• To be paid for work that you’ve done. Your employer cannot deny you your wages because you don’t have a work permit or Social Security number.

• To be paid the amount of wages you were promised.

• To be paid the minimum wage.

• In many cases, to be paid overtime pay of 1½ times your normal wage for each hour you work over 40 in a week.

• To be paid on time, on your regular payday.

• To not be discriminated against because of your race, sex, age, ethnic group, disability or religion.

• To work in safe conditions.

• To present a claim for workers’ compensation if you are injured and your employer is insured. If your employer is not insured, you may have other legal options.

• To organize into a union to improve your wages or work conditions.*

• To talk to your co-workers about work conditions that you dislike.*

• To complain in groups of two or more to your employer about work conditions or pay.*

All workers have the right to be paid for the work they perform, whether or not they have work

authorization.

*These last 3 rights probably do not apply if you are working in agriculture.

• You are probably an “employee” even if your employer calls you or treats you as an independent contractor. It is important that your employer treat you as an employee because you have many more rights as an employee.

• If you are truly an independent contractor, you do NOT have the right to the minimum wage, overtime pay, workers’ compensation, unemployment compensation, and most workplace protections. Independent contractors have to pay more taxes, too.

• Your employer is treating you like an independent contractor if you get a 1099 instead of a W2, or if you are paid in cash and your employer is not withholding taxes.

• However, just because your employer says you are an independent contractor does not make it true. Even if you have signed an agreement stating that you are an independent contractor, you are still probably an employee.

Don’t let your employer take away your rights by calling you an

independent contractor!

•Example: Joe works in construction and he regularly gets work from Sam Perez. Sam provides the materials and tools for Joe and tells him when to show up and when to stop working. Sam decides how much Joe will get paid, pays Joe in cash, and doesn’t withhold taxes.

Joe is an employee of Sam.

MINIMUM WAGE

The minimum wage is $7.25/hour as of July 24, 2009.

Tipped Employees

• If you are a tipped employee, your employer can pay you $2.13/hour.

• However, your tips combined with your hourly wages have to add up to at least the minimum wage ($7.25/hour), or else your employer has to make up the difference.

• Your employer cannot take any of your tips, even if you sign an agreement saying s/he can.

• Your employer must keep accurate records of the tips that you make.

OVERTIME

You have the right to be paid 1.5 times your normal wage for each hour worked over 40 hours per week.

For example, if you work 50 hours in a week, and you normally receive $10/hour, you should calculate your overtime pay like this:

40 Hours x $10/hour = $40010 Hours of “Overtime” x $15/hour = $150(Overtime Hourly Rate = $10 x 1.5 or $15) ______ TOTAL = $550

Some workers DO NOT receive overtime!Most agricultural workers, managers, and some other classes of workers do not have the right to overtime pay.

CALCULATING YOUR HOURS(FOR MINIMUM WAGE AND OVERTIME)

You should be paid for all of the hours during which you are doing something for the

benefitofyouremployer.

Travel Time

If your employer makes you travel after arriving at work, you should be paid for the time that you spend traveling.

Example: Ana cleans homes for “Super Clean”, a cleaning service company. Ana arrives to clean her first house at 8 AM. At 10, she had to drive to a second home. She arrivied at her second home at 10:30. Ana should get paid for the 30 minutes she spent traveling from the first house to the second.

Waiting Time

If your boss makes you stay at the worksite, you have the right to be paid for the time that you spend there, even if you aren’t working.

Example: Richard is a painter for “J & J Painting.” His employer asks Richard to arrive at the worksite at 9AM, but his employer doesn’t arrive until 9:45. Richard should be paid for the 45 minutes that he spent waiting.

Your employer generally does not have to pay you for:

• Time spent traveling to or from your home to work.

• Time spent on your lunch break, if the break is at least 30 minutes and you don’t have to work during that time.

DEDUCTIONS

Your employer cannot withhold part of your wages (make deductions from them) unless:

• a court ordered your

employer to make deductions (for child support, for example);

• your employer has the right to do so by law (for Social Security taxes, for example); or

• you gave him authorization in writing to make deductions for a lawful purpose.

DO YOUR PART TO MAKE SURE THAT YOU GET PAID CORRECTLYKeep your own record of the hours and dates that you work.

Keep all your pay stubs. If your employer pays you in cash, note the date and amount of each payment.

Always note:

• The full name of your employer and supervisor.

• The phone number and address of your employer and the company.

• The names and phone numbers of your co-workers.

• The address where you worked.

WHAT SHOULD I DO IF MY EMPLOYER DOES NOT PAY ME WHAT I AM OWED?

Try to talk with your employer to explain why s/he has not paid you.

Contact the U.S. Department of Labor’s Wage and Hour Division at 1-866-478-9243. All services are free and confidential, whether you are documented or not.

File a complaint with the Texas Workforce Commission at 1(800) 832-9243 within 180 days.

Take the case to the Justice of the Peace for amounts up to $10,000.

Contact a lawyer. See page 2 for free legal services.

You have the right to demand your rights. It is illegal for your employer to retaliate against you for

demanding your rights.

Intente hablar con su empleador para pedirle explicar porque no le ha pagado.

DEDUCCIONES

Su empleador no debe quitarle parte de su salario (hacer deducciones) a parte si:

• una corte le ordenó a su empleador hacer

deducciones (para la manutención de los hijos, por ejemplo);

• su empleador tiene el derecho por ley (para impuestos del numero social, por ejemplo); o

• usted le dió permiso por escrito a que él haga deducciones y que cualquier deducción sea por un propósito permitido por la ley.

TIEMPO DE ESPERA

Si su patrón le exige a usted que esté en su sitio de trabajo, usted tiene que ser compensado por este tiempo que pasa allí, aunque no este trabajando.

Ejemplo: Ricardo es pintor para una compañía, J&J Painting. Su empleador le exige que Ricardo llegue al sitio de trabajo a las 9 de la mañana, pero su empleador no llega con las brochas y la pintura hasta las 9:45. Ricardo sí debe ser pagado por los 45 minutos que estuvo esperando.

Su patrón típicamente NO está obligado a pagarle por:

• el tiempo que pasa viajando de su hogar al sitio de trabajo.

• el tiempo de “lonche,” si el tiempo de lonche es por lo menos 30 minutos y si no tiene que trabajar durante ese tiempo.

CALCULANDO SUS HORAS (por el salario mínimo y sobretiempo)

Si su empleador requiere que usted viaje después de llegar al sitio de trabajo, el tiempo que usted pasa viajando debe ser compensado.

Ejemplo: Ana limpia casas para ¨Super Clean,¨ un servicio de limpieza. Ana llega para limpiar la primera casa a las 8 de la mañana. A las 10, su supervisora la recoge para llevarla a otra casa. Llega a la otra casa a las 10:30. Ana sí debe ser pagada por los 30 minutos de viaje que pasó en el camino entre las dos casas.

SOBRETIEMPO (“OVERTIME”)

Usted tiene derecho de ser pagado 1.5 veces su salario normal por cada hora que trabaja en exceso de las 40 horas semanales.

Por ejemplo, si usted trabaja 50 horas en una semana, y normalmente recibe $10 dólares la hora, debe calcular su pago de sobretiempo así:

40 horas x $10/hora = $40010 horas de sobretiempo x $15/hora = $150(sobretiempo por hora = $10 x. 1.5, o $15)) ______ TOTAL = $550

Algunos trabajadores NO reciben sobretiempoLa mayoría de empleados agrícolas, gerentes, y algunas otras clases de trabajadores no tienen derecho a recibir pago de sobretiempo.

SALARIO MÍNIMOComenzando el 24 de julio, 2007, el salario mínimo es de $7.25 la hora.

Empleados que reciben propinas:

• Si usted recibe propinas (tips) en su empleo, su empleador le puede pagar $2.13 la hora.

• Sin embargo, sus propinas juntas con su sueldo tienen que igualar al salario mínimo ($7.25 la hora), caso contrario su empleador tiene que ajustarle la diferencia.

• Su empleador no le puede quitar sus propinas, aunque haya firmado un contrato que indique lo contrario.

• Su empleador tiene que mantener un récord de las propinas que usted recibe.

•Ejemplo: José trabaja en la construcción y regularmente consigue trabajo con el Sr. Pérez. El Sr. Pérez le provee los materiales y herramientas y le dice cuándo presentarse al trabajo y cuándo parar de trabajar. El Sr. Pérez decide cuánto pagarle a José, le

paga a José en efectivo y no le rebaja impuestos. José sí es el empleado del Sr. Pérez.

• Usted es probablemente un “empleado” aunque la persona que lo emplea lo llame o lo trate como contratista independiente. Es importante que su empleador le trate como empleado porque usted tiene muchos mas derechos siendo clasificado como un empleado.

• Si usted es un contratista independiente, NO tiene derecho a recibir el sueldo mínimo, pago de sobretiempo, compensación para trabajadores (workers’ compensation), compensación por desempleo, y la mayor parte de las protecciones en el sitio de trabajo. Además, los contratistas independientes pagan más impuestos.

• Su empleador le está tratando como contratista independiente si recibe un formulario 1099 en vez del W-2, o si le paga en efectivo y el empleador no descuenta impuestos de su pago.

• Sin embargo, no porque su empleador diga que usted es un contratista independiente es así. Aun cuando haya firmado un acuerdo que dice que usted es contratista independiente, probablemente sigue siendo usted un empleado normal.

• Pago de un sueldo mínimo.
