AT a meeting of the Executive Council held in the Executive Council Chambers, at Perth, the 28th day of June, 1933, the following Orders in Council were author- ised to be issued: The Government Tramways Act, 1912, and The Public Works Act, 1902. ORDER IN COUNCIL. WHEREAS it is enacted by Section 2 of "The Public Works Act, 1902," that a tramway is a public work for the purposes of the said Act, and by Section 11 of the said Act that the Governor may by Order in Council authorise the Minister to undertake, construct, or pro- vide any public work : And whereas it is enacted by Section 3 of "The Government Tramways Act, 1912," that the Minister may, pursuant to any Order in Council whereby the construction of tramways is authorised, construct such tramways on roads, and in relation thereto may do and perform all the acts, matters, and things in the said Section 3 mentioned: And whereas, it is enacted by Section 2 of the said "Government Tramways Act, 1912," that all tramways the property of the Government, and declared by the Governor by Order in Council to be a Government tramway, shall be Government tramways within the meaning ,of this Act: And whereas the Lieut.-Governor and Administrator, in exercise of the powers conferred by the said Acts by Order in Council made the 31st day of May, 1933, au- thorised the construction of a trackless tramway, as described in the said Order in Council: And whereas it is now deemed. desirable to vary the route and con- struction of the said tramway in the manner hereinafter mentioned, and also to declare such tramway to be a Government tramway under and for the purposes of the said "Government Tramways Act, 1912 ": Now, there- fore, His Excellency the Lieut.-Governor and Adminis- trator, acting by and with the advice and consent of the Executive Council, and in 'exercise of the powers con- ferred by the said two Acts respectively, doth hereby authorise the construction of the trackless tramway as described in the Schedule hereto in lieu of the construc- tion of the tramway as authorised by the Order in Council made the 31st day of May, 1933, as aforesaid, and also cloth hereby declare that the said trackless tramway when so constructed as aforesaid shall be a Government tramway under and for the purposes of "The Government Tramways Act, 1912": The Schedule above referred to. Commencing at the intersection of Kensington Street and Trafalgar Road, East Perth, and proceeding along Trafalgar Road in a Southerly direction to Brown Street; thence along Brown Street in a Westerly direc- tion to Claisebrook Rpad; thence along Claisebrook Road in a Southerly direction to Witten000m Street; thence along Wittenoom Street in a Westerly direction to Hill Street; thence along Hill Street in a Southerly direction to Wellington Street; thence along Wellington Street in a Westerly direction to Market Place; thence along Market Place under the West Perth Sub-way and along Sutherland Street in a North-Westerly direction to Stone. Street; thence along Stone Street in a South- Westerly direction to Havelock Street; thence along Havelock Street in a Northerly direction to Cambridge Street; thence along Cambridge Street in a Westerly direction to Kimberley Street; thence along Kimberley Street in a Southerly direction to Railway Parade; thence along. Railway' Parade in a Westerly direction to Northwood Street; thence along Northwood Street in a Northerly direction to Cambridge Street; thence along Cambridge Street in an Easterly direction to Havelock Street; thence along the same relative route as described above, but in the opposite. direction, as far as the inter- section of Claisebrook Road and Brown Street. Prom this point the route is continued along Claisebrook Road in a Northerly direction to Kensington Street; thence along Kensington Street in an Easterly direction to the point of commencement at the intersection of Kensing- ton Street and Trafalgar Road, a total distance of 7 miles 50 chains or thereabouts and more particularly delineated on Tramway Plan 128/31. No. 1808/16.WHEREAS by Section 49 of "The Land Act, 1898,"it is made lawful for the Governor to direct that anyReserve shall vest in and be held by any Municipality,Road Board, or other person or persons to be namedin the order in trust for any of the purposes set forthin Section 39 of the said Act, or for the like or otherpublic purposes to be specified in such order: Andwhereas it is deemed expedient that Reserve No. 16545(Korbel Lots 15 and 16) should vest in and be heldby Herbert William Teasdale, Peter Keith McQueen,and John Charles Forster in trust for the purpose ofan Agricultural Hall. No. 1195.WHEREAS under the provisions of "The Health Act,1911-26," a Local Health Authority may make By-laws,and may amend, repeal, or alter any By-laws so made:Now therefore, the Collie Municipal Council, being aLocal Health Authority, cloth hereby make the follow-ing By-law:

No person shall apply arsenic or lead, either as aspray or powder, or in any other form whatsoever, tocabbage, cauliflower, or any other plant of the Brassieafamily, within four weeks of cutting for sale.

No person shall sell or attempt to sell, or receive forsale, or have in possession for sale, expose, send, for-wayh, or deliver for sale any cabbage, cauliflower, orany other plant of the Brassiea family which has ad-hering to it or upon any part of it any arsenic or leador any other poisonous or deleterious substance of anykind whatsoever.

No person shall sell or attempt to sell, or receive forsale, or have in possession for sale, expose, send, for-

ward, or deliver for sale any fruit of any kind whatso-ever which has adhering to it or upon it any arsenic orlead.

No person shall send any fruit or any vegetable tomarket for sale unless and until it is clean and freefrom any spray residue or any other foreign substancewhich is deleterious, objectionable, or injurious tohealth.

(West AustralianBranch) Association of Workers, being an IndustrialAssociation of Workers, registered under the provisionsof "The Industrial Arbitration Act, 1912-25":Whereby it is mutually agreed by and between the par-ties hereto that the several stipulations, conditions, andprovisions set out herein shall in all cases be bindingupon, and shall be faithfully and promptly carried out,observed, performed, and complied with, according tothe true intent and meaning thereof, by the partieshereto.

1.Definitions.For the purpose of this Agreement "The above-men-

tioned Companies" shall mean the '' Employers," andthe "Association" shall mean the Federated Engine-Drivers and Firemen's Association (West AustralianBranch).

(a) "Engine-driver" shall mean and include any per-son who operates or drives any engine or engines themotive power of which is either steam, gas, air, oil,water, compressed air, or electricity.

(b) "Fireman" shall mean any person employed ina stoke hole attending a steam boiler or suction-gasgenerator.

(c) "Greaser" shall mean an employee who is em-ployed mainly in oiling engines or shafting, and whoassists the engine-driver as required.

2.Schedule.The parties to this Agreement mutually agree that the

minimum rate of wages that shall be paid by the em-ployers respectively to the persons employed by suchemployers in the capacities under-mentioned is asfollows:

Engine-drivers, firemen, or greasers who shall be em-ployed on boiler cleaning work, cleaning inside of pas-teuriser, or bottle soaker, shall receive an additional ls.per hour in addition to his ordinary or overtime rateof pay.

3.Hours.Forty-four hours, consisting of eight hours per day,

from 'Mondays to Fridays inclusive, and four hours onSaturday, shall constitute a week 's work for engine-drivers, firemen, and greasers, who shall commence worknot before 5 a.m. on any day, and the employer mayrequire any engine-driver, fireman, or greaser to startwork at any time after that time, but such work shallnot be less than eight hours per day, from Mondays toFridays inclusive, and four hours on Saturdays, so thateach engine-driver, fireman, and greaser shall workforty-four hours from Monday to Saturday in everyweek. Where one shift only is worked, such shift shallbegin not later than eight a.m.

4.In all cases, in reckoning the time of duty, any time

necessarily occupied in raising steam, in starting up orclosing down engines, or in banking fires shall be in-cluded.

the rate of double time.

8.Holidays.All holiday shifts to rotate; if no work be done, the

ordinary rates shall be paid for holidays. If work isperformed on a. holiday, ordinary rates shall he paid inaddition.

The dn.ys to be observed as holidays, according to theprovisions of this A eyeement, are:--1: tristmas Day,Good Friday, New Year's Day, Eight !lours' Day, ShowDay, Easter Saturday, Easter Monday, Sovereign'sBirthday, Annual Picnic Bay, Roving Day, the 26thJanuary, and Anzac Day.

10.The engagement between the emplmyer tind employees,

except casual hands, shall he weekly, a week's noticefrom either party to terminate same, except in case ofthe employee absenting himself without leave, not obey-log lawful contmands, or being guilty of misco a duet, orof the weeks of the employer being stopped through fireor tempest, when such agreement may lie terIlliniite:1 im-mediately.

11.Any employee, being unable, through sickness or ac-

cident, to attend to his duties, shall notify the employernot later than 1.6 a.m. on the day lw first absents him.self from duty, and lie shall also satisfy the employerthat lie is unable to attend to his duties, and, if calledupon, shall provide a medical certificate that he is Unfitto perform his work through sickness.

12.All employees oil {lay- shift, engaged in or about a

brewery or bottling works shall, if required to workmore than one (1) hour's overtime, after 5 p.m. knockoff between 5 p.m. and 6 p.m. for refreshments.

13.Area.This Agreement shall apply to all workers engaged in

the Brewing Industry as engine-drivers, firtanen, andgreasers in the SOuth-West land Division in the Stateof Western Australia.

14.Term of Agreement.This Agreement shall u, crate front the twentieth day

of .November, one thousand Moe hundred and thirty-two, and shall remain in force for three (3) years fromthat day. .Provided that either party shall have a rightto apply fur amendment after 1.1w expiration of twelvemonths, and provided that Um rates of pay will he sub-ject to amendment in accordance with "The IndustrialArbitration Act Amendment Act, .1.912-25."
