    Definitions 2. (1) In this Act,

    3. (1) For the purposes of this Act, the Gov-

    ernor in Council may, by order, designate anyindustry either generally or with respect to anyregion of Canada.

    Council is satisfied that(a) the industry in Canada generally is un-dergoing significant economic adjustment ofa non-cyclical nature by reason of importcompetition or by reason of industrial re-structuring implemented pursuant to a policyor program of the Government of Canada toencourage such restructuring; and

    nificant loss of employment in the industryin that region.

    5. (1) Subject to subsection (2), the Gover-

    nor in Council may, in any order made undersection 3 or 4, declare

    (a) that the designation of the industry in theorder is retroactive in effect and applies as ofsuch day, before the date of the order, as isspecified in the order; and

    (b) that this Act applies in respect of lay-offsfrom a Canadian establishment in the indus-try designated in the order occurring on orafter the day specified pursuant to paragraph(a).

    bers.

    (f) he has no present prospect of employ-ment, whether with or without training or re-location assistance, or has accepted employ-ment with earnings that are less than hisaverage weekly insurable earnings.

    (a) he meets the requirements set out inparagraphs (1)(a), (d), (e) and (f);

    (b)

    the aggregate of(i) his age on his effective date of lay-off,and

    (ii) his years of employment in the rele-vant designated industry preceding his ef-fective date of lay-off

    equals eighty or more; and

    (c) he was, on his effective date of lay-off,under sixty-five years of age.

    (2)

    and, if the Commission decides that the personhas received, in consequence of that applica-tion, information or report, labour adjustment

    benefits for which he was not qualified or inexcess of the benefits payable to him, the Com-mission shall calculate the amount of such ben-efits or excess and shall notify the person inwriting of its decision.

    private dwelling, where he believes on reason-able grounds any employee was employed andmay make such examination and inquiry asmay be necessary to determine whether or notthe employee is eligible to apply to the Com-

    (4) The Minister, on the request of theBoard, may, in writing, authorize any officer of

    the Board to exercise the powers conferred bysubsection (1) in respect of any particular em-

    ployee or employees named or described in theauthorization and to administer or receive anyoath, solemn affirmation or statutory declara-tion required to be given pursuant to this sec-tion in respect thereof, and, on entering any

    premises or place referred to in that subsection,the officer shall, if so requested, produce theauthorization to the person in charge of the

    premises or place.

    (5) The Minister, on the request of the Com-

    mission, may, in writing, authorize any em-ployee of the Department of Employment andSocial Development to exercise the powersconferred by subsection (2) in respect of any

    particular employee or employees named or de-scribed in the authorization and to administer orreceive any oath, solemn affirmation or statuto-ry declaration required to be given pursuant tothis section in respect thereof, and, on enteringany premises or place referred to in that subsec-tion, the employee shall, if so requested, pro-duce the authorization to the person in chargeof the premises or place.
