Law For Business: Seminar Activity: Topic 3 Contractual Agreement

This week will introduce the concept of a legal contract. This is a lengthy and complex area of law andso has been broken down into its component parts.

In Activity 1, you will be put into groups of FIVE students per group. Each group will be presented witha case scenario that focuses on the key elements of offer and acceptance.

In Activity 2, you will be presented with a problem question. You will need to highlight some of the keycases and application of the law surrounding contractual agreements

Activity 1

This activity is based around the following scenario:

On Monday morning Fizz put the following advert on Betterbuys notice board:

At 11 a.m. on Monday, Steve sent Fizz a letter stating he would call round on Wednesday

evening to get the scooter, and enclosed a cheque for 1500. Fizz got the letter on Tuesdaymorning.

On Monday at 2 p.m., Vernon posted a note through Fizzs door stating: I would like to buy

the scooter. Will you accept a Northern Rock bankers draft rather than cash?

At 3.30 p.m. on Monday, Fizz met Violet at Betterbuys and agreed to sell the scooter to her.

When Fizz arrived home at 4.30 p.m. that day she found Dev waiting outside her house. He

told Fizz that he had come round with 1500 in cash to buy the Scooter.

1. Group ActivityIn your groups, read through this scenario and complete the assignment below.

Task: Document how you would advise all the parties as to their legal position, and which offershould be accepted.

2. Role-Play ActivityIn your groups, assign one student the role of Fizz.Then assign each student one of the four other roles in the scenario:

Vernon

Violet

Dev

Task: Devise and write a script for a role-play activity depicting the interaction between Fizz andthe various interested parties.

For Face-to-Face and Real Time Online Synchronous Students:Rehearse your role-play in preparation for performing in front of the whole class. Then perform itin front of the class.

For Your TimeOnline Asynchronous Students:Finalise your script and upload it to the course Wiki for the class to view.

All modes of delivery:Once presented (either in class or via the Wiki, invite responses from the other students to the

legal aspects of the scenario relating to the key elements of offer and acceptance.

Scenario Exercise

TV4U distributed leaflets to a large number of houses giving information on their current specialoffers. The leaflet showed that purchasers of the latest Sonsung Digital 46 TV would be entitled to afree Clear DAB radio (widely acknowledged as one of the best on the market!).

Bob rang TV4U and ordered the Sonsung Digital TV, payment to be made on delivery. The driverhanded him the radio and told him that the offer had been popular and that TV4U had now run out ofthe Clear DAB radios but this one was just as good. He also handed him a booklet which told himabout the TV set up and his rights.

Had Bob read this carefully he would have discovered a statement on the last page which stated thatThis TV must be installed by a qualified Sonsung engineer. In the event of failure of this productfollowing installation by unauthorised personnel, the liability of TV4U will be limited to the cost ofreplacement.

Bobs friend Carl installed the TV and now neither the TV, satellite nor DVD player will work.

Support your responses by using relevant cases.

Collate your responses and collate them into an MS PowerPoint presentation which you willpresent to the rest of the class in the seminar time.

2. Presentation ActivityFace-To-Face and Real Time Online Synchronous students:In your pairs, deliver your responses (in person or online) to any of the questions as directed bythe tutor.

Your Time Online Asynchronous students:In your pairs, record your presentation as a Camtasia file using your responses prepared in Part 1and recording your voices as audio voiceover.

All modes:After delivering or uploading your presentations, be prepared to ask questions of your own ofother students' responses and to answer questions from other students on your presentation.Ensure you focus your questions and/or answers on relevant cases and the key cases andapplication of the law surrounding contractual agreements.
