Letters Patent Constituting the Sovereign Kingdom of Aotearoa, New Zealand, and

The Government of the Sovereign Kingdom of Aotearoa, New Zealand (SKOA 2015/2406)

King Ruatapu Ariki

MATUA IO TE ATUA The Burning Bush.............The Ball of Fire

We, Ruatapu Ariki, e te iti Tangata o Ngati Hako; Hako, born about 88BC, and his whanau were the first people to arrive and settle on the land of Aotearoa, having first stepped upon the whenua at Tirohia. Whereas, we do hereby Proclaim and Declare by genealogy, that we are of the House of Joseph, he who was sold into Egypt and thus became Ruler thereof under Pharaoh. Some of us are of Joseph, some are of Manasseh, and some are of Ephraim [the Leader of Israel – Ephraim the Birthright Tribe]; Ephraim being the younger son of Joseph. Thus our genealogy coincides with Her Majesty Queen Elizabeth IIs’ Insignia or Royal Coat of Arms, wherein Ephraim is symbolised by the Unicorn, standing opposite the Sceptre Tribe, the Lion – the symbol of the House of Judah from whence, Her Majesty Queen Elizabeth IIs’ genealogy originates.

Now therefore, We, Ruatapu Ariki, non-adverse, non-belligerent, non-combatant, and non-contentious, by the Grace of God, King (Ariki) of Aotearoa, New Zealand, for and in behalf of the Kings (Arikis) of the Sovereign Kingdom of Aotearoa, New Zealand, in their collective capacity, as Sovereign Monarchs and Sovereign Heads of State of the Sovereign Kingdom of Aotearoa, New Zealand, Defenders of the Faith:

To all to whom these presents shall come, Greetings:

Recites the Declaration of Independence 28th October 1835 1. We, the hereditary Chiefs and heads of tribes of the Northern Parts of New

Zealand, being assembled at Waitangi, in the Bay of Islands on this 28th day of October, 1835, declare the Independence of our Country, which is hereby constituted and declared to be an Independent State, under the designation of the United Tribes of New Zealand.

2. All sovereign power and authority within the territories of the United Tribes ofNew Zealand is hereby declared to reside entirely and exclusively in thehereditary chiefs and heads of tribes in their collective capacity, who also declarethat they will not permit any legislative authority separate from themselves in theircollective capacity to exist, nor any function of government to be exercised withinthe said territories, unless by persons appointed by them, and acting under theauthority of laws regularly enacted by them in Congress assembled.

3. The hereditary chiefs and heads of tribes agree to meet in Congress at Waitangi inthe autumn of each year, for the purpose of framing laws for the dispensation ofjustice, the preservation of peace and good order, and the regulation of trade; andthey cordially invite the Southern tribes to lay aside their private animosities andto consult the safety and welfare of our common country, by joining theConfederation of the United Tribes.

They also agree to send a copy of this Declaration to His Majesty, the King of England, to thank him for his acknowledgement of their flag, and in return for the friendship and protection they have shown, are prepared to show, to such of his subjects as have settled in their country, or resorted to its shores, for the purposes of trade, they entreat that he will continue to be the parent of their infant State, and that he will become its Protector from all attempts upon its independence.

Agreed to unanimously on this 28th day of October, 1835, in the presence of His Britannic Majesty’s Resident.

Recites Treaty of Waitangi 1840 HER MAJESTY VICTORIA Queen of the United Kingdom of Great Britain and Ireland regarding with Her Royal Favour the Native Chiefs and Tribes of New Zealand and anxious to protect their just Rights and Property and to secure to them the enjoyment of Peace and Good Order has deemed it necessary in consequence of the great number of Her Majesty's Subjects who have already settled in New Zealand and the rapid extension of Emigration both from Europe and Australia which is still in progress to constitute and appoint a functionary properly authorised to treat with the Aborigines of New Zealand for the recognition of Her Majesty's Sovereign authority over the whole or any part of those islands – Her Majesty therefore being desirous to establish a settled form of Civil Government with a view to avert the evil consequences which must result from the absence of the necessary Laws and Institutions alike to the native population and to Her subjects has been graciously pleased to empower and to authorise me William Hobson a Captain in Her Majesty's Royal Navy Consul and Lieutenant-Governor of such parts of New Zealand as may be or hereafter shall be ceded to her Majesty to invite the confederated and independent Chiefs of New Zealand to concur in the following Articles and Conditions.

The first buying of a thing. A privilege formerly enjoyed by the crown, of buying up provisions and other necessaries, by the intervention of the king’s purveyors, for the use of hid royal household, an appraised valuation, in preference to all others, and even without consent of the owner. 1 Bl. Comm. 287; Garcia v. Callender, 125 N. Y. 307, 26 N. E. 283. Pre-emption claimant. One who has settled upon the land subject to pre-emption, with the intention to acquire title to it, and has complied, or is proceeding to comply, in good faith, with the requirements of the law to perfect his right to it. Acknowledgement: In conveyancing. The act by which a party who has executed an

instrument of conveyance as grantor goes before a competent officer or court, and declares or acknowledges the same as his genuine and voluntary act and deed. The certificate of the officer on such instrument that it has been so acknowledged. Rogers v. Pell, 154 N. Y. 518, 49 N. E. 75; Strong v. Unites States (d. C.) 34 Fed. 17; Burbank v. Ellis, 7 Neb. 156.

The term is also used of the act of a person who vows or admits the truth of certain facts which, if established, will entail a civil liability upon him. Thus, the debtor’s acknowledgement of the creditor’s demand or right of action will toll the staute of limitations. Ft. Scott v. Hickman, 112 U. S. 150, 163, 5 Sup. Ct. 56, 28 L. Ed. 636. Admission

The person who possesses the equitable right to property and receives the rents, issues, and profits thereof, the legal estate of which is vested in a trustee. It has been proposed to substitute for this uncouth term the English word "beneficiary," and the latter, though still far from universally adopted, has come to be quite frequently used. It is equal in precision to the antiquated and unwieldy Norman phrase, and far better adapted to the genius of our language. Cestui que use. Sovereign: A chief ruler with supreme power; a King (Black’s Law Dictionary 2nd Edition) Proprietor: This term is almost synonymous with "owner,"

(Black’s Law Dictionary 2nd Edition) Owner: The person in whom is vested the ownership, dominion, or title of

property; proprietor. He who has dominion of a thing, real or personal, corporeal or incorporeal, which he has a right to enjoy and do with as he pleases, even top spoil or destroy it, as far as the permits, unless he be prevented by some agreement or covenant which restrains his right.

The term is, however, a nomen generalissium, and its meaning is to be gathered from the connection in which it is used, and from the subject-matter to which it is applied. The primary meaning of the word as applied to land is one who owns he fee and who has the right to dispose of the property, but the term also includes one having a possessory right to the land or the person occupying or cultivating it. The tem “owner” is used to indicate a person whom one or more interests are vested for his own benefit. The person in whom the interests are vested has “title” to the interests whether he holds them for his own benefit or for the benefit of another. Thus the term “title,” unlike “ownership,” is a colorless word; to say without more that a person has title to certain property does not indicate whether he holds such property for his own benefit or as a trustee. Restatement, Second, Trusts, § 2, Comment (d); Restatement of Property, § 10. (Black’s Law Dictionary 6th Edition)

Allodarii: /ǽlәdériyay/. Owners of allodial lands. Ownership of estates as large as a subject may have. (Black’s Law Dictionary 6th Edition)

Revocation: The recall of some power, authority, or thing granted, or a destroying or making void of some deed that had existence until the act of revocation made it void. It may be either general, of all acts and things done before; or special, to revoke a particular things. 5 Coke, 90. See Wilmington City Ry. CO. v. Wilmington & B. S. Ry. Co., 8 Del. Ch. 468, 46 Atl. 12. Revocation by act of the party is an intentional or voluntary revocation. The principal instances occur in the case of authorities and powers of attorney and wills. A revocation in law, or constructive revocation, is produced by a rule of law, irrespectively of the intention of the parties. Thus, a power of attorney is in general revoked by the death of the principal. Sweet. (Black’s Law Dictionary 2nd Edition)
