With Conditions:1. All work shall be in accordance with plans by NHDOT Bureau of Bridge Maintenance signed 3/28/18 as received by theDepartment on April 3, 2018.2. Dredged material shall be placed out of the DES Wetlands Bureau jurisdiction.3. Unconfined work within the river, exclusive of work associated with installation of a cofferdam, shall be done duringperiods of low flow.4. Cofferdams shall not be installed during periods of high flow, whether due to seasonal runoff or precipitation. Once acofferdam is fully effective, confined work can proceed without restriction.5. Prior to commencing work on a substructure located within surface waters, a cofferdam shall be constructed to isolate thesubstructure work area from the surface waters.6. Temporary cofferdams shall be entirely removed immediately following construction.7. Construction equipment shall not be located within surface waters.8. Discharge from dewatering of work areas shall be to sediment basins that are: a) located in uplands; b) lined with haybales or other acceptable sediment trapping liners; c) set back as far as possible from wetlands and surface waters, with apreferred undisturbed vegetated buffer of at least 50 feet and a minimum undisturbed vegetative buffer of 20 feet.9. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that noturbidity escapes the immediate dredge area, and shall remain until suspended particles have settled and the water at thework site has returned to normal clarity.10. Within three days of the last activity in an area, all exposed soil areas, where construction activities are complete, shallbe stabilized by seeding and mulching during the growing season, or if not within the growing season, by mulching with tackon slopes steeper than 3:1 or netting /matting and pinning on slopes steeper than 2:1.11. Where construction activities have been temporarily suspended within the growing season, all exposed soil areas shallbe stabilized within 14 days by seeding and mulching or if temporarily suspended outside the growing season, all exposedareas shall be stabilized within 14 days by mulching, mulching with tack on slopes steeper than 3:1 and stabilized by mattingand pinning on slopes steeper than 2:1.12. The contractor responsible for completion of the work shall utilize techniques described in the New HampshireStormwater Manual, Volume 3, Erosion and Sediment Controls During Construction (December 2008).13. Extreme precautions to be taken within riparian areas to limit unnecessary removal of vegetation during roadconstruction and areas cleared of vegetation to be revegetated as quickly as possible.14. There shall be no further alteration to wetlands or surface waters without amendment of this permit.15. Standard precautions shall be taken to prevent import or transport of soil or seed stock from nuisance, invading speciessuch as purple loosestrife or Phragmites.

16. There shall be no use of welded plastic or biodegradable plastic netting or thread in erosion control matting at this projectsite as specified by the NH Fish and Game Department.17. Prior to construction a qualified biologist is to identify the plant species and the specific area which is to be avoided asnoted by the Natural Heritage Bureau.

VVith Findings:1. This is a major impact project per Administrative Rule Env-Wt 303.02(p), a replacement of a stream crossing structure ina tier 3 stream.2. The need for the proposed impacts has been demonstrated by the applicant per Env-Wt 302.01.3. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impactto areas and environments under the department’s jurisdiction per Env-Wt 302.03.4. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(a) Requirements forApplication Evaluation, has been considered in the design of the project.5. The project was coordinated through the Natural Resource Agency monthly meetings and discussed on Nov. 16, 2016.6. The project does not require mitigation as this meets rule Env-Wt 302.03(c)(2)(c), protection of existing infrastructure.7. In accordance with RSA 482-A:8, DES finds that the requirements for a public hearing do not apply as the permittedproject is not of substantial public interest, and will not have a significant impact on or adversely affect the values of theriverine resource, as identified under RSA 482-A:1.8. The DES has determined the applicant has met the purpose of the current stream rules relative to not causing damageupstream or downstream and not impeding aquatic organisms.9. The permit includes specific conditions relative to species identified by the Natural Heritage Bureau and NH Fish andGame Dept.

All development activities associated with this project shall be conducted in compliance with applicable requirements ofRSA 483-B and N.H. Code of Administrative Rules Env-Wq 1400 during and after construction.4. This permit does not authorize the removal of trees or saplings within the waterfront buffer that would result in a tree and

Work shall be carried out in a time and manner to avoid disturbances to migratory waterfowl breeding and nesting areas.6. Appropriate turbidity controls shall be installed prior to construction, shall be maintained during construction such that no

turbidity escapes the immediate dredge area and shall remain until suspended particles have settled and water at the worksite has returned to normal clarity.7. All construction-related debris shall be placed outside of the areas subject to RSA 482-A. Any spoil material depositedwithin 250 feet of any surface water shall comply with RSA-483-B.8. The contractor responsible for completion of the work shall use techniques described in the New Hampshire Stormwater

Manual, Volume 3, Erosion and Sediment Controls During Construction (December 2008).9. Any subdivision of the property frontage will require removal of a sufficient portion of the docking structures to comply withthe dock size and density requirements in effect at the time of the subdivision.10. Only those structures shown on the approved plans shall be installed or constructed along this frontage. All portions ofthe structures shall be at least 20 feet from the abutting property lines or the imaginary extension of those lines into the water.11. No portion of any of the proposed piers shall extend more than 105 feet from the shoreline at full lake elevation

(Elevation 407.25).12. All seasonal structures, including watercraft lifts, shall be removed for the non-boating season.13. This permit does not allow dredging for any purpose.14. This permit shall not preclude DES from initiating appropriate action if DES later determines that any of the structures

depicted as “existing” on the plans submitted by or on behalf of the permitted were not previously permitted or grandfathered.

With Findings:1. This project is classified as a major project per Rule Env-Wt 303.02(d), construction of modification of a major docking

facility.2. The applicant has an average of 3, 574 feet of frontage along Lake Ossipee.3. A maximum of 48 slips may be permitted on this frontage per Rule Env-Wt 402.13, Frontage Over 75’.4. The proposed docking facility will provide 36 slips as defined per RSA 482-A:2, VIII and therefore meets Rule Env-Wt402.13.5. A Public hearing is waived based on the finding that the project impacts will not significantly impair the resources of LakeOssipee.

All work shall be in accordance with the Proposed Wetland Crossing Plan by Evans Land Consultants dated January2018, revised through June 2018, as received by the NH Department of Environmental Services (NHDES) on June 8, 2018.2. No person undertaking any activity shall cause or contribute to, or allow the activity to cause or contribute to, any violationsof the surface water quality standards in RSA 485-A and Env-Wq 1700.3. There shall be no impacts to the stream bed or banks.4. No excavation shall be done in flowing water. No construction equipment shall be operated in flowing water.5. Not less than 5 state business days prior to starting work authorized by this permit, the permittee shall notify the NHDESWetlands Program and the local conservation commission in writing of the date on which work under this permit is expectedto start.6. Prior to construction, all wetland and surface water boundaries adjacent to construction areas shall be clearly marked toprevent unintentional encroachment on adjacent wetlands and surface waters.7. Prior to starting any work authorized by this permit, the permittee shall place orange construction fencing at the limits ofconstruction to prevent unintentional encroachment on wetlands.8. Appropriate siltation and erosion controls shall be in place prior to construction, shall be maintained during construction,and shall remain until the area is stabilized. Temporary controls shall be removed once the area has been stabilized.9. Work shall be conducted in a manner so as to minimize turbidity and sedimentation to surface waters and wetlands.

10. Dredged materials, whether to be stockpiled or disposed of, shall be dewatered in sedimentation basins lined withsiltation and erosion controls, and located outside of areas subject to RSA 482-A jurisdiction.11. All dredged and excavated material and construction-related debris shall be placed outside of the areas subject to RSA482-A. Any spoil material deposited within 250 feet of any surface water shall comply with RSA-483-B.12. Any fill used shall be clean sand, gravel, rock, or other suitable material.13. The contractor responsible for completion of the work shall use techniques described in the New Hampshire StormwaterManual, Volume 3, Erosion and Sediment Controls During Construction (December 2008).14. Erosion control products shall be installed per manufacturers recommended specifications.15. Construction equipment shall be inspected daily for leaking fuel, oil, and hydraulic fluid prior to entering surface waters orwetlands or operating in an area where such fluids could reach groundwater, surface waters, or wetlands.16. The permittee’s contractor shall maintain appropriate oil/diesel fuel spill kits on site that are readily accessible at all timesduring construction, and shall train each operator in the use of the kits.17. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall bestaged and refueled in upland areas only.18. Faulty equipment shall be repaired immediately prior to entering areas that are subject to RSA 482-A jurisdiction.19. A certified wetlands scientist or qualified professional, as applicable, shall monitor the project during construction to verifythat all work is done in accordance with the approved plans and narratives, adequate siltation and erosion controls areproperly implemented, and no water quality violations occur. A follow-up report including photographs of all stages ofconstruction shall be submitted to the NHDES Wetlands Program within 60 days of final site stabilization.20. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surfacewaters, all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within thegrowing season, by mulching with tackifiers on slopes less than 3:1 or netting and pinning on slopes steeper than 3:1.21. Where construction activities occur between November30 and May 1, all exposed soil areas shall be stabilized within 1day of establishing the grade that is final or that otherwise will exist for more than 5 days. Stabilization shall include placing3-inches of base course gravels, or loaming and mulching with tack or netting and pinning on slopes steeper than 3:1.22. Areas of temporary impact shall be regraded to original contours following completion of work. The permittee/permittee’scontractor shall regrade temporary impacts to pre-construction conditions and seed with a native wetland seed mix.23. Seed mix within the restoration area shall be a wetland seed mix appropriate to the area and shall be applied inaccordance with manufacturers’ specifications.24. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require a new application andfurther permitting.

With Findings:1. This is a Minor Impact project per Administrative Rule Env-Wt903.01(O(1)(b), for a new tier 2 stream crossing that meets

the criteria of Env-Wt 904.03(b).2. The project consists of dredging and filling 697 square feet of palustrine forested wetland to install a permanent bridge

crossing with a 27 foot wide span over an unnamed, perennial (tier 2) stream on Map I Lot 576-410. Permanent impactsinclude the installation of four floodplain drainage structures measuring three feet, two feet and 15 inches (two) in diameter.Temporary impacts include 126 square feet within the wetland for equipment access.3. The project proposes no impacts to the stream below bankfull elevation. 697 square feet of permanent impact and 126square feet of temporary impact are proposed within the floodplain wetland located below the top of bank.4. The project meets the tier 2 stream crossing criteria pursuant to Rule Env-Wt 904.03(b), which states that any new tier 2

stream crossing shall be a span structure, pipe arch embedded with stream simulation, open-bottom culvert with streamsimulation, or closed-bottom culvert embedded with stream simulation.5. The project meets the design criteria for new tier 2 stream crossings pursuant to Rule Env-Wt 904.05(a) through (g) to theextent practicable.6. In accordance with Env-Wt 904.09, NHDES has approved the applicant’s request for an alternative design, received June8, 2018. The applicant has demonstrated that the crossing can accommodate the 100-year flood stage, modelled at 96.49feet. The project proposes to install four floodplain drainage structures to increase the flood capacity of the crossing.Although an entrenchment ratio of greater than 2.2, as specified for a Rosgen C2 stream classification, will not be met by thisproject, the applicant has worked with NHDES to increase the entrenchment ratio to 18.7. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impactto areas and environments under the department’s jurisdiction per Env-Wt 302.03.8. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(a) Requirements forApplication Evaluation, has been considered in the design of the project.9. The original plan submitted with the application included a proposed subdivision of Lot 576-41 0, however, the approvedplan for this permit does not include plans for a subdivision. In response to the NHDES Request for Information, the applicanthas stated that the landowner does not have plans to subdivide the parcel.10. The New Hampshire Natural Heritage Bureau fNHB) has reviewed the proposed project and determined that there are norecorded occurrences for sensitive species near the project area, per the letter dated December 1, 2017.11. The Sutton Conservation Commission has signed the application waiving its right to intervene pursuant to RSA 482-A: 11.12. Compensatory mitigation shall not be required in accordance with Rule Env-Wt 904.03(e)(1), for any new tier 2 streamcrossing that meets the requirements of Env-Wt 904.03 and Env-Wt 904.05.

This permit is not valid unless a septic system construction approval pursuant to RSA 485-A:29-44 and Env-Wq 1000 isissued.3. Any further alteration of areas on this property that are subject to RSA 482-A jurisdiction will require further permitting.4. No person undertaking any activity shall cause or contribute to, or allow the activity to cause or contribute to, any violationsof the surface water quality standards in RSA 485-A and Env-Wq 1700.5. Work shall be done during low flow and in the dry only.6. Blanding’s turtles may be encountered in uplands as well as in or near vernal pools, wetlands, and slow moving streams.Construction personnel should be made aware of the potential to encounter this turtle especially during turtle nesting seasonwhich extends from late May through the beginning of July. If Blanding turtle are found laying eggs in a work or staging areaat any time, please contact Kim Tuttle or Mike Marchand, NH Fish and Game, Nongame and Endangered Wildlife Programat 271-3016 for instructions.7. Avoid the use of welded plastic or ‘biodegradable plastic’ netting or thread in erosion control matting at this site if needed.There are numerous documented cases of wildlife being trapped and killed in erosion control matting with synthetic netting.

The contractor responsible for completion of the work shall use techniques described in the New Hampshire StormwaterManual, Volume 3, Erosion and Sediment Controls During Construction (December 2008).12. Dredged materials, whether to be stockpiled or disposed of, shall be dewatered in sedimentation basins lined withsiltation and erosion controls, and located outside of areas subject to RSA 482-A jurisdiction.13. All dredged and excavated material and construction-related debris shall be placed outside of the areas subject to RSA482-A. Any spoil material deposited within 250 feet of any surface water shall comply with RSA-483-B.14. Any fill used shall be clean sand, gravel, rock, or other suitable material.15. Construction equipment shall be inspected daily for leaking fuel, oil, and hydraulic fluid prior to entering surface waters orwetlands or operating in an area where such fluids could reach groundwater, surface waters, or wetlands.16. The permittee’s contractor shall maintain appropriate oil/diesel fuel spill kits on site that are readily accessible at all timesduring construction, and shall train each operator in the use of the kits.17. All refueling of equipment shall occur outside of surface waters or wetlands during construction. Machinery shall bestaged and refueled in upland areas only.18. Topsoil in wetlands shall be stripped and segregated from subsoil during construction. Wetland topsoil shall bestockpiled separately from subsoil and shall be restored following backfill.19. The permittee/permittee’s contractor shall vegetate the enhancement area in accordance with the planting plan.20. Mulch used within the wetland restoration areas shall be natural straw or equivalent non-toxic, non-seed-bearing organicmaterial.21. Seed mix within the restoration area shall be a wetland seed mix appropriate to the area and shall be applied inaccordance with manufacturers’ specifications.22. Within three days of final grading or temporary suspension of work in an area that is in or adjacent to wetlands or surfacewaters, all exposed soil areas shall be stabilized by seeding and mulching during the growing season, or if not within thegrowing season, by mulching with tackifiers on slopes less than 3:1 or netting and pinning on slopes steeper than 3:1.23. A certified wetlands scientist or qualified professional, as applicable, shall monitor the project during construction to verifythat all work is done in accordance with the approved plans and narratives, adequate siltation and erosion controls areproperly implemented, and no water quality violations occur. A follow-up report including photographs of all stages ofconstruction shall be submitted to the DES Wetlands Program within 60 days of final site stabilization.24. The permittee or permittee’s contractor shall properly construct, landscape, and monitor the enhancement area, and shalltake such remedial actions as may be necessary to ensure proper function. Remedial measures may include replanting,relocating plantings, removal of invasive species, changing soil composition and depth, changing the elevation of the wetlandsurface, and changing the hydrologic regime.25. A post-construction report, prepared by a Certified Wetland Scientist or Qualified Professional, as applicable,documenting status of the project area and restored jurisdictional area or buffer, including photographs, shall be submitted tothe NHDES Wetlands Program within 60 days of the completion of construction. DES Wetlands Program may requiresubsequent monitoring and corrective measures if DES deemed the area inadequately stabilized or restored.26. The wetland enhancement area shall have at least 75% successful establishment of wetlands vegetation after two (2)growing seasons, or shall be replanted and re-established until a functional wetland is replicated in a manner satisfactory tothe NHDES Wetlands Program.

With Findings:1. This is a Minimum Impact Project per Administrative Rule Env-Wt 303.04(f), alteration of less than 3,000 square feet inswamps or wet meadows that are not in prime wetlands or do not meet the requirements of Env-Wt 303.02(k), provided thatno previous department permit has placed restrictions on the property of the applicant.2. The project consists of dredging and filling 1,842 square feet of palustrine forested wetland to install a 12 foot wideresidential access drive and enhance the treatment capacity of a wetland drainage swale. This project also includes thepermanent removal of road fill and an existing culvert.3. The applicant has provided evidence which demonstrates that this proposal is the alternative with the least adverse impactto areas and environments under the department’s jurisdiction per Env-Wt 302.03. The property owners currently accesstheir residence from a shared driveway on an abutting parcel. They have requested new access through a parcel owned bythe family trust in order to alleviate maintenance issues and so emergency services may locate the property accurately. One

alternative to the proposed layout would be to locate the driveway between Bassey Lane to the east and the wetland to thewest. This alternative is not the least impacting because it would place the driveway directly upslope of the wetland andsurface runoff over the road would drain to the wetland. Tree clearing might also be required.4. The applicant has demonstrated that permanent wetland impacts will be minimized by improving stormwater treatment inthe vicinity of the wetland and Lake Mascoma. The project proposes to dredge the wetland drainage swale at the outlet of theexisting culvert under Bonardi Drive. The swale is currently providing a stormwater retention function. The swale will bedredged and planted with woody shrubs, to increase the storage and treatment capacity of the swale. In addition, the projectproposes to remove a section of road fill and an existing culvert, which will improve hydrologic connection of the wetlands oneither side. These improvements are anticipated to improve the water quality of the runoff that reaches Lake Mascoma.5. The applicant has demonstrated by plan and example that each factor listed in Env-Wt 302.04(b) Requirements forApplication Evaluation, has been considered in the design of the project.6. Enfield Tax Map 22, Lot 6, 7 Bonardi Drive, is jointly owned by Thomas Bonardi and Henry Haynes, Ill and SandraHaynes, as trustees of the Bonardi Haynes Realty Trust. NHDES has received a signed letter by both owners authorizingconstruction of the driveway extension through Lot 6.7. The New Hampshire Natural Heritage Bureau fNHB) has reviewed the proposed project and determined that there are norecorded occurrences for sensitive species near the project area, per the letter dated February 16, 2018.8. The applicant has addressed comments provided by the Mascoma River Local Advisory Committee.9. The Enfield Conservation Commission has signed the application waiving its right to intervene pursuant to RSA 482-A:11.10. Compensatory mitigation shall not be required in accordance with Rule Env-Wt 302.03(c)(2)(a), for projects that qualify asminimum impact in accordance with Env-Wt 303.04.
