Statement of Sh. Dharmender Kumar, S/o Sh. Niranjan Kumar, R/o C-203, Plot no. 13, Shubham Apartments, Sector-22, Dwarka, New Delhi.On S.A

I am the complainant / rightful owner in the present case. I have voluntarily compromised the offences under Section 379/411 IPC with the accused. I do not want to proceed further against him. I may kindly be allowed to compound the offences U/s. 379/411 IPC with the accused. I have also filed photocopy of passport in proof of my identity.RO&AC



Order:-Statement of the complainant has been recorded.In view of same, offences U/s 379/411 IPC are allowed

to be compounded and accused is acquitted for the said offences.Accused be released from JC, if not required in

any other case.An application moved by complainant for releasing of

mobile phone is pending for disposal. Complainant has also filed photocopies of bills of mobile phone. Since, the matter has been settled, application is allowed and mobile phone be released to the complainant Sh. Dharmender Kumar.

Copy of order be given dasti to the complainant.Copy of order be also attached with the warrants of

accused.File be consigned to Record Room after necessary

11.05.2015By this order, I shall dispose of bail application of

accused Pradeep Kumar.

Present: Ld. Addl. PP for the state.Sh. Amit Kumar, Ld. counsel for applicant / accused.Report has already been filed. It is submitted by Ld. counsel for applicant / accused

that accused is poor person and has been falsely implicated in the present case and he is in custody since 06.04.2015. It is further submitted by Ld. defence counsel that there is no evidence against the accused person. It is further submitted by Ld. defence counsel that co-accused persons have already been granted bail and no purpose would be served by keeping the accused in JC and hence, it is prayed that accused be released on bail.

On the other hand, Ld. Addl. PP for the state has opposed the bail application.

I have heard the arguments of Ld. defence counsel, Ld. Addl. PP for the state as well as perused the record.

Keeping in view the facts and circumstances of the case and also the fact that the accused is in custody since 06.04.2015 and co-accused have already been granted bail, accused is admitted to bail on furnishing a personal bond in the sum of Rs.7,000/- with one surety in the like amount.

Application stands disposed of accordingly.

Copy of the order be also sent to concerned Jail Superintendent for information.
