    What is your understanding of the phenomenon of organ trafficking?

    From a law student point of view, organ trafficking is the illegal trade or selling or

    bartering of kidney organs in exchange for a huge amount of money. Ive heard about

    this in a tv documentary preview years ago, and from what I know its a prevalent

    phenomenon in the country.

    What are your thoughts on kidney provision as a means of gaining compensation?

    Well I think its stupid. In a business perspective, this is ust a one time pay off forsomething you have since the day you were born. Its being compensated once in a

    lifetime. !uti sana kung auto reproduce yung body natin ng kidneys. "endency is,the people who get blinded by this #compensation will soon spend on necessities

    until the moneys all but gone.

    $o you think that the word organ donation is applicable in the context of kidneyproviders in the philippines? %given the monetary motivation&

    'o, it think the word organ #donation serves a circumvention. (iven the economiccondition of the )hilippines, people in the lower classes will get easily blinded by the

    reward in exchange for donating ones organs. *dd to this the fact that almost all ofthem are uneducated and have no idea at all about the repercussions of having ust one

    kidney. +ence, organ donation is ust a circumvention that will allow brokers- to

    continue this trade.

    Would you consider organ providers as victims of organ trafficking for the purposesof criminal ustice? %given personal initiative of providers to look for brokers, that

    recruitment is open and voluntary etc&

    es they are victims. /ven though they consented to such an act, you have to reali0e

    that they were induced to doing so given an array of factors 1 for instance, the lowlyeconomic condition in life and the promise of brokers- of a lump sum of money.

    *nd you have to consider their education 1 ano bang alam nila? (ovt needs to step

    up an information campaign in this area.

    What do you think are the factors that have contributed to the ineffectiveness of phil

    legislation to curb the increased activity of the illegal kidney trade?

    Its all about procedure. "he main factor here, in my opinion, is the way 2ongresslegislates. If Im not mistaken there is no present available legislation regarding

    organ trafficking 1 ust an administrative order3ban by the $epartment of +ealth. ouhave to understand how a lot of political factors are involved in putting a 2ongress

    bill into a law. * lot of people have vested interests, for instance business moguls on

    tax increase, and teachers, on govt employee benefits. In this case, you have doctorsand influential people in the health industry who have vested interests in a bill

    prohibiting kidney trade. 4o unless the 2ongress do away with being induced bybackers- given the procedure they have, phil legislation curbing this trade will be

    ineffective.

    $o you think that compensated kidney provision should be legitimi0ed? What would

    be the effects positive and negative if it were?

    'o, I dont think it should be legitimi0ed. oull be creating a whole legitimate

    market where, and soon after, given the law of supply and demand, prices will go

    down because a lot of people are now donating. If they want to donate, do it with nostrings attached. *nd if you are the donee, return the favor 1 at any rate you wish.
