No.95 and for the

. participant in Sl.No. 12 for the value of A. A very strange thing is that

marks were seen given only for 4 value points, though 5 parts were noted.

No marks are seen to have been given for the 5s value point o1g This

score sheet was handled by Sri. B. Sivakumar, Judge. In the case of the

item Tabala, the score sheet handled by Sri. Pandit and Sri, Hari, Judge, is

seen manipulated by over writings and corrections. In page No.18 for the

participant serial No.3 with Code No.41, he was first given 2 marks each

The participant in serial No.10 with Code No.46 and serial No.12 with

Code No.54 was first given '6' each which was corrected as '8' each. The

above mentioned two items are only the example items to prove the gross

items staged in the State School Kalolsavom. This kind of extensive

cormption and favouritism by manipulating records, are in its superlative

form in all the items. The first place in most of the items are declared

under the hidden auction processed by accepting bribes. Incidentally it is

to be noticed that the documents produced include copy of the score

sheets prepared for the competition in Veena and Tabala in the I'.erala

State School Kalolsavom held at Kottayam on 18.1.2011 and 19.L.2011.'

18. Counsel appearing for the complainants submitted that

,money' plays a vital.role in tilting the balance and naturally the affluent

are the beneficiaries. Participants having genuine interest, talent and

potential are overtaken by students coming from reputed schools in the

urban areas. According to the counsel it is not mere talent or merit alone

that determines the ultimate result. The dark side of the Festival is that it

iS attracted , by undesirafte aia undue publicity, grace marks and :such

other advantag€s:, eqioyed by the winners and making the competitions

niore unfair and less sportive. Instead of harmony, unrt5r, amity and

cordiality what prevails among the participants is spitefulness,

belligerence and vindictivenes s.

19. Some complainants had approached this Forum alleging

cormpt practice on the part of the Departmental offrcers and the

Members of the panel of,:"qggl' ryu"i"g t"g

allegations, orders were passed directing the Investigating Agency

attached to this Fomm to enquire into the truth or falsity of the

came forward to give any direct evidence regarding the alleged demand of

bribe. When questioned by the Investigating Officer even the

complainants stated that allegations of cormpt practice were made relying

on hearsay information. No independent evidence was adduced by those

complainants before this Forum to substantiate their plea. Hence those

cases were dismissed.

2A. I have made mention of the above category of cases to

notice the fact that one cannot blindly believe the stateri{ents of the

complainants and indict or fi.nd fault with the'of;frcers and the organisers.

At the same titrne, we cannot shut.oqf eyes against the accusation of lapses

and deliberate rnanipulations alleged'to have,taken at various levels of the

Festival.

21. Submissions made by the Senior Government Pleader for

the respondents can be sgmmed up as follows: School Kalolsavam is

intended to afford fair opportunity to the students to exhibit their talents

in various performing arts and cultural activities in open stages. They

participate in a competitive and sporting spirit in the presence of their

high profile public men and members of the public. Persons proficient in

various art forms come to the venue of the competition and witness the

performance. From the .School level, the competition goes to the Sub

District Level,. then to the District Level and finally to the State Level.

Competitions become tougher and more intensive as they reach the

District Level and the State Level. IndMdual participants and the "eam

members of the group items perform their best to be adjudged as the top

scorer. They work hard spending valuable time, energy and money. It is

true that availability of adequate funds often becomes a major problem for

the organisers. It is also true that the affluent among the participants may

have got proper training. But the poor sections of the students are also

able to come to the top with the help of their teachers,'colleagues and

members of the public. As far as possible the Festival has to be conducted

free from fault and errors. Complaints about the non-compliance of the

guidelines in the Manual must be examined by the Director of Public

Instructions and appropnate remedial measures should be taken'

22. Both sides agree that if the guidelines laid down in the

Manual are earnestly follorved that alone will give a quietus to the

apprehensions and the grievances of a major section of ihe contestants.

No doubt, School Kalolsavam serves a dual puqpose. Students are allorved

and disturbances in the audio system is a complaint generally made by the

participants. Similar complaints have been made about the light system

caused by miscreants set up by ingenious participants to let down the rival

24. Complaints have been filed alleging that the Judges were

found attending calls made to them over mobile phones while the show

was on. Participan[s suspect that influentia] persons are contacting the

judges over phone so as to provide instant help to them to identify the

participants to be favoured with, Guideline in the Manual that the names

and the address of the judges who are included as expert persons in the

panel shall not be disclosed earlier than the commencement of the

competition - a provision cautious$ made to avoid attempts to influence

them - is observed by the Department in its breach than in its compliance.

25. Unhealthy competitions spoil the purpose of the festival.

Government have got the duff to preserve the dignity and the serenity of

the Kalolsavam if such festivals are meant for the benefit of the budding

talents among the school children. Unscrupulous interference by the

parents and the school au'thorities coupled with lack of deligence of the

officers to do away with such tendencies sends the wrong message that

is a sad state of affairs. Authorities must guard against such interferences

lest we plant the seeds of dejection, despondency and foul play in the

minds of the adolescents. Let the children feel confldent that virtue and

hard work do have its merits. Let not the tiny tots have the ill fortune to

learn evil lessons from their own parents and teachers. It is for the

executive government to play the lead role and evolve suitable

mechanisms to iron out the creases. Litigations and judicial interventions

are not the effective solutions in matters of this nature.

26. Cerlain remedial measures are highlighted hereunder.

27. There is need to en5ure that the guidelines in the Manual

are made knowil to the office bearers and the members of the organizing

committees, the members of the judges' committees as also the appeal

committee.

: 28. Sufficient number of copies of the Manual shall be made

available so as to enable the concerned to go through the same,

understand the importance of those guidelines and to implement them.

29. Needless to state that earnest efforts shall be taken by all

concerned to conduct School Kalolsavom as laid down in the Manual

issued by the Government.

They can submit reports to the DPI about the facts and events noticed by

them. Reports thus received by the DPI c.qn form the material along with

other relevant materiaJs for evaluating the functional efficiency of the-.-----

These methods may be fruitful to prevent malpractices to some extent, Itmay bring down arbitrary and unjust decisions being taken and executed

by the authorities concerned. Reports received from the Officers who visit

to take remedial measures. Those who violate the guidelines in the

Manual shall be made urrrru.rlble to the Heads of the Department and

subjected to disciplinary action in appropriate cases. No doubt, the

respective fields of activity. For example, the sub committee in charge of

'stage and panthal' as also that in charge of 'light and sound' must ensure

that they carq/ out their job free from deficiency and fault. It may be

noticed that serious allegations have been made against the wbrking of the

aforesaid sub committees by almost all persons who have filedtomplaints.

Government and the needful done to the extent possible.:

33. At the risk of repetition, it has to be stated that lack of

supervision by high level offrcers ls one of the reasons for the defects and

. deficiencies pointed out by the complainants in the conduct of the School

34. Organizing committees in general and, the sub committees

experts in the respective arl but also men of integrity. They must show the

courage to rise above partisan interests, bias and prejudice. Merit alone

hall be the criterion for awarding marks to the contesting students. Even

laymen know the principle that justice shall not only be done but must

appear to be done also.

36. No uniform practice is followed in the matter of

announcernent of the result of the competitions in the Sub District and the

District Level Competitions. Arrangements shall be made to ensure that

the results are published immediately so that not only the grades and the

"points but also the marks awarded to the contestants are made available to

the parties and all others' concerned. Failure to do so shall be made

punishable.

37. Members of the staff of the Education Department who are

entrusted with the duty to receive the appeals shall not be allowed to

arbitrarily deny the aggrieved persons the opporlunity to file appeals.

Aggrieved persons shall be permitted to remit the fees within the time

limit prescribed. As

38.' Some of the appeal committees are not disposing of the

taken serious note of. It is also seen that even in cases where timely

decision is taken in the appeals, the appellate order is not communicated

to the concerned persons at once.

39. Members of the appeal committee shall have the basic

lcrowledge as to how appeals are to be dealt wit}. In cases where the
