PART 1 Leases in General

PART 2 Leases of Residential Property

PART 3 Leases of Commercial Property

PART 4 Leases of Agricultural Property and Sporting Rights

The law of leases is perhaps the least academic of all branches of the law, relying as it does on what the parties may agree (especially in commercial leases) and what statutes may impose (especially in residential and agricultural leases). For this reason the authors deal with questions of practice as well as matters of pure law. They use vast experience and their individual specialist knowledge on particular types of lease to provide insight on practicalities and commercial aspects of leases, including negotiation and vocabulary – absolutely essential as court decisions very often depend on the words used in particular leases.

Leases is a thoroughly modern and up-to-date book, providing expert insight on current issues including:

• The law relating to agricultural tenancies – consolidated in 1991, radically overhauled in 2003 and further amended in 2011 and 2012 with proposals for more reform yet.

• The question of interpretation of lease – raised in recent court cases with this relevant case law discussed in the text.

• Restrictions on the length of leases – always a hot topic.

• Human Rights in relation to leases – an extensive chapter is included on this subject

A combination of specialist knowledge, in-depth treatment and practical advice makes Leases an essential text for solicitors, advocates and all others with an interest in this area of law. This is set to become the ‘go to’ work on the subject, with guaranteed answers and respected advice for the busy practitioner.

Robert Rennie is a Partner at Harper MacLeod in Glasgow and a Professor of Conveyancing at the University of Glasgow.

Stewart Brymer is a principal in Brymer Legal Limited, Dundee and Edinburgh and is an Honorary Professor in Law at the University of Dundee.

Mike Blair is a Partner at Gillespie Macandrew LLP and one of the accredited specialist lawyers in Scotland in the land and rural business sector.

Tom Mullen is a Professor of Law at the University of Glasgow.

Frankie McCarthy is a Senior Lecturer in Law at the University of Glasgow.

The subject of Leases in Scotland has not been tackled fully in text since 1967. This new title published under the auspices of the Scottish Universities Law Institute remedies that requirement at a time when economic conditions have led to increased activity in residential letting combined with increased litigation in the commercial sector as disputes arise between landlords and tenants.

This brand new book brings together a team of specialist authors to give an in-depth and complete treatment of the general law in this subject area, and also covers the most significant specific types of lease, namely commercial leases, residential leases and agricultural leases, especially in the context of that general law.
