Through the processing of the application a biodiversity checklist was submitted including an assessment of the site. Natural Environment Division were consulted and is content that the proposed development is unlikely to significantly impact protected or priority habitats. DfI - Roads offers no objection to this development proposal subject to appropriate conditions. The proposal is policy compliant with PPS 3 Access Movement and Parking.

Proposed dwellings would be unduly prominent

This is an outline planning application and appropriate conditions will be applied to any potential decision notice with regard to ridge height, levels and landscaping to ensure the development is not prominent in the landscape.

Not a substantial and built up frontage and would create a ribbon of development

The proposed site represents a suitable gap within the existing roadside development along Ballyregan Road sufficient to accommodate up to a maximum of two dwellings within a substantially and continuously built up and common frontage in compliance with Policy CTY8 of PPS 21.

Rural Character The view was expressed that the proposal would change the rural character of the area and is an important visual break. The proposal is policy compliant with policies CTY 1 and CTY 8 of PPS 21 Sustainable Development in the Countryside which sets out the planning policies for development in the countryside.

Loss of privacy to neighbouring properties

The separation distances and boundary treatment would ensure that the design and layout will not conflict with adjacent land uses and there is no unacceptable adverse effect on existing or proposed properties in terms of overlooking, loss of light, overshadowing, noise or other disturbance.

Consideration of Objections Issue Consideration of Issue Flood Risk Concern has been expressed that there is a watercourse on the boundary

of the site that is prone to flooding, and therefore the dwellings will be susceptible to flooding. Amended plans were received on the 22/1/18, 27/4/18/, 25/6/18 and 2/10/18 with the proposal shown to be removed from of the flood plain.

The proposed buildings will increase the risk of flooding and damage to the objector’s property.

A flood risk assessment and a drainage assessment were submitted. Rivers were also asked to comment on the initial objection. In their final consultation Rivers stated that the applicant has shown that all works are taking place outside the determined 1 in 100 year fluvial floodplain, so they had no reason to disagree with its conclusions, therefore had no objections to the proposed development from a drainage or flood risk perspective. I am satisfied that any concerns raised regarding flooding have been addressed.

Natural Heritage Issues

The view was expressed that a biodiversity checklist submitted did not address the concerns raised in their initial objection. The biodiversity checklist was sent to NIEA and no concerns were raised in this regard.
