    I. STAFF RECOMMENDATION

    Staff recommends CONDITIONAL APPROVAL based on the information submitted as the application demonstrates compliance with the conditions for approval as outlined in Kent County Code §205-329 Public Utilities and Uses.

    A. Code Requirements:

    1. List the conditions of approval on the plans for Public Utilities and Uses as

    follows: • The use shall conform to such setback, screening or other requirements as

    the Department of Planning Services, Division of Planning, shall deem necessary for the protection of neighboring and adjacent property.

    • Any principal part of a tower, excluding guy cables, shall be set back from the street line or any other lot line of the lot on which it is located a distance

    of not less than the height of such tower, and any blinking or rotating light thereon shall be placed so as not to throw its light below the horizontal plane in which it is installed.

    • Any storage of materials or trucks, maintenance and repair facilities and housing of repair crews shall be contained within a building.

    • All requirements, regulations and recommendations submitted by any agency member of the Development Advisory Committee shall be satisfied.

    2. A final plan must be approved within 24 months of preliminary plan approval and construction must commence within 18 months of final plan approval.

    B. Staff Recommendations:

    1. In order to buffer the proposed use from the existing adjacent agricultural parcel, Staff recommends that the buffering outlined in §187-79(A) be required not only on the northern and eastern property lines separating the subject site from the adjacent residential properties, but also on the southern property line that abuts the agricultural parcel. A tree planting similar to what is being planted on the northern and eastern property lines would buffer the neighboring properties and provide privacy. See waiver request below.

    2. Research shows that solar panels have a maximum life span of 25-30 years.

    After this land use ends, it will be important to restore the land back to ground suitable for agriculture or other permitted uses in the zoning district. To be sure that this occurs in a timely manner after the use ceases, Staff recommends that the applicant submit a Reclamation Plan and a decommissioning security in the form of bonds to guarantee the availability of funds for system removal prior to final site plan approval. The bond amount should be equivalent to the decommissioning and reclamation costs for the entire project. The site Reclamation Plan shall define the reclamation, re-vegetation, restoration, and soil stabilization plans for the project area. The decommissioning and reclamation activities should ensure expeditious reclamation of construction areas and the re-vegetation of disturbed areas to reestablish the inherent agricultural value of the land. This should occur within 12 months of the closing of this facility.

    II. WAIVER REQUEST

    Section 187-80 states: Where it can be shown that strict compliance with the requirements of this chapter would result in extraordinary hardship to the applicant because of unusual topography or other conditions which are not self-imposed, or that these conditions would result in inhibiting the achievement of the objectives of these regulations, the Commission may

    modify or waive the requirements so that substantial justice may be done and the public interest secured; provided, however, that such variance, modification or waiver will not have the effect of nullifying the intent and purpose of this chapter or be contrary to the goals and objectives of the Comprehensive Plan for the County. Section 187-74D. requires new trees shall be planted at a rate of one tree per 3,000 square feet of site area for nonresidential land development for nonwoodland portions of development tracts. This would require a total of 3,114 trees to be planted. A waiver is being requested for the requirement of planting 2,780 trees. Staff recommends that this waiver be granted MODIFIED APPROVAL. While the southern adjacent property is currently being used as agriculture, tree buffering would provide visual screening and privacy to the proposed site, the adjacent agricultural parcel, and passing traffic on Farmington Rd. With a planted buffer on the southern property line, matching the proposed buffer along the eastern and northern property lines, a modified waiver approval would be more in line with the intent and purpose of the zoning code than the requested tree planting reduction.

    III. ADEQUATE PUBLIC FACILITIES ORDINANCE

    Public utilities are exempt from the Adequate Public Facilities Ordinance per Section 187-90.2 D. (4).

    IV. BACKGROUND INFORMATION

    • The 2018 Kent County Comprehensive Plan Future Land Use Map recommends that the

    subject property be utilized for low density residential purposes. The property is zoned AR (Agricultural Residential District). This zoning district provides for a Public Utility as a conditional use for approval by the Levy Court through the Conditional Use with Site Plan process. If approved, this plan will comply with the 2018 Comprehensive Plan and the AR Zoning District requirements.

    • The 306.58± acre subject site is currently improved with a 1,876 sq. ft. dwelling and 8

    outbuildings that are to be demolished. The project consists of a fenced solar array field of approximately 110,000 panels and 50 inverters, on approximately 205.95 acres of the subject site. A proposed 207’-8” by 78’-6” concrete pad to be used for electric equipment will be installed in the northern eastern portion of the parcel. The site includes 18.257 acres of wetlands and 92.143 acres woodlands on the west side of the parcel. The proposed solar farm will be accessed from Farmington Road.

    • The subject site is located to the west of the intersection at Farmington Road and

    Fairground Road, 0.28+ miles south of the intersection of Farmington Road and Walt Messick Road, and adjacent to the City of Harrington.

    • The character of the surrounding area is predominantly residential and agricultural. The subject site is surrounded on all four sides by Agricultural Residential (AR) zoning. Approximately 0.18 miles to the east is Kent & Sussex Fair Grounds, zoned IL (Limited Industrial).

    • There have been no previous Planning applications on the subject site.

    • Prior to final plan approval, all outside agency requirements must be met.

    • The Levy Court may add any necessary conditions to protect the health, safety, and welfare

    of the citizens of Kent County. V. AGENCY COMMENTS

    required plan submissions to DelDOT.

    VI. OWNER/DEVELOPER The owner/developer shall be aware of and be prepared to comply with all comments regarding this project stated in this report. All comments must be addressed in the final plan prior to final approval. Final approval of the plan must occur within 24 months from the date of preliminary plan approval. Failure to obtain final approval shall nullify the plan. Letters of “No Objection to Final Approval” from the following agencies will be required prior to final approval:

    1. DelDOT, Division of Highways 2. Kent Conservation District 3. Office of the State Fire Marshal

    This recommendation was made without the benefit of public testimony and is based on the information presented when the application was received by the Department of Planning Services. The Regional Planning Commission shall give considerable weight to public testimony received during public hearing in considering its recommendation to Levy Court in this matter.
