The Licensor and the Licensee now agree that the room is licensed to the Licensee for the Period from the start date for the Licence Fee subject to the following terms:

Definitions

These definitions apply unless the context requires a different interpretation:

“Reasonable Wear and Tear” means reasonable damage brought about by dwelling in the Property. The accommodation shall be used only for the purpose by which the parties agree. The longer the agreement is for, the greater the reasonable damage will be regarding the general condition of the Room. Specific items are expected to be damaged less than the overall feel of the Room. Reasonable Wear and Tear is foreseeable damage. Non-foreseeable damage, such as damage which renders the item unusable is not Reasonable Wear and Tear.

The Agreement

1 Either party may terminate this Licence at any time by giving to the other written notice of 14 days

2 The following services will be provided to the licensee:

2.1 Use of treadmill

3 The Licensee may use other parts of the house in common with other members of the household, namely:the bathroom, toilet, kitchen and living room laundry, and lounge.

4 Space will be provided in the lock up garage for a small to medium sized car of the Licencees.

5 The Household Costs are for:

5.1 electricity

5.2 gas

5.3 water over and above council standards

6 The Charge to cover the Licensee’s proportionate amount of the Household Costs is the bills as received divide by three, per person. For water this is for usgae amounts over standard council rates.This sum may be increased at the discretion of the Licensor if in his reasonable opinion; the Licensee’s usage exceeds this proportion of the total cost payable by the Licensor.

7 The inventory means the list of the Licensor's possessions in the Room or otherwise at the Property which has been signed by the Licensor and the Licensee.

8 This Licence is personal to the Licensee, is not assignable, and will terminate automatically without notice if the Licensee ceases to reside at the Property or it at any time more than two payments are due and unpaid.

9 In this paragraph, the “Inventory” means the list of items in the Room, as set out in the schedule to this agreement and thereby agreed by the Licensee.

A promise by the Licensee not to do something also implies that the Licensee will not allow someone else to do that same thing. The Licensee now promises that he will:

9.1 keep clean, in good repair and in accordance with the Inventory set out in the schedule (subject to Reasonable Wear and Tear):

9.1.1 the interior of the bedrooms, bathroom, toilet and othershare use rooms

9.1.2 the carpets, curtains and all other items in the Inventory;9.1.3 all fixtures and fittings

9.2 both parties agree that the Inventory accurately reflects the condition of the items in the Room.

9.3 if any of the items are damaged beyond what is reasonable, the Licensee shall replace or repair them so that they reflect the price given in the Inventory.

9.4 if damaged or in need of repair, the Licensee shall ensure the items have been repaired before the end of the tenancy period.

9.5 the Licensor has a period of 2 weeks after the Licensee has left the Room in which to notify the Licensee of any damage to any of the items listed. After this time, the Licensee will no longer be responsible under this agreement.

9.6 if during the period mentioned above, the Licensor notices an item requiring attention, he shall notify the Licensee by fax or post. The Licensor shall state the amount required to repair / replace the item.

9.7 if the Licensor chooses to have the item repaired / replace, he shall send a copy of the receipt to the Licensee within 7 days from the repair date. The Licensor is permitted to deduct this amount from the Deposit.

9.8 the Rent Deposit (of the same amount paid in the first instance, minus any cost for damage / repair) shall be returned to the Licensee within 14 days after vacating the Property.

9.9 the Licensee is responsible for ensuring the accommodation is kept in a clean and liveable condition. This includes ensuring the accommodation is thoroughly cleaned every two weeks.

Additionally, the Licensee must:

9.10 pay the Licence Fee and the Household costs when due;

OR9.11 make a reasonable and proportionate contribution to the cost according

to use of all charges in respect of any electricity, gas, water and telephony services used at or supplied to the Property and Council Rates or any similar tax;

9.12 keep the interior of the Room in a good and clean state and condition and not damage or injure any part of the Property;

9.13 give up the Room at the end of the Period in the same clean state and condition it was in at the beginning of the Period;

9.14 keep in the Room and in a good and clean condition all of the items listed in the Inventory;

9.15 not make any alteration or addition to the Room nor without the Licensor's prior written consent to do any redecoration or painting of the Room;

9.16 not do or omit to do anything on or at the Property which may be or become a nuisance or annoyance to the Licensor or any other occupiers of the Property or owners or occupiers of adjoining or nearby premises or which may in any way prejudice the insurance of the Property or cause an increase in the premium payable;

9.17 not without the Licensor's prior consent allow or keep any pet or any kind of animal at the Property;

9.18 not use or occupy the Room in any way whatever other than as a private residence;

9.19 not permit any person to sleep, or stay at the property;

9.20 provide the Licensor with a forwarding address when the licence agreement comes to an end and remove all rubbish and all personal items (including the Licensee's own furniture and equipment) from the property before leaving;

9.21 pay interest at the rate of 5% above the base lending rate for the time being of the Licensor's bankers upon any payment or other money due from the Licensee under this Licence which is more than 14 days in arrears in respect of the period from when it become due down to the date of payment;

10 The Deposit

10.1 The Deposit will be held by the Licensor and will be refunded to the Licensee at the end of the Period (however it ends) but after deduction

of any costs or losses reasonably incurred by the Licensor as a result of any breach of the Licensee's obligations. No interest will be payable by the Licensor to the Licensee in respect of the Deposit.

10.2 The Deposit will be sent to the Licensee, at the forwarding address provided to the Licensor, as soon as reasonably practicable.

10.3 If at any time during the Period the Licensor needs to use any part of the Deposit to cover any costs incurred as a result of any breaches of his obligations by the Licensee or other sums properly due to the Licensor, the Licensee shall immediately pay whatever sum is necessary to restore the full amount of the Deposit.

11 The Licensor is under no obligation to the Licensee to insure the Property or any of its contents, but the Licensee agrees to comply with any requirements of any policy, which are made known to him by the Licensor, and to indemnify the Licensor against any loss arising from his failure to do so.

12 The Licensee shall not have exclusive possession of the Room and the identity of any other occupiers of the Property shall be in the absolute discretion of the Licensor.

13 The Licensee shall provide within 14 days of signing this agreement, a WA police criminal record. Any previously non-disclosed information will result in immediate termination of this agreement without predijuice to the Licensor and the deposit being forfeited.
