6.8 RIGHT OF WAY REGULATIONS The purpose of this section is to ensure that all public grounds, utility easements, streets, sidewalks,

alleys, bridges, culverts, overpasses, underpasses, grade crossing separations and approaches,

public ways, squares, and commons are open, in repair, and free from nuisance.

C. Maintenance of Area Between Lot Line and Curb Line.

It shall be the responsibility of the abutting property

owner to maintain all property outside the lot and

property lines and inside the curb lines or edge of

public streets, except that the abutting property owner

shall not be required to remove diseased trees or dead

wood on the publicly owned property or right-of-way.

Maintenance includes timely mowing, trimming trees

and shrubs and picking up litter.

I. Responsibility for Maintenance of Driveways and Sidewalks.

It is the responsibility of the property owners abutting any public right-of-way to repair, re-

place or reconstruct, or cause to be repaired, replaced, or reconstructed, all broken or de-

fective driveways and sidewalks and to maintain it in a safe and hazard-free condition.

K. Responsibility for Sidewalk Maintenance and Liability for Injuries.

It is the responsibility of the abutting property owners to repair, replace or reconstruct, or

cause to be repaired, replaced or reconstructed, all broken or defective sidewalks and to

maintain in a safe and hazard-free condition any sidewalk outside the lot and property

lines and inside the curb lines or traveled portion of the public street. An abutting property

owner who fails to maintain or repair defective or broken sidewalks as set forth in this sec-

tion shall be liable for damages caused by said failure to repair, replace or reconstruct bro-

ken or defective sidewalks. The City’s general duty to maintain public places pursuant to

Section 364.12 of the Code of Iowa does not include a duty to remove natural accumula-

tions of snow or ice from sidewalks or to repair, replace or reconstruct all broken or defec-

tive sidewalks. However, when the City is the abutting property owner, it has the specific

duty of the abutting property owner as set forth in this section.

“It’s important to learn the different sounds of smoke and carbon monoxide

alarms. When an alarm makes noise—a beeping sound or a chirping sound—

you must take action!” said Drew Becker, Fire Chief.

“Make sure everyone in the home understands the sounds of the alarms and

knows how to respond. To learn the sounds of your specific smoke and carbon

monoxide alarms, check the manufacturer’s instructions that came in the box,

or search the brand and model online.”

AVOCA FIRE AND RESCUE wants to share safety

tips to help you “Learn the Sounds of Fire Safety”

1. A continuous set of three loud beeps—beep, beep, beep—means smoke or fire. Get out,

call 9-1-1, and stay out.

2. A single chirp every 30 or 60 seconds means the battery is low and must be changed.

3. All smoke alarms must be replaced after 10 years.

4. Chirping that continues after the battery has been replaced means the alarm is at the

end of its life and the unit must be replaced.

5. Make sure your smoke and CO alarms meet the needs of all your family members, in-

cluding those with sensory or physical disabilities.

Chapter 4: Offenses Subject to a

Municipal Infraction Penalty

4.1 Municipal Infraction Penalty.

A violation of this Chapter or the omission or failure to perform any act or duty required by

the same, is a municipal infraction punishable by civil penalty not to exceed seven hun-

dred and fifty dollars ($750.00) for the first offence and not to exceed one thousand dol-

lars ($1,000.00) for each repeat offense. Each day that a violation occurs or is permitted

to exist constitutes a repeat offense.

4.19 Placing Debris on Street or Sidewalk.

It shall be unlawful for any person to throw or deposit on any street or sidewalk any yard

waste, glass, glass bottle, nails, tacks, wire, cans, trash, garbage, rubbish, litter, offal, or

any other debris, or any other substance likely to injure any person, animal, or vehicle.

Avoca Fire and Rescue were recognized as local heroes and received years of service certificates on

Sat., Sept. 11 , 2021. A picture titled “Noble Call” was also presented to the department. The open

house event was held on the 20th anniversary of the 9/11 terrorist attack and a time of silence was

held for the many first responders, fireman and others who lost their lives on that fateful day.
