On behalf of the Jefferson County Election Commission, comprised by statute of Circuit Clerk Anne-Marie Adams, Lt. George Ponder (who is Sheriff Mike Hale’s representative) and myself, I wanted to provide everyone with a Recap of the 2016 Elections.

We began the process of recapping our elections in 2014, and it is our intention to recap our election activity following each General Election. Hopefully, the pages that follow will speak for themselves in reflecting the enormous amount of work that goes into Jefferson County Elections by a large group of talented and dedicated Jefferson County employees and citizens. There is year round activity in planning, organizing and effecting successful elections in Jefferson County. I would like to thank our Elections Coordinator, Alexandria Stephens, for compiling this data and assisting in preparing this report, and Keith Harris, our Chief of Elections, for assisting with the data. The Department of Justice notified us during the summer of 2016, that several of our precincts were deficient in meeting the needs of disabled voters. The Election Commission, County Manager Petelos, Registrar Stephenson, county attorneys, Probate Elections Coordinator Stephens, Probate Staff Attorney Reid and I met on several occasions with attorneys from the DOJ. An agreement was reached whereby Jefferson County shall take actions such as: select facilities to be used as

polling places that do not exclude individuals with disabilities from or deny them the benefits of the polling place or otherwise subject them to discrimination, implement measures to remediate the violations at polling places identified and as set forth in the agreement to make those polling place locations accessible on election day or relocate those locations to an alternative accessible location pursuant to the process established by the DOJ agreement, maintain in operable working condition during elections those features of facilities and equipment (including, but not limited to, permanent equipment such as lifts and elevators, and temporary equipment such as portable ramps, traffic cones, signs, wedges, and door stops) that are required to make polling places accessible to and usable by persons with disabilities.

In addition, the Alabama Legislature, during the 2016 legislative session, approved a pilot program for counties to use a limited number of e-poll books during the General Election. The Election Commission volunteered Jefferson County and the Alabama Secretary of State assigned six (6) e-poll books total, that were utilized at the Downtown Courthouse (two e-poll books) and at the Homewood Library (four e-poll books). We found that the e-poll books saved a large amount of time, and it is hoped that the Alabama Legislature will approve the use of e-poll books in future elections. (Note: A majority of state legislatures have already approved the use of e-poll books in their states.)

The cost of each election (in which state and/or federal officers are on the ballot) is borne by both Jefferson County and the State of Alabama. The County Finance Department invoices the State following the election cycle for partial reimbursement to the county’s general fund.

Note: Per Code of Alabama §17-6-2 - §17-6-7, the state is to reimburse counties for qualified election expenses. The reimbursement amount can range between 50-100% depending on the type of election held (i.e. state-wide or constitutional amendment election). Once the election expenses are paid, the Jefferson County Finance Department invoices the state of Alabama for reimbursement.

2016 GENERAL ELECTION ELECTION DAY AFTERMATH

*Center Point City Hall turned in one Voted Ballot Bag on Election Night. The trunk of the Chief Inspector’s car was unloaded; however, due to limited lighting in the alley where Chief Inspectors drop off their election materials, there were two (2) bags of voted ballots that were not removed from the trunk. The Voted Ballot Bags were discovered two weeks later by the Chief Inspector. The voted ballots were immediately obtained and placed in the election vault where they were specially labeled. The procedure for unloading has now been changed and a new checklist has been implemented.

NOTE: After each election, the Jefferson County Election Staff does an assessment of all voting machines to ensure all ballots and materials are accounted for. The above information denotes the materials that were discovered after the General Election on November 8, 2016. All materials were properly and safely transferred to the Election Vault in Birmingham. Also, the polling officials are contacted to discuss the issue in an effort to avoid the error during the next election.

*Please note that all ballots were counted and included in vote totals, inasmuch as the vote totals are tallied on Election Night and the ballots left in the machines are/were discovered after the election. Election night closing procedures are given a great deal of attention in our Election trainings. Historically, approximately 20 years ago, thousands of ballots would be recovered from Jefferson County’s voting machines; however, even today, four ballots and three record of Election Box are four ballots and three Record of Election Boxes, and obviously two bags of voted ballots, are too many. For the represented precincts above, all of the Chief Inspectors have been contacted and the issues have been discussed with him or her.

Precinct Number and Name: 3010 Hunter Street Baptist Church

Complaint Overview: Voter complained about excessive voting wait times and the size of the precinct versus the

number of registered voters zoned to that precinct. Voter continued that precinct layout did not provide easy

access to voting machines due to large crowd of voters.

Action Taken: The Jefferson County Election Commission and Chairman of Board of Registrars were notified and

have made the decision to split the precinct due to the large amount of registered voters within the precinct.

Follow Up: Voter was contacted and ensured that the issue would be presented to the Jefferson County Election

Commission and the Chairman of Board of Registrars. As a result, the BOR Chairman and Election Commission

have decided to split the precinct due to the large number of registered voters.

Complaint #2

Precinct Number and Name: 3010 Hunter Street Baptist Church

Complaint Overview: Voter complained that wait time exceeded three hours in some lines, while other lines

had no wait times. (I.e. Line A-F had an extreme wait time compared to others)

Action Taken: The Jefferson County Election Commission and Chairman of Board of Registrars were notified and

have made the decision to split the precinct due to the large amount of registered voters within the precinct.

Follow Up: Complaint was followed up by contacting the voter and thoroughly explaining Jefferson County’s

plan to reduce the number of registered voters in the precinct by splitting it into two, which will ultimately

reduce the voters’ wait time.

RECOUNT

The State of Alabama election laws require an Automatic Recount (§17-16-20) if the margin of the results in a race is less than one-half of one percent. The Bessemer Division District Attorney’s race had the prevailing candidate with 50.17 % and the second place candidate with 49.78 %, which was a 0.39% difference. As a result, a Recount was conducted in the Election Headquarters located at 801 Richard Arrington Jr. Blvd. N., Birmingham, AL 35203 on December 1, 2016 (which was the date set by the Alabama Secretary of State). The Recount began at 7:00 AM and ended at 9:00 PM. The following 52 precincts were recounted as they are in the Bessemer Division (including Bessemer Absentee and Provisionals):

Three (3) ES&S 850 High Speed Tabulators along with five (5) ES&S DS 200 voting machines were used. General Services personnel, Probate Court personnel and Sheriff’s Deputies were involved in the Recount. Representatives from both the Democratic and Republican parties were also present and allowed to observe. As with all elections and recounts, everything we do in Jefferson County is transparent. Following the Recount, the prevailing candidate on Election night (again) received the largest number of votes and she was certified by the Election Commission. (Note: Jefferson County Election Officials have conducted five (5) recounts since the automatic recount legislation was enacted by the Alabama Legislature in 2004, and no Jefferson County election has ever been overturned by a recount.)

ELECTION IMPROVEMENTS

These would have to be implemented via legislation but many states have adopted the following:

1. Early voting two or more weeks prior to each election;

2. Locate 5-7 “Election Centers” throughout Jefferson County, so voters could vote at convenient

locations close to their place of employment prior to, and on, election day;

Counties and municipalities across the United States have implemented the improvements above, and

have saved money in election costs, and have provided a valuable service to their citizens.
