SUMMARY OF OPINION: A contractor filed suit against two local agencies and a project engineer seeking to recover payment for additional paving work that it performed in connection with a borough sidewalk project that was funded by a grant issued by the state Department of Community and Economic Development (DCED). The parties’ discovery revealed that almost seven years after the filing of this case, DCED identified and recaptured excess community development block grant funds that had been unused by the county, including grant proceeds that were allegedly earmarked for the sidewalk project at issue. After the contractor filed an amended complaint joining DCED and asserting an unjust enrichment claim, DCED filed preliminary objections demurring to that claim based upon sovereign immunity and legal insufficiency, and challenging subject matter jurisdiction on the ground that the Board of Claims was vested with exclusive jurisdiction. Since the contractor’s claim against DCED concerned grant funds, rather than a procurement contract, relating to improvements to borough property that was not owned, operated, or maintained by DCED, it was immune from liability pursuant to 1 Pa.C.S. § 2310. Furthermore, inasmuch as the contractor never conferred a benefit upon DCED for which it would be inequitable for DCED to retain without payment of value, it was clear and free from doubt that the contractor could not recover from DCED for unjust enrichment. As a consequence, the preliminary objections in the nature of a demurrer were sustained.

SUMMARY OF OPINION: Plaintiffs filed an auto accident suit seeking compensatory damages from the other motorist and their own underinsured motorist (UIM) carrier on the basis that the liability insurance limits were insufficient to fully compensate them. Plaintiffs also asserted a punitive damages claim against the motorist for operating a vehicle while under the influence of controlled substances. Following the tortfeasor’s admission of liability for the accident and his insurer’s tender of its policy limits, the UIM insurer filed a motion to sever the UIM claims from the tort claims and to stay the consideration of the UIM claims until the tort claims had been concluded. PA R.C.P. 213(b) provides for the severance or bifurcation of claims or issues in order to avoid prejudice or promote convenience, and in making that determination, the court should consider whether the separate issues to be addressed are so interwoven that evidence bearing on those questions will overlap at trial. The compensatory damages that were recoverable from the tortfeasor and the UIM insurer involved the same evidence and issues, but plaintiff’s punitive damages claims were irrelevant to the compensatory damages determinations, and proof of the motorist’s illegal drug use could unfairly prejudice the UIM insurer by inflaming the jurors’ passions and improperly influencing the compensatory damages awards. Although bifurcations of the compensatory damages and punitive damages for trial appeared to be warranted, that decision was reserved for the assigned trial judge after the completion of discovery and the filing of a Certificate of Readiness. In the interim, no legitimate basis existed for severing the tort and UIM claims for discovery and pre-trial purposes, or for staying the litigation progress of the UIM claims. Accordingly, the motion to sever and stay for discovery and pre-trial purposes was denied, and any ruling on the motion to bifurcate the compensatory and punitive damages claims for trial was deferred to the assigned trial judge.

The first vacant position is on the Pa Board of Law Examiners. Applicants must be members of the Pennsylvania bar or jurists and be knowledgeable about law school curriculum, legal practice and attorney ethical obligations. Please note – law school faculty may not serve on this Board. Applicants should not apply if, during the term of service, they will have immediate family members who will be taking the bar examination or seeking membership in the Pennsylvania bar. The second vacancy is on the Appellate Procedural Rules Committee. Applicants should be knowledgeable about the Pennsylvania Rules of Appellate Procedure and experienced in state appellate practice in Pennsylvania. The third and fourth vacancies are on the Civil Procedural Rules Committee. Each vacancy will be for a five year term. Applicants should be knowledgeable about the Pennsylvania Rules of Civil Procedure and experience in state civil practice in Pennsylvania.
