A. APPROVAL OF AGENDA LC001-96 That the agenda for the February 14, 1996, Licensing Committee meeting be approved as printed. CARRIED B. CONFLICTS OF INTEREST Nil C. DELEGATIONS D. REPORTS D1. Adult Entertainment Parlours - registration of dancers & proposed Sunday Opening Discussion took place regarding the proposed new by-law changes dealing with the registration of the

dancers and days of closure. The owners requested a change to the registration form and enforcers of the by-law will only accept the identification listed on the forms (not all Government Issued I.D.’s are being accepted). The owners also requested that they be allowed to open on Good Friday, as some owners are opening and only receiving a $600.00 fine, but the business generated is much higher.

LC002-96 That the registration form be changed to include any Federal/Provincial issued identification, and; That the “Manager or Designate” be changed to read the “Owner or Designate” and That the records be kept for a minimum of 2 years, and That the issue of opening on Good Friday be discussed at the Works and Transportation Meeting

of February 21, 1996, and That the By-law be forward to the Works and Transportation meeting of February 21, 1996. CARRIED D2. Transient Traders This item was placed on the agenda at the request of City Councillor Richards, who was given the

information prior to the meeting. Nothing was discussed at the meeting. D3. Taxi Owner Plates - issuance and fees, notes of the public meeting of February 8, 1996. Discussion took place as to what population figures would be used to determine whether or not taxi license

plates would be issued. Discussion also took place as to the ratio to be used. LC003-96 That the minutes of the Public Meeting of February 8, 1996 be received and forward to the Works

and Transportation Meeting of February 1, 1996, without recommendation, and

That a report be prepared by Mr. Paul Howorun, Director, Works & Transportation, to be presented to the Works and Transportation Committee on February 21, 1996, re: Proposed formula for Taxi Cab ratio to the City’s population.

CARRIED E. ADDITIONAL ITEMS 1. Tow Truck Driver Report - update Nothing to report. 2. Flea Market/Food Handler - update Nothing to report. Question Period 1. P. Dray, Prosecutor, Legal Services, informed committee that 13 Flower Vendors had been charged, trial

dates where set and $100.00 fines were imposed. 2. City Councillor Hunter requested a report be written regarding the Hatch Decision on Lap Dancing to be

forwarded to the Works and Transportation meeting of February 21, 1996. 3. City Councillor Cowie requested a report from the legal department on the possibility of having a tribunal

set up for first time offenders of City By-laws, whereby a tuition fee would be charged and a training program would be provided.

Licenses on a population ratio. He felt that a ratio of 1/2,100 would be beneficial. LC005-96 That the delegation of Mr. Rajinder Sandhu to the March 6,1996, Licensing Committee be

received. CARRIED 2. Sami Khairallah, re: Taxi Cabs Mr. Sami Khairallah appeared before committee to speak in favour of the decision to issue Taxi Cab

Licenses on a population ratio. He also suggested that other criteria be considered and not just population, i.e. economic situation, actual accounts of brokers.

LC006-96 That the delegation of Mr. Sami Khairallah to the March 6, 1996, Licensing Committee be

received. CARRIED 3. Inderjit Singh, re: Taxi Cabs Mr. Inderjit Singh spoke against the formula for issuing taxi cab licenses. He felt the ratio was too high

and would like to see an increase in the number of plates available. Mr. Singh felt that the increase of taxi’s on the road would increase revenue by way of competition between taxi cab companies.

4. Ernie Mowat, re: Taxi Cabs Mr. Ernie Mowat spoke in favour of the proposed formula for the issuance of Taxi plates. LC008-96 That the delegation of Mr. Ernie Mowat to the March 6, 1996, Licensing Committee be received. CARRIED D. REPORTS 1. Report from Mr. P. Howorun, Director, Works and Transportation dated February 21,1 996, re: Formula

for the Issuance of Taxi Plates. LC009-96 That the report from Mr. P. Howorun, Director, Works and Transportation, dated February 21,

1996, re: Formula for the Issuance of Taxi Plates be received; and That no new taxi plates be issued in 1996; and That the population figures be based on Statistics Canada data and that new residential occupancies be used to determine population growth for the issuance of plates; and That the by-law be amended to lift the 200 plate ceiling and be replaced with the formula using residential occupancies; and That new plates issued will be based on 1,800 people per plate should Statistics Canada’s census show a Brampton population of 256,000 or 2,100 people per plate should Statistics Canada’s census show a Brampton population of 269,000 for 1995; and

That a maximum of five plates be issued in any year commencing in 1997; and That this formula be reviewed with the taxi industry every three years.

CARRIED 2. Verbal report from Mr. P. Howorun, Director, Works and Transportation re: Uses Fee Study. Mr. Howorun informed committee that a User Fee Study has been asked through the Budget Process and

that he will be preparing a report for September 1996 on the Licensing User Fee structure to be approved by this committee and that the report will be used in 1997 Budget preparations.

ADDITIONAL ITEMS 1. Tow Truck Drive Report - update Mr. Howorun informed committee that a Regional Meeting will be taking place in May. Councillor Cowie

and Councillor Hunter informed committee that they have met with someone interested in setting up a Collision Reporting Centre. A report will follow.

Nothing to report. 3. Adult Entertainment Parlours Nothing to report. 4. Bingo Licenses Councillor Hames questioned the information being asked for by applicants for Bingo Licenses. She has

had complaints that staff is asking for more information every time the forms are returned. It was decided that Councillor Hames would speak with P. Howorun directly regarding the group that has complained to her as Licensing has not had any complaints.

5. Paving Contractors Councillor Linton inquired as to the possibility of licensing Paving Contractors and having a standard

contract available for the public to have access to. Legal staff advised that this is an area that would require more discussion as the new Municipal Act allows for this type of licensing, but at present more information is needed to make an informed decision.

Discussion took place regarding the licensing of driveway paving contractors and whether or not this would regulate the industry. Staff informed committee that they are not trying to regulate the industry but provide a backup to home owners wishing to make themselves aware of minimum standards for paving, and by licensing the contractors they then have a basis to go back to the contractor or through civil litigation to have a poor job corrected. City Councillor Bob Hunter asked if there was any objection to City Councillor Bill Cowie becoming the Chairperson for the Licensing Committee as the minutes are forwarded to the Works and Transportation Committee of which City Councillor Cowie is a member and would be able to answer any question that committee may have. Councillor Hunter is not able to make the Works and Transportation Committee meetings. LC017-96 That City Councillor Bill Cowie be the new Chairperson for the Licensing Committee. The Regional Committee is having ongoing discussions regarding conduct, training, fees. The minutes of the Regional Meeting will be distributed to committee members when available. The Regional Committee is also monitoring the fees being charged in the City of Toronto and there is a desire of the committee to wait for the decision of Toronto before proceeding with things here. The next meeting of the Regional Committee is June 25, 1996, in the City of Mississauga. Paul Howorun will advise council members of the location of the meeting (Regional Councillor Bissell). It was asked if a Central Reporting Centre was being looked into by the Regional Committee. Licensing Committee was informed that it has been discussed, but the feeling from the Police and from the Towing Industry is that the system that is in place is working fine and other areas that are testing the Reporting Centre are finding that it isn’t working. The Towing Industry also feel that it is a form of control over them.

2. Flea Market/Food Handlers

The question of how to assess Flea Market/Food Handlers is still with the Assessment Department. Once information has been received as to how Assessment is going to handle things a report will be sent to Licensing Committee. Assessment is looking at taxing the Vendors but there is a control problem involved with this and it needs to be solved.

3. Adult Entertainment Parlours This issue has been completed and may be removed from Tabled Items.

4. Paving Contractors This issue has been completed and may be removed from Tabled Items.

5. Bingo Licenses

Licensing has experienced some problems with people obtaining their bingo license, and reported that some licenses have been suspended. A report will be available for the September meeting of the Licensing Committee.

6. Massage Parlours A report will be available for the September meeting of the Licensing Committee.

7. Pool Installation Contractors A report will be available for the September meeting of the Licensing Committee.

F. OTHER BUSINESS 1. Discussion on the Philosophy of Licensing.

Discussion took place regarding why we license. There are two reasons why we license. 1. As a revenue generator, and 2. To protect the public. In the past licensing was governed under the Municipal Act which stipulated what could be licensed by the Municipality. Bill 26 has now expanded the Cities power to license. The only areas that cannot be licensed are manufacturing and warehousing, and group homes can be registered but not licensed. A report from staff will be coming to the September 1996 meeting of the Licensing Committee.

2. Correspondence from Colm O’Higgins, dated May 9, 1996, re: Taxi Plate -Priority List

Discussion took place regarding the Taxi Plate priority list renewal and the reasoning for the renewal fee. It was explained that under the by-law a renewal fee of $25.00 is to be charged along with the request of verification that the person is still working in the industry. In the past the renewal fee has been charged but verification has not been asked for. Staff are now asking for the verification.

LC018-96 That the correspondence from Colm O’Higgins, dated May 9, 1996, re: Taxi Plate -Priority List

be received. CARRIED 3. Billiard Halls

Paul Howorun requested committee to approve a change in the by-law to allow Billiard Halls to be open until 2:00 a.m. The by-law covers Adult Entertainment Parlours and Billiard Halls. The change was made for Adult Entertainment Parlours but was not done for Billiard Halls.

LC019-96 That By-law 15-91 be amended to reflect the change in hours of operation of Billiard Halls to be

the same as Adult Entertainment Parlours. CARRIED

Detective Mark Marple of the Peel Regional Police Force was in attendance to request support from City Staff by licensing Massage Parlours so that the Police can enforce a by-law. Detective Marple advised the committee that there are 6 Massage Parlours operating in the City of Brampton. Advertisements are found in the Sun, and Brampton Guardian newspapers. Most of the Massage Parlours are located through advertisements, but they are better known as “Body Houses”. There are qualified massage therapists that have the initials of R.M.T. and there are no problems with these type of establishments. The problem is where there is no R.M.T. on staff and sexual favours are also being given with the massage.

CARRIED D. REPORTS: 1. Report from Paul Howorun Director, Works & Transportation /Tom Hillis, Manager of Enforcement,

Works & Transportation dated August 29, 1996, re: Taxi Cab Advisory Committee.

Discussion took place regarding the set-up of a Taxi Cab Advisory Committee. Paul Howorun explained that letters were sent to everyone in the Taxi Industry informing them of the creation of an Advisory committee and asking anyone interested to contact his office. 41 responses were received, and an additional letter was sent to the 41 respondents informing them of a date and time for an initial meeting. The date of the meeting arrived and 17 people from the Taxi Industry attended the meeting. The Advisory Committee was formed from these 17 people.

Licensing Committee questioned the criteria that was used to decide who would be on the committee, the length of time they would be on the committee and how someone else that may be interested would become a member of the committee. After much discussion the following recommendation was made.

Discussion took place regarding the licensing of Pool Installation Contractors and the reason for licensing this trade. The common practice of Pool Installation Contractors is to have the home owner take out the permits and place the security deposit. Staff believe this is penalizing the home owner when the Pool Installer does not complete the clean up and restoration of grass and fences. If the home owner has placed the security deposit then it is the home owners money that is used to pay for the repairs when it should be the contractor paying for the repairs.

Discussion took place regarding the reasons the City of Brampton licenses and what legislation governs what can and can not be licensed as well as the amount of the fee that is charged. Bill 26 deleted the general tax provision and replaced it with allowing Municipalities to charge a fee that reflects the cost of doing business with no net profit. Further discussion took place regarding setting a “Fair Test” or “Framework” to be applied to arrive at all fees being charged.

Mr. Howorun presented correspondence from Mr. Dennis A. Trinaistich, representative of the Ice Cream Truck Vendors, asking for a deferral, as most of the people that should be attending the meeting were unavailable.

1. Tow Truck Driver Report

Tom Hillis informed committee that he had attended a sub-committee meeting of the Tow Truck Industry and that the Authorization Form is in its final stages. A copy of the form was submitted to the committee for their approval. Committee was informed that the final draft of the Authorization Form will be brought back to Committee before it goes into use. Discussion also took place regarding the Tow Truck Driver Hearing that took place on November 20, 1996. Comments were made during the hearing by Police Constable Spence that enforcement of tow truck drivers is not what it should be in Brampton as he is based in Mississauga. Direction was given to staff to investigate how Constable Spence’s time is split and to request that a portion of his time (1 or 2 days) be devoted to Brampton.

2. Flea Market/Food Handlers

Regional Councillor Bissell questioned whether or not Craft Show vendors require a license. Staff responded that permanent locations ie. Rec. Centres do hold licenses and that the Assessment Office is looking into assessing Flea Markets and their vendors for tax collection purposes.

3. Bingo Licenses

Discussion took place regarding roving casinos and whether or not a permanent location has been approved. To date nothing has been approved and changes to the Act are still expected. Staff were asked if we currently license Charity Casinos and they replied that no we do not but the

Councillor Hames questioned whether or not pinball type machines in variety stores are licensed. Staff responded that only locations where the main source of revenue is from pinball type machines are currently licensed. Councillor Hames asked if this could be added to the January agenda.
