The Commissioner of the Northwest Territories,under section 12 of An Act to Amend the Vital StatisticsAct, S.N.W.T. 2016, c.12, orders that such Act, exceptsection 2 and subsections 3(1) and 11(3), come intoforce July 1, 2017.

The Commissioner, on the recommendation of theMinister, under section 23 of the Change of Name Actand every enabling power, orders as follows:

1. The Change of Name Regulations, established byregulation numbered R-018-2008, are amended bythese regulations.

(a) a copy of a birth certificate or a certifiedcopy of a birth registration statement witha single name issued by the RegistrarGeneral in respect of the applicant or aperson who is related lineally to theapplicant;

(b) a copy of a change of name certificatewith a single name issued by the RegistrarGeneral in respect of the applicant or aperson who is related lineally to theapplicant;

(c) a copy of a document that is equivalent toa document referred to in paragraph (a) or(b) issued by

(i) a government of a province oranother territory, or

(ii) a government of a jurisdictionoutside Canada;

(d) a certified copy of a valid immigrationdocument with a single name issued bythe Government of Canada under theImmigration and Refugee Protection Act(Canada) in respect of the applicant or aperson who is related lineally to theapplicant; or

(e) a statement from one of the following

(a) a copy of a birth certificate or a certifiedcopy of a birth registration statement with

(iii) a person who is from an Aboriginalcommunity that represents thetraditional culture and who isrecognized as an Elder by thecommunity,

(iv) a consul of a nation that representsthe traditional culture,

(v) an academic with expertise in thetraditional culture or in namingpractices or a related field who isaffiliated with a college oruniversity.

2.2. The prescribed form of the statutory declarationreferred to in subsection 4(4) of the Act is set out inForm 1 of Schedule A and must include the followinginformation:

(a) the person’s full present and proposednames;

(b) the person’s current address, phonenumber and date of birth;

(c) confirmation of the spousal relationship,including the date on which the spousalrelationship commenced;

(d) confirmation of the person’sunderstanding that the declaration doesnot confer any legal rights orresponsibilities other than the right to usethe surname of a spouse.

3. Subsection 6(2) is repealed and the following issubstituted:

(b) the name of the traditional culture;(c) confirmation that the requested single

name was determined in accordance withthe traditional culture.

(3) If a person is applying to change the name ofa child in his or her lawful custody to a single name, thestatutory declaration referred to in subsection 9(4) ofthe Act must include the following information, inaddition to the information listed under that subsectionof the Act and under subsection (1) above:

(a) confirmation that either the applicant orthe child is a member of a traditionalculture that has a single naming practice;

(b) the name of the traditional culture;(c) confirmation that the requested single

name was determined in accordance withthe traditional culture.

(4) An applicant shall submit with a change ofname application, in respect of each person for whoma change of name is requested, in addition to theinformation, evidence and supporting material listed insubsection 9(5) of the Act,

(a) documentation proving residency; and(b) where the applicant anticipates that the

Registrar General will decline to publishnotice of the change of name of the personunder paragraph 14(4)(b) of the Act,documentation proving common usage ofthe name applied for by the person.

1. The Vital Statistics Regulations, established byregulation numbered R-86-2012, are amended bythese regulations.

(c) a registered social worker as defined insection 1 of the Social Work ProfessionAct;

(d) a person who is licenced to practicepsychology under subsection 11(2) of thePsychologists Act; or

(e) a person who is authorized in a provinceor another territory to practice a health orsocial services profession equivalent tothat practiced by a person referred to inparagraph (a), (b), (c) or (d). (fournisseurde soins de santé)

(e) an academic with expertise in thetraditional culture or in naming practicesor a related field who is affiliated with acollege or university.
