Article 2 (Definition) 1) For the purpose of this regulation, the "state inventory" means the list of intangible cu ltural heritage of high value falling un der any one of the following subparagraphs as potent ial candid ates f or the nomination to the Intangible Cu ltural Heritage of Human ity among the intangible cu ltural heritag e items referred to in Article 2 Paragraph 1 Subparagraph 2 of the Cultural Heritage Protection Act (hereinafter refer red as the "Act"). 1. Importa nt Intangible Cultural Heritage des ignated un der Article 24 of t he Act; 2. I ntangible Cultural Heritage of Cities and Provinces designated under Article 70 of the Act; 3. Preliminary li st prepared un der Paragraph 2 of th is re gulation. 2) For the purpose of this regulation, the "preliminary list" me ans the intangible cultural heritage ite ms select ed pursuant to Article 4 of this reg ulation among those not designated by the cen tral government or local autonomo us bodies. Regulations on Selection of the Nomination list for the Intangible Cultural

Heritage of Humanity

Cultural Heritage Ad ministration's Regulation No. 109, April 17, 2012

Article 1 (Purpose)

The purpose of this regu lation is to enhance rationality and efficiency in selecting the nomination

list of Intangible Cultural Heritage of Humanity by defining the necessary procedures and

measures to select properties for nomination to the Representative List of the Intangible Cultural

Heritage of Humanity (hereinafter referred as the "Intangible Cu ltural Heritage of Humanity")

pursuant to Article 19 of the Cultural Heritage Protection Act and the UNESCO Convention for the

Safeguarding of Intangible Cul tural Heritage.

Article 2 (Definition)

1) For the purpose of this regulation, the "state inventory" means the list of intangible

cu ltura l heritage of high value falling under any one of the following subparagraphs as

potential candidates for the nomination to the Intangible Cu ltural Heritage of Human ity

among the intangible cultural heritage items referred to in Article 2 Paragraph 1

Subparagraph 2 of the Cultural Heritage Protection Act (hereinafter referred as the "Act").

1. Important Intangible Cultural Heritage designated under Article 24 of the Act;

2. Intangible Cultural Heritage of Cities and Provinces designated under Article 70 of the

Act;

3. Preliminary list prepared under Paragraph 2 of th is regulation.

2) For the purpose of this regulation, the "preliminary list" means the intangible cultural

heritage items selected pursuant to Article 4 of this regulation among those not

designated by the central government or local autonomous bodies.

Artic le 3 (Research on the prel iminary list)

1) Concerning an intangible cultural heritage deemed invaluable as an Intangible Cultural

Heritage of Humanity, the Administrator of the Cultural Heritage Administration may

conduct a survey by himself/herself on the item's value or entrust it with an agency or

organization falling under any one of the following subparagraphs.

L Incorporated bod ies or organizations estab lished with the purpose of investigation,

research, education or academic activities relevant to intangib le cu ltural heri tage;

2. Affil iated research institutes or industry-academic cooperation centers relevant to

cul tural heritage pursuant to Article 2 of the Higher Education Act.

2) In the case of conducting a survey pursuant to the above Paragraph 1, the survey results

shal l include the facts and ideas falling under each of the following subparagraphs.

L The name of the intangible cultural heritage concerned;

2. The scope of the intangible cultural heritage concerned;

3. The concept and definition of the intangible cultural heritage concerned;

4. The communities for transmission and their scope of the intangible cultural heritage

concerned;

5. The conditions of transmission and the ways of performance of the intangible cultural

heritage concerned;

6. The societal functions and relationship of the intangible cu ltural heritage concerned;

7. Safeguarding measures for the intangible cultural heritage concerned.

3) The Administrator of the Cultural Heritage Administration shall make endeavors to

encourage participation of various individuals and groups at diverse levels including

concerned individuals, groups, communities and research organizations in the process of

a survey under Paragraph 1.

4) In case the survey is entrusted pursuant to Paragraph 1, Articles 12, 13 and 14 of the

Regulations on the Commission and Entrustment of Administrative Authority shall apply

mutatis mutandis to the procedure for selecting the organization.

Article 4 (Selection of the preliminary list)

1) The Administrator of the Cultural Heritage Administration may select items recognized

invaluable for the Intangible Cultural Heritage of Humanity for the preliminary list based

on the survey results conducted pursuant to Article 3, after deliberation by the Cultu ral

Heritage Committee under Article 8 of the Act (hereinafter referred as the Cultural

Heritage Committee).

2) The Administrator of the Cultural Heritage Administration may add, change or cancel the

preliminary list after the procedure pursuant to Paragraph 1.

Article 5 (Proclamation of the state inventory)

1) The Administrator of the Cultural Heritage Administration shall notify the information

involved with the state inventory to the public through the Cultural Heritage

Administration website, etc.

2) The Administrator of the Cultural Heritage Administration shall renew the information

involved with the state inventory on a regular basis to maintain and manage the list up to

date at all t imes.

Article 6 (Selection of the nomination list for the Intangible Cultural Heritage of Humanity)

1) From the state inventory, the Admin istrator of the Cultural Heritage Administration may

select the nomination list deemed highly necessary to nominate to the Intangible Cultural

Heritage of Humanity after deliberation by the Intangible Cultural Heritage Subcommittee

and World Heritage Subcommittee of the Cultural Heritage Committee.

2) The Administrator of the Cul tural Heritage Administration sha ll make endeavors to

encourage participation of various individuals and groups at diverse levels including

individuals, groups, communities or research organization s, etc in the process of preparing

the nomination.

Article 7 (Period of reexa mination)

Pursuant to the Regulation on Proclamation and Management of the Directives and Ru les

(Presidential Directive No. 248), the period during which this regulation is to be abolished and

revised shall be before or on March 31, 2015, after reexamining the laws and reality conditions

having changed upon the proclamation.

ADDENDA

Article 1 (Enforcement date)

This regulation shall enter into force upon proclamation.
