Legislative Changes for Leave of Absence

Pregnancy Disability Leave (PDL)
Background: Prior to January 1, 2012, the law did not mandate that the County maintain an employee’s group health coverage during the 16 weeks the employee is on PDL.
Pregnancy Disability Leave (PDL)
Amendment: Effective January 1, 2012, SB 299 requires:• The County to maintain group health coverage during the 16 weeks the employee is on PDL. •This is applicable to employees beginning PDL on or after January 1, 2012.
Note: Family Medical Leave Act (FMLA) leave taken for this condition runs concurrently with PDL.
Scenario One:
Sara will take pregnancy disability effective February 1, 2012, to May 30, 2012 (17 weeks). Her physician certified she is disabled due to her pregnancy. She is eligible for PDL and FMLA.
The County is required to maintain Sara’s health coverage for up to 16 weeks during her PDL. Week 17 is not covered under PDL.
Since Sara is eligible for 12 weeks under FMLA leave, both leaves will run concurrently. PDL will run from February 1, through May 23. FMLA will run from February 1 through April 25.

PDL (16 weeks) February 1, 2012 to May 23, 2012
FMLA (12 weeks) February 1, 2012 to April 25, 2012
Scenario Two:
Jennifer was employed by the County effective January 15, 2012. She is pregnant and requested to take 8 weeks of leave from June 18, 2012 to August 10, 2012. She is eligible for PDL because her physician certified she is disabled due to her pregnancy, and there is no length of service or hours-worked required under PDL.
The County’s obligation for Jennifer’s health coverage is only for the duration of the time she is disabled due to her pregnancy.
PDL will run from June 18, through August 10.
