Annex 1 – Mandatory Conditions 01 Where any condition of this licence requires that, at specified times, one or more individuals must be at the premises to carry out a security activity, each such individual must be licensed by the Security Industry Authority subject to any exemptions in accordance with the provisions of the Private Security Industry Act 2001. 02 Where a programme includes a film in the 12A, 15 or 18 category, no person appearing to be under the age of 12 (and unaccompanied in that case), 15 or 18 as appropriate shall be admitted to any part of the programme; and the licence holder shall display in a conspicuous position a notice in the following terms: PERSONS UNDER THE AGE OF [INSERT APPROPRIATE AGE] CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME. Where films of different categories form part of the same programme, the notice shall refer to the oldest age restriction. This condition does not apply to members of staff under the relevant age while on duty provided that the prior written consent of the person’s parents or legal guardian has first been obtained. 03 Immediately before each exhibition at the premises of a film passed by the British Board of Film Classification there shall be exhibited on screen for at least five seconds in such a manner as to be easily read by all persons in the auditorium, a reproduction of the certificate of the Board indicating the category of the film. For a film passed by the Licensing Authority, notices shall be displayed both inside and outside the premises so that persons entering can readily read them and be aware of the category attached to any film or trailer. 04 If the Licensing Authority does not agree with the category in which any film passed by the British Board of Film Classification is placed, they shall be at liberty to alter such category, and, on notice of such alteration being given by the Licensing Authority to the licence holder, the film thereafter shall be treated as having been placed in the altered category and the conditions applicable to the exhibition of films in such altered category shall be complied with. If the Licensing Authority requests the licence holder to exhibit to them any film, he shall do so at such reasonable time as the licensing authority may, in writing, direct. 05 No supply of alcohol may be made under the premises licence- (a) at a time when there is no designated premises supervisor in respect of the premises licence, or (b) at a time when the designated premises supervisor does not hold a personal licence or his/her personal licence is suspended.

06 Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. 07 (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises. (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance or harm to children: (a) games or other activities which require or encourage, or are designed to require or encourage individuals to - (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or (ii) drink as much alcohol as possible (whether within a time limit or otherwise); (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act); (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less; (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on - (i) the outcome of a race, competition or other event or process, or (ii) the likelihood of anything occurring or not occurring; (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can be reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner. 08 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that person is unable to drink without assistance by reason of a disability). 09 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

10 The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark. 11 The responsible person shall ensure that: (a) where any of the following alcoholic drinks is sold and supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures:- (i) beer or cider: 1/2 pint; (ii) gin, rum,vodka or whisky: 25ml or 35ml; and (iii) still wine in a glass: 125 ml; and (b) customers are made aware of the availability of these measures. 12 (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price. (2) For the purposes of the condition set out in paragraph 1 - (a) "duty" is to be construed in accordance with the Alcoholic Liquor Duties Act 1979; (b) "permitted price" is the price found by applying the formula - P = D + (D x V) where - (i) P is the permitted price, (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol; (c) "relevant person" means, in relation to premises in respect of which there is in force a premises licence - (i) the holder of the premises licence, (ii) the designated premises supervisor (if any) in respect of such a licence, or (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

(d) "relevant person" means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and (e) "valued added tax" means value added tax charged in accordance with the Value Added Tax Act 1994. (3) Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny. (4) (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day ("the first day") would be different from the permitted price on the next day ("the second day") as a result of a change to the rate of duty or value added tax. (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

Annex 3 – Conditions attached after a hearing by the licensing authority 01 There shall be no direct access for members of the public between the premises to which this licence relates and the adjacent venue located within the perimeter of the same building. 02 There will be no striptease or lap dancing for, or on behalf of, the licence holder at the premises 03 Persons under the age of 18 years will not be admitted to the premises except in the company of a responsible adult unless they are attending types of regulated entertainment especially organised for the youth market. 04 At all times when the premises are open to the public for the provision of licensable activities, there shall be a sufficient number of staff in the building for ensuring compliance with the conditions of the licence or such numbers as may be requested by the Chief Officer of Police for ensuring adequate public order.In any case, between the hours of 20:00 and the closing time of the venue, the licence holder shall ensure the provision of a ratio of 3 door supervisors for the first 200 customers, then 1 per hundred thereafter. This ratio refers only to door supervisors employed solely on door supervisor duties, ie. safety and security. 05 The licence holder shall ensure that where door supervisors are employed for security purposes both within the venue and for the purposes of monitoring the entrance and exits, those staff shall wear a fluorescent and/or reflective orange tabard, clearly marked "door supervisor". The tabard should also be fitted with a clear plastic window on the chest area in which to satisfactorily display the licence issued to the door supervisor by the Security Industry Authority. This condition may be disapplied at the discretion of the Chief Officer of Police. 06 At the terminal hour of operation, the licence holder shall ensure that adequate numbers of door supervisors are employed to assist with the management of customers leaving the venue as well as those remaining in the vicinity of the premises. 07 From one hour before the closing time as provided by this licence, there will be no supply of alcohol. Further, there will be no further admissions or readmissions to the premises. This criteria will apply even when due to a dynamic management on the night, a premise prepares to close earlier than the timings permit. The licence holder shall also comply with the following: a) Thirty minutes before closing time there will be no consumption of alcohol; b) Wind down music and increased lighting shall be utilised during this period; c) The supply of non-alcoholic drinks shall continue until the closing hour. The wind down conditions do not prevent the premises from closing when all patrons have vacated the premises.

08 The licence holder shall comply with the following conditions relating to the CCTV system installed at the premises: Operation and Storage. The CCTV system must be fully operational whilst the venue is open to the public. The recording equipment should be stored and operated in a secure environment with limited access, to avoid damage, theft, unauthorised viewing and maintain the integrity of the system. A record should be kept of any access made to information held on the system. The system should be regularly maintained and serviced. The system clock should be checked regularly for accuracy taking account of GMT and BST. The images produced will be time and date stamped. Digital systems will have sufficient storage capacity for 31 days good quality pictures or such other timings for retention of images as may be agreed in writing with the Chief Officer of Police. Access It is important that the Police are able to access data from the systems quickly and easily and therefore provision should be made for someone to have access to the secure area and also be able to operate the equipment. All operators receive training from the installer when equipment is installed and will be cascaded down to new members of staff. A simple operator’s manual available to assist in replaying and exporting data (particularly important with digital systems). 09 This Licence shall have no effect until such time as a satisfactory Dispersal Procedure has been agreed, in writing, with the appropriate responsible authorities or if agreement cannot be reached, shall be referred to the Licensing Authority for final determination. The Dispersal Policy shall include reference to: a) adequate CCTV provision outside the premises controlled and linked to the Local Authority CCTV system; b) adequate lighting to be provided within the vicinity of the premises; c) improvements to the highway; d) management of waste; e) adequate supervision/marshalling of persons entering/leaving the premises; f) any other such requirements that may subsequently emerge which impact upon the promotion of the licensing objectives. 10 Any measures identified in condition 9 above shall be implemented and completed to the satisfaction of the responsible authorities prior to the premises opening to the public and if agreement cannot be reached, shall be referred to the Licensing Authority for final determination. 11 Where required by the Police, a text, pager or radio will be used to keep in contact with other premises in Portsmouth. Such text, pager or radio shall be kept in good working order and shall

be monitored by a responsible member of staff. Relevant incidents of crime or disorder shall be reported to the Police via the text, pager or radio. 12 The licence holder shall maintain a duty register giving details of each and every person employed in the role of a security/door person and shall provide upon request by any Police Officer or Council Officer, the following details:- (a) The licence number, name, date of birth and residential address of that person; (b) The time at which he/she commenced that period of duty, with a signed acknowledgement by that person; ( c) The time at which he/she finished the period of duty, with a signed acknowledgement by that person; (d) Any times during the period of duty when he/she was not on duty; (e) If that person is not an employee of the licence holder, the name of the person by whom that person is employed or through whom the services of that person were engaged; (f) The register shall be so kept that it can be readily inspected by an authorised officer of the Council or Police Officer; (g) The duty register shall comprise of a bound, consecutively page-numbered book and the licence holder shall ensure that this register is kept in a secure environment in order to prevent unauthorised access or alterations to same. 13 Any female customer who needs to be searched shall be searched by a female door supervisor or a female member of staff. 14 No person who is drunk or disorderly will be allowed access to or be allowed to remain on the premises. 15 No person who is the subject of a court banning order or who is restricted access through a Pubwatch/Clubwatch Scheme will be allowed in the premises provided the details of such person have been provided to the premises by the Police. 16 Any customer who behaves inappropriately shall be barred from the premises and their details passed to any relevant Pubwatch/Clubwatch Scheme. 17 The licence holder shall co-operate with the responsible authorities in relation to dealing with issues of drugs on the premises. 18 Random searching shall take place of those people suspected of carrying drugs or offensive weapons. 19 Agreement shall be reached with the Police about the storage of such drugs or weapons recovered from customers as part of the search procedure and their delivery to the Police. 20 No customer shall be allowed to bring open or sealed bottles on to the premises and no person shall be allowed to leave the premises with any bottle or glass. 21 Tables shall be cleared of all empty bottles and glasses on a regular basis.

22 A notice shall be displayed at the entrance to the premises that CCTV is in operation in the premises. 23 Photographic driving licences, passports or in agreement with the Police, a form of identification with the PASS hologram, will be used as evidence to confirm the age of anyone who appears to be under the age of 18 years. 24 The manager of the premises shall be an active member of any local Pubwatch or Clubwatch Scheme. 25 An incident book shall be kept at the premises in which will be recorded all incidents of crime and disorder. This book will be reviewed by senior management in association with the designated premises supervisor. 26 All staff who work behind the bar shall be fully trained to ensure that no person who is drunk, or disorderly or who appears to be under the age of 18 years is served with intoxicating liquor, such training to be repeated every 6 months. 27 Any glasses into which drink is dispensed shall be made from toughened shatterproof glass. 28 The holder of the premises licence shall maintain suitable and sufficient sound attenuation throughout the whole of the building. 29 The holder of the premises licence shall ensure that the noise limited (where fitted) is used and maintained as set up by the qualified sound engineer. 30 The holder of the premises licence shall adopt a bespoke dispersal policy for the premises and shall provide any of the responsible authorities with a copy of it if requested to do so. 31 Noise or vibration from within the premises or from any plant machinery or equipment shall not emanate from the premises so as to cause a nuisance to any residential dwelling. 32 All staff shall be trained to ensure that no person under the age of 18 years will be sold alcohol including the need for any person who looks under the age of 18 years to provide evidence of their age. 33 At all times the licence holder will maintain a comprehensive policy for the protection of children. 34 Signs shall be displayed at the bar stating that any person who appears under the age of 18 years will not be served with alcohol. 35 The licence holder, when holding specially organised events for the youth market, shall ensure that the venue adheres to the following documentation: a) Admission policy;

b) General Policies Statement; c) Code of Conduct for Staff Statement; d) Child Protection Policy. 36 The premises shall not open to the public until all of the responsible authorities have visited the premises and have confirmed the premises are safe to open. 37 The premises shall not open to the public until all relevant safety certificates have been provided to the responsible authorities. 38 The maximum occupancy capacity for the premises shall be 1910 persons subject to any views by the Chief Fire Officer. 39 An accurate record shall be kept of the number of persons admitted to each part of the premises and such records shall be retained for a period of 6 months and shall be made available to the responsible authorities. 40 There shall be a suitable number of adequately trained staff to prevent overcrowding in parts of the premises, keep exit routes clear and to ensure the safe evacuation of people from the premises. In the event of an emergency, such staff shall have been issued with specific duties in the event of an emergency. 41 A Fire Evacuation Plan shall be agreed with the Chief Fire Officer. 42 All staff shall have received training on the safe evacuation of the premises in the event of an emergency and such training shall be repeated at least annually. A record of the training provided shall be kept at the premises for at least 12 months and shall be made available to the Fire Authority or Licensing Authority. 43 Adequate arrangements shall be made in the Fire Evacuation Plan to ensure the safe evacuation of any disabled persons in the event of an emergency. 44 All fire escape routes and access to emergency vehicles shall be kept unobstructed and will be clearly identifiable. 45 All escape doors and escape routes shall be checked before the premises open for trading to the public and record of the check shall be maintained. 46 All fire exit doors shall be available and shall be capable of opening without the use of any key, card, code or similar means. 47 Fire doors shall be self-closing and shall not be held open other than by devices approved by the Fire Authority. 48 Edges to steps and stairways shall be maintained so as to be conspicuous.

49 All fabrics and furnishings shall comply with the relevant British Standard with regard to fire resistance including hangings, curtains and temporary decorations. 50 Any upholstered seating shall comply with current fire safety regulations. 51 Notices detailing the action to be taken in the event of fire or other emergency will be prominently displayed in the premises. 52 Fire alarm/fire evacuation/emergency lighting tests will be carried out at least monthly and a record maintained of those tests. Such records shall be kept at the premises for at least 12 months and made available to the Fire Authority and Licensing Authority. 53 All fire fighting equipment will be maintained in good working order and shall be available for immediate use. Such equipment will be inspected annually by a competent person and records of those inspections must be kept at the premises for at least 12 months and made available to the Fire Authority and Licensing Authority. 54 At least one first-aider, trained to deal with problems associated with alcohol and drugs, shall be on duty and if there are more than one persons on duty, then their roles shall be clearly defined. 55 All emergency lighting and fire safety signage shall be maintained in good working order and will not be altered without the approval of the Fire Authority. The emergency lighting will be capable of lasting at full capacity for not less than 3 hours. 56 All electrical installations shall be inspected by a competent person before the expiry of the current electrical certificate and the certificate issued will be the current standard form certificate issued by that competent person's professional body. 57 If any work is undertaken to the electrical installation, it shall be inspected, tested and certified by a competent person as soon as possible. 58 All electrical socket outlets provided for entertainers portable equipment must be protected by a residual current device with is part of the fixed wiring, such RCDs to have a rated residual operating current not exceeding 30 milliamps and a maximum operating time of 30 milliseconds. The RCDs must be tested before the sockets are used for entertainers. 59 No lasers or pyrotechnics will be used without the prior approval of the Licensing Authority. 60 There shall be no demonstration of hypnotism without the prior approval of the Licensing Authority. 61 An adequate supply of free drinking water shall be provided for all customers. 62 Risk assessments (including a fire risk assessment) shall be carried out and following such assessment, an action plan shall be prepared and any additional action required shall be implemented. This shall be reviewed annually.

63 A qualified medical practitioner shall be present throughout any sporting entertainment involving boxing, wrestling, judo, karate or sport of a similar nature. 64 Where a ring is used, it shall be constructed by a competent person and shall be inspected by a competent authority before use and any material used to form the skirt of the ring shall be flame retardant. 65 Members of the public shall not occupy any seat wich is closer than 2.5 metres to the ring. 66 The licence holder shall ensure that the variation of the layout of the premises shall have effect upon the completion of the works as notified to the Licesing Authority in writing relating to the smoking terrace added to the roof area and Bar 4 layout undergone minor amendments to avoid existing steelwork. 67 The licence holder shall ensure in relation to the smoking terrace added to the roof area that: 1. No fixed seating within 1 metre of the screening. 2. The maximum of one drink at any one time to be carried up by the patron. 3. No glasses to be taken on to the roof terrace area, plastic only. 4. All ashtrays to be non-glass. 5. All furniture to be fixed, including bins. 6 One steward/supervisor to be present on the roof terrace after 20:30hrs daily. 68 The licence holder shall ensure that regulated entertainment shall not be provided to the external smoking area or to the stepps leading to it.
