2 18
GENERAL
1. THE MEANS AND METHODS OF THE WORK AND THE SAFETY OF THE CONTRACTOR'S EMPLOYEES ARE SOLELY
THE RESPONSIBILITY OF THE CONTRACTOR.
2. THE CONTRACTOR SHALL CONFINE ALL OPERATIONS TO THE AREA SHOWN ON THE PLANS. ANY AREA
DISTURBED BEYOND THESE LIMITS SHALL BE RESTORED TO ITS ORIGINAL CONDITION AT THE CONTRACTOR'S
EXPENSE. NO WORK SHALL BE PERFORMED BEYOND THE PROJECT LIMITS WITHOUT PRIOR AUTHORIZATION
FROM THE DIVISION.
3. CONSTRUCTION EQUIPMENT AND MATERIALS SHALL BE STORED ON THE PROPOSED CONSTRUCTION SITE AND
NOT ON ANY PUBLIC STREET OR RIGHT OF WAY.
4. THE CONTRACTOR SHALL KEEP ALL PUBLIC ROADS OPEN TO THROUGH TRAFFIC AT ALL TIMES.
5. ALL WORK WITHIN A PUBLIC RIGHT OF WAY SHALL BE COORDINATED WITH THE APPROPRIATE GOVERNING
AUTHORITY AND SHALL BE DONE IN ACCORDANCE WITH THEIR STANDARDS.
6. ANY WORK REQUIRED TO COMPLETE THE SCOPE OF THIS PROJECT BUT NOT SPECIFICALLY ITEMIZED, SHALL
BE CONSIDERED INCIDENTAL TO THE PROJECT. NO ADDITIONAL COMPENSATION SHALL BE ALLOWED FOR THE
COMPLETION OF THIS WORK.
7. THE CONTRACTOR SHALL REPAIR OR REPLACE DAMAGE TO EXISTING FACILITIES (TILE, UTILITIES, FENCES ,
ETC.) DESIGNATED TO REMAIN, AT NO ADDITIONAL EXPENSE TO THE DIVISION. ALL AREAS DISTURBED BY
CONSTRUCTION, INCLUDING STAGING AREAS AND HAUL ROUTES, ARE TO BE RESTORED TO THEIR ORIGINAL
CONDITIONS AND SEEDED AT NO ADDITIONAL COST TO THE DIVISION IF OUTSIDE OF PROJECT LIMITS AND NOT
APPROVED BY THE ENGINEER.
8. ANY WORK DONE CONTRARY TO THE INSTRUCTIONS OF THE DIVISION, ANY WORK DONE BEYOND THE LINES
SHOWN ON THE PLANS OR ANY EXTRA WORK DONE WITHOUT THE AUTHORITY OF THE DIVISION WILL NOT BE
PAID FOR BY THE DIVISION.
9. THE FOLLOWING STANDARD ROAD PLANS BY THE IOWA DEPARTMENT OF TRANSPORTATION ARE INCLUDED BY
REFERENCE:
ML-103 & ML-104 DETAILS FOR FIELD FENCE CONSTRUCTION
EC-201 EROSION CONTROL DETAILS FOR SILT FENCE
UTILITIES
10. UNDERGROUND FACILITIES, STRUCTURES AND UTILITIES HAVE BEEN PLOTTED FROM AVAILABLE SURVEYS
AND RECORDS. THEIR LOCATIONS MUST BE CONSIDERED TO BE APPROXIMATE ONLY. IT IS POSSIBLE THERE
MAY BE OTHERS, THE EXISTENCE OF WHICH IS NOT PRESENTLY KNOWN OR SHOWN. IT IS THE CONTRACTOR'S
RESPONSIBILITY TO DETERMINE THEIR EXISTENCE AND EXACT LOCATION AND TO AVOID DAMAGE THERETO.
11. IOWA CODE 480, UNDERGROUND FACILITIES INFORMATION , REQUIRES VERBAL NOTICE TO IOWA ONE-CALL
1-800-292-8989, NOT LESS THAN 48 HOURS BEFORE EXCAVATING, EXCLUDING WEEKENDS AND HOLIDAYS.
SURVEYING & STAKING
12. THE CONTRACTOR SHALL PROTECT AND CAREFULLY PRESERVE ALL PROPERTY MARKERS AND MONUMENTS
UNTIL THE DIVISION, THE LANDOWNERS AND AN AUTHORIZED SURVEYOR IN THE STATE OF IOWA, OR AGENT,
HAS WITNESSED OR OTHERWISE REFERENCED THEIR LOCATION.
13. THE CONTRACTOR IS RESPONSIBLE FOR ALL SURVEY LAYOUT AND CONTROL REQUIRED TO COMPLETE THE
WORK.
REMOVALS
14. ALL DEBRIS AND TRASH ENCOUNTERED DURING CONSTRUCTION SHALL BE PROPERLY DISPOSED OF
ACCORDING TO THE PROJECT REQUIREMENTS. PAYMENT FOR ANY SUCH REMOVAL IS NOT INCLUDED IN THE
CONTRACT BUT WILL BE NEGOTIATED IF NECESSARY DURING CONSTRUCTION.
15. THE CONTRACTOR SHALL PROTECT ALL TREES SHOWN TO BE SAVED ON THE DRAWINGS. UNDER NO
CIRCUMSTANCE SHALL THE CONTRACTOR PARK OR TRAVEL WITH ANY VEHICLE UNDER THE DRIP LINE OF A
TREE THAT IS TO REMAIN.
16. THE CONTRACTOR SHALL OBTAIN PERMISSION OF AFFECTED LANDOWNERS PRIOR TO ANY BURNING
ACTIVITIES AND SHALL NOTIFY LANDOWNERS WHEN BURNING WILL OCCUR.
17. NO TREES SHALL BE DISTURBED FROM APRIL 1 TO SEPTEMBER 30.
EARTHWORK
18. A SHRINKAGE FACTOR OF 15% WAS ESTIMATED FOR THIS PROJECT. THE CONTRACTOR SHALL MAKE
ADJUSTMENTS IN EARTHWORK AS NECESSARY TO COMPENSATE FOR INACCURACIES INHERENT WITH
ESTIMATING THE SHRINKAGE FACTOR. THESE ADJUSTMENTS SHALL ONLY BE MADE AFTER CONSULTATION
AND APPROVAL BY THE ENGINEER AND THE DIVISION.
19. PROPOSED CONTOURS AND SPOT ELEVATIONS ARE SHOWN TO FINISHED GRADE.
20. SOME CONTOUR LINES MAY NOT BE SHOWN FOR CLARITY.
21. ANY UNSUITABLE MATERIAL ENCOUNTERED DURING CONSTRUCTION SHALL BE REMOVED BY THE
CONTRACTOR AND REPLACED WITH SUITABLE MATERIAL AS APPROVED BY THE ENGINEER.
22. ALL OPEN EXCAVATIONS SHALL BE PROTECTED.

25. EXCEPT AS SPECIFICALLY NOTED IN THE PLANS, THE CONTRACTOR IS RESPONSIBLE FOR ALL DEWATERING
THAT MAY BE REQUIRED AT NO ADDITIONAL COST TO THE DIVISION. AS NOTED IN THE PLANS, THE EXISTING
POND AT THE NORTH END OF THE SITE THAT IS TO BE REMOVED SHALL BE DRAINED IN A MANNER THAT WILL
DISSIPATE THE WATER BY INFILTRATION AND/OR EVAPORATION. NO OFFSITE DISCHARGE WILL BE ALLOWED.
26. NO PONDING OF WATER WILL BE ACCEPTED. IT IS THE RESPONSIBILITY OF THE CONTRACTOR TO IDENTIFY
ANY AREAS OF EXISTING OR PROPOSED GROUND THAT HAVE THE POTENTIAL TO POND WATER AND TO MAKE
ANY ADJUSTMENTS NECESSARY TO ENSURE THAT WATER WILL POSITIVELY DRAIN. GRADES AT PROJECT
LIMITS SHALL BE ADJUSTED AS NECESSARY TO PROVIDE A SMOOTH TRANSITION FROM PROPOSED SURFACES
TO EXISTING SURFACES.
MATERIALS & WORKMANSHIP
27. WORK WHICH DOES NOT CONFORM TO THE REQUIREMENTS OF THE CONTRACT WILL BE CONSIDERED
UNACCEPTABLE. UNACCEPTABLE WORK, WHETHER THE RESULT OF POOR WORKMANSHIP, USE OF DEFECTIVE
MATERIALS , DAMAGE THROUGH CARELESSNESS OR ANY OTHER CAUSE, FOUND TO EXIST PRIOR TO THE
FINAL ACCEPTANCE OF THE WORK , SHALL BE REMOVED AND REPLACED IN AN ACCEPTABLE MANNER, AS
REQUIRED BY THE DIVISION AT THE CONTRACTOR 'S EXPENSE.
28. THE CONTRACTOR SHALL SUBMIT MANUFACTURER'S CERTIFICATION AND MATERIAL DATA FOR ALL MATERIALS
DELIVERED TO THE PROJECT SITE AS REQUESTED BY THE DIVISION.
PERMITS
29. THE CONTRACTOR SHALL BE RESPONSIBLE FOR ALL DEPARTMENT OF NATURAL RESOURCES (DNR) NPDES
PERMIT AND STORM WATER POLLUTION PREVENTION PLAN (SWPPP) REQUIREMENTS AND REQUIRED
CONTAINMENT STRUCTURES . THE DIVISION HAS OBTAINED A DNR GENERAL PERMIT#2 FOR THE PROJECT AND
A TEMPLATE SWPPP HAS BEEN PREPARED BY THE ENGINEER. THE CONTRACTOR SHALL DEVELOP, IMPLEMENT,
MAINTAIN, AND UPDATE THE SWPPP AS REQUIRED TO MEET ALL LOCAL, STATE, AND FEDERAL REQUIREMENTS.
REFER TO THE SWPPP AND SWPPP DRAWINGS FOR ADDITIONAL INFORMATION.
30. THE DIVISION HAS OBTAINED A SECTION 404 PERMIT FROM THE U.S. ARMY CORPS OF ENGINEERS. THE
CONTRACTOR SHALL COMPLY WITH ALL PERMIT REQUIREMENTS.
