F1N&1#GR0* 'arnataka governmenthas planned to introduce an amendment tothe 'arnataka #and Revenue 1ct+?A, to regularise unauthorised constructions of dwellinghouses in government lands in urban areas, official sources said.The amendment Fill would seek to insert a new section ? 55 in the 1ct, providing for grantof land in the case of unauthorised construction of dwelling houses in government land inurban areas.&overnor! R FhardwaD had returned the 'arnataka #and Revenue (Eecond 1mendment)Fill, %B+%, passed in both the !ouses of the #egislature during the previous FKgovernmenton the ground that Lthe amendment does not serve any public good or socialcause. 1 team of advocates is studying the points raised by the &overnor. 'eeping in mind publicinterest, the government would draft the Fill again and introduce it in the 1ssembly.Regularisation of constructions on government6revenue lands would benefit lakhs ofhouseholds in Fangalore. The proposed legislation is aimed at regularising unauthorisedoccupation of revenue land belonging to government in urban areas with dwelling housesconstructed, by granting the land to unauthorised occupants, the sources said.

2ollowing this, the 1krama-Eakrama scheme was launched in Eeptember %BBH after rules,fi>ing fees for regularisation, depending upon type of violation, were framed.

Then, the Fruhat Fangalore Cahanagara alike (FFC), with much fanfare, issued abooklet with application forms for regularising four types of irregularities M plot inunauthorised layout6sub-divided land building with land use violation set back violation (upto /B per cent for residential and %/ per cent for commercial) and floor area violation M

!owever, the scheme was put on hold after the owners of unauthorised structures6sitesrose in protest, terming the regularisation fee as e>orbitant, and the government agreed torevise the fee. 1t the same time, the 'arnataka !igh 5ourt was moved by some citiensOuestioning the legality of the scheme, while a few property owners Ouestioned the high fee.

Fut a cross section of residents and legal e>perts say that the aim of such schemes shouldbe to prevent recurrence of such illegality in future while regularising the e>isting violations

as a one-time measure.

Fut unfortunately, the sole obDective of the scheme is to make it a revenue generator fortaking up development works as promised by the parties in their manifestos. 4n the process,the property owners are painted as Ilaw-breakersJ, though the politically well-connecteddevelopers are responsible as they are on the ones who formed these unauthorised layoutsand sold the sites to the gullible buyers. I=hy should only the purchasers of land paypenalties7 =hy is no penalty levied on developers who actually violated the law whileforming layouts, and the officials who did not stop illegal formation of layouts and failed toprotect the interest of the purchasers of sites,J said Ramesh ', a resident of Eai #ayout. !ealso said that even banks had failed to protect the interest of borrowers as many people had

purchased sites only after banks approved loan following a perusal of land documents.

Fangalore evelopment 1uthority (F1) has become a den of corruption and thegovernment needs to take steps to check large scale irregularities in the authority, saideputy #eader of 5ongress in the 1ssembly T F Kayachandra.

Epeaking on the demands on departments in the 1ssembly, the 5ongress leader on 2ridayurged the government to constitute a !ouse 5ommittee to look into the irregularities.

IThe F1 has unlawfully de-notified hundreds of acres of land to help builders to formprivate layouts.

!e added that many people whose lands were acOuired for developing layouts were madeto run from pillar to post to get compensation.
