"The reclamation of the port area shall be carried out with the dredged material. Dredged material shall not be dumped into the sea. No reclamation shall be carried out outside the port limits." 1. The Port has received EC for development of Fourth Container Terminal and Marine Chemical Terminal on 29th July 2008. In the EC, Specific condition number (vi) is as under: Maharashtra Pollution Control Board (MPCB) in the personal hearing held on 8th February 2016, in respect of the complaint received by MPCB from Citizens Association for Rights. Member Secretory, MPCB vide letter dated 11th March, 2016 has directed JNPT to obtain necessary clarification regarding reclamation using stone material instead of dredged material as mentioned in condition No. (vi) of Environment Clearance (EC). ''The stones for the construction shall be obtained from existing licensed quarries. The stones shall be transported in he covered trucks or boats and it shall be ensured that no spillage takes place."

8 Accordingly, the work of capital dredging for Phase-I has been taken up by the BMCTPL and the dredged material has been disposed off at designated dumping site DS-3. The work of reclamation for Phase-I is taken up by the concessionaire in accordance with the Specific condition No. (viii) which reads as under:

7 An Independent Engineer appointed by the Port for this project has also confirmed unsuitability of the dredged material for reclamation.

6 Thereafter, following the global open competitive bidding process, the work is awarded to M/s. Bharat Mumbai Container Terminals Pvt. Ltd. (Subsidiary of Port of Singapore Authority) on 6th May, 2014. After award of work, BMCTPL has also carried out soil investigations and informed that the dredged material is not suitable for reclamation and due to restrictions on sand mining in Maharashtra or other parts in India, the quarry material and murrum from the nearby land sources will be primarily used for reclamation.

5 The Port could not take up the project as per schedule due to various reasons and the validity of Environment Clearance was extended for further five years by MoEF & CC vide letter dated 26th February, 2014 i.e. up to 28th July 2018.

After receipt of the Environment Clearance in July 2008, the Port had carried out technical studies through llT Bombay for determining whether dredged material is suitable for reclamation or not. llT Bombay, in its report of June 2009 had submitted that the dredging material is not suitable for the reclamation. A copy of the llT Bombay's report is enclosed as Annexure-111.

A copy of the letter dated 12/171h April, 2008 is enclosed as Annexure-11.

b. In the Point No.-7 of the said letter, it was already clarified that the dumping area is about 40Kms offshore from the north most water limit and about 36 Kms offshore from the proposed container terminal.

a. In the Point No.-7 of the said letter, it was clarified that, the area will be reclaimed in two phases spanning for about 5 years. The reclamation will be done using quarry material to be borrowed from existing quarries in and around the port, which are 20 to 25 Kms away from the port and the existing road network will be used for transportation of this quarry material.

4 In this connection, after scrutiny MOEF had raised certain queries regarding reclamation and dredging in their letter dated 20th February 2008. In reply, the Port vide letter no. PPD/M­ ll/Envn/2008/385 dated 12th April, 2008 has informed the following:

2007-08, wherein it is mentioned that reclamation of 200ha of land will be carried out by filling quarry run material from Uran - Panvel hills transported through trucks. It is also mentioned in the report that the dredged material shall be disposed off at DS-3 location approved by the CWPRS, Pune as dumping ground. (Extract of EIA page no, 202, 204 & 209 to 212 are enclosed as Annexure-1.)
