Did you know . . . . .

Clement Clarke Moore (1779-1863) wrote the poem “Twas the night before Christmas” also called “A Visit from St. Nicholas” in 1822. It is now the tradition in many American families to read the poem every Christmas Eve. The New York Sentinel first published the poem on December 23, 1823 and it was an immediate success. It was not until 1844 that Clement Clarke Moore claimed ownership when the work was included in a book of his poetry.

What tradition will you start this year or continue with your family this year? Does it mean hosting a Christmas gathering at your home, attending a Christmas Eve program, playing games with family and friends or traveling to parents’ or grandparents’ homes? Oh, so many great and wonderful memories!

I’m also looking forward to the HBAL Christmas Party on December 6 at Hillcrest Country Club. What an evening this will be with great friends, great fun and great music! I look forward to seeing each and every one of you as we enjoy the evening together.

Tis the Month Before ChristmasTis the month before Christmas, we’re all going nuts;

With so much to do, there’s no ifs, ands or buts. Buy presents, hang tree lights, pop cards in the mail, Send gift packs, thread popcorn, find turkeys on sale.

Decorations need stringing up all through the house. And you haven’t a clue what to buy for your spouse.

School concerts, receptions, open houses with friends, Long lineups, short tempers, tying up the loose ends.

With all our mad dashing, we’re reeling from shock; Let’s stop for a minute and really take stock.

It’s crassly commercial, the cynical say; If that’s true, that our fault-it’s us and not they.

Take time for yourself-though hard as that seems— Enjoy your kids’ laughter, excitement and dreams.

Take a moment out now, don’t get overly riled, Instead make an angel in snow with your child.

The shortbread can wait, and so can the tree; What’s important to feel is a child’s sense of glee. The holidays aren’t about push, rush and shove;

They’re for friendship and sharing and family love.

Hear the bells, feel the warmth, light up with the glow Of a message first sent to us so long ago:

Peace, love and goodwill, and hope burning bright. Merry Christmas to all, and to all a good night!

2012 Year-End Tax Strategies for Business OwnersProvided by Brian Willet, Waddell & ReedTax reform is one of the most contentious topics in this year’s election, with both personal and corporate income tax rates under scrutiny. While leaders in both parties agree that corporate rates should be reduced from the current high of 35%, they differ on how to do so without further widening the budget deficit. Should foreign income continue to be taxed, and if so, how? Should deductible expenses be reduced or eliminated, and if so, which ones? And what will be the overall economic impact when 9 out of 10 businesses don’t even pay corporate income taxes? Indeed, according to the Senate Finance Committee, 95% of all U.S. businesses are structured as “pass-through” entities, which means their income is reported on owners’ personal income tax returns.*

Regardless of whether you pay corporate or personal income tax on your business income, you probably know that time is of the essence when it comes to tax reform. If Congress doesn’t act by December 31, the nation will face the ominously and now infamously named “fiscal cliff”--the series of impending tax code and budgetary spending changes that some economists say will propel us into another protracted recession.

So what should a business owner do--wait for Congress to act or plan now for the looming cliff? Perhaps a good move might be to plan ahead while remaining flexible enough to address last-minute changes. Following are some strategies you might want to consider. Be sure to consult your tax advisor to see how these suggestions apply to your particular situation.

Reverse the rulesTypically, the advice for business owners at the end of any year is to defer income to the following year to help reduce the organization’s current income tax obligation. However, because individual income tax rates are scheduled to rise in 2013, this year may call for a reverse strategy. If your organization is taxed as a pass-through entity and your accounting method permits it, you may want to consider accelerating revenue into 2012 to take advantage of the current lower rates.

Similarly, owners of C corporations may want to consider cashing in on appreciated stock or paying themselves in dividends to take advantage of lower capital gains and dividend rates slated to expire at the end of the year.

Another rule-reversal move would be to consider deferring deductions and capital losses until 2013 to maximize your company’s tax profile in a higher-rate environment.

Buy needed equipment and put it to useThere is one case where you may not want to defer deductions: if you think you’ll need new office furniture or equipment in 2013, you may want to make that purchase in 2012. That’s because two special provisions enacted several years ago to help spur business investment will expire at year’s end.

The first is a temporary increase in the Section 179 property-expensing deduction, which allows a business to deduct the entire cost of qualified equipment in the year it was purchased rather than utilize the standard depreciation schedule.** In 2012, businesses can deduct up to $139,000 of the cost of qualified property, up to a maximum total property purchase of $560,000. (Total property purchases above that ceiling will reduce the amount of the allowable deduction.) The second provision is a special first-year bonus depreciation allowance of 50% of the cost of the equipment, which is not subject to the $560,000 limit.** In 2013, the $139,000 and $560,000 Section 179 property-expensing limits are scheduled to plummet to $25,000 and $200,000, respectively, while the 50% bonus depreciation allowance will be eliminated.

The Section 179 deduction and the bonus depreciation allowance can be used in conjunction with one another. It’s worth analyzing these two provisions and comparing them with the standard depreciation deductions to determine the best possible tax-planning moves for your business.

Vehicle purchases also receive favorable tax treatment until the end of 2012. This is particularly true for heavy sport-utility vehicles and pickups with a gross vehicle weight rating in excess of 6,000 pounds, which may qualify for special depreciation and Section 179 allowances.

Note that property must be placed into service, not merely purchased, by the end of 2012 in order to qualify.

Hire a veteranIn 2011, the Vow to Hire Heroes Act extended the Work Opportunity Tax Credit to encourage employers to hire unemployed veterans. The credit, which also expires at the end of this year, ranges from $2,400 to $9,600 depending on several factors, including length of employment and whether the veteran has a service-related disability. Note that the veteran must begin work prior to January 1, 2013. For more information on hiring a veteran, visit the Department of Labor’s Veterans’ Employment and Training Service web page at www.dol.gov/vets/.

Be watchfulAlthough there is some risk in not waiting to see if Congress acts by year’s end, these are just some of the moves you may want to make now to take advantage of current, and potentially short-lived, tax benefits. In the meantime, keep a close eye on Washington to see what legislative changes may lie ahead.

So whether you are laying sod, seeding, grading, tilling, trimming, planting, installing hardscapes, or whatever else, you’re good to grow.

General Membership Meeting

General Membership MeetingNovember 12, 2012 • Nebraska Champions Club

HBAL members had two opportunities to hear Elliot Eisenberg, Ph.D. speak last month.

Elliot’s first presentation was on the economic impact of home building in Nebraska at the City Council Chambers. This is available for replay on 5 City-TV’s website:

www.lincoln.ne.gov/city/mayor/cic/5citytv/index.htmLater that evening at the General Membership Meeting, Elliot spoke about the negative effect regulation can have on the economy.

October was a busy month for the Lincoln Home Builders Care Foundation’s community service projects. Jerry Boyce (right) and Mark Aksamit (below) reported at the General Membership Meeting on the success of the Habitat for Humanity Blitz Build and Santa Cop Project. See photos from these events on pages 10-11,14-17.

The Lincoln Home Builders Care Foundation’s mission is to support the educational and charitable activities of the Home Builders Association of Lincoln. The Foundation strives to support the community by contributing to community service projects focused on housing, as well as providing scholarships for students pursuing a career related to the building industry, and providing funding for other industry related educational and research programs.

Please consider a contribution to the Lincoln Home Builders Care Foundation this Holiday Season. Named scholarships can be established with larger or planned contributions to be awarded to worthy students who plan to enter our industry.

Gifts are tax deductible to this 501(c)(3) non-profit organization. Please contact Bob Bryant (402-486-1040) or Mike Benker (402-423-4225) if you have questions.

Lincoln Included in List of Improving Housing Markets for 12 Straight Months

Lincoln’s housing market is showing signs of improvement. Building permits are on the rise and we are on track to have the highest number of permits pulled in 2012 than in any of the last four years. Another notable sign is Lincoln’s presence in the list of improving housing markets for the twelfth straight month.

The National Association of Home Builders/First American Improving Markets Index (IMI) identifies metropolitan areas that have shown improvement from their respective troughs in housing permits, employment and house prices for at least six consecutive months.

The IMI is designed to track housing markets throughout the

country that are showing signs of improving economic health. The index measures three sets of independent monthly data to get a mark on the top improving Metropolitan Statistical Areas.

The three indicators that are analyzed are employment growth from the Bureau of Labor Statistics, housing price appreciation from Freddie Mac and single-family housing permit growth from the U.S. Census Bureau. NAHB uses the latest available data from these sources to generate a list of improving markets. A metropolitan area must see improvement in all three measures for at least six consecutive months following those measures’ respective troughs before being included on the improving markets list.
