    I ar11 directed to forward herewith a copy of tl1e Targeted Public Distributio11 (Control) Order, 2015 as notified in Section 3 sub-section (i) of the Gazette Extraordinary vide GSR No. 2 IJ(E) Uatcd 20.03.2015 for infor111ution and compliance. 'fhe new Order which has been issued under section 3 of the Essential Co1nn1odities Act, 1925, is in consonance with the NFSA, 201 J and replaces the PDS Control Ord As provided in the nev,r Order, the provisions of the PDS ( .onlro rder, 2001 shall continue to have effect as against the corresponding provisions of the 'J'PDS (C) Order, 2015 in State/U1' w_hich has not implemented the NFSA or is i1nplen1enting it only in part.

    I • • • 2.Sb10 00 l I'-/>.~ - ~ Oc, -(2) The. State·W[se ceiling on coverage ~f number of persons belonging to. eligible households for rcceJving subsidised foodgmns under the Targeted Publie Distribution System, indicated in column s of Anncx·I, shan be under the following two categories-

    (i) existjng Aatyodaya households; (H) remaining to be covered W1der priority households category 10 be identified by State Oovemmcnt a per griteria to be

    evolved by them subject to the other provisions of this Order. -

    (3) The State,.wise number of Antyodaya households shall not exceed the awepted number of Antyodaya households in that Statet as specified in column 6 of Annex-I:

    Provided that when an Antyodaya household becomes ineligible on account or migration outside the Statet improvement in social or economic status, death, etc., no new Antyodaya household shall be identified in that State and the 1ot!1 number of A~tyoo@ya hot1!~hc,ld, ,htdl ~ rm1r.r.rl 1n tut r.xtt.nt. ( 4) Upon a reduction in the number or Antyodaya households, the States may increue the c;overage of the penons to that extent in the priority category, subject to the ceilings prescribed in svb-clau,c (2). (5) The State Oovcmmcnt shall prepare and notify the guidelines for ldendfi~on of priority households in the rural ·and urban areas. with special focus on cove~e of all the vulnerable or needy sections. of the society. and display 1hc guidelines· in the pubUc domain lncJudlng on the State web portal. · (6) For the purpose of allocation of sabsidised foodgrains under Targeted Public Distribution Sy.stem by the Central Government, there shall be no increase in the Slate-wise number of persons c;:overed under Targeted Pu.blio Distribution System. till the data from the next population Census, after the commencement of this Order, becomes avaHabl e. (7) The list of eligib[e households shall be drawn up by the designated authority in respect of area under their jurisdiction. (8) The State Government shall get the provisional list of_ eligible households displayed in the public domain inc;:luding the office of the local authority and on the State web portal. showing I.he calcgo,:y-wise Hsts of eligible households and their n1embers. (9) The State Government shall use the list of persons as compiled during Census of India by the Resimar GeneraJ and Census Commissioner or voters list notified by Election Commission of India or Socio Economic and Ca.,te Census data or any other authentic source of data to cross--check and verify the lis~ or eligible households and their members. ( I 0) The State Government shall prescribe the detailed procedure far finalisation of the list of eligible housohglds covering~ inter-alia. aspects like the process of drawins up of draft Ii~ putting the draft list in the public domain inc:luding reading out of the list in meetings of the Oram Sabha or equivalent body in urban areas, inviting objections, disPoSal of objections,

    appeals and so on. (11) The head of the loc.a1 authority and the designated authority shall jointly verify and certify the final list of eligible households and the local authority shall pus a resolution adopting the final list of the r:ligJblc households. (12) The final list of the eligible households shall be displayed in the public domain including office of 1he low authority and on the State web portal. showing the cateao.ry-wise names of cUgible households and their members. ( 13) The State Government shall regularly review the list of the eligible households for the purpose ~f deletion of ineligible

    households or inclusion of eligible households. -- · (14) During ·the reviewt the State Government lhall take into aca)Unt, lnter-alia, the increase in the nu~ber of eligible hou.,ehol ds or their members due IO migration in to the Slate, birth, marriage, change in sodal and econo.ffll~ status and ~e deer-ease in the number of eligibl~ households or their members. due to migmtion outside the State, death, mamage~ change 1n

    6. Delivery or. foodgrafns.--( I) The Corporation sbaU ensure physical delivery of foodgrains of prescribed quality specifl ~at ions UplO dtS;ignated depots in each State for distribution under the Targeted Public Distribution· System, as per the aUocat1on made by the Central Government. withln seven working days of the receipt of payment from the State Go"f"'.emment. ·

    (2) In case of States opting for decentralised procurementt the foodgrains for dlstribution under Targeted Public Distribution System shall be released by the States as per the allocatic,n made by the CcntraJ Oovenunent out of the quantity of foodgrains procured and stored for the Central Pool by the State Government o~ its agencies and in case of any shorthll, the Corporation shaU provide the balance quantity of foodgrains ~t the de;sigoated depots in the manner as prescribed in sub-ciausc (I). (3) The State Government .shaU deposit the cost of foodgrains to the Corporation in advance during the month preceding the aHocation month so that ~e foodgrains are lifted from the Corporation as per the time prescribed in su~tause (9) of cJause 7.

    7. Lirt1ng or foodgrains by States.-{l) The State Government shall lift foodgrains from the designated depots of the Corporation through its authorised agency. (2) The State Government shallt on getting allocation of foodgrains from the Cen~I Government_. issue aUocation orders authorising their agencies to Jift foodgraias from the Corporation and such order among others shaU specify-

    (i) number of cards and units; (ii) balance ;n hnnrl~ j1ncl . ... ' (iii) aHocation made for each month in respect of a fair price shop.

    . (3) WhUe making allocation to the ·fair ptic,; shop, the designated authority .shall take into account the baJance stock, if any, lyjng undistributed with the fair price shop owner for the subsequent allocations. ( 4) The designated authority shall ensure that one copy of the allocation order made to the fair price shop is delivered to the local authorityJ vigilance committees,, and any other body nominated by the State Government for monitoring the functioning of the fair price shop. (5) The State Government shall ensure that the allocation order depicting the stocks of foodgrains a11otted during the month to the fair price shops. is displayed on the public domain including on the State web portal. (6) Before taking delivery of foodgrains from the Corporation_. an officer of the State Government not below the rank of Food and Civil Supplies Inspe.ctor and an officer of the Corporation shall jointly inspcct the stocks of foodgrains intended for issue to ensure that the stocks conform to the prescribed quality specifications. (7) After the joint insp~ction, the Corporation shaU issue to the State Govcmmen~ bef~re dispatch of foodgrains from godown, one stack-wise sealed sample jointly drawn for display at the fair price shop and a duplicate sealed smnple drawn

    Provided mat hi case the authorised agency of the State Government takes deHYel)' of foodgrains from the Corporation and stores the foodgrains in an intermediate godown before delivering them to the fair price shop dealers1 the authorised agency shall follow the procedure under this sub-clause at that intcnncdiate godpwn:

    Provided further that where decentralised procurement of foodgrains is in operation in the Statest the authorised agency of the State Government· shall follow ~e procedure under this sub-clause. (8) The quantity of ~e samples to be drawn, retention period of the samples and disposal of the samples shall be as per the

    instructions issued by the Central Government from time to time. (9) The State Government shall ensure the lifting of foodgrains from .the Corporation by the last day of the monlh preceding

    the ailocation month. • (10) The extension of time for lifting of foodgt1ins from 1he Corporation may be considered by the Cen~at Government or the Corporation only in very rare and deserving ~es ~ per the instructions issued by the Central Government.. (l l) The State Government shall devise suitable mechanism for transportation of f~dgrains from the Corporation godovm. to the intennediate godo~ and the door-step dclive:ry of the foodgraim to the fajr price shop: · .

    Provided that the State Government may also transport foodgrains di~ectly to the fair price shop from 1:he Corporation

    godown and ensure its door•step delivery to the fair price shop. . . ()2) The .State Government shall .fumish a report on quarterly basis to the Central Government rcgardmg door-step delivery

    (S) A~y ration card holder desirous of obc.aining extracts from the rewrds of a fair price shop owner may m~ a wtitccn rcquesc to the owner along with the deposit of the fees specified by the State Goyemment The fair price shop owner shall provide .such extracts of records to the ration wd holder within fourteen days from the date of receipt of I request and the fee specified by the State Government:

    · Provided that lhc Stale Government may prescribe the period for which lhc·records arc to be kept for providing it to the ration ~ holder by the fair price shop owner. · · (6) 11te State Oovemmcnt sha11 prescribe the procedw-e to be followed by the designated authority in cases wbero the fair price shop owner does not provide the records in the manner refcmd. in sul,.clause (S) to the ration card holder in the stipuhucd period and the dcsjgnated authority in each case s~all,ensurc that the records arc provided to the ration card holder

(8) The · State Govemment shall prescribe the maximum period within which proceeding., relating lo enquiry into irregularitjcs committed by the fair pri1;:e sh9p owner shall be conclud6d, resulting in any action as under sub.clause (7). (9) In case· of suspension or cancellation of the Jimicelt the Staie Government shall make alternative an.angements for ensuring uninterrupted supply offoodgraim ta the eligible households:

    Provided that in case of cancellation of the licence of the fair price shop owner, new licence shaJI be issued within a monlh of cancel]ation. ( 10) The State Government thall furnish complete infonnation on action taken against a fair price shop owner under this claus1: annuaJly to the Central Oovmunent in lhc fonnat al Ailncx-V. 11. Monitorina .. --{ 1) The State Government shall ensure regular inspections of fair price shops not less than once in

(3) Any authority or any person authorised by ii in this behalf or any other person. who is en&ag~ in th~ distribution and handling of foodgrains under the Targeted Public Distribution System, shall not indulge in substitution or adulteralion or diversion or theft of stocks at any stagc_till delivery to the ration card holder.     15. Appeal.,---(1) The State Governments shall appoint an officer of that Government not below the rank of Additional · District Magjstrate of a District as an Appellate Authority for exercising 1he powers conf errtd upon and discharging the functions assigned to him under this Order. . .

    Provided that an appeal pending before an Appellate Authority appointed under the' Public Distribution Systetn (Conttul) Order~ 200) shall be disposed ofby such authority as iflhis Order had not been made.

    (2) Any person aggrieved by an order of the dcsignatai authority denying the issue or renewal ~fa ration card or cancellation :· of the ration card may appeal to the Appellate Authority within thirty days of the date of receipt of the order. .i

    (3) Any person aggrieved by an order of the desjgnated authority denying the i~uc or renewaJ of the licence to the fair price : shop owner, or cancellation of the licence may appeal to the Appellaie Authority within thirty days of the date of receipt of j tne order and the Appellate Authority shall, as far as practicable,. (tispose the appeal within a period cf sixty days; 1

    15. AppeaJ.~1) The State Governments shall appoint an officer of that Government not below 1he rank of Additional District Magistrate of a District as an Appellate Authority for exercising the powers confemd upon and discharging the functions assigned to him m1dcr this Order. .

    ........

    Provided that an appeal p·ending before an Appellate Authority appointed under the· Public Distribution Syste1n (Contro1) Order~ 2001 shall be disposed ofby such authority as if this Order had not been made.

    (2) Any person aggrieved by an order of the designated authority denying the jssue or renewal 9f a ration card or cancellation of the ration card may appeal to the Appellate Authority within thirty days of the date of receipt of the order. (3) Any person aggrieved by an order of the designated authority denying the is,uc or renewaJ of the licence to the fair price shop owncr1 or cancellation of the licence may appeal to the Appellate Authority within thirty days of the date of receipt of tpe order and the Appellate Authority shall, as far a.s practicable~ dispose the appeal within a period cf sbdy days:
