Jones, Jr. CCSD School Board President P.O. Box 3899 Shiprock, NM 87420 [email protected] Dear Board President Jones, The CCSD School Board voted to discharge Superintendent Levinski at the August 18, 2015, board meeting. I am concerned this may have been done in violation of the Open Meetings Act. It appears that personnel action was not on the board's agenda for the August 18, 2015, meeting and the board gave no notice of possible personnel action prior to the vote to discharge Superintendent. Rather, the agenda only listed the matter of the Superintendent's evaluation. In addition, it does not appear that the board followed any discharge procedures. It is essential that the board, as a public body, follow the law and conduct itself appropriately. I urge you to seek the advice of legal counsel on this matter. While it is the board's responsibility to hire and supervise the district superintendent, I am concerned with the board's discharging of the superintendent during the first week of school. It is imperative that the district's operations continue without interruption, especially during the critical first days of the school year. My utmost concern is the welfare of the district's students, and I have directed my staff to monitor the district closely during this transition. There are a number of upcoming budgetary and programmatic reporting deadlines, and I expect district staff to work closely with PED to avoid any disruption to the education of the district's students.
