TERMS, 'HOLIDAYS, SITTINGS, AND VACATIONS,1. The Ternis, Holidays, Vacations, Circuits, and Sittings of
the Court shall be those mentioned in the Law Almanac an-nexed hereto. ':

ADDITIONAL DAYS FOR DEMURRERS, AND SPECIALCASES.
2. Demurrers and Special Cases may be heard on such addi-tional days as two Judges shall appoint.
EQUITY, INSOLVENCY, ECCLESIASTICAL, ANDDIVORCE APPEALS.
3 Equity, Insolvency, Ecclesiastical, and Divorce Appealsmay be set down for, and will take precedence, on the Monday,Tuesday, Wednesday, and Thursday of the second and of eachalternate week during Term. Appeals in interlocutory motionsin these jurisdictions may, in case of emergency, be heard onany Tuesday or Friday in Term.
SITTINGS IN EQUITY, ECCLESIASTICAL, AND LUNACYNATTERS.
4. In Equity, Monday, Tuesday, Wednesday, and Thursday,from 11 o'clock, will be devoted to the hearing of Causes.Chamber business and short motions will be taken on Tuesdayfrom 10 to 11 o'clock, and on Friday, Motions, Petitions, andshort causes from 11 o'clock.
6. Applications for Probates, Letters of Administration, andother Ecclesiastical matters, will he taken on Monday andWednesday from 10 o'clock.
6. In Lunacy matters the Court will sit on Thursday from10 to 11 o'clock.
SETTING DOWN CAUSES AT LAW.7. To the extent limited for each day as next mentioned'
Causes shall he set down consecutively only. No more thanfour Causes shall be set down for any day for Trial by a Jury offour persons, nor more than two Causes for Trial by a SpecialJury, or three Causes by a Common Jury : Provided that anadditional oumber of Causes, not exceeding two, may be setdown for any day, if the Prothonotary shall see fit.
3. For each day of the Sittings for Causes there shall be twoseparate Cause Lists, which will be taken respectively in No. 1and No. 2 Jury Courts. And until both Lists have been filled,in accordance with the preceding Rule, no Cause shall (exceptby leave of the Prothonotary, approved of in writing by a Judge)be set down in either List for any subsequent day.
JURIES OF TWELVE.9. Provided that Causes for Trial by Juries of Twelve
(whether Special or Common Jurors) shall be set down for suchdays only as the Prothonotary shall in each case direct
CAUSES UNCONCLUDED DURING THE SITTINGS.10. Any Cause, not concluded on the last day of the Sittings,
may be continued on such day or days as the Presiding Judgeshall think fit.

TRANSFERRING CAUSES.11. Causes, on the List of either Court, may be transferred
to the List of the other, by order of a Judge, for Trial on theday next but one following, or any later day : Provided thatno such day shall be earlier than that for which the Cause wasfirst entered.
REMANETS GENERALLY.12. Remanets from any Sitting will have precedence over
other Causes ; and shall be set down by the Prothonotary, eachaccording to its appropriate List, for the next Sittings.
CAUSES ON CIRCUIT.13. Causes for Trial in the Circuit Courts, respectively, shall
be entered for the day fixed for holding the Circuit in the LawAlmanac annexed hereto. But whenever it shall appear to theChief Justice, or to the Judge intending to hold any CircuitCourt, that it will not be convenient to hear the Civil Causes(if any) set down for trial at that Court on the day named forsuch Causes in the Calendar for the time being, it shall becompetent to the Chief Justice or to such Judge, not less thansixteen days before the day which shall have been fixed by theCalendar for opening the said Court, to appoint some other dayfor the trial of such Causes, by direction to the Prothonotary,and the Prothonotary shall thereupon forthwith give notice ofsuch appointment to the Solicitors in the said Causes or totheir town agents, and also to the Sheriff, so that the CivilJury maybe summoned or receive notification accordingly, andall notices already given between the parties shall hold goodand be applied to the day so specially appointed, and allnotices and subp0enas to be thereafter given or issued shall begiven or issued for that day.
14. If there shall be no Civil Causes set down and notice oftrial given and notified to the Prothonotary for any CircuitCourt, up to the sixteenth day before the day named in theCalendar for the time being for the trial of Civil Causes thereat,no jury shall be summoned to such Court for the trial of Civ ilIssues without the leave of a Judge, and it shall be the duty ofthe Prothonotary to give notice to the Sheriff accordingly.
CROWN CASES RESERVED. .15. Special Cases reserved on anp Criminal Trial, when re-
ceived by the Prothonotary, shall be set down for hearing onthe next ensuing Friday on which the Court shall sit, unless aJudge shall otherwise order.
NOTIONS NISI FOR NEW TRIAL.16.All Causes' in which the usual Memorandum has been
filed of a Motion Nisi fora New Trial, shall be entered in theorder of filing ; and be called on in that order on every day inTerm until disposed of.

PARTIES NOT READY TO PROCEED.17. Every case so called on, in which no Counsel shall move,
shall (unless the Court extends the time) be struck out of thePaper—with leave to the adverse Party to sign Judgment.And the like, where a Rule Nisi has been granted, and theMoving Party is not prepared to proceed.
FILED MEMORANDUM NECESSARY,18. A filed Memorandum shall in all cases be necessary,
under the Rules of the 10th August, 1861; but, where .theCause shall have ended during the Term, or within four dayspreceding the Term, no Motion in pursuance of such Memo-randum need be made earlier than the fourth day after thefiling thereof.
RULES NISI FOR NEW TRIAL.19. Every Rule Nisi for a New Trial shall be entered in the
Term Book as soon as granted, and called on hi the order inwhich it was granted ; and the Moving Party shall in all casesbegin, and the Party showing cause follow—one Counsel havingthe reply.
20. Every such Rule shall be taken out filed and served withintwo days after it has been granted, otherwise it shall be heldto have lapsed, and the Prothonotary shall thereupon strikethe case out of the Terni Book.
NOTIONS ON NOTICE.21. All Motions on notice shall be entered in the Terni Paper
by the Prothonotary in the order in which they are filed, andshall cane on for hearing in the said order.
PRECEDENCE OF BUSINESS.22. Subject to Rule 3, Motions Nisi for New Trials will, on
every day except Friday, have precedence of all other busi-ness. On Fridays Criminal and other Crown Cases will haveprecedence. On Tuesdays and on Fridays (after Criminalbusiness) Motions geoerally will have precedence, then appealsin cases of emergency in interlocutory motions in the Equity,Insolvency, Ecclesiastical, and Divorce jurisdictions ; thenMotions on Notice, and then Motions. On Thursdays,Demurrers and Special Cases will have precedence. By leaveof the Court, Common Motions may be taken on any day.
ORDER OF BUSINESS GENERALLY.23. On every day, subject to the preceding Rule, all Matters
in the Term Paper for argument shall be entered, and called onand heard, in the order of their date. Rules Nisi for NewTrials will be classed under this Rule. All other Rules to showcause (unless the Court shall otherwise order) will be enteredfor and heard on some Tuesday or Friday only.

VACATION BUSINESS.24.During the Vacations, Causes may be set down, and
notices of Trial, and to admit or produce documents, may begiven, and all Writs may be issued, executed, and returned;and all necessary proceedings may be taken for the purposesof an Appeal, or for obtaining or dissolving any Injunction.And Summonses in cases of emergency may be returnable inChambers on any Friday.
25. During the Vacations no other business than that abovespecified will be taken without the leave of a Judge, nor shallany pleadings be filed or delivered without such leave, norshall Time run at Law or in Equity.
26. In actions upon Bills of Exchange, Promissory Notes,and Cheques, all steps and proceedings which may be takenout of vacation without the leave of a Judge, may be takenduring vacation without such leave, notwithstanding anythingto the contrary in the preceding Rule contained.
CHAMBER BUSINESS.27. Chamber Busioess at Law will be taken on Mondays,
