A) SMT. Kashibai Navale Medical Callwe and Hospital -Pune

Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. ? 0 ? 3/!7 .%. 3 o?/@WJl- 3, dated 29' November 2012 appointed the Enquiry Committees in furtherance of the decision of Samiti dated 8/11/2012 (at Item No. 5[a] & 5[b]).

Said committees were to enquire in to following aspects:-

) To consider all complaints in respect of admissions in Private Unaided Institutions (Medical and Dental) for the Academic Year 2012-13

2) To enquire into whether adequate and proper publicity was given by the Institutions for admissions after CAP round.

3) Whether adequate opportunity was given to students desirous of seeking admissions.

4) Whether Samiti schedule was followed.

5) Whether vacancies were filled in considering merit of students

6) Whether reservation rules were followed.

7) Whether guidelines per Government resolution No. WPM 1012/Pra.Kra. 165/12/Edu-2, dated 29/05/2012 along with the corrigendum dated 5/6/2012 were followed by Institutions.

Accordingly, in respect of this College Committee - A - submitted its report. Samiti perused the general remarks and findings of the committee - A, appointed under GR No. * ? 0 ? *.%. 3 o?mWJl-3, dated 29' November 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) All admissions were done as per DMER, Schedule. b) The candidate Miss Ahire Snehal was offered the seat in General Quota, but

she refused. As a result she was given seat in OBC quota. General Quota seat was given to Abhishek Borle, the next candidate in the list. Because of this selection of candidate would not have changed.

llth January 2013 4. Contentions of the College/Institute are not acceptable for the following

reasons:-

The Samiti perused the affidavit filed by said Snehal Ahire. It is dated 9.1.2013. The said affidavit thus appears to have been obtained after thought. Contention of the College that the selection of candidate would not have changed can not be accepted, because it was for the College authority to admit the students against seat in a particular quota. College has not done this. The findings of the Committee therefore needs to be confirmed.

Samiti therefore confirms the findings of Enquiry Committee that the reservation rules were not followed by this College. The admission process was thus not fair, transparent & merit based and reservation rules having not followed in the right perspective. Samiti therefore disapproves all the adrr~issions i.e. 07 done by the College/Institute after the last "Common Admission Process" (CAP) round of MHT-CET-2012 for the Academic Year 2012-13. Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of MHT-CET-2012.

5. Considering the number of resultant vacancies, Samiti decides to suggest Government of Maharashtra to consider moving the Hon'ble Supreme Court of India, New Delhi for permissions to fill in the resultant vacancies, extension of cut-off-date and also praying their in that all admissions even after CAP rounds be brought under "Common Admission Process" only.

B) MIMER' s Medical Collese Taleciaon Pune.

1. Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. ? 0 ? 3/5T .v. 2 ~?/@TWJT- 3, dated 2gM November 2012 appointed the Enquiry Committees in furtherance of the decision of Samiti dated 8/11/2012 (at Item No. 5[a] & 5[b]).

Said committees were to enquire in to following aspects:-

) To consider all complaints in respect of admissions in Private Unaided Institutions (Medical and Dental) for the Academic Year 2012-13

2) To enquire into whether adequate and proper publicity was given by the Institutions for admissions after CAP round.

3) Whether adequate opportunity was given to students desirous of seeking admissions.

4) Whether Samiti schedule was followed.

5) Whether vacancies were filled in considering merit of students

2. Accordingly, in respect of this College Committee - A - submitted its report. Samiti perused the general remarks and findings of the committee - A, appointed under GR No. * ? 0 ? ?/ST.$. 3 O Y ~ W ~ T - ? , dated 2gth Woverr~ber 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) There is no rule for maintaining attendance record for counseling. b) That it will be maintained next time. c) ST category candidate Samreen Khanam Hameed Khan cancelled her

admission on 30th September due to her personal problem. Against her seat SC Candidate has been admitted. Wadate Sushautak Suresh who was present in the campus. On 30/9/2012 at 2200 hrs. admissions were given to those who were present. This is in formed on 4/10/2012 to PNS.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

One an hand college says "There is no rule for maintaining attendance record for counseling". On the other hand College says ' That it will be maintained next time". Contentions are thus after thought and not honest. The fact that the attendance were not being marked compels us to conclude that the procedure being followed was violating basic principles of transparency, fairness and reasonability.

Contentions that on 30/09/2012 at 22:OO hrs admissions were given to those who were present and the said thing was informed to Samiti can not be accepted being after thought. 'The fact that admissions were being given after working hours till late night on 30/09/2012, shows dishonest motives of the College and further shows that the College even did not wish to adopt the transparency in the process.

Resultantly Samiti therefore confirms the findings of Enquiry Committee that non meritorious students were admitted by the institute. 'The admission process was not fair, transparent and merit based. Sarrliti therefore disapproves all admissions i.e. 06 done by the College/Institute after the last "Common Admission Process" (CAP) round of MHT-CET-2012 for the Academic Year 2012-13. Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of MHT-CET-2012.

5. Considering the number of resultant vacancies, Samiti decides to suggest Government of Maharashtra to consider moving the Hon'ble Supreme Court of

C) Institute of Medical Science and research, Mavani, Satara.

1. Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. + P 0 P ?h.s. 3 O~ /~~VWJI -? , dated 2gth November 2012 appointed the Enquiry Committees in furtherance of the decision of Samiti dated 8/11/2012 (at Item No. 5[a] & 5[b]).

Said committees were to enquire in to following aspects:-

1) To consider all complaints in respect of admissions in Private Unaided Institutions (Medical and Dental) for the Academic Year 2012-13

2) To enquire into whether adequate and proper publicity was given by the Institutions for admissions after CAP round.

3) Whether adequate opportunity was given to students desirous of seeking admissions.

4) Whether Samiti schedule was followed.

5) Whether vacancies were filled in considering merit of students

6) Whether reservation rules were followed.

7) Whether guidelines per Government resolution No. WPM 1012/Pra. Kra. 165/12/Edu-2, dated 29/05/2012 along with the corrigendum dated 5/6/2012 were followed by Institutions.

2. Accordingly, in respect of this College Committee - A - submitted its report. Samiti perused the general remarks and findings of the committee - A, appointed under GR No. - P 0 9 *.?#if;. 3 o?/@r+Vr-?, dated 2gth November 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Findings of the Hon'ble inquiry committee is totally perverse and without applying mind and hence liable to be rejected in toto.

b) College has submitted website access statistics report ( C - panel report )

c) Most of the complaints were made after 3oth September 2012 and which were after thought and filed due to instigation by Jayant Jain.

llth January 2013 d) Out of 31 students only 3 students namely a) IVahida Shaikh b) Sadiya

Rawool c) Morris Christie appeared before committee. 28 Students failed to appeare before Committee.

e) Institute prayes that the complaints as well as report dated on 07/01/2013 by the enquiry committee be quashed and rejected in toto and admission made after second round of Asso- CET 2012 be approved.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

) Fee refunded by post dated cheque to Nahida shaikh in view of cancellation of her admission for betterment resulted into her not getting the admission in any college. This College is thus responsible for the inconvenience caused to the said student.

Findings of the Committee that a) Vacancy position after conclusion of 2nd round was not reported to Samiti, b) Out of 85 candidates 29 Applications were rejected without proper reasons. (e.g. CVC and NCL, Medical Certificate.), c) Attendance record was not kept on 27/9/2012, d) The List of students prepared on 26/9/2012 on the basis of which admissions were done was defective. This defective List was used for admission of 34 candidates on 27/9/2012, e) Injustice to meritorious students. are not responded to by the Institute adequately, properly, and reasonably.

In light of foregoing, Samiti therefore confirms the findings of Enquiry Committee as under :-

Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of Asso-CET-2012.

Government of IYaharashtra to consider moving the Hon'ble Supreme Court of India, New Delhi for permissions to fill in the resultant vacancies, extension of cut-off-date and also praying their in that all admissions even after CAP rounds be brought under "Common Admission Process" only.

D) Ashwini Rural Medical Colleae and Hos~ital, Sola~ur.

1. Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. *Sf ? 0 ? 3 h - 5 . 3 o?/@'Em- 3 , dated 2gth November 2012 appointed the Enquiry Committees in furtherance of the decision of Samiti dated 8/11/2012 (at Item No. 5[a] & 5[b]).

Said committees were to enquire in to following aspects:-

1) To consider all complaints in respect of admissions in Private Unaided Institutions (Medical and Dental) for the Academic Year 2012-13

2). To enquire into whether adequate and proper publicity was given by the Institutions for admissions after CAP round.

3) Whether adequate opportunity was given to students desirous of seeking a'dmissions.

4) Whether Samiti schedule was followed.

5) Whether vacancies were filled in considering merit of students

6) Whether reservation rules were followed.

7) Whether guidelines per Government resolution No. WPM 1012/Pra.Kra. 165/12/Edu-2, dated 29/05/2012 along with the corrigend~~m dated 5/6/2012 were followed by Institutions.

Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7' January 2013 college has contended mainly as under :-

a) Vacancies were declared on website. b) Reservation rules were not mentioned in AMUPMDC broacher. c) Applications were accepted as per PNS direction. d) Institute conducted admission process for the first time, did not know about

maintaining attendance records at the time of counseling.

", e) Admission Process conducted in transparent manner &was merit based.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

Attendance sheets were not kept by the Institute at the time of counseling. This is admitted by the college. It is beyond the ordinary expectation of prudent mankind to believe in the fact that out of 290 only 8 students were present for counseling even if alternatively it is considered that the adequate and proper publicity was given by the College. Contention that the Institute conducted the process for first time and did not know about maintenance of attendance sheet being put forth after thought can not be accepted. These contentions could have been raised before the Enquiry Committees also.

Following findings of the Committee are not properly, adequately and reasonably answered by the College a) Admitted non meritorious students, b) Applications send by speed post and email were not accepted by the College.

I n light of above, Samiti therefore confirms the findings of Enquiry Committee as under:-

a) College admitted non Meritorious Students. b) Reservatior~ rules were not followed. c) Applications sent by speed post and email were not accepted by college. d) Attendance record was not kept at the time of counseling

The admission process was thus not fair, transparent & merit based and reservation rules having not followed in the right perspective. Samiti therefore disapproves all the admissions i.e. 07 done by the College/Institute after the last "Common Admission Process" (CAP) round of Asso-CET-2012 for the Academic Year 2012-13. Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of Asso-CET- 2012.

E) Terna Medical Collecre, Navi Mumbai.

1. Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. P 0 P .TG.$o 9mWJl- P, dated 2gth

Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Attendance was taken of only 5 admitted candidates. b) Reservation rules were followed. c) Admission process was done on 30/09/2012 instead of 29/09/2012.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

Contention that attendance was taken of only 5 admitted candidates and reservation rules were followed being put forth after thought and not being supported by any corroborative evidence cant be accepted. Findings of the Committee that admission process conducted on 29/09/2012 for filling 05 seats was not transparent is not adequately, properly and reasonably and justly responded to by the College. It is observed that the advertisement for filling in vacancies in Indiar~ Express and Loksatta was published on 15/09/2012 and not on 22/09/2012 as contented by the College. College has not submitted any documentary evidence in support of its claim.

Findings of the Committee that the College admitted non meritorious students in respect of complaint of 1) Krina Shah, 2) Harshvardhan Savne, 3)

llth January 2013 Mithali Salve, 4) Ajit Yadav, 5) Dhara Parmar, 6) Monica Chavan, Krejiya Joy, 7) Lubna Rizwan, 8) A.F. Quereshi are also not properly, reasonably and adequately responded to by the College. Contention of the College that the said students were not present for counseling can not be accepted for want of any supportive, corroborative and sufficient evidence.

I n view of the above, Samiti therefore confirms the findings of Enquiry Comrrlittee as under :-

a) 5 candidates were admitted without giving advertisement. b) Admitted non Meritorious Students. c) Attendance report was not maintained at the time of counseling. d) Reservation rules were 'not followed.

The admission process was thus not fair, transparent & merit based. Considering the number of resultant vacancies, Samiti decides to suggest Government of Maharashtra to consider moving the Hon'ble Supreme Court of India, New Delhi for permissions to fill in the resultant vacancies, extension of cut-off-date and also praying their in that all admissions even after CAP rounds be brought under 'Common Admission Process" only.

F) Sinhsad Dental Collese and Hos~ital Vadqaon, Pune.

1 Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Contentions that no directions were issued from the Samiti for maintenance of attendance records for counseling round is not acceptable having raised after thought. The fact that such records were not kept shows that the College was not keen in maintenance of transparency in the process seriously and honestly. Contention that there was no other claimant for any other category seats who reported to College is also not adequate, proper, just and reasonable for arriving at the conclusion that reservation rules were being observed in right perspective.

Samiti therefore confirms the findings of Enquiry Committee as under :-

The admission process was thus not fair, transparent & merit based and reservation rules having not followed in the right perspective. 4. Contentions of the College/Institute are not acceptable for the following reasons:-

Contention that the schedule of Samiti dated 14/08/2012 was followed is not acceptable, since it remains the fact that the College did not follow the subsequent schedule. Subsequent Schedule was approved by the Samiti in a meeting of September 2012. The schedule was subsequent and thus a revised one. The said subsequent schedule was followed by other colleges also. College did not follow the said schedule and resultantly did not follow the subsequent procedures as per the said schedule. This resulted in desiring students being denied the opportunity of seeking admissions leave a side the non meritorious students being admitted in the College.

Samiti therefore confirms the findings of Enquiry Committee as under :-

Contentions put forth being after thought can not be accepted. It is not answered as to why this f a d was not brought before the Enquiry Committee earlier. Further finding of the Committee that merit was not maintained is not adequately, properly and reasonably responded to by the College.

a) Merit was not maintained.

1. Samiti had received complaints from students/parents with respect to the admissions in Private Unaided Institutions after CAP rounds in Academic Year 2012-13. Medical Education and Drugs Department of Government of Maharashtra vide its G.R. No. 9- P 0 P ?/k .m. 3 03/h$fJT- 3, dated 29" November 2012 appointed the Enquiry Cornmittees in furtherance of the decision of Samiti dated 8/11/2012 (at Item No. 5[a] & 5[bJ).

Said committees were to enquire in to following aspects:-

1) To consider all complaints in respect of admissions in Private Unaided Institutions (Medical and Dental) for the Academic Year 2012-13

2) To enquire into whether adequate and proper publicity was given by the Institutions for admissions after CAP round.

3) Whether adequate opportunity was given to students desirous of seeking admissions.

4) Whether Samiti schedule was followed. 5) Whether vacancies were filled in considering merit of students 6) Whether reservation rules were followed. 7) Whether guidelines per Government resolution No. WPM 1012/Pra.Kra.

165/12/Edu-2, dated 29/05/2012 along with the corrigendum dated 5/6/2012 were followed by Institutions.

2. Accordingly, in respect of this College Committee - B - submitted its report. Samiti perused the general remarks and findings of the cornmittee - A, appointed under GR No. - P 0 P m.5.3 ~ ? / @ R T T - ? , dated 29" November 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show Cause/Adm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Candidate viz. Abbas Patanwala reported at 2.00 pm and accepted that he was late.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

It has been observed by Committee per the annexure C of the College (Important directions given to applicant in news papers, College website and on Notice board - No. 6 - counseling was to start at sharp 1400 hrs. Students were expected to mark their attendance in register between 900 to 1330 hrs. I n view of this the candidate doest not render him self in elibible for the counseling/interview merely because he attended at 1400 hrs. It is to be noted that though he accepted he was late; he has not withdrawn the complaint. I n light of the above findings need to be confirmed.

a) Abbas Pathanwala was present for counseling at 2.00 O'clock, he was not considered for admission.

The process followed by College resulted in denial of admission to a needy and desirous student. The admission process was thus not fair, transparent & merit based. Samiti therefore disapproves all the admissions i.e. 09 done by the College/Institute after the last "Common Admission Process" (CAP) round of Asso-CET-2012 for the Academic Year 2012-13. Samiti perused the general remarks and findings of the committee - A, appointed under GR No. P 0 P 7 h .B. 3 0 s/@m- 7 , dated 29' November 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show CausefAdm-2012/4010, dated 7th January 20 13 .-',

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Advertisement was published on 16/09 & 17/09/2012 in Dainik Sakal & Indian Express .

b) PNS schedule was followed. c) Attendance of 22/09/2012, 25/09/2012 and 28/09/2012 for counseling

round was kept.

4. Contentions of the College/lnstitute are not acceptable for the following reasons:-

Contentions happen to have put forth after thought. They could have been raised before Enquiry Committee. This was not been done by the College. 'The Contentions are not supported by proper and adequate documentary evidence.

I n view of the above, Samiti therefore confirms the findings of Enquiry Committee as under :-

a) Vacancy Position was not Properly Published. b) PNS Schedule was not followed.

'The admission process was thus not fair, transparent & merit based. Samiti therefore disapproves all the admissions i.e. 16 done by the College/Institute after the last 'Common Admission Process" (CAP) round of Asso-CET-2012 for the Academic Year 2012-13. 3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Vacancy position was displayed on website on 25/09/2012. b) All the complaints were after thought. c) 23 candidates were present on 28/09/2012 for vacancy round, because of

wide publicity only. d) Dean of the College has vide his letter No.

NKP/Dean/Stud/Sec/0129/2012, dated 8/1/2013 has requested for 10 days to submit the explanation to the findings of the Enquiry Committee. He has further requested to supply a copy of report of Enquiry Committee to enable him to prepare a reply.

4. It is to be noted that the show cause notice was issued to the College on 7/1/2013. Replies were sought before 10/01/2013. The college was also supplied the relevant information on 10/01/2013 immediately after it was demanded to by the representative of the College. The College has submitted its reply on 10/01/2013 which bears the date 8/1/2013. This shows that the reply was ready but handed over PNS at the latter date. The reply no where asks for more time to reply. Therefore at this juncture it is not necessary to grant more time to the applicant College for submission of a reply again. Samiti feels that time allowed for responding to the show cause notice was fair, proper and a reasonable period. Samiti therefore, rejects the request for extension of further time to respond again.

5. Contentions of the College/Institute are not acceptable for the following reasons:-

College has submitted that vacancy position was displayed on website on 25/09/2012. Findings of the Committee in respect of complaints is that vacancy position was not properly displayed on 24/09/2012. The submission of the college thus confirms that it has not displayed vacancy position on 24/09/2012. The contention that 23 candidates were present on 28/09/2012 for vacancy round because of wide publicity only, can not be considered being put forth after thought.' 'This contention could have been raised before the Enquiry Committee. Fact that complainants complained that vacancy position was not properly published on 24/09/2012 and the fact that Institute admittedly published vacancy position on 25/09/2012 shows that as on 24/09/2012 students were kept un aware of the admission process that was being followed by the College. Thus there was no proper publication of vacancies giving chances of non meritorious students being admitted.

The Enquiry Committee report resultantly needs to be confirmed.

Samiti therefore confirms the findings of Enquiry Committee as under :-

1) Vacancy Position was not Properly Published on 24/9/2012

College not having followed the proper procedure resulted in to unfair, unjust, not merit based and not transparent admissions. Samiti therefore disapproves all the admissions i.e. 11 done by the College/Institute after the last "Common Admission Process" (CAP) round of Asso-CET-2012 for the Academic Year 2012-13. Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of Asso-CET- 2012.

Accordingly, in respect of this College Committee - C - submitted its report. Samiti perused the general remarks and findings of the committee - A, appointed under GR No. + ? 0 ? ?h .%. 3 oQ,/fhWJT-?, dated 2gth November 2012. Findings of the Committee were communicated to the College vide office letter bearing No. PNS(Med)/Show CauselAdm-2012/4010, dated 7th January 2013

3. Amongst other points in response to the show cause notice dated 7th January 2013 college has contended mainly as under :-

a) Candidate from Reserved Category has to submit Caste Validity Certificate at the time of admission as per MUHS letter dated 31/7/2012. Action to reject admission to Abdul Rehaman Abdul Bashir for want of CVC, from OBC Category is Justifiable.

4. Contentions of the College/Institute are not acceptable for the following reasons:-

Samiti observed that one Mr. Abdul Bashir Mohd. Ismail was allotted to Ashvini Rural Medical College, Solapur in first round. I n second round he was allotted to this College. He therefore cancelled the admission which was offered to him in first round. But this college rejected the admission for want of Caste Validity Certificate (CVC). Committee after enquiry felt that it would have been in the fittest of the things had the college considered the request of the applicant.

College is however has taken a stand that as per University letter dated 31/07/2012 submission of CVC was necessary and therefore action of rejecting the admission to the said students was justifiable.

I n view of the fact that the student was duly admitted in Ashivini Rural Medical College, Solapur during first round and in view of the fact that he cancelled the admission for betterment purposes he was allotted to this college, College could have considered his case; resulting an admission to a deserving candidate; provisionally till the production of CVC at a later date suitably.

Saniiti therefore confirms the findings of Enquiry Committee as under :-

a) Injustice has been done to the candidate and his case should have been considered by the college.

Considering the letter and spirits of the rules and the set parameters of procedures being followed this admission process was thus not fair, transparent & merit based. Samiti therefore disapproves all the admissions i.e. 04 done by the College/Institute after the last "Common Admission Process" (CAP) round of Asso-CET-2012 for the Academic Year 2012-13. Samiti recommends to Government of Maharashtra to direct the said College/Institute to cancel the admissions after last CAP round of Asso-CET-2012.

5. Considering the nurr~ber of resultant vacancies, Saniiti decides to suggest Government of Maharashtra to consider moving the Hon'ble Supreme Court of India, New Delhi for permissions to fill in the resultant vacancies, extension of cut-off-date and also praying their in that all admissions even after CAP rounds be brought under "Common Admission Process" only.

Samiti also perused the reports of Committees in respect of following Colleges:-

) Dadasaheb Kalmegh Dental College, Nagpur 2) C.S.M.S.S. Dental College, Aurangabad. 3) M.I.D.S.R. Dental College, Latur 4) Y.C.M.M. and R.D.F.S. Dental College, Ahmednagar

After deliberations, Samiti approves the finding of the Enquiry Committees.

Applicant Dr. S.A. Dhole has lodged the complaint to Samiti against malpractices during admissions by Dr. P.D. Memorial Medical College, Amravati for Academic Year 2011-12 dated 21/12/2012. Samiti perused the letter dated 21/12/2012 addressed to said applicant by Dean, Government Medical College, Nagpur. Samiti also perused letter dated 2/1/2013addressed to Samiti by the said applicant and letter dated 3/12/2012 addressed to Secretary, Medical Education and Drugs Department.

Samiti notes that the complaint is about admissions of Academic Year 2011-12. Since the academic year is already over, the points raised by said applicant do not survive they being after thought. Samiti therefore files the application. Inform the applicant, accordingly.

The College/Tnstitute can admit the students appearing MHT-CET-2012 and/or Asso-CET-2012 and those who are other wise eligible for the first year B.H.M.S. course admissions. Hence the request made by the aforesaid College/Institute to admit students on the basis of performance of candidate in GUJ-CET-2012 for Academic Year 2012-13 can not be considered. 'The request is therefore rejected.
