MINIMUM WAGE INCREASE JANUARy 1, 2015 Once again, Colorado employers will be required to increase the hourly pay of both non-tipped and tipped workers begin-ning January 1, 2016 according to the proposed Wage Order 31 by the Colorado Department of labor and Employment.

As you may recall, the passage of Amendment 42 in 2006 mandated that the minimum wage be adjusted EVERy year based on the Consumer Price Index (CPI) used for Colorado. Although not final until after a perfunctory public hearing, the minimum wage for non-tipped employees will rise to $8.31 per hour, and the minimum wage for tipped employees will go to $5.29 per hour (the $3.02 tip credit remains the same). These new wage rates are effective at midnight on December 31, 2015. The increase is 1%.

NOTE: Amendment 42 calls for the minimum wage to be adjusted annually based on changes in the cost of liv-ing. The Colorado Department of labor uses the Denver- Boulder-Greeley Consumer Price Index for all urban consumers (CPI-U) for the six month period of January 1 through June 30 to determine the Colorado minimum wage. As 2016 draws close, restaurateurs are gearing up for a new phase of the Affordable Care Act – one that will affect hundreds of thousands more employers, and in new and different ways.

Here are a few reminders of ongoing and new obligations for employers as the law moves forward.

• Keep employees informed. The health care law requires all employers covered by the Fair labor Standards Act to provide employees with written notice about the existence of government-run health care exchanges, also known as health insurance marketplaces. The Department of labor offers model language employers can use at DOl.gov/ebsa/healthreform. In addition to telling employees about the exchanges, the notice advises employees that they may be eligible for federal tax help to buy qualified insurance plans on exchanges. Notice must generally be given to employees within 14 days of their start date.

• Know your numbers. Starting Jan. 1, 2016, all employers with 50 or more full-time-equivalent employees will face possible penalties for failing to offer affordable, minimum-value health plans to “substantially all” full-time employees and their dependents. For 2015, penalties apply to employers with 100 or more full-time-equivalent employees; to avoid penalties for 2015, these employers are required to offer coverage to at least 70 percent of full-time employees. Starting in 2016, all large employers – those with 50 or more FTE employees – must offer coverage to at least 95 percent of full-time employees to avoid possible penalties. If you operate separate business entities, talk to your accountant to see whether your businesses meet the “common control” definition; if so, you’ll need to aggregate all employees as you determine the business’s total size.

• Prepare to report. Any employer with 50 or more full-time-equivalent employees must begin filing informa-tion returns with the IRS and provide statements to full-time employees about the health insurance coverage the employer offered. These are first effective for coverage offered (or not offered) in 2015. Employers must file a Form 1094-C and a Form 1095-C for each employee with the IRS by Feb. 28 (or March 31 if filed electronically) for 2015. large employers must furnish Form 1095-C to each full-time employee no later than Feb. 1, 2016, for the 2015

calendar year. Reporting is required for each business entity within a group of “common control” businesses.

• Know who’s full-time. As large employers count employees, make health-care coverage offers, and collect data on full-time employees to report to the IRS, keep in mind that full-time under the ACA is a person who averages 30 hours of service a week, or at least 130 hours of service in any given month. Members of Congress from both parties are working together to try to change this to 40 hours a week, but for now, the definition remains 30 hours. • Watch the penalty process. As the IRS begins to collect new information reports from employers, government-run exchanges and other sources, it will use the data in part to begin assess-ing penalties against large employers. These penalties kick in for large employers only when a full-time employee of a large employer gets a federal tax subsidy to buy a health plan through a federal or state marketplace. later this year, large employ-ers can expect heightened interaction with the IRS. Exchanges have already begun to notify employers about which employees received federal tax subsidies to buy plans on an exchange. Employers who get these notices have 90 days from the time of the notice to appeal the eligibility determination, if they choose to, since such a determination helps drive possible penalties. The IRS process for issuing penalties will become clearer in 2016.

• Engage with your broker about coverage options. If you haven’t yet been quoted a rate from United Healthcare, be sure to ask your broker to do so. National Restaurant Association mem-bers receive a discount on their premiums. Contact Randy Spicer, the NRA’s vice president of health insurance services at [email protected].

• Watch for more regulation. While not as significant as the employer mandate and information-reporting rules, new nondiscrimination rules under the ACA will apply to all fully insured plans. The nondiscrimination rules for self-funded plans may see changes as well. There’s no timetable yet for implementation of these nondiscrimination rules. There’s also still no word on an ACA mandate that could require employers with 200 or more full-time employees to automatically enroll full-time employees in company plans unless they opt out.

Wage and hour lawsuits continue to be the biggest source of liability for employers under the Fair labor Standards Act (FSlA) according to the Federal Judicial Center. Our members consistently express to us the challenges they face with labor law and striving to stay compliant.

To assist our members, the CRA has started a series high-lighting common labor law concerns and how to avoid violations. If you have questions on regulations, laws, or rules affecting your business, don’t hesitate to call the CRA. We can either help answer your questions or guide you to appropriate legal assistance.

TIP CREDITWe all know that employers are allowed to pay tipped employees a lower hourly wage than those employees who don’t make tips, provided the tipped employee makes $30 or more a month in tips. But there are certain requirements an employer must fulfill. The employer must provide advance written notice to the employee before they can take a tip credit on the employee. The notice must include the amount of tip credit the employer will claim on the employee. If the employee’s tips don’t make up the difference between what

HEAlTH INSURANCE OPEN ENROllMENT 2016The Affordable Care Act (ACA) requires all Americans to have health insurance. If you or your employees don’t have health insurance or wish to select a new individual plan, you have from November 1, 2015 to January 31, 2016 to shop and select the best plan for you.

Individuals that are not insured through Medicaid, Medicare, or an employer can purchase insurance through Connect for Health Colorado and may qualify for help with paying pre-miums and other health care costs. An individual earning as much as $46,680 may qualify for assistance and for a family of four that guideline goes up to $95,400.

they are being paid per hour and the Colorado minimum wage, calculated over a period of one week, the employer must pay the difference to ensure the employee received at least minimum wage for hours worked. Also, during an employee’s shift no more than 20% of their work activities can be maintenance or work that is not directly related to serving customers. If they exceed 20%, than they must be paid the full minimum wage for those hours worked. (2016 minimum wage will be $8.31 non-tipped, and $5.29 tipped)

TIP POOl PARTICIPATION Employers may run a tip pool but they must comply with certain requirements. The employer must provide written no-tice to all employees who will be participating in the tip pool prior to their participation. Only employees who customar-ily and regularly receive tips can participate in the tip pool. According to federal law, servers, counter personnel, bussers, and service bartenders can clearly participate. Those that can’t participate are owners, managers, supervisors, janitors, dishwashers, chefs, cooks, and food prep personnel. TIP VS SERVICE CHARGEThis issue is getting a lot of media attention recently due to coverage of a couple restaurants moving away from the tipped model. Under both Colorado and Federal law any charge that is automatically applied to the bill and the customer must pay, even automatic gratuities for large parties, is considered a service charge. There are very distinct differences between tips and service charges, here are just a few.

Tips:• Are given freely from the customer to the employee• Belong to the employee, not the restaurant• Management cannot direct the use of that money• Sales tax is not applied to a tip

Service Charge: • Is anything automatically applied to the bill• Is considered revenue of the business• Management can determine how the money will be used• Funds can be given to the employee, but must be done

through the payroll system• Any money given to the employee from the service charge

cannot be counted towards a tip credit• Restaurants must collect appropriate sales tax

EXEMPT EMPlOyEESSimply giving an employee the title of manager and paying them a salary does not automatically make them exempt from overtime rates. There are two tests employees must meet first before they can be considered exempt:

1) Must meet the salary requirements of $455 a week or $23,660 a year; and

2) Must meet one of the duties tests. (There are several but the one most often relating to our industry follows.) Executive/Managerial: Many restaurant employees are exempt from federal wage and overtime rules because their duties qualify them for the “executive” or “managerial” exemption. To meet this exemption, the employee’s primary duty must include:

i) Managing the business or a recognized division, subdivision or department

ii) Customarily and regularly supervising and directing the work of two or more full-time employees or their equivalent, and

iii) Having authority to hire or fire other employees, or having their recommendations as to hiring, firing, job advancement, promotion or any other change of status of employees be given particular weight.

BREAkSUnder the Fair labor Standards Act, employees are entitled to certain breaks during their shifts.

Meal Period – After consecutive hours of work employees are entitled to a 30 minute, uninterrupted, and unpaid meal period. If an employee is asked to do any work during that 30 minutes they must be paid for the whole 30 minutes. If work conditions don’t allow for the employee to take a meal period then the employer must allow the employee to eat a meal of their choice while they work. However, this does not require the employer to provide the meal. Rest Period - Employees are entitled to a 10 minute paid rest period in the middle of each 4 hours of work when practicable.

COlORADO AFFIRMATIONAll employers in the State of Colorado are required to complete the Colorado Affirmation requirements when hiring new employees. Employers must comply with the requirements of the affirmation within 20 days of hiring an employee and must retain copies of work eligibility documents used on the Federal I-9 form. If an employer has not completed these requirements on current employees DO NOT try and complete them after 20 days past hiring. Simply start complying with this requirement on employees hired after learning about the affirmation requirements.

DO NOT:• Complete a valid form once the 20 day calendar days

have elapsed• Backdate or otherwise enter incorrect information onto

the form for the affected employees. The employer must not enter false of fraudulent information onto the form.

• Attempt to make and retain copies of employee identity and employment authorization documentation if you did not comply with the requirement within 20 calendar days of hiring the employee. Seeking such documen-tation after the 20 day window has elapsed does not comply with Colorado law, and may also violate separate federal immigration laws.

It is recommended that these forms and the copies of documents used to comply with the affirmation are kept in a separate file than the federal employment verification forms and the personnel file.

OFF THE ClOCk WORkDO NOT AllOW OFF THE ClOCk WORk! All nonexempt employees must be paid for all hours worked. This includes job relevant training and meetings that employees are required to attend.
