  • Narratives Deputy: 10986 -Crego, Michael Narrative Date: 4130/2014 I responded to Publix Supermarket at 800 Ocala Road to conduct a theft investigation. Sgt. Benjamin Benedict was already on scene viewing video of the incident, captured by the store's cameras, when I arrived (see Sgt. Benedict's supplemental report). I viewed the video and observed the following:

    A black male, later identified as Mr. Jameis Winston, entered the store and walked to the seafood counter. Mr. Winston collected three. pounds of steamed crab legs and one pound of steamed crawfish from the counter. Sgt. Benedict informed me earlier video d.epicted Mr. Winston placing the order and leaving the store. Mr. Winston proceeded from the seafood counter to the rear of the store. He walked north through the rear aisle, stopping at the dairy case. Mr. Winston selected a stick of butter from the dairy case andw alked toward the front of the store. When Mr. Winston reached the front of the store, Deputy Graves was visible in front of Mr. Winston. Deputy Graves was working a securitf cfetail in the store in an off duty capacity at the time of the theft. Mr. Winston paused visibly. near a series of sale bins and allowed Deputy Graves to pass in front of him. The pause appeared to be an attempt to avoid walking in front of Deputy Graves. Mr. Winston then walked behind Deputy Graves, passed all points of sale, and exited the store without paying for the merchandise. Mr. Winston did not approach any of the available che.ckout stands or complete any transaction in the store.

    I spoke with Mr. Nathaniel Craver, the seafood clerk who took and prepared Mr. Winston's order. He stated he recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He stated Mr. Winston visits the store frequently. Mr. Craver stated Mr. Winston ordered three pounds of steamed crab legs with Old Bay seasoning and one pound of Crawfish with ca jun seasoning. Mr. Craver prepared the order, affixed the barcode price tag, and placed the order on the counter. Mr. Craver was certain he affixed the barcode price tag because he displayed it to another customer who inquired about the price. Mr. Craver watched when Mr. Winston returned to collect his order a short time later. Mr. Craver completed a sworn affidavit

    I spoke with Mr. Justin Buis. Mr. Buis is employed by Publix as Customer Service Staff and was working behind the customer service counter at the front of the store. Mr. Buis observed Mr. Winston walking towards the front of the store, pastthe sale bins, carrying merchandise. He assumed he hadn't paiclfor it because it was not in a bag. He recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He turned to his Manager. Ms. and pointed out that Mr. Winston was in the store. Mr. Buis watched. as Mr. Winston exited the store with the merchandise. Mr. Buis assumed Mr. Winston was going to the vestibule to get a shopping cart. When Mr. Winston did not return, he walked outside and spoke with Deputy Graves. They looked around the parking lot but could not locate Mr. Winston.

    Deputy graves advised that the total value of the crab legs, crawfish, and butter was $32. 72. ~lated she spoke with her supervisors and Publix wished to pursue the matter.~rovided four DVDs containing video of the incident as captured by the store's closed circuit cameras.

    I responded to Saddle Brook Court and' spoke to Mr. Winston. I explained I wanted to speak with him about the incident and he agreed. I read Mr. Winston Miranda warnings from an agency form. Mr. Winston stated he understood and agreed to speak with me. Mr. Winston signed the form, waiving his rights. Post Miranda, Mr. Winston admitted to the theft. He stated he placed the order and left the store. He returned a short time later, collected his order from the seafood counter. and walked to the dairy case. He selected a stickof butter from the case and walked to the front of the store. Mr. Winston stated he stopped when he reached the sale bins and realized he did not need the butter. He put the butter into the sale bin and exited the store. He admitted he did not pay for the seafood he ordered before leaving the store. He stated he forgot to pay, however, Mr. Winston stated he realized his error when he arrived home, but did not make any attempt to return to the store or contact the store. Mr. Winston apologized repeatedly and stated he wanted to make it righr .

    Mr. Winston met the criteria for an Adult Civil Citation. I explained the Civil Citation program to Mr. Winston and he agre.edto the Civil Citation in lieu of arrest. I completed the form and assigned Mr. Winston 20 hours of community service. I explained the form to Mr. Winston, explained the penalties for non-compliance with the program, and provid.ed an Adult Civil Citation pamphlet for his reference.

    I went back to Publix and looked in the bins where Mr. Winston stated he dropped the butter. I did not locate the butter. Mr. Buis stated if merchandise, especially refrigerated merchandise, was left in the bin another employee would return the item to the proper place. I was unable to determine from the video if Mr. Winston left the store with the butter and it was not included as stolen merchandise. The total value of the crao legs and crawfish is $28.56.     On April 29, 2014 I was working off duty at Publix located at 800 Ocala Road. At approximately 2055 hours I escorted a customer out of the store to her awaiting vehicle and obseived Jameis Winston--alkin out behind me_ When I returned into the store I was advised by the manager on duty, that Mr. W inston wa.lked out of the store without paying for his groceries. e t en went upstairs and began watching in store video suiveillance . The first camera reviewed was in the seafood department, camera #3, and at 20:41: 16 hours it showed Mr. Winston placing an order. It was later determined that he ordered 3 pounds of steamed crab legs, valued at $7 .99 a pound, and 1 pound of steamed crawfish, valued at $4.59 a pound_ Mr. Winston is then obseived wa.lking away from tbe seafood counter, returning at 20:53:45 to pick up the order. Mr. Winston then turns away from the seafood counter and starts to walk towards the produce section. Mr. Winston then makes a left turn in the produce section and then another left walking towards the dairy section. Mr. Winston then continues down the dairy section, also known as the back speedway of tbe store. A t the end of the dairy section Mr. W inston is obseived picking up a stick of butter, valued at $3.69. Mr. Winston then enters into HBC section of the store and starts toward the front of the store. Mr. Winston continues to walk towards the entrance/exit of the store and follows me out of the store. Mr. W inston never made an attempt to stop and pay for the stated items in his possession_ Total amount of stolen food is valued at $32. 72. At this t ime--=ontacted the store manager, Mark Grant, via the telephone and explained ti:':""

    ~o him_ ~as then instructed to contact the loss prevention coordinator, Brad Hounshell. After speaking with him via the telephone I was notified that they wished to pursue this matter. At this t ime I contacted the on duty Watch Commander, Lt. Charlie Strickland, and advised him of the situation. Lt . St rickland advised me to stand by and that he was on his way to the store.     On 04/29/ 14 I responded to the Publix located at 800 Ocala Road regarding a theft_ Upon my arrival I spoke with the on duty manager, and Dep. Marc Graves who was working at Publix in an extra duty capacity . Prior to my arrival I instructed Dep. Michael Crego to respond to tbe store to complete an offense incident report .

    - old me tbat Jameis Winston had exited the store without paying for crab legs and ~e had obtained from tbe seafood department. Dep. Grawes explained that he had conducted a preliminarily review of the in store suiveillance video. During his review he determined that Winston had not paid for the aforementioned items belonging to Publix before ex iting the store .

    While waiting for Dep. Crego to arrive I asked tbe time W inston arrived to the time he left the s ore, explained that the store has four (4) DVRs due to the large number of cameras in t e store, She further explained that tbe timestamps on the DRVs were not synchronized, with each being slightly off from the others.

    I responded to Winston's residence with Dep. Crego while he spoke with Winston about the theft.

    While at the Leon County Sheriffs Office I reviewed some of the DVDs provided by Buis with Dep. Crego. The DVD for DVR 1 started at 20:57:28. The video needed from DVR 1 is from 20:56:02 to 20:57:00. Dep. Crego will contact Mahoney or Buis on 04/30/ 14 to obtain the video from DVR 1 for the correct time period.

  • I responded to Publix Supermarket at 800 Ocala Road to conduct a theft investigation. Sgt. Benjamin Benedict was already on scene viewing video of the incident, captured by the store's cameras, when I arrived (see Sgt. Benedict's supplemental report). I viewed the video and observed the following:

    A black male, later identified as Mr. Jameis Winston, entered the store and walked to the seafood counter. Mr. Winston collected three pounds of steamed crab legs and one pound of steamed crawfish from the counter. Sgt. Benedict informed me earlier video depicted Mr. Winston placing the order and leaving the store. Mr. Winston proceeded from the seafoo.d counter to the rear of the store. He walked north through the rear aisle, stopping at the dairy case. Mr. Winston sele.cted a stick of butter from the dairy case and walked toward the front of the store. When Mr. Winston reached the front of the store, Deputy Graves was visible in front of Mr. Winston. Deputy Graves was working a securitf detail in the store in an off duty capacity at the time of the theft. Mr. Winston paused visibly near a series of sale bins and allowed Deputy Graves to pass in front of him. The pause appeared to be an attempt to avoid walking in front of Deputy Graves. Mr. Winston then walke.d behind Deputy Graves, passed all points of sale, and exited the store without paying for the merchandise. Mr. Winston did not approach any of the available checkout stands or complete any transaction in the store.

    I spoke with Mr. Nathaniel Craver, the seafood clerk who took and prepared Mr. Winston's order. He stated he recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He stated Mr. Winston visits the store frequently. Mr. Craver stated Mr. Winston ordered three pounds of steamed crab legs with Ole! Bay seasoning and one pound of Crawfish with cajun seasoning.. Mr. Craver prepared the order, affixed the barcode price tag, and placed the order on the counter. Mr. Craver was certain he affixed the barcode price tag because he displayed it to another customer who inquiredoaboutthe price. Mr. Craver watched when Mr. Winston returned to collect his order a short time later. Mr. Craver completed a sworn affidavit.

    I spoke with Mr. Justin Buis. Mr. Buis is employed by Publix as Customer Service Staff ancl was working behind the customer service counter at the front of the store. Mr. Buis observed Mr. Winston walking towards the front of the store, past the sale bins, carrying merchandise. He assumed he hadn't paid for it because it was not in a bag. He recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He turned to his Manager, and pointed out that Mr. Winston was in the store. Mr. Buis watched as Mr. Winston exited the store with th . i is assumed Mr. Winston was going to the vestibule to get a shopping cart. When Mr. Winston did not return, he walked outside and spoke with Deputy Graves. They looked around the parking lot but could not locate Mr. Winston.

    Deputy graves advised that the total value of the crab legs, crawfish, and butter was $32. 72 supervisors and Publix wished to pursue the matter. rovided four DVDs con by the store's closed circuit cameras.

    I responded to Saddle Brook Court and spoke to Mr. Winston. I explained I wanted to speak with him about the incident and he agreed. I read Mr. Winston Miranda warnings from an agency form. Mr. Winston stated he understood and agreed to speak with me. Mr. Winston signed the form, waiving his rights. Post Miranda, Mr. Winston admitted to the theft. He stated he placed the order and left the store. He returned a short time later, collected his order from the seafood counter, and walked to the dairy case. He selected a stick of butter from the case ancl walked to the front of the store. Mr. Winston stated he stopped when he reached the sale bins and realized he did not need the butter. He put the butter into the sale bin and exited the store. He admitted he die! not pay for the seafood he ordered before leaving the store. He stated he forgot to pay, however, Mr. Winston stated he realized his error when he arrived home, but did not make any attempt to return to the store or contact the store. Mr. Winston apologized repeatedly and stated he wanted to make it right".

    Mr. Winston met the criteria for an Adult Civil Citation. I explainecfthe Civil Citation program to Mr. Winston and he agreed to the Civil Citation in lieu of arrest. I completed. the form and assignee! Mr. Winston 20 hours of community service. I explained the form to Mr. Winston, explained the penalties for non-compliance with the program, and provided an Adult Civil Citation pamphlet for his reference.

    I went back to Publix and looked in the bins where Mr. Winston stated he dropped the butter. I did notlocate the butter. Mr. Buis stated if merchandise, especially refrigerated merchandise, was left in the bin another employee would return the item to the proper place. I was unable to determine from the video if Mr. Winston left the store with the butter and it was not included as stolen merchandise. The total value of the crab legs and crawfish is $28.56.   • I responded to Publix Supermarket at 800 Ocala Road to conduct a theft investigation. Sgt. Benjamin Benedict was already on scene viewing video of the incident, captured by the store's cameras, when I arrived (see Sgt. Benedict's supplemental report). I viewed the video and observed the following:

    A black male, later identified as Mr. Jameis Winston, entered the store and walked to the seafood counter. Mr. Winston collected three pounds of steamed crab legs and one pound of steamed crawfish from the counter. Sgt. Benedict informed me earlier video depicted Mr. Winston placing the order and leaving the store. Mr. Winston proceeded from the seafoo.d counter to the rear of the store. He walked north through the rear aisle, stopping at the dairy case. Mr. Winston sele.cted a stick of butter from the dairy case and walked toward the front of the store. When Mr. Winston reached the front of the store, Deputy Graves was visible in front of Mr. Winston. Deputy Graves was working a securitf detail in the store in an off duty capacity at the time of the theft. Mr. Winston paused visibly near a series of sale bins and allowed Deputy Graves to pass in front of him. The pause appeared to be an attempt to avoid walking in front of Deputy Graves. Mr. Winston then walke.d behind Deputy Graves, passed all points of sale, and exited the store without paying for the merchandise. Mr. Winston did not approach any of the available checkout stands or complete any transaction in the store.

    I spoke with Mr. Nathaniel Craver, the seafood clerk who took and prepared Mr. Winston's order. He stated he recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He stated Mr. Winston visits the store frequently. Mr. Craver stated Mr. Winston ordered three pounds of steamed crab legs with Ole! Bay seasoning and one pound of Crawfish with cajun seasoning.. Mr. Craver prepared the order, affixed the barcode price tag, and placed the order on the counter. Mr. Craver was certain he affixed the barcode price tag because he displayed it to another customer who inquiredoaboutthe price. Mr. Craver watched when Mr. Winston returned to collect his order a short time later. Mr. Craver completed a sworn affidavit.

    I spoke with Mr. Justin Buis. Mr. Buis is employed by Publix as Customer Service Staff ancl was working behind the customer service counter at the front of the store. Mr. Buis observed Mr. Winston walking towards the front of the store, past the sale bins, carrying merchandise. He assumed he hadn't paid for it because it was not in a bag. He recognized Mr. Winston from numerous television appearances. and his affiliation with the university football team. He turned to his Manager, nd pointed out that Mr. Winston was in the store. Mr. Buis watched as Mr. Winston exited the store with the merchandise. Mr. Buis assumed Mr. Winston was going to the vestibule to get a shopping cart. When Mr. Winston did not return, he walked outside and spoke with Deputy Graves. They looked around the parking lot but could not locate Mr. Winston.

    Deputy graves advised that the total value of the crab legs, crawfish, and butter was $32. 72. - stated she spoke with her supervisors and Publix wished to pursue the matter~rovided four DVDs containing video of the incident as captured by the store's closed circuit cameras.

    I responded to Saddle Brook Court and spoke to Mr. Winston. I explained I wanted to speak with him about the incident and he agreed. I read Mr. Winston Miranda warnings from an agency form. Mr. Winston stated he understood and agreed to speak with me. Mr. Winston signed the form, waiving his rights. Post Miranda, Mr. Winston admitted to the theft. He stated he placed the order and left the store. He returned a short time later, collected his order from the seafood counter, and walked to the dairy case. He selected a stick of butter from the case ancl walked to the front of the store. Mr. Winston stated he stopped when he reached the sale bins and realized he did not need the butter. He put the butter into the sale bin and exited the store. He admitted he die! not pay for the seafood he ordered before leaving the store. He stated he forgot to pay, however, Mr. Winston stated he realized his error when he arrived home, but did not make any attempt to return to the store or contact the store. Mr. Winston apologized repeatedly and stated he wanted to make it right".

    Mr. Winston met the criteria for an Adult Civil Citation. I explainecfthe Civil Citation program to Mr. Winston and he agreed to the Civil Citation in lieu of arrest. I completed. the form and assignee! Mr. Winston 20 hours of community service. I explained the form to Mr. Winston, explained the penalties for non-compliance with the program, and provided an Adult Civil Citation pamphlet for his reference.

    I went back to Publix and looked in the bins where Mr. Winston stated he dropped the butter. I did notlocate the butter. Mr. Buis stated if merchandise, especially refrigerated merchandise, was left in the bin another employee would return the item to the proper place. I was unable to determine from the video if Mr. Winston left the store with the butter and it was not included as stolen merchandise. The total value of the crab legs and crawfish is $28.56.   • On the afternoon of 04.3014, I was dispatchecHo Publix, 800 Ocala Road where I collected a DVD of security camera recordings from property receipt issued.

    I secured the disc in the Evidence Drop Box.

    My follow up was documented under 14047010.

    On 01 May2013 a requestfor copies of the videos in this case to be made for the State Attorneys Office. Upon copying the videos dropped into evidence by Deputy Crego it was discovered video listed as DVR 2 would not copy and would not play on a computer.

    I made contact with Publix and requested another copy of the video. I responded to Publix and spoke with the store manager, Mark Grant. The first attempt to burn another copy was unsuccessful. Upon further checking by Publix staff, the group of cameras labeled as DVR 2 contained two camera locations which were blank screens due to no camera being attached. These tvVo camera locations were eliminated in what to burn and the second attempt was successful.

    I collected the CD from Mark Grant at 1436 hours. The video was subsequently placed into evidence at the Leon County Sheriffs Office.
