1. The Nuclear Regulatory CorsLission (the Commission) has found that:

A. The application for amendment to Construction Permit No. CPPR-iOd filea by Georgia Power Company, datea July 11, 1975, for the purpose of extending completion dates for the facility, ana the application for amendnent to such construction permit filed by Georgia Power Company, Oglethorpe Electric Membership Corporation, Municipal Electric Authority of Georgia and the City of Dalton (hereinafter collectively referreu to as "applicants") dated July 15, i975, as amendea on December K5, 1975, and September 16, 197o, for the purpose of adding Oglethorpe Electric Memoership Corporation, Municipal Electric Authority of Georgia ana the City of Dalton as co-owners of the facility, complies with the standaras ana requirements of the Atomic Energy Act of 1954, as amenaea, and the Commission's rules and regulations set forth in lU CFR Chapter 1;

B. Good cause has been shown for the extension or completion dates as stated in the Atomic Safety and Licensing Board's Supplemental Initial Decision dated January ii, i977.

C. Tne applicants are financially qualified for joint participation in the ownership of the proposed facility in toe ownersnip percentages statea in the application, provided that in the case of the City of Dalton, satisfactory evidence of oonu valiaation is proviaed to the Director Nuclear Reactor Regulation in accordance with paragraph I.E. oelow;

D. Tne issuance of this amendment will not be inimical to the common defense or to the health ana safety of the public;

E. Tne issuance of this amendment nas oeen authorized by the Supplemental Initial Decision (Construction Permit Proceeaing) of the Atomic Safety and Licensing Board, dated January ii, 1977, suDject to the conaition that prior to the issuance of an amenament adding co-owners, the Director of Nuclear Reactor Regulation is provided with the following documents:

(1) A copy of the Commitment Notice on a loan guaranteed by the Rural Electrification Administration;

(2) Evidence of bond validation from both Municipal Electric Authority of Georgia ano tne City of Dalton; and

(3) Documentation of approval by the Securities and Exchange Commission to Georgia Power Company of the sale of its ownership interests in the facility;

F. All of the documents referrec to in paragraph i.E. above have been received Dy and are satisfactory to the Director of Ouclear Reactor Regulation, except evidence of bond vaidoation from the City of Dalton.

G. The issuance of this amendment is in accordance with lU C2R Part 51.

2. Accoraingly, pursuant to the Supplemental Initial Decision dateu January 11, 1977, Construction Permit No. CPPR-108 is amended to reflect a change in the ownership and construction completion Oates as follows:

A. Paragraph i.t3 is amenued by aeieting the parenthetical phrase "(the applicant)".

B. Paragraphs I.D and 1.F are amended oy deleting all references to "the applicant" ana suostituting "Georgia Power Company."

C. Paragraph i.G is deleted ana tne following paragraph substituted:

"I.G. Georgia Power Company, Oglethorpe Electric me-wersnlip Corporation, Municipal Electric Authority of Georgia ana the City of Daiton (collectively hereinafter referred to as "applicants") are financially qualified to design and construct their respective snares of the facility, provided that in the case of tne City of Dalton, satisfactory evidence of bond validation is provided to the Director of Nuclear Reactor Regulation."

D. Paragraph 2 is deietea anu the following paragraph suostituted:

"2. Pursuant to Section lU3 of the Atomic Energy Act of 1i54, as amenaea (the Act), and Title iU, Chapter I, Code of Federal Regulations, Part 50, "Licensing of Production and Utilization Facilities", and pursuant to the Initial Decisions of the Atomic Safety and Licensing Board dated May 24, 1974, June 27, 1974, and January 11, 1977, the Nuclear Regulatory Commission (the Commission) hereby issues a construction permit to the Georgia Power Company, the Oglethorpe Electric Meioersnip Corporation, the Municipal Electric Authority of Georgia, and the City of Dalton, Georgia (the applicants), as their interests appear in the application to add co-owners, as amended, for a utilization facility designed to operate at 3411 megawatts thermal as described in the application and amendments thereto (the application) filed in this matter oy Georgia Power Company and as mire fully described in the eviuence received at the puolic hearing upon that application, provided that the City of Dalton snail not oecoaie a co-owner of the facility until evidence of bona validation has oeen received from the City ot Dalton anci the Director ot Nuclear Reactor Regulation has advised applicants that such evidence is satisfactory. Tne facility, known as the Alvin W. Vogtle Nuclear Plant, Unit 1, will oe located at the site as describea in the application, in Burke County, Georgia."

E. Paragraph 3.A is amended to reflect a change in estimated construction completion date as follows:

"J.A. The earliest date for the completion of the facility is October 1981, and the latest date for completion is April 19d3."

F. Paragraph 3.C is amenaed by aeleting "applicant" and substituting "applicants".

G. Paragraph 3.E is amenoed by deleting all references to "applicant" and substituting "Georgia Power Company".

Li. Paragraph 4 is amended oy deleting the phrase "the applicant submits" in both places where the phrase occurs ana sunstituting "the applicants submit".

J. The rights of creditors shall oe in accordance with the provisions

4. This amendment is effective as of the date of its issuance.

Notice is hereoy given that the U. S. Nuclear Regulatory Comiission

(the Commission) pursuant to a Supplementai Initial Decision dated

January 11, 1977, nas issued Amendment No. 1 to Construction Permits

Nos. CPPR-l0d and CPPR-1U9 issued to Georgia Power Company for the

construction of Alvin W. Vogtie Nuclear Plant, Units 1 and 2,

respectively. These units are pressurized water reactors and are

located in Burke County, Georgia. The amendments are effective as of

the date of issuance.

'he amendments reflect a change in ownership of Alvin w. Vogtle

Nuclear Plant, Units i ana 2. As a result of the change, Oglethorpe

Electric MPlemership Corporation (OEMC), ana the Municipal Electric

Authority of Georgia (HEAG) will acquire interests in the ownership

of the facilities. The Georgia Power Company will retain sole respon

sioility for overall planning, design, construction, operation, main

tenance and disposal of the facilities. In addition, the amendments

extend the latest dates for completion of construction of Units 1 and 2.

The application for the amendments complies with the standards and

requirements of the Atomic Energy Act of 1954, as amended (the Act), and

the Commission's rules and regulations in 10 CFR Chapter 1, which are

set forth in the construction permit amendments. Notice of supplemental

wita this action was publishea in the FEDERAL REGISTER on SeptemDer 6,

1975 (40 FR 415bd).

The Comnission has determined that the issuance of these amendments

will not result in any significant environmental impact and that pursuant

to ,l CFR S5i.5(d)(4) an environmental impact statement neea not

be prepared in connection with issuance of these amendments. A Negative

Declaration supporting change of ownership interest and extension

of dates for completion of construction was published in the Federal

Register on November 26, 1976 (41 F.R. 52111).

For further details with respect to this action, see (I) the

application for amendments aated July 15, 1975, as amended on

December 15, 1975, and Septemnoer i6, 1976; (2) Supplemental Initial

Decision aated January 11, 1977, (3) Amendment No. I to Construction

Permit No. CPPR-lUd, and (4) Amendment No. 1 to Construction Permit

No. CPPR-iU9. All of these items are available for public inspection

Pursuant to Section i03 of the Atomic Energy Act of 1954, as amended (the Act), and Title i0, Cnapter I, Code of Federal Regulations, Part 50, "Licensing of Production and Utilization Facilities", and pursuant to tne Initial Decisions of the Atomic Safety and Licensing Board dated May 24, 1974, June 27, 1974, ana January 11, 1977, the Nuclear Regulatory Commission (the Conmission) hereby issues a construction permit to the Georgia Power Company, the Oglethorpe Electric Meoership Corporation, the Municipal Electric Authority of Georgia, and the City of Dalton, Georgia (the applicants), as their interests appear in the application to add co-owners, as amended, for a utilization facility designed to operate at 341i megawatts thermal as described in the application and amendments thereto (the application) filed in this matter oy Georgia Power Company and as more fully described in the eviaence received at the public hearing upon that application, provided that the City of Dalton snail not become a co-owner of the facility until evidence of bona validation has been received from the City of Dalton and the Director of Nuclear Reactor Regulation has advised applicants that such evidence is satisfactory. The facility, known as the Alvin W. Vogtle Nuclear Plant, Unit 1, will be located at the site as describea in the application, in Burke County, Georgia."

E. Paragraph 3.A is amended to reflect a change in estimated construction completion date as follows:

"J.A. The earliest date for the completion of the facility is October 1981, and the latest date for completion is April 1963."

F. Paragraph 3.C is amenaed by aeleting "applicant" and substituting "applicants".

G. Paragraph 3.E is amended by deleting all references to "applicant" and substituting "Georgia Power Company".

1. The Nuclear Regulatory Comnission (the Commission) has found that:

A. The application for amendment to Construction Permit No. CPPR-109 filed Dy Georgia Power Company, dated July li, 1975, for the purpose of extending completion dates for the facility, and the application for amendment to such construction permit filed by Georgia Power Company, Oglethorpe Electric Memoersnip Corporation, Municipal Electric Authority of Georgia and the City of Dalton (nereinafter collectively referred to as "applicants") dated July ib, 197j, as amended on December 15, 1975, and Septemoer 16, 1976, for the purpose of awoing Oglethorpe Electric Memoership Corporation, Municipal Electric Authority of Georgia and the City of Dalton as co-owners of the facility, complies with the standards ana requirements of the Atomic Energy Act of 1954, as amended, and the Commission's rules and regulations set forth in lU CFR Chapter I;

a. Good cause has been shown for tne extension of completion dates as stated in the Atomic Safety and Licensing Board's Supplemental Initial Decision dated January 1i, 1977.

C. The applicants are financially qualified for joint participation in the ownership of the proposed facility in the ownership percentages stated in the application, provided that in the case of the City of Dalton, satisfactory evidence ot bona validation is provided to the Director Nuclear Reactor Regulation in accordance with paragraph i.E. below;

D. The issuance of this amendment will not Oe inimical to the common defense or to the health and safety of the public;

E. The issuance of this amendment has Deen authorized by the Supplemental Initial Decision (Construction Permit Proceeding) of the Atomic Safety and Licensing Board, dated January 11, 1977, subject to the condition that prior to the issuance of an caendaent adding co-owners, the Director of Nuclear Reactor Regulation is provided with the following documents:

(1) A copy of the Commitment tiotice on a loan guaranteed by the Rural Electrification Administration;

(2) Evidence of bond validation from both Municipal Electric Authority of Georgia and the City of Dalton; ana

(J) Documentation of approval by the Securities and Exchange Commission to Georgia Power Company of the sale of its ownership interests in the facility;

F. All of the documents referred to in paragraph i.E. above have been received Dy and are satisfactory to the Director of wuclear Reactor Regulation, except evidence of bond validation from the City of Dalton.

G. The issuance of this amendment is in accordance with i0 CFR Part 51.

2. Accordingly, pursuant to the Supplemental Initial Decision datea January 11, 1977, Construction Permit No. CPPR-1U9 is amended to reflect a change in the ownership and construction completion dates as follows:

A. Paragraph 1.8 is amended by deleting the parentheticai phrase "(the applicant)".

B. Paragraphs i.D and I.F are amended by deleting all references to "tne applicant" and suDstituting "Georgia Power Company."

C. Paragraph l.G is deleted ana the following paragraph substituted:

"i.G. Georgia Power Company, Oglethorpe Electric Membership Corporation, Mýunicipal Electric Authority of Georgia ana the City of Dalton (collectively hereinafter referred to as "applicants") are financially qualified to design and construct their respective snares of the facility, provided that in the case of the City of Dalton, satisfactory evidence of bona validation is provided to the Director of Nuclear Reactor Regulation."

D. Paragraph 2 is deleted and the following paragraph substituted:

Pursuant to Section 10J of the Atomic Energy Act of 1954, as amended (the Act), anU Title 10, Chapter i, Code of Federal Regulations, vart 50, "Licensing of Production and Utilization Facilities", and pursuant to the Initial Decisions of the Atomic Safety and Licensing Board dated May 24, 1974, June 27, 1974, and January 11, 1977, the W4uclear Regulatory Commission (the Commission) hereby issues a construction permit to the Georgia Power Company, the Oglethorpe Electric Membership Corporation, the Municipal Electric Authority of Georgia, and the City of Dalton, Georgia (the applicants), as their interests appear in the application to add co-owners, as amended, for a iýtilization facility designed to operate at 3411 megawatts thermal as described in the application and amendments thereto (the application) filed in this matter by Georgia Power Company and as more fully described in the evidence received at the public hearing upon that application, provided that the City of Dalton shall not become a co-owner of the facility until evidence of bond validation has been received from the City of Dalton and the Director of Nuclear Reactor Regulation has advised applicants that such evidence is satisfactory. The facility, known as the Alvin W. Vogtle Nuclear Plant, unit 2, will be located at the site as described in the application, in Burke County, Georgia."

E. Paragraph 3.A is amendea to reflect a change in estimated construction completion date as follows:

"3.A. The earliest date for the completion of the facility is October 1982, and the latest date for completion is April lb4."

F. Paragraph 3.C is amended by deleting "applicant" and substituting "applicants".

G. Paragraph 3.E is amended by deleting all references to "applicant" and substituting "Georgia Power Company".
