GeneralThe Republic of Korea (South Korea) is located on the eastern edge of the Asian continent. Thetotal area of South Korea is 99,538㎢ and its population is approximately 50 million. The capitalof South Korea is Seoul. Neighbors include China to the west separated by the Yellow Sea, andJapan to the east and south just across the South Sea. To the north lies North Korea and justbeyond the boundaries of the Amnok and Duman Rivers in North Korea are China and Russia.

HistoryThe first nation to be established on the Korean peninsula was Gojoseon founded by Dangun in2333 B.C. Gojoseon was the first of many tribal nations to rise and fall on the Korean peninsulauntil the ancient kingdoms of Goguryeo, Silla, and Baekje were founded. In 688, the dividedcountry was unified by the Silla kingdom. After the era of a unified Silla kingdom, Koreaexperienced the Goryeo and Joseon dynasties which contributed greatly to the shape it has today.

Korea is proud of its long history and tradition from ancient times to the present. In the process ofdeveloping the nation, Korea faced hardships such as the Japanese Colonial Period and theKorean War, but each time it was able to persevere with the strong spirit of the people. In the1960s, South Korea achieved unprecedented economic growth, and in 1988 it hosted the 24thSummer Olympic Games in Seoul. Afterwards in 1996, the Republic of Korea became a memberof the OECD, and in 2002 the nation co-hosted the 2002 FIFA World Cup with Japan.

Terrain & ClimateKorea is surrounded by water on three sides and has a magnificent landscape with manymountains and rivers.

As for the climate, Korea is a temperate region with four distinct seasons. Spring comes in Marchwith clear skies and warm weather and lasts until May. In June, July, and August, the temperaturegoes up, and during the monsoon season from late June to early July, the weather can get quitehot and humid. In September, October, and November the temperature cools down, but thediurnal temperature ranges become larger. Winters in Korea which begin in December and lastuntil February, are usually cold and dry.

CultureDespite rapid industrialization, Korea still embodies muchagricultural tradition and culture, because it was originally afarming community. Also, the influences of Confucianismand Buddhism enrich Korea's culture even today. Korea'sfilial piety and respect for elders originates from Confucianteachings and Buddhist elements strongly remain in Koreanculture.

In addition, Korea has many traditional holidays such asChuseok (harvest festival), Seol (Lunar New Year),Jeongwol (First full moon of the year), and Dano (start ofsummer, May 5 by lunar calendar). Koreans spend theirtraditional holidays with family and share authentic dishes.

Also, Koreans use a unique alphabet called "Hangul," which was created by King Sejong theGreat in 1443.

People & CustomsKoreans are basically diligent and polite. Having good manners is very important to Koreans, andbecause of a rich tradition in confucianism, it is quite common to see young people offer theirseats to elders in the subway or bus.

Koreans speak in an honorific tone when addressing an older person, and the younger person isobliged to bow to the older person first unless he wants to be regarded as impolite. It is also badmanners for the younger person to smoke in front of an elder.

Another characteristic of Korean people is that they are full of affection for their fellow neighborsand have a strong sense solidarity. The collective cheers of Korean supporters and the "RedDevils" during the 2002 World Cup are a good example Koreans showing their unity to theworld.

Traditionally, Koreans are a people that enjoy song, dance, and wine. They are accustomed tosharing in celebration, so they offer each other drinks, and fill one another's empty glass. Anempty glass should always be filled to the brim and it is against tradition to refill a glass that isnot empty. Also, when pouring a drink or receiving one from an elder, the younger person shoulduse both hands to be polite.

The Han River is the fourthlongest river in Korea at a total length of514km. Most of the rivers in the Han Rivervalley are river-heads covering a total area of27,260㎢. In the Han and Imjin River valleyslie the Paju and Pyeongtaek plains. Thewestern coast of Gyeonggi Provinceconstitutes a very complicated coastline withmany bays and peninsulas. The total length ofthe coastline is 304㎢ and there are 59 islandsalong the coastline such as Jebudo andDaebudo.

Ancient CenterSince ancient times Gyeonggi was the centerof politics, economy, and culture, and becauseit was the capital of Baekjae, Goryeo, andJoseon for over 1,000 years, it has manyhistoric treasures.

Located at the center of a divided nation, Gyeonggi Province surrounds the capital of SouthKorea, Seoul, and borders with North Korea to the north. Recently, border areas such asPanmunjeom and Odusan observatory have been converted into locations for national securityeducation.

Gyeonggi Province also has many historic sites and artifacts among its modern leisure facilities.This makes it a splendid tourism destination. In particular, Hwaseong Fortress has been registeredas a UNESCO World Heritage site, and Icheon, Yeoju, and Gwangju are famous for pottery.These areas can be visited all in one day. In addition, the Korean Folk Village provides aninteresting view of traditional Korean life, and museums such as the Gyeonggi ProvincialMuseum and the Mok-A Museum house many historic artifacts.

The Heart of KoreaThe population of Gyeonggi Province as of the end of 2003 was about 10,360,000 which is21.2% of the nation's total population. The total area is 10,183㎢ which is approximately 10% ofthe total land area of South Korea. Furthermore, there are 31 city and county-level localautonomous governments in Gyeonggi Province.

Gyeonggi Province is the largest local jurisdiction in South Korea already exceeding Seoul withan annual population increase of 340,000 for the past five years. In addition, Gyeonggi Provinceis located at the center of not only Korea, but the economic sphere of Northeast Asia as wellwhich strengthens its position as a "Truly Global Gyeonggi Province."

Terrain & ClimateGyeonggi Province is located at the heart of theKorean peninsula. Geographically, it is situatedbetween longitude 126。and 127。East and betweenlatitude 36。and 38。North. It is bordered to the northby the 38th parallel, and the Yellow Sea to the west.Also, to the east it meets Gangwon Province, and itborders with Chungcheong Province to the south. Inthe center of Gyeonggi Province lies the capital cityof South Korea, Seoul.

Since Korea has a temperate climate, GyeonggiProvince has four distinct seasons and its annualaverage temperature rests at around 12 ~ 13℃. Theannual average rainfall is about 1,100mm whichmakes it a rainy region. In addition, the naturalenvironment of Gyeonggi Province has beenpreserved well with 55.4% of the region being forestland. Therefore, mountains and rivers are easilyaccessible just outside the urban areas. Urban cultureand activities co-exist with rural society within theboundaries of Gyeonggi Province.

Any foreigner planning to stay in Korea for a long period oftime must report to the Korean Immigration Bureau or aregional office and apply for a Certificate of AlienRegistration within 90 days of entry into the country. At theregistration desk, the employee at the window will reviewthe application form and issue a receipt if he/she findsnothing wrong with the submitted documents. TheImmigration Office usually requires 3 ~ 4 days to issue thecertificate and a stamp approving Foreign Resident status isimprinted next to the visa in the applicant's passport.

Single Entry Visa� Single entry into the country is allowed within the expiration period.� The expiration date is 3 months after the date of issuance. (However, if a separate agreement

has been concluded, the period specified in the agreement will determine the expiration date ofthe visa.)

Multiple Entry Visa�Multiple entry (more than two times) into the country is allowed within the expiration period.� Since date of issuance

- 3 years for Diplomat (A-1) or Agreement (A-3) type visas- In the case of visas issued through multiple visa issuance agreements, the period specified in the

agreement will determine the expiration date of the visa.- In the case of visas issued on grounds of reciprocity and national interest, the expiration date will be

determined by a separate period decided by the Minister of Justice.

Certificate for Confirmation of Visa IssuanceThe Certificate for Confirmation of Visa Issuance allows visas to be issued upon the request ofinvitors residing in Korea before visa application at Korean embassies or consulates abroad. TheKorean Immigration Bureau will issue the certificate after reviewing the application form andrequired documents. This certificate will then be submitted to the Korean embassy or consulateabroad and the visa will be issued accordingly.

Who should register� Any foreigner who wishes to stay in Korea for more than 91 days� Any person who acquires foreign citizenship after losing Korean citizenship or a foreigner

born in Korea who wishes to stay in Korea for 90 days or longer from the date of beinggranted a permit to stay in Korea.

� Any foreigner who wishes to stay in Korea for 91 days or longer after being granted a changein the status of his/her sojourn.

When to register� Foreigners who wish to stay in Korea for more than 91 days

must register within 90 days of entry into the country.� Foreigners who have been granted a change in the status of

his/her sojourn must register immediately after receivingnotice of status.

Documents to prepare� Alien Registration Form (Available at Immigration Offices or can be downloaded at the

Korean Immigration Bureau website)� Passport or Entry Permit� Three color photographs (3㎝×4㎝)� Application Fee : 10,000 won� Any additional documents (i.e. school certificate or statement of employment)

ModificationAny registered foreigner who needs to change any information on the Certificate for instancename, sex, date of birth, nationality, or passport (number, date of issuance, expiration date etc.)must notify the Immigration Office within 14 days.

Where to registerApplications for Alien Registration shall be made by the applicant at the Immigration Office thathas jurisdiction over his/her place of stay.

Duty to Carry and Present Certificate of Alien RegistrationForeigners residing in Korea (under 17 excluded) must carry their passport, visa, and certificateof alien registration at all times, and must present them to immigration officers or otherauthorities (city/county/district registration officers) when requested in the process of performingofficial duties. Any foreigner who violates his/her duty to carry and present the certificate of alienregistration will be subject to punishment.

FingerprintingForeigners staying in Korea for a certain amount oftime are required to submit their fingerprints toauthorities at the Immigration Office or local branchas is the case with Korean nationals. If a foreignerrefuses to submit his/her fingerprints, the ChiefOfficer at the Immigration Office or Branch maycancel any privileges granted to the concerned partyaccording to Immigration Control Laws such asextension of sojourn in Korea. The followingforeigners are subject to fingerprinting.

- Any registered foreigner over 20 that wishes to stay in Korea for more than 1 year. In this case, the applicant(over 20) must submit his/her fingerprints within 60 days upon receiving permission to stay in Korea for morethan 1 year.

- Any foreigner who is in detention must submit their fingerprints when the Detention Order is issued.- Any foreigner who has received deportation orders is required to submit their fingerprints when the

deportation order is issued.- Any unidentified foreigner who is under investigation for violating Immigration Control Laws must submit their

fingerprints during investigations.

Changing Status of SojournAny foreigner residing in Korea who wishes to change his current Status of Sojourn must submitan application for Change of Status of Sojourn. The application must be submitted in person or byproxy at the Immigration Office that has jurisdiction over the applicant's address.

▶▶Required Documents : Passport, Certificate of Alien Registration, Application form for Change of Status ofSojourn, additional documents according to respective status of sojourn, and anapplication fee of 50,000 won.

Extending Sojourn PeriodAny foreigner who wishes to extend his/her sojourn period must submit an application formgranting extension of sojourn period from 30 days up until the date of visa expiration. Theapplication must be submitted in person or by proxy at the Immigration Office that hasjurisdiction over the applicant's address.

▶▶Required Documents : Passport, Certificate of Alien Registration, Application form for Extension of SojournPeriod, additional documents according to respective status of sojourn, and anapplication fee of 30,000 won (only 20,000 won for F-2 visa holders).

Changing Address in KoreaAny registered foreigner who changes his/her address in Korea must report the change of addressto the Immigration Office that has jurisdiction over his/her address or City, County, District

offices within 14 days. A change of address must be reported even if the new address is in thesame city, county, or district as the previous address. Passport and Certificate of AlienRegistration are required to file a report.

Permission for ReentryAny foreigner residing in Korea who wishes to temporarily leave the country and return withinhis legal sojourn period must receive permission for reentry before leaving the country. However,nationals of countries that have concluded reentry permit waiver agreements are excluded fromthis requirement.

▶▶Required Documents : Passport, Certificate of Alien Registration, Application form for Permission forReentry, application fee (single reentry permit 30,000 won, multiple reentry permit50,000 won), documents to verify diplomat (A-1) or waiver agreement holder (A-3)status or recommendation or written consent of employer in the case of industrialtrainees (D-3) or training employment (E-8).

Marriagedocuments must include the signatures (or seals) of two witnesses and must be submitted to thecity, county, or district office of the place of register or home address of the Korean spouse.

NaturalizationMarriage with a Korean national does not automatically guarantee Korean citizenship. In order toacquire Korean citizenship, foreign nationals must receive a separate permission fornaturalization from the Minister of Justice.

� Conditions for naturalization: Foreigners who have lived in Korea for more than 2 yearscontinuously with a Korean spouse are eligible to apply for naturalization. If a foreign nationalhas been married to a Korean spouse for more than 3 years, he/she may apply fornaturalization by living in Korea as a married couple for more than 1 year.

� Naturalization process: Any foreigner who wishes to acquire permission for naturalizationmust submit an application to the Minister of Justice. Applicants will be subject toqualification tests in the fields Korean language competency and Korean customs. Ifdetermined to be equipped with basic knowledge and understanding of Korea, the applicantwill be approved for naturalization.

Citizenship of ChildrenChildren may acquire Korean citizenship even if onlyone parent is a Korean citizen. The children of legallymarried couples in Korea automatically receiveKorean citizenship at the time of reporting birth.However, if both parents are foreign nationals, thechild cannot receive Korean citizenship even if he/sheis born in Korea. In addition, for the child to acquiredual citizenship, a birth certificate must be submittedto the native country embassy at the time of reportingthe birth.

Reporting a birthReporting a birth is the same for international marriage couples as is the case with Koreannationals. The father or mother of the child must report the birth to the Dong office within 1month.

Tenants must conclude a lease agreement with house ownersbefore moving into a house. Housing contracts are usuallymade through real estate brokers (for a certain fee), buttenants can directly negotiate with house owners if desired.Recently, real estate listings in newspapers and on theinternet have become popular sources of information.However, most foreigners find concluding a housing contracta complicated task, so they seek the help of Koreanacquaintances.

Jeonse (Long-Term Rent)

This is a type of housing agreement where the tenant pays a Jeonse deposit in advance to coverthe rent during the lease period. The Jeonse period is two years by law, but in many cases thecontracting parties choose to rent only one year. The tenant gets back his/her Jeonse despoit whenthe lease expires.

Monthly Rent

This is a payment system where tenants lay down a security deposit at the beginning of thecontract and pay rent to the owner each month. The monthly rent is not returned, but the securitydeposit is returned when the lease expires. However, if a tenant fails to pay his/her monthly rent,the house owner will collect the unpaid rent from the security deposit.

Things to remember

� Check the register document before signing a contract: Always check the register book(deunggibudeungbon) of the property to see if it is under provisional seizure or provisionalregistration and make sure it is not an encumbered real estate. The register book can beobtained at the registration office of jurisdiction.

Types of residenceKorea has many types of residences such as individual houses, villas, tenement houses, andapartments. Most housing complexes in Korea do not come furnished, and damages to theresidence during the lease period must be compensated by the tenant.

Individual house

This is a house built on selected land for asingle family. Each house has its ownprivate gate and garden. Many foreignworkers in Korea choose to rent a house

and live together. The house owner receives a securitydeposit and monthly rent from tenants.

Villa

This is a type of common housing where many individual living quarters exist ina single building. Each living quarter has its own bedroom, kitchen, andbathroom, and separate heating as well. Tenants can pay in the form of monthlyrent or Jeonse (long-term rent).

Tenement house

This type of housing is similar toindividual house in that it is built onprivate property, but the purpose is tocreate a tenancy. These houses cannothave more then 4 stories and at least one

side of individual tenements within the complex will meetanother tenement. In a strict sense, it is different fromapartments in that each household has its own private yard.Tenants can pay in the form of monthly rent or Jeonse(long-term rent).


Housing 3 Apartment

Apartments have become the mostcommon type of housing in Korea becauseit efficiently utilizes the country's limitedland space. The whole complex (includingplayground and park) is shared and jointly

managed by occupants except for individual flats.Apartments are usually bought by occupants, but Jeonse(long-term rent) is possible and there are apartments for rentas well.

� The agreement must be concluded with theowner listed in the register book. Any housingagreement concluded with a lessor and not theoriginal owner is not protected by law and canbe made void.

� Double check the contract: Check to see if thename, address, contact number, and signatureof the lessor, lessee, and broker are correct,and confirm the total payment amount andmethod of payment, along with schedules anddates.

� Check the utilities before entering into theagreement: Before moving into the house,check if water, electricity, and heating areoperational, and decide with the owner on howtaxes and utilities will be paid.

� Receive a confirmation date stamp(hwakjeongiljain) after signing the contract: Submit your Resident Registration Certificate andcontract to the registration office of jurisdiction and receive a confirmation date stamp. Thestamp is also granted by the Dong Office at the time of moving-in notification. Personalidentification and housing contract are required for this process.

Real Estate Brokerage Fee

Real estate brokerage fees are applied differently according to the type of transaction such aspurchase or rent, and the price of the deal. However, there is a ceiling on the amount ofcommission an agent can request.

▶▶Useful Information

- The unit to measure floor space in Korea is "pyong." (1pyong = 3.3058m2)

- In most cases furniture is not included with the house. Furniture can be purchased cheap at local recyclecenters (second hand).

- Normally shoes are not allowed inside the house and must be taken off at the entrance.

- The leasing period for housing is usually two years, but this period may be shortened upon agreement.

- Before moving out, the occupant should notify the owner of the house at least 1~2 months before leaving toreceive the security deposit without any complications.

- The actual date of moving can be different from the maturity date on the contract to provide convenience tothe parties moving in and out.

- The services of professional movers are usually solicited when moving. For a certain fee, movers will takecare of everything from packing to unloading.

Koreans get their hair cut at beauty salons and barbershops. Recently, beauty salons have been outnumberingbarber shops, and it is quite common for men to have theirhair cut at beauty salons instead of barber shops. The feevaries according to shop, but it is usually around 10,000won.

KTX (Gwangmyeong Station)The bullet train (KTX) can be boarded atGwangmyeong Station without going to SeoulStation or Yongsan Station. Passengers boarding theKTX at Gwangmyeong Station can arrive in Busanin about 2 hours.

Driver's License 4International License HoldersAccording to the Geneva Agreement an International Driver's License is valid in Korea for up toone year. Any foreigner who intends to stay longer or has an expired International License mustconvert his/her foreign license (license issued by home government) into a Korean license.

Foreign License HoldersForeign license holders without an international license may receive a Korean driver's licenseafter passing a simple physical examination. However, according to the principle of reciprocity,only foreign license holders from a country that recognizes a Korean license will be exempt fromdriving tests. Television sets can be purchased at electronics shops or large discount stores. A 20-inch TV setcan be purchased for around 100,000 won. Apartments usually come with antennas and fixedcable connections, so viewers only need to plug in their TV sets for viewing, but single houses donot have antennas, so users must install antennas to get good reception.Viewers can also subscribe to cable TV. The cable company will install an antenna and viewerscan receive a variety of additional channels. However, in addition to the basic TV reception fee,cable TV subscribers must pay a monthly cable TV fee as well.


- The monthly cable TV fee is around 5,000 won but varies according to region.

- The TV reception fee (2,500 won) is included in the electricity fee.

- When moving out, the cable company must be notified and the contract terminated.

Electricity is available without any separate installation processrequired. The electricity bill is paid each month and most houseshave separate gauges so that occupants are able pay for theamount they actually used. For houses without gauges, the ownercollects the electricity fee from the occupants and pays in total.For independent houses, a separate electricity bill is issued to bepaid at the bank or post office. The bill can be paid through anautomatic payment system or the internet for convenience.

Skylife is Korea's sole digital satellite broadcast operator, and itoffers more variety of services than terrestrial or cable broadcasting.Viewers must install a receiver to receive services. With Skylifeviewers have access to more than 160 channels covering movies,news, music, sports, and foreign broadcasting in addition to publicbroadcasting such as KBS and MBC. The resolution and soundquality is also much better than conventional broadcasting.

Anyone who wishes to use the Internet must subscribe with a service provider. The major serviceproviders are Hanaro, KT, or any local cable broadcasting company. The subscriber must pay formodem rental and installation and a service fee of about 30,000 won each month. Each companyhas its own policy for rates, installation fees, and modem usage, and some companies offer freetrial periods so it is recommended to look into the offerings of each company before choosing aservice provider.

How to Use Banks in Korea are open Monday through Friday from 9:30 to16:30. They are not open Saturdays, Sundays, or legal holidays. When you visit a bank, you must first take a number from thenumber ticket dispenser. The ticket dispenser is usually locatednear the entrance of the bank or in the middle of the row ofwindows. If you cannot find it, you may ask a security guard toindicate where it is. Take your number and wait until it appears onone of LCD displays above the windows. Opening an Account Foreigners residing in Korea can open bank accounts just like Koreans. They can openinstallment savings accounts as well as regular savings accounts. Overseas Remittance of the Korean Won Remittance of Korean won exchanged into foreign currency entails some complicatedrestrictions. Many foreigners remit money in the name of a Korean friend or colleague. You canremit Korean won overseas as follows:

▶▶Foreigners who have resided in Korea for over five years can freely remit up to $10,000 in Korean won peryear, just like Koreans. Any amount over US$ 10,000 is reported to the National Tax Service, and you maybe required to submit documentation to confirm the source of the funds. At the bank, they need to fill in the application form for remittance. They may be requested to present yourpassport and a document that proves your residency in Korea for over five years.

▶▶Foreigners who have resided in Korea less than five years can remit the equivalent of up to US$ 10,000during their stay. If their reentry is confirmed, they may remit up to another US$ 10,000. When remittingfunds, they are required to show passports.

▶▶Foreigners who are on the payroll of an employer can freely remit anamount within the limit of their salaries. They also may remit the equivalentof over US$ 10,000 without their transactions being reported to theNational Tax Service, regardless of whether they have stayed in Koreaover five years or not. Regional Taxes of Gyeonggi ProvinceSome regional taxes are directly managed by the provincial government, others by the municipal,county, or district government. Acquisition Tax When you purchase real estate or an automobile, you are required to report the purchase to theappropriate municipal, county, or district office within 30 days of the purchase and pay theacquisition tax. A penalty fee will be incurred if you miss the deadline.

Registration Taxes When you purchase a piece of real estate or an automobile, you are required to report thepurchase to the relevant municipal, county, or district office and pay the registration tax beforeapplying for a registry/registration of the purchased item.

Property Taxes Those who own buildings, ships, or airplanes are required to pay property taxes. The property taxis billed with other minor tax items, including the Urban Planning Tax, Public Facilities Tax, andEducation Tax. The due period of the tax payment is July 16 to 31.

Automobile Tax Those who own automobiles are required to pay the automobile tax. The tax is supposed to bepaid twice a year in principle. The first due period of the tax payment is June 16 to 30, and thesecond, December 16 to 31.

Taxes in Korea break down largely into national and regional taxes. National taxes are handledby the National Tax Service. Regional taxes are levied by each local autonomous government,including those of the metropolitan cities, provinces, cities, counties, and districts. They varyfrom one jurisdiction to another.

National Taxes The national taxes include the global income tax, corporate tax, inheritance tax, donation tax,value-added tax, special excise tax, and liquor tax. The tax law dictates that foreigners face thesame tax treatment as Koreans.

Income Tax If you receive a salary at work or acquire income from self-employment or other activities, youare obliged to pay the appropriate amount of income taxes. The tax schedule is progressive: thehigher the income, the higher the tax rate. Foreigners who work at a company do not need to go to a tax office to pay their income taxesbecause the company deducts the taxes from each paycheck. Thecompany is required to withhold taxes from the paychecks oftheir employees and remit them to the tax office on behalf of theemployees.

Corporate Taxes Corporations are required to report their income to the tax officeand pay income taxes on their earnings.

VAT (Value-Added Tax) You do not need to pay the VAT directly to the tax office: Almostall commercial transactions, such as purchase of goods and movietickets, already include the VAT. The VAT rate is 10%.

Prices of Goods Some goods sold in Korea have fixed prices; others do not. Large discount stores and departmentstores apply fixed prices. Industrial Trainee Program The Industrial Trainee Program was introduced in 1993 under the Immigration Control Act,requiring two years of training. The act was revised in 2002, however, to require one year oftraining and two following years of employment. Those trainees who do not change theirqualifications to stay after the expiration of the training period and those who remain in Koreaafter their two-year employment contracts expire become illegal aliens.

Industrial Trainees They are not fully covered by the Labor Law of Korea.

OJT Employees � Foreign industrial trainees who, after having finished the one-

year training, have either passed the designated technologyqualification examination or completed the OJT employmenttraining course may get a job as a worker for two years.

� They are fully covered by the Labor Law of Korea just like Koreans.

Transfer of industrial trainees to OJT employees Those who want to become OJT employees must visit the Immigration Office of the Ministry ofJustice and obtain permission to change their visa status (D-3� E-8).

Foreigners Employment Permit System The Foreigners Employment Permit System, which is slated to take effect in 2004, is designed forcompanies that are unable to hire enough Korean workers to legally employ an appropriatenumber of foreign workers. The government takes responsibility for the introduction andmanagement of the foreign workforce, building an efficient management system and maintainingthorough supervision.

▶The visa status of foreign workers employed under the system is E-9 (non-professional employment). Theycan be employed for three years, but a change in workplaces is prohibited in principle. ▶They are subject to same treatment under the labor laws as Koreans, entitled to basic labor rights, including

the minimum wage and the three primary labor rights. ▶They are covered by medical insurance, industrial accident insurance, and employment insurance as a

matter of course. The national pension is, on the principle of reciprocity, applicable only to workers fromcountries where foreign workers benefit from the national pension scheme. ▶When the foreigners employment permit system takes full effect, a strong crackdown on illegal aliens and

their employers will be conducted, eliminating opportunities for unlawful employment at source.

Minimum wage is guaranteed. The laws guarantee the minimum wage for workers to protect their livelihood.

Labor hours and working overtime Employees who work overtime are entitled to extra allowances for the overtime.

Compensation for industrial accidents If workers are injured, contract a disease, or die at a workplace in the course of performing theirduties, the employer is responsible for compensation. The workers may demand compensationfrom the employer or claim payment of insurance money as provided under the IndustrialAccident Compensation Insurance Act via the Korea Labor Welfare Corporation, an organizationunder the Ministry of Labor.

� You should not sign your name on a document before making sure what it is about.

� You must not put your passport and flight ticket in the hand of your employer. Even if theemployer asks for them, make it clear that they belong only to you and keep them safe.

� It is safer to make a labor contract in writing. A verbal commitment may not normally beproblematic, but you will have difficulty proving your case in the event of a dispute.

� You should carefully read the working conditions before agreeing on them with the employer._ You should check what the workplace is like.

You need to check if the employer has often delayed payment, if industrial accidents haveoccurred many times, if the safety system is properly in place, and how good the lodgings are.


Korea guarantees the human rights of workers through the labor laws. The labor laws include theLabor Standards Act, Minimum Wage Act, Industrial Accident Compensation Act, and others.The rights guaranteed by the labor laws in Korea are as follows:

They shall not be subject to discrimination. The employer is prohibited from discriminating against foreign workers with regard to workingconditions on the basis of their sex, nationality, religion, or social status. Discrimination offoreign workers is, therefore, banned in principle whether they are industrial trainees or workersemployed despite illegal aliens status.

Forced labor and acts of violence are prohibited. The employer shall not force labor by acts of violence, threat, detention, or any other means thatrestrict mental or physical freedom unjustly. They shall not forbid workers leaving the premisesof the workplace nor force them to work overtime or at night and/or on holidays.

Forced saving of money is prohibited. The employer is prohibited from forcing workers to save money for any reason. Therefore, theycannot deduct part of workers’ pay in the name of saving for them.
